Notice of Final Decision
On November 30, 2011,the Staff Advisor for the Ashland Planning Division administratively approved
your request for the following:
A request for a Limited Activity and Use Permit for a multi-year Maintenance Plan for the Ashland Park and
Recreation Department's trail easement within the Water Resource Protection Zone of Ashland Creek located at 50
West Hersey Street. COMPREHENSIVE PLAN DESIGNATION: Employment; ZONING: E-1; ASSESSOR'S
MAP: 39 lE 04CD; TAX LOT: 1200.
The Staff Advisor's decision becomes final and is effective on the 13'h day after the Notice of Final
Decision is mailed.
Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a
reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance
(ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in
the ALUO 18.108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue,precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.

DECISION
The subject property is a 159,932 square foot parcel located at the southwest corner of the Oak
and Hersey streets, and is zoned Employment or E-1. The parcel is irregular in shape, and is
bound by Southern Oregon Pacific Railroad and Van Ness Avenue rights-of-way to the south,
and Ashland Creek to the west. The site currently contains the Ashland Christian Fellowship's
three buildings and a large asphalt parking lot.
The Ashland Parks and Recreation Department (APRD)has recently acquired an easement from
Ashland Christian Fellowship (ACF) to provide an ADA path along the riparian corridor,of
Ashland Creels. Under the easement maintenance agreement, the Parks Dept. will have the
authority to maintain the riparian corridor from the path to the centerline of Ashland Creek,the
entire length of the western property line. A hazardous tree removal permit for 6 trees was
submitted and approved on November 9, 2011. Because the approval was after October 31St; a
Limited Activity and Use permit is needed to complete the work
The applicant has proposed a Multi-Year Maintenance plan for the portion of trail that APRD is
responsible for. The maintenance plan makes provisions for basic maintenance such as tree
pruning, noxious vegetation removal, and hazardous tree removals within the riparian corridor.
The applicant's findings state that although the majority of the proposed work would fall under
exempt-activities (18.63.060), there may be instances where power-assisted machinery will need
to be utilized past the October 31St date. In that circumstance, all requirements of 18.69.060.Li
will be adhered to, including the use of materials (plywood, mulch, etc)that will disperse the
weight of machinery over a large area so that the root zones will not be negatively impacted.

At their November 3rd, 2011 meeting, the Tree Commission reviewed the initial tree removal
proposal noting that many of the trees appear to be maintained. Anne Thayer, Ashland Parks and
Recreation Horticulturist, responded that indeed many trees do need to be taken care of, however
that particular application (PA-2011-01428) only addressed the hazardous trees and not other
that are in need of minor maintenance. Staff suggested that Parks apply for a multi-year
maintenance plan that would address a number of issues under one approval.
In staff's opinion, because of the small scale of proposed work and the type of restoration of the
riparian corridor that the Parks Dept. will perform, that the multi-year maintenance plan is the
best course of action to maintain and remedy the Ashland Creek Riparian Corridor, The Ashland
Parks and Recreation Department utilizes best practices guidelines when working in forested and
riparian areas, and follows a Natural Resource Enhancement Plan that is not defined by Land use
codes. Therefore, staff believes that the multi-year plan meets the criteria of the ordinance and is
approved.
The criteria for a WATER RESOURCE LIMITED ACTIVITIES AND USES are described in AMC
Chapter 18.63.070.D as follows:
A Water Resource Permit shall be issued by the Staff Advisor when the Applicant demonstrates the
following;
1. All activities shall be located as far away from streams and wetlands as practicable, designed
to minimize intrusion into the Water Resources Protection Zone and disturb as little of the
surface area of the Water Resource Protection Zone as practicable.
2. The proposed activity shall be designed, located and constructed to minimize excavation,
grading, area of impervious surfaces, loss of native vegetation, erosion, and other adverse
impacts on Water Resources.
3. On stream beds or banks within the bank full stage, in wetlands, and on slopes of 25% or
greater in a Water Resource Protection Zone, excavation, grading, installation of impervious
surfaces, and removal of native vegetation shall be avoided except where no practicable
alternative exists, or where necessary to construct public facilities or to ensure slope stability.
4. Water, storm drain and sewer systems shall be designed, located and constructed to avoid
exposure to floodwaters, and to avoid accidental discharges to streams and wetlands.
5. Stream channel repair and enhancement, riparian habitat restoration and enhancement and
wetland restoration and enhancement will be restored through the implementation of a
mitigation plan prepared in accordance with the standards and requirements in Section
18.63.120.
6. Long term conservation, management and maintenance of the Water Resource Protection
Zone shall be ensured through preparation and recordation of a management plan as
described in Section 18.63.120.C, except a management plan is not required for residentially
zoned lots occupied only by a single-family dwelling and accessory structures.

Planning Action 2011-011594 is approved with the following conditions. Further, if any one or
more of the following conditions are found to be invalid for any reason whatsoever, then
Planning Action 2011-01594 is denied. The following are the conditions and they are attached to
the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise
modified here.
2) That the multi-year maintenance plan is for the portion of property that is identified in
application submittals, and any expansion of the area be a modification of the
maintenance plan.
3) That if an Emergency Tree removal permit, as defined in 18.61.042.A, be deemed
necessary,that the applicant notify the Staff Advisor as soon as possible.

Ashland Parks and Recreation Department is seeking relief and approval from the land
use codes Limited Activity and Use permit for planning action#2011-01594 to remove
two hazard trees (Cottonwood) and remove the dead top of another Cottonwood under
Emergency Tree Removal 18.61.042 (4 a, &b). APRD must prevent an imminent threat
to public health and safety, and to public or private property in due diligence, by
removing hazardous trees and pruning deadwood out of hazardous trees within a timely
manner.
Ashland Parks and Recreation Department has met the criteria for Tree Removal
ordinance as described in AMC Chapter 18.61.080,with the addition of habitat boxes as
mitigation for each tree removed along the Ashland Creek Trail. The Tree Commission
Staff has certified arborists on the staff that agreed that many of the trees appear to be in
fair to declining health.
As a certified arborist for APRD,there are three Cottonwood trees that are hazardous
and require immediate removal/and or significant deadwood removal to provide Ashland
citizens safety and well being along Ashland Creek Trail. The tagged trees are marked
with numbers (# 12,13,14) signifying work to be done by a sub-contractor(Beaver Tree
Service). Two of three trees require immediate removal and# 12 requires large deadwood
removal for danger of collapse. Factors that contribute to the immediate need for
removal include:
Heavy lean and extensive decay.
Winter snow and rain loads in combination with high wind conditions.
Target zone is a much used public path.

The following written findings is for a Water Resource Limited Activity Permit for a Multi-year
Maintenance Plan for the "Ashland Creek Trail"within the Riparian Protection Zone located at
50 West Hersey Street.

NARRATIVE
The Ashland Parks and Recreation Department(APRD) strives to provide access along our
riparian corridors whenever possible. Recently APRD was approached by Ashland Christian
Fellowship, located at 50 W. Hersey Street,to develop and maintain an ADA trail across their
southern property boundary,then north parallel along Ashland Creek terminating at West Hersey
Street. 400 feet of the ADA trail along Ashland Creels is within the Stream Protection Zone in
accordance with 18.63.020.
Because APRD will be responsible for the safety and well being of our citizens, APRD must
provide maintenance safety standards within the public and easement properties maintained by
APRD. Ashland Parks & Recreation does not have a previously approved management plan for
this portion of the Ashland Creels riparian zone as the easement has been signed recently and
work is in process in the establishment of an ADA trail. Likewise, APRD is also committed to
being stewards of the health and prosperity of our riparian corridors, which is why APRD is
applying to establish a multi-year maintenance plan for this property. This trail will be
maintained and managed by Ashland Parks and Recreation thereof.
This maintenance plan includes provisions for landscape maintenance and hazard tree removals
for the 24,OOOsq.ft. piece of property that APRD would be responsible for. Because of the small
scale of our landscape and tree maintenance, we recognize that most of the activities described
are covered under the exempt section in accordance with 18.63.060, including City Emergency
Activities. This project does not involve in-stream work, nor will local native plant species be
damaged or removed,however the use of power-assisted machinery will have to be utilized past
the October 31"deadline due to the timing of legal easement agreements and Council approval.
All of the proposed activities fall under APRD's Natural Resource Enhancement Plan and,-are not .
defined by Land Use Codes.

and other pertinent information is included at the end of this document.
FINDINGS
18.61.080. Tree Removal Criteria.
A tree removal permit for six hazardous has been filed with the Planning Division and
decision pending at the time of this application. APRD foresees approval being granted by
staff and conditions set for maintaining wildlife habitat.
18.63.060. Exempt Activities.
1. Vegetation Maintenance, Planting and Removal.
a. Landscape Maintenance. Existing vegetation will be continually maintained, including
being in accordance with weed abatement polices set by Ashland Fire and Rescue.
c. Non-native,noxious and invasive vegetation removal. The removal/mowing of
blackberries shall not occur between May 1St and July 31St to protect nesting birds.
c. Tree pruning. Maintenance pruning of existing trees shall be kept to a minimum,meeting
clearance for trails and shall be in accordance with the Tree Preservation and Protection
Chapter 18.61. Under no circumstances shall the maintenance pruning be so severe that it
compromises the tree's health, longevity, or resource functions (ie. shade, soil stability,
erosion control, etc.).
e. Hazardous Tree Removal. A permit for Hazardous Tree Removal shall be processed
under procedures and approval criteria described in the Tree Preservation and Protection
Chapter 18.61.
i. In-Channel Vegetation Removal. Debris in Ashland Creek will be monitored and
determined if it should be removed due to future blockage of nearby culvert(Hersey St.).
g. Routine planting. The planting of local native plant species or the replacement of non-
native, noxious and invasive plants with local native plant species, as identified on the
City of Ashland's Local Native Plant Species List. Vegetation preservation(18.63.1200
mitigation shall be identified within the water resources protection zone.
h. Use of Hand-held Equipment or Machinery. The use of hand-held machinery(ie. walk
behind mowers,weed eaters) for vegetation maintenance and fire hazard prevention.
i. Use of Power-Assisted Machinery. When larger machinery is necessary for removal or
maintenance of trees with in the riparian corridor, soil compaction from equipment
(bucket trucks) will be reduced by distributing the weight of equipment over a large area

utilizing non-invasive materials such as plywood,mats,mulch, etc. whenever working
within the riparian protection area.
2. Building Paving and Grading.
The trail consists of granite 4" deep compacted down to 2", with a sub-base of weed mat
and other materials. This type of trail requires constant upkeep and maintenance to meet
the standards of ASTHO guidelines for ADA accessibility, as well our own standards for
safety and overall riparian health. Additional work performed on the established trail will
consist of replacing garbage can liners,Mutt-Mitt stations, and care for related
educational displays.
4. City Emergency Activities.
Above all else, APRD must provide a safe and responsible environment for the welfare of
all citizens. Because of this, ARPD will interfere when a tree or other natural hazard
impacts the riparian corridor when it presents a potential imminent danger to public or
private property. This will most likely be in the form of debris potentially blocking the
nearby Hersey Street culvert. The creek and associated corridor will be monitored and
determined if an action or event that presents imminent danger will be handled. In such
an event, APRD will notify the Planning Department of activity so that it can
documented.
18.63.070. Limited Activities and Uses.
4 Approval Standards for Limited Activities
1. All activities shall be located as far away from streams and wetlands as practicable,
designed to minimize intrusion into the Water Resources Protection Zone and disturb as
little of the surface area of the Water Resource Protection Zone as practicable. Because of
the level of care that the vegetation will require within the riparian corridor,most of the
work will be on such a small scale as it would be considered an exempt activity, and as
such will not derogate the riparian protection area. However in all cases that require more
heavy machinery or invasive procedures,protective measures will be taken to ensure that
soils and roots are not negatively impacted, and that native plantings are preserved
whenever possible.
2. The proposed activity shall be designed, located and constructed to minimize
excavation, rg ading, area of impervious surfaces, loss of native vegetation, erosion, and
other adverse impacts on Water Resources. All work will be performed to restore and
preserve the riparian habitat of Ashland Creek wherever possible. No impervious surfaces
are proposed with the trail,nor loss of native vegetation, or negative impacts to the
riparian corridor;just the maintenance of the trail easement and the associated riparian
area.

3. On stream beds or banks within the bank full stage, in wetlands, and on slopes of 25%
or rg eater in a Water Resource Protection Zone, excavation, rg ading installation of
impervious surfaces, and removal of native vegetation shall be avoided except where no
practicable alternative exists, or where necessary to construct public facilities or to ensure
slope stability. APRD is not proposing to install impervious surfaces, significant grading,
or native vegetation removal.
4. Water, storm drain and sewer systems shall be designed, located and constructed to
avoid exposure to floodwaters, and to avoid accidental discharges to streams and
wetlands.No water systems are proposed to be installed with this application. However
with ongoing maintenance of the Ashland Creels riparian corridor,the safety of the
Hersey Street culvert will be monitored to prevent flooding in the event of fallen trees or
blockage.
5. Stream channel repair and enhancement,riparian habitat restoration and enhancement
and wetland restoration and enhancement will be restored through the implementation of
a mitigation plan prepared in accordance with the standards and requirements in section
18.63.120. Being the property in contact with Ashland Christian Fellowship,the ongoing
maintenance and care is provided by the existing easement agreement and best practices
standards by APRD.
6. Long term conservation, management and maintenance of the Water Resource
Protection Zone shall be ensured through preparation and recordation of a management
plan as described in section 18.63.120.C, except a management elan is not required for
residentially_zoned lots occupied only by a single-family dwelling and accessory
structures. Because the property is held under a legal contract by the City to maintain, a
legal contract is not necessary to ensure management will be adhered to.
18.63.120. Mitigation requirements.
A. Vegetation Preservation and Construction Staging,
As mentioned earlier in this document,the APRD utilizes best practices when working in
forested and/or riparian areas. Work areas on the immediate site shall be identified and
marked to reduce damage to trees and vegetation. Temporary construction fencing shall
be placed at the drip line of trees bordering the work area.No equipment maneuvering,
staging or stockpiling shall occur outside of designated work areas within the riparian
protection zone. Trees will not be used as anchors for stabilizing equipment. And the
stockpiling of soil, or soil mixed with vegetation, will not occur in the Water Resource
Protection Areas on a permanent basis. When work is performed that is beyond that of
exempt activities in accordance with 18.63.060,APRD will employ temporary erosion
control measures installed to prevent encroachment and flow of runoff material or other
debris into the Water Resource Protection Zone

B. Options for Satisfying Restoration and Enhancement Requirements in Mitigation_ Plans.
This application is for the maintenance and care of the APRD's trail easement at 50 W.
Hersey Street.No additional plantings or mitigation requirements are required or
proposed at this time. APRD understands that any potential activity or use proposed that
is beyond the scope of Exempt activities and those mentioned of the maintenance plan
may be subject to further planning review in accordance with AMC 18.63
C. Management Plan.
Because this easement in now the responsibility of that Ashland Parks and Recreation
Department, on going maintenance will be ensured by the contract drafted between
Ashland Christian Fellowship and the APRD. The ongoing maintenance and care is
provided by the existing easement agreement and best practices standards by APRD.
Because the property is held under the above standards, APRD feels that an additional
legal maintenance agreement to ensure maintenance is not necessary at this time
