A Cottonwood behind 641 Nepenthe; A Raywood Ash in right-of-way between 795 and 785 Creekstone; A Raywood Ash adjacent to the community garden in the Upper'Park; A Pear tree that is leaning against a building , and a Shore Pine located behind the Fitness center and clubhouse. Tree#1, a Raywood Ash, is located directly next to a light pole and irrigation boxes adjacent to the community garden in the Upper Park. This tree is within the Riparian Protection Zone of Kitchen Creek. ! i The applicant's findings state that the tree has caused serious damage to pipes and valves of the irrigation lines, and some of the roots had to be cut for repair which will eventually cause the tree to die. The tree is located approximately 40 feet from the center of the Kitchen Creek and will not have a negative impact because the tree is upland enough not to cause erosion or soil stability issues. Because of various other trees located in close proximity, the applicant is not proposing to mitigate this tree at this location. Tree#2, another Raywood Ash, is located in a small landscape strip between two properties. The findings state that the roots have caused damage to the sidewalk as it had to be replaced once before, and keeping the tree would ultimately become a tripping hazard to residents. Tree #3, a Cottonwood located in the riparian protection zone behind 641 Nepenthe, is placed at the terminus of the private drive and is cracking the pavement. This tree is located approximately 30 feet from the centerline of Kitchen Creek. Tree#4, a large ornamental Pear, is leaning towards the building and has outgrown the space it was j planted for. This tree is not considered a hazard by the applicant's findings and therefore would require to be removed. Tree#5, a Shore Pine, has been recommended for removal by the Ashland Fire Department's Fire Wise program because it is too close to the building and is considered a fire hazard. PA#2011-01467 855 Mountain Meadows Dr/MP Page 1 The Tree Commission did not have a quorum for their December 7th 2011 meeting; therefore no commission recommendations were given for the removal request,however staff has visited the site three times at various times of the day.The applicant has requested not to mitigate trees#1 and.#2. Staff sees no issue with not mitigating Tree#1 due to its proximity to the riparian protection zone and many other trees in this section of the Kitchen Creek. However, Tree#2 was approved as a street tree in accordance with the City's Site Design and Use Standards (SDUS) Section II-E; and 1 street tree per 30 feet is required. Staff noted that similar trees in similar sized landscape strips did not seem to have the same issue, and perhaps more*attention can be given to the type of tree planted as to not have the same reoccurring issue in the future. Therefore a mitigation tree will be required with a more appropriate tree chosen from the City's Recommended Street Tree Guide. Tree#3 appears to be a•healthy mid-sized Cottonwood tree that is approximately 30 feet from Kitchen Creek. Opposed to the northern section of Kitchen Creek adjacent to the Community Garden,this section of Kitchen creek has a few varieties of trees planted in a cluster. Staff's site visit shows that the tree is slightly lifting the asphalt and does not appear to be severely damaging the parking area.Despite the slight damage;this tree is in good health and adds diversity and shade to the riparian corridor, and ultimately staff feels that removal would be detrimental to overall health of the riparian zone. With that said, staff recognizes the constant repair of parking area will increase as the tree ages; and with vehicles parked directly underneath the canopy,the potential of the tree damaging persons or property later in life is too great,therefore,the tree is approved to be removed. Although approved, removal will leave a void in the area and the-health of the riparian.area may suffer. As such, a condition will be added that an equal caliber replacement tree be mitigated elsewhere in the riparian zone at maximum 100 feet from Tree 43's location. Trees#4 and#5 are planted in the courtyard open space of the Parkside Condo Neighborhood. Tree#4 . has simply outgrown the space it was planted. This tree is not considered a hazard by the applicant's findings and therefore would require to be mitigated elsewhere. Tree#5 was requested to be removed by Ashland Firewise due to being too close to the building. While staff recognizes fire and life safety as the upmost importance, not all trees close to buildings are considered to be hazardous. Therefore staff recommends that an equal caliber coniferous tree be mitigated elsewhere on the property. Overall Staff believes the Mountain Meadows community deeply cares for its trees and removes only those that have a reasonable rationale to do so. Having Kitchen Creek meander through the property is a valuable asset to the community, and its overall health is largely dependent on the care that Mountain Meadows gives to its trees and landscaping. The conditions of approval have been added to ensure long-term care and maintenance for trees and riparian corridor will continue for many generations to come. Prior to the removal of the trees the applicant shall submit their proposed method of`mitigation' to the Planning Division so as it may be part of the record of decision. The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080; as follows: A. Hazard Tree: The StaffAdvisor shall issue a tree removal permitfor a_hazard tree if the applicant demonstrates that a tree is a hazard and-warrants removal. 1. A hazard tree is a tree that is physically damaged to.the.degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate PA#2011-01467 855 Mountain Meadows Dr/MP Page 2 that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning. 2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084.Such mitigation requirements shall be a condition of approval of the permit. A Tree that is Not a Hazard- The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following.• 1. . The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards. (e.g. other applicable Site Design and Use Standards). The StaffAdvisor may require the buildingfootprint of the development to be staked to allow for accurate verification of the permit application,.and 2. Removal of the tree will not have.a significant negative impact on erosion, soil stability,flow of surface waters,protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone.Nothing in'this section shall require that the residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures or alternate landscaping designs thatwould lessen the impact'on trees, so long as the alternatives continue'to . comply with other provisions of the Ashland Land Use Ordinance. 4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61-.084. Such mitigation requirements shall be a condition of approval of the permit. Planning Action 2011-01467 is approved with the following conditions. Further, if'any one or more of the following conditions are found to be invalid for any reason whatsoever,then Planning Action 2011- 01467 is denied. The following,are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That Tree#2 be replaced with a more appropriate tree be planted in the landscape strip as chosen from the City's Recommended Street Tree Guide. 3) That Tree#3 be replaced with an equal caliber replacement tree that will equal or exceed the removed trees size and stature at maturity shall be planted elsewhere within the riparian protection zone of Kitchen Creek at a maximum of 100 feet from Tree#3's location. 4) That Tree#4 be replaced elsewhere on the property in a more appropriate location. 5) That Tree#5-be replaced with another coniferous tree in a more appropriate location. 6) All trees shall be shall be planted in the locations designated by the applicant within a minimum of 180 days of this approval. The applicant shall submit their proposed mitigation trees to the Planning Division so as it may be part of the record of decision. The tree shall be planted and maintained according to the specifications in the City Tree Planting and Maintenance.Guidelines. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental Constraints. The Staff Advisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of j adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property, The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone, In making this j determination, the City may consider alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance. 4. Raywood Ash in Upper Park. 16"d.b.h. is on the edge of the Riparian Zone. Tree is causing damage to irrigation boxes and valves. According to the landscape service hired by Mountain Meadows, this tree has caused serious damage to the pipes and valves, the roots had to be cut away from the irrigation pipes for repair. This will eventually cause the tree to die and become a hazard. Also this tree is approximately 40 feet away from the bottom of the creek and removing it will not cause any erosion to the bank. Replacing this tree is not recommended because it will cause the same issues, plus there are many trees in the area. 2. Raywood Ash between 795 and 785 Creekstone. The tree is cracking and lifting the sidewalk. 16: d.b.h. The sidewalk has been replaced once already and has cracked again. This tree is a danger to the residence, they could trip and fall over the cracked j and lifting sidewalk. This tree roots have grown 6-8" above soil grade. This tree should be removed and not replaced with another tree because it will cause the same issues. 3. Cottonwood at rear of 641 Nepenthe. Approximate d.b.h. 24-26" damaging concrete parking area. The tree is situated in the Riparian Zone. This tree should never have been planted in this area. The parking lot has been repaired before and will need it again in the future if the tree isn't removed. Residence can trip over cracked and broken concrete. There is no plan by Beaver Tree Service to replace this tree. If a replant is required by the City of Ashland, then that is something that the City can discuss with Mountain Meadows. It is my understanding that when the City of Ashland has required replanting they have done so. 4. Large Ornamental Pear tree 8" d.b.h. this tree is leaning towards the building and has out grown the space to where it was planted. 5. Shore Pine 9" d.b.h. this tree has been tagged by Ashland Firewise for removal. The trees near Kitchen Creek that are within 50-feet of the'top of bank'(I mistakenly told Dan 30-feet)are subject to the Water Resources Protection Zone codes-essentially the trees will have to be shown that they are a hazard to persons and property.The permit is still a tree removal permit and are subject to the same code as the other trees being removed. The trees in the common areas and private lawns outside of the Water Resources areas are subject to a tree removal permit if they are greater than six-inches in diameter at breast height. The trees within the public right-of-way(street trees)are a different process entirely but can be addressed in the same document. I have attached the Tree Protection and Preservation ordinance(AMC 18.61). We will need a written description of the trees and address the criteria from the code regarding the reason for the request and a site plan showing where the trees are located. Specifically address 18.61.050, 18.61.080& 18.61.084. I There is a$27.00 fee and a signed application(signed by Beaver as the applicant and Mt.
