The property is zoned Employment(E-1)and has an—R residential overlay, and is located within a Detail Site Review Zone and the Railroad Addition Historic District. The site slopes downhill in a northerly direction an average of two-and-a-half percent. The street trees and sidewalk are located on the private property with a public pedestrian easement for the sidewalk. There is an existing two-story building located on the parcel, which contains two businesses: Gathering Glass, a glass blowing studio owned by the property owner, and Deux Chats Bakery, a wholesale bakery with a limited retail component operated by the current applicants. A total of nine on-street spaces are adjacent to the property frontage with two parallel spaces available on Pioneer Street and seven diagonal spaces on the A Street frontage. These nine on-street parking spaces provide an on-street parking credit to offset five spaces of the off-street parking demand. Three off-street parking spaces are available on the subject property,meaning that there are total of eight parking spaces available to meet the combined parking demand for the two businesses. The bakery portion of the existing building was approved as an addition to the Gathering Glass building in 2004; that approval included ground-floor retail and a one-bedroom apartment on the second floor. The apartment was never constructed,and the second floor space has been an unused mezzanine space since the addition was completed. With the current application, the applicants are proposing to convert the unused second floor mezzanine space to wholesale bakery space to allow them to consolidate their baking business, which is currently split between this building and the building at 310 Oak Street across the street into a single space to gain operational efficiencies. PA#2011-00038 222 A Street/dds Page 1 After constructing the building,the property owner who also operates the Gathering Glass business on the subject property,placed a shipping container to accommodate on-site storage of materials associated with the glass blowing business. This container was place two to three years ago in an area previously identified as landscaping; the container was placed without obtaining the required modifications to the existing Site Review approval despite the fact that the property is located in a Detail Site Review Zone within the Railroad Addition Historic District. The proposed expansion into this second floor space will add approximately 922 square feet of production space within the existing shell. The expansion does not entail any exterior modifications to the existing building or changes to the footprint; no new signage is proposed; existing utility services are in place to serve the building including the expanded second floor production space;and there is no associated addition of seating involved with the current proposal. As such, in staff's view there are really only two items to consider in reviewing the request: 1)That available parking is sufficient to meet the requirements with the additional space; and 2) That the placement of the shipping container in a required landscaped area on the site is addressed to ensure that adequate landscaping remains on the site to adequately address Site Design and Use Standards requirements,that the container is adequately screened from view from the right-of-way to minimize visual impacts, and that it poses no concerns for the Building or Fire Departments. The applicants propose to utilize 130 square feet of the existing ground floor space as retail, with the remaining 2026 square feet of lease space serving as wholesale bakery production/manufacturing space. The application includes parking calculations demonstrating that the parking demand associated with the existing and proposed uses of the building can be satisfied with the eight existing parking spaces approved under Planning Action#2004-018. The property owners have provided calculations noting that with the 160 square foot storage container in place, 17.7 percent of the site remains in landscaped area exceeding the Site Design & Use Standards' requirement for 15 percent landscaping. The Historic Commission reviewed the application at their February 2"d, 2011 meeting and recommended approval of the interior-only building modifications as presented. With regard to the on-going use of the shipping container for on-site storage,the Commission felt that the placement of the container behind the building and the generally industrial character of the area somewhat lessened the visual impacts,however the Commission recommended that if the container were to remain it must be screened from view from A Street. The Commission was supportive of the use of ' vegetative screening,and believed that such screening could be accomplished in a way that would screen the container without requiring pavement modifications,thus allowing continued access to the container while also facilitating its eventual removal. The Commission recommended that a single planter be constructed which would provide for adequate soil volumes and irrigation to support a mix of deciduous and evergreen materials or vines which would adequately screen the container as viewed from A Street, and further recommended that the planter's final design and placement be reviewed and approved by the Historic Commission's weekly review board and the Staff Advisor before installation. A condition to this effect has been added below,and staff has also included requirements that the container be painted a more muted color to further minimize visual impacts and that the property owner verify that the container's placement and use do not pose concerns for the Building or Fire Departments. I PA#2011-00038 222 A Street/dds Page 2 The criteria for a Site Review approval are described in AMC Chapter 18.72 as follows: A. All applicable City ordinances have been met or will be met by the proposed development. B. All requirements of the Site Review Chapter have been met or will be met. C. The development complies with the Site Design Standards adopted by the City Council for implementation of this Chapter. D. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. All improvements in the street right-of-way shall comply with the Street Standards in Chapter 18.88, Performance Standards Options. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2011-00038 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever,then Planning Action 2011-0003 8 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein, including that there shall be no exterior changes to the existing building and that no seating is to be added with the proposal. 2) That all requirements of the previous Site Review approval, Planning Action #2004-018, shall remain in effect unless otherwise modified herein. 3) That the plans submitted for the building permit shall be in substantial conformance with those approved as part of this application. If the plans submitted for the building permit are not in substantial conformance with those approved as part of this application,an application to modify the Site Review approval shall be submitted and approved prior to issuance of a building permit. 4) That the recommendations of the Historic Commission's February 2nd, 2011 meeting shall be conditions of approval, where consistent with applicable standards and with final approval by the Staff Advisor,including that vegetative screening of the container be provided using a single planter constructed to provide adequate soil volumes and irrigation to support of mix of deciduous and evergreen plant materials or vines which will adequately screen the container as viewed from A Street. In addition, the storage container shall be painted a muted color to further minimize its visual impacts to the streetscape. Prior to installation of the planter or vegetative screening,the final design and placement of the planter shall be reviewed by the Staff Advisor and Historic Commission Review Board, and the property owner shall verify that the container satisfies requirements as a code-complying structure for a pre-fabricated storage occupancy and that the container and associated screening do not obstruct required firefighter access pathways. 5) That the requirements of the Fire Department shall be satisfactorily addressed prior to the issuance of a certificate of occupancy including approved addressing, firefighter access pathway, fire flow, hydrant clearance,extinguishers,and limits to obstructions to firefighter access. Final determination of fire hydrant distance, fire flow and fire apparatus access requirements will be based upon plans su�mitted for Building Permit review. Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way,Ashland, Oregon 97520 prior to 4:30 p.m.on the deadline date shown above. However, our retail is only open two days a week and only occupies 130 square feet. We are focusing on expanding our wholesale business and being located in one building will be necessary. This request is to modify a prior approved planning action and to complete the second floor. This space will allow us to improve production and will add 922 square feet within the existing building shell. No exterior modifications nor interior seating are proposed. LANDSCAPING REQUIREMENT: No exterior changes, expansions or modifications are proposed to the height,mass and building footprint will not change. Therefore, the requirement was met with the approval of PA2004-0018. TREES: This is an interior improvement only. No trees will be disturbed. Any demolition, construction and staging of materials will utilize the rear entrance. PARKING,ACCESS, AND INTERNAL CIRCULATION: No additional parking will be required and we show that we meet the standards set and approved in PA2004-0018 i SETBACK: No changes to the exterior of the building are proposed so no changes in the setback should be required. LOT COVERAGE: No exterior changes are proposed the building footprint will not change so the lot coverage is the same as in approval PA2004-0018. SIGNS: No sign changes are proposed. 1 BASIC SITE REVIEW: All of the criteria of the Basic Site review and Detail Site Review standards have been met and with respect to this modification,the owner and applicant agree: A.
