The Staff Advisor's decision becomes final and is effective on the 13th day after the Notice of Final

Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a
reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance
(ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in
the ALUO 18.108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application,by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue,precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.

DECISION
The subject property is on the north side of Oregon Street at the northwest intersection of Monroe Street.
The subject property and the surrounding lots are zoned R-1-7.5. The lot has a steep slope from Oregon
Street to the existing structure, is flat in the area of there the home and driveway are located and drops j
off steeply to the north. The area of the lot is 6,232 square feet, below the minimum 7,500 square feet lot
size for the zone. The lot by ordinance definition of front lot line and corresponding setbacks is
orientated towards.Monroe Street,but the existing single-family residence is orientated with the front
door towards Oregon Street. There are nine large Oak trees surrounding the property.

The applicant is requesting to remove the existing 1,446.square foot residence and garage and a portion
of the existing paved driveway to construct a new 2,529 square foot two-story residence with garage.
The existing structure, driveway and other and paved surfaces cover 62 percent of the.lot area. This
exceeds the maximum lot coverage of 45 percent in the R-1-7.5 zone. The site was developed prior to
modern zoning requirements and the parcel is considered existing, non-conforming in lot width, lot area,
solar access and the maximum amount of lot coverage permitted by code.
The applicant has proposed to reduce the total amount of lot coverage by 9 percent to 51 percent. The
maximum lot coverage in the zone is 45 percent and 51 percent exceeds that. Since the parcel still j
exceeds the maximum coverage allowed, a Conditional Use Permit in accordance with Ashland
Municipal Code (AMC) 18.68.090.2 allows a non-conforming structure to be modified or enlarged
under the process of a.Conditional Use Permit(CUP). The applicant is coming closer to conforming to
the permitted lot coverage.

The proposed structure is completely within the existing"developed" area of the parcel,the applicant
has proposed a modern building design to take advantage of the southern sun while preserving the solar
access for the parcel to the north. The parcel is considered a Solar Setback Standard B lot by AMC
18.70,which allows for a 16-foot shadow on the north property line. One of the existing structures non-
conformities was that it did not comply with the Solar Ordinance,the new structure will comply.
The new structure will not increase traffic.generation,noise, light or glare on adjacent properties any
more than the existing structure does. The size of the residence is similar to many within the impact'area
and the bull,,and the mass will not be out of character with the neighborhood. Architecturally,this
structure is different in that it will have a more modern look with interesting roof lines, windows and
fenestrations than the typical ranch style homes directly adjacent,but is architecturally compatible with
the larger impact area and will resemble homes along Windsor Street a block to the south.
There are a number of trees in proximity to the construction. The City of Ashland Tree Commission
reviewed the proposal at their January 5,2012 meeting, expressed concern regarding the impacts of
construction to the trees, and recommended a Certified Arborist be retained to review the proposed
construction and the potential impacts to the trees. A condition to this effect has been added. The trees
are proposed to be protected but a Tree Protection and Preservation Plan in accordance with AMC
18.61.200 has not been provided..A condition of approval requiring a plan and implementation of the
plan prior to any site disturbance has also been added.
The City received a letter from an adjacent property owner that was concerned about the impacts to the
steep slope between their properties and the potential erosion and hillside failure. The applicant has
specifically designed the home to be located outside,of the hillside slopes. A condition of approval has
been added to require that an erosion control plan be submitted for review and approval and that erosion
control measures be implemented on site prior to the issuance of the demolition permit for the existing
structure.
The proposed modifications to the non:conforming parcel are consistent with the criteria of a .
Conditional Use Permit and the end result will be closer to conforming with the current codes of the City
of Ashland and the end result will be a nice addition to an eclectic neighborhood with topographic
constraints and non-conforming lot sizes, orientations and coverage's.
The criteria for a Conditional Use Permit are described in AMC Chapter 18.104.050, as follows:
-4. That the use would be in conformance with-all standards within the zoning district in which the
use is proposed to be located, and in conformance with relevant Comprehensive plan policies
that are not implemented by any City, State, or Federal law or program.
B. That adequate capacity of City facilities for water, sewer,paved access to and through the j
development, electricity, urban storm drainage, and adequate transportation can and will be
provided to and through the subject property.
C. That the conditional use will have no greater adverse material effect on.the livability of the
impact area when compared to the development of the subject lot with the target use of the zone.
When evaluating the effect of the proposed use on the impact area, the following factors of
livability of the impact area shall be considered in relation to the target use of the zone:
1. Similarity in scale, bulk, and coverage.

2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and
mass transit use are considered beneficial regardless of capacity of facilities.
3. Architectural compatibility with the impact area
4. Air quality, including the generation of dust, odors, or other environmental pollutants.
5. Generation of noise, light, and glare.
6 The development ofadjacentproperties as envisioned in the Comprehensive Plan.
7. Other factors found to be relevant by the Hearing Authority for review of the proposed use.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2011-01733 is approved with the following conditions. Further, if any one or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2011-
01733 is denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here.
2) That the applicant shall secure a licensed and certified Arborist to review the existing trees, the
health of the trees and the potential impacts to the trees from the demolition and reconstruction
proposed. The recommendations of the arborist, where consistent with Ashland Municipal Code
shall be implemented on site.
3) That building permit submittals shall include:
a) Details pertaining to the proposed method of erosion control for the downhill"(north)property
line shall be submitted with the building permit for review and approval by the staff advisor prior
to the issuance of the demolition permit. Erosion control measures such as, strawbales, straw
mats and/or erosion control fabric shall be shown on the plan.
b) That a Tree Protection and Preservation Plan in accordance with AMC 18.61.200 shall be
provided to review and approval by the Staff Advisor:
3) That prior to the issuance of a building permit:
a) That a Demolition/Relocation application shall be submitted for review and approval by the
City of Ashland Building Division in accordance with Ashland Municipal Code 15.04.210.
b) The approved erosion control measures shall be installed and approved on site prior to the
demolition of the existing structure.
c) Tree protection fencing shall be installed according to the approved Tree Protection Plan prior to
any site work, storage of materials or permit issuance. The tree protection shall be chain link
fencing six feet tall and installed in accordance with 18.61.200.B.
d) Tree Verification Permit shall be applied for and approved by the Ashland Planning Division
prior to permit issuance, site work, building demolition, and/or storage of materials. The
Verification Permit is to inspect installation of tree protection fencing for the trees to be retained
on site, and on adjacent properties. J

e) That the a new driveway apron be permitted through the Public Works, Engineering Division per
City Street Standards.
4) That prior to the issuance of a certificate of occupancy:
a) The driveway curb cut shall be installed and inspected prior to the issuance of a Certificate of
Occupancy for the new residence.

To Whom It May Concern:
We received the notice of application for demolition of the existing structure and construction of
a new structure on the lot above our house at 595 Monroe mailed on December 22, 2011.
We currently object to a plan for demolishing the structure at 1315 Oregon Street. This structure
sits on a hillside above our property on lot 8900. The land above our garage and house is quite
sloped and we are concerned that without adequate precautions on the construction site,the hill
may slide onto the garage and/or house causing damage.
We need additional time to review the plans for the demolition and new construction to assess
the impact they might have on our property at 595 Monroe, Ashland, Oregon. Because of the
Christmas and New Year holidays and the fact that we reside more than 200 miles from Ashland,
Oregon we will not be able to obtain the plans for review before the January 5, 2012 deadline.

Re: Conditional Use Permit—1315 Oregon St.
A. The current zoning and use of 1315 Oregon Street property is a single
family residence. The proposed project will conform to the same property
type and also be a similar sized single family residence.
The proposed project could not comply with today's standards given the
existing site constraints. The existing site constraints include a lot width of
49.98'which is less than what is called out in the Ashland Municipal Code
18.20.040 General regulations, corner lot as a required width of 60 ft. In
addition to the site being an existing non-conforming site the slope of the
property in areas not currently developed are over 35%. The proposed
project is placed within the existing developed areas to decrease impact on
the steeper sloped vegetated areas. As a result, we have oriented the
building form in a way that minimizes impact on the site, the solar impact on
neighbors, and reduces imperviousness. Within this existing non-conforming
narrow site we have worked to reduce the imperviousness of the project
towards the required 45%. Under the Ashland Municipal Code 18.68.090.2
which allows for a non-conforming structure to be modified or enlarged under
the process of a Conditional Use Permit, of which we ask that 1315 Oregon j
Street classify for. Currently we are over this required 45% because of the
existing non-conforming site issues addressed above, but have moved to
reduce this amount from the existing 62%to 51%.
Per our plan we have called out Monroe Street as our front yard as the
garage and entry stairs of the prosed property face Monroe Street. The front
yard is also a signature element by a front facing large deck which addresses
the street connectivity to the neighbors. We show that we conform to the side
setbacks as well as the rear setback of 10 feet per story as seen on our site
plan.

B. 1315 Oregon Street will have adequate capacity of City facilities for
water, sewer, paved access to and through the development, electricity,
urban storm drainage, and adequate transportation can and will be provided
to the subject property because the new project will also be a single family
residence in similar size and plumbing needs as the existing home. The

driveway will conform to a similar outline as the existing driveway and the
overall site impact will be less than the existing dwelling.
C. The conditional use will have no greater adverse material effect on the
livability of the impact area because the proposed project is designed in a
similar scale and coverage as the existing property. The use of the house will
also be similar which won't affect the generation of increased traffic or other
noise effects on the surrounding neighborhood. This comparison between
the existing property and the proposed project as well as the surrounding
neighborhood also speak towards the architectural compatibility, air quality,
generation of noise, light, and glare. Techniques that we employed to
address these concerns was that we recognized the allowable height limit
and kept well below this limit, even with the solar setback addressed.
Another architectural element was to appear to be a one level home from
Oregon Street to retain a similar scale as the existing home does. To
recognize the Northwest architectural vernacular in the same vein of
surrounding ranches we designed the proposed residence with a low sloping
shed roof. Finally to address and minimize parking and vehicle concentration
the proposed project has a one car garage.
