Two of the trees are located along University Way which is a private campus street. One tree is located to the west of Churchill Hall. They are located on the main campus property south of Siskiyou Boulevard. The two trees along University Way are as follows; one 6-inch in diameter at breast height (DBH) birch tree just to the west of Taylor Hall near the crosswalk. This tree has a large exposed cavern and the base in rotten. The other is an approximately 36-inch DBH Silver Maple tree. This tree is located near the Stevenson Union Building,just behind the sidewalk on University Way. This tree has numerous dead branches in the upper portions of the tree and has failing limbs. The University feels this tree is hazardous due to its proximity to the street and sidewalk. The third tree is a 40-inch DBH Silver Maple tree an Arborist reviewed the tree and found that it has bark inclusions and evidence of decay in the heartwood near the base and above the branch junctions. This tree is very near Churchill Hall which is going through a major renovation; the University is concerned for the contractor's safety due to the large branches and the number of inclusions at the branch junctions. Because the trees are greater than 18 inches D.B.H. and located on Southern Oregon University property a tree removal permit is required. The applicant's findings state that the trees are hazardous. With the evidence of decay and the bark inclusions, staff concurs that the trees are hazardous. According to horticulture and tree pruning resources, inclusions are one of the most dangerous conditions other than root rot a tree can have and pose a great danger in terms of branch drop. PA#2011-01312 1250 Siskiyou Blvd/adg Page 1 There are a large number of trees throughout the University property.,The University also has a very diverse mixture of trees throughout campus. The Tree Commission discussed the proposed removals at their November 4th meeting and concurred with the applicants findings regarding the health of the trees and their need for removal. They agreed that the two trees near University Way should be mitigated at different locations on the University Campus. The Commission made the recommendation that Tree 3,the Maple near the Churchill Hall, shall be mitigated in the same location following the remodel of the Churchill Hall. Staff believes that the tree removal request meets the Hazard Tree Removal Permit criteria of the ordinance and the removal of the three trees is approved to be removed with mitigation. Evidence of the mitigation is required to be provided to the Staff Advisor. This is in the form of receipts for the purchase of the tree and a site visit by the Staff Advisor to confirm compliance. The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080, as follows: An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The StaffAdvisor may require an arborist's report to substantiate the criteria for a permit. A. Hazard Tree: The StaffAdvisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and warrants removal, 1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger ofproperty damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning. 2. The City may require the applicant to mitigate for the removal of each hazard tree. pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. B. Tree that is Not a Hazard.• The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards. (e.g. other applicable Site Design and Use Standards). The StaffAdvisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability,flow . of surface waters,protection of adjacent trees; or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. Planning Action 2011-01312 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2011- 01312 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That the applicant shall select two replacement trees to be placed within 200 feet of the trees removed near University Way that will equal or exceed the removed trees in size and stature at maturity, and shall be planted within 180 days of this approval. The trees shall be planted and maintained according to the specifications in the City Tree Planting and Maintenance Guidelines. 3) The applicant shall select one replacement tree to be placed in the same location as the Maple tree removed near Churchill Hall with a tree that will equal or exceed the removed Maple in size and stature at maturity. This tree shall be planted immediately following construction on the exterior of Churchill Hall. The tree shall be planted and maintained in accordance with the City Tree Planting and Maintenance Guidelines. 4) Evidence of the mitigation is required to be provided to the Staff Advisor. Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way,Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone, In making this determination,the City may consider alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees,so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance. 4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61,084. Such mitigation requirements shall be a condition of approval of the permit. There are five modesto ashes that overhang the sidewalk along the south side of Siskiyou Blvd. These should be pruned to mitigate the risk of long endweighted braches failing where they pose hazards to high traffic areas. There are two trees in front of the Cascade Residence Halls, one a red oak and the other an ash. Similar to the ashes along the Boulevard, these have a number of long heavy branches that should be thinned of endweight before they fail under their own weight.Again,this is a high traffic area. j The last trees that need pruning to reduce the risk of limb failure are two silver maples on University Ave,by Taylor Hall. In addition to the abovementioned nine trees,there are three trees that should be removed as soon as it is possible. These are the silver maple by the Student Union, the birch by Taylor, and the doug fir above Madrone Residence Halls. I will perform the work listed here for$5,945.00, including cleanup. j Itemized,this is the sum of: pruning five modesto ashes for $2,750.00, pruning an ash and a red oak for$750.00, pruning two silver maples for$815.00, and removing a birch, a doug fir, and a silver maple for$1,630.00. We had discussed timing this work with Thanksgiving break, and I think r that's a good idea for the removals. It will be good to have as little foot traffic as possible during this work. This will also allow time for you to get the removal permits from the city.
