PERMANENT BICYCLE AND PEDESTRIAN
ACCESS EASEMENT
THE STATE OF OREGON, acting by and through the STATE BOARD OF HIGHER
EDUCATION on behalf of Southern Oregon University, hereinafter"GRANTOR"does hereby
grant and convey unto the City of Ashland, Oregon, hereinafter"GRANTEE", a Municipal
Corporation of the State of Oregon with offices at 20 East Main Street, Ashland, OR 97520, an
easement for the purpose of constructing a sidewalk for pedestrian and bicycle use upon the
following described real property, in Jackson County, State of Oregon to wit:
A strip of land, 10.00 feet in width located adjacent and contiguous to the west right of
way line of Walker Avenue in the City of Ashland, Jackson County, Oregon beginning at
the southerly boundary line of Webster Street, a former public street vacated by
Ordinance No. 2378 on December 19, 1985 and terminating at the northerly right of way
of Ashland Street, also known as Highway 66 or Greensprings Highway in said City.
GRANTEE, its licensees, successors, and assigns shall have the right of ingress and egress over
the above described area for the construction of a concrete sidewalk and for the continual and
perpetual use of the walk by the public. This easement is being granted to allow flexibility in the
placement of the sidewalk for the preservation of several mature trees.

GRANTOR shall have the right to use the land subject to the above described easement for all
purposes consistent with the uses and purposes of the property and not inconsistent with the uses
of the easement without the prior written consent of GRANTEE.
All rights hereunder shall cease and the easement shall terminate if and when said easement area
ceases to be used for a public sidewalk.
This easement is granted subject to all prior easements or encumbrances of record on the above
described property.
