professional musician, artist, and former educator.
I am speaking on behalf of the small businesses of Ashland in
asking that you consider the impact of Supreme Court's "Citizens
United" decision on Ashland's future. The heart of Ashland IS
small business. OSF employs actors, costume designers,
seamstresses, artists, writers, directors. . .all small businesses. It
gives life to the restaurants, small farms, art galleries, shops, and
an Art Center full of artists...small businesses every one. Our
community's discontent is already evident as unprecedented
numbers of Ashland residents have withdrawn their funds from
major banks in favor of the smaller, more personal, local banks
and credit unions. For the many faces of small business, "we"
ask that you add to your upcoming agenda the inclusion of this
issue on the next election ballot, an indication that our Council is
open to consulting voters. Small business people and all citizens
need to know our vote still counts in Ashland. Thank you.

Statement to Ashland City Council on June 5, 2012:
My name is John Tyler, and I live at 812 Plum Ridge Drive in Ashland. I am sure most of you are
aware of the decision of the U.S. Supreme Court in the Citizens United case that Corporations
are people and can spend unlimited amounts of money to influence political elections. We all
know that money influences elections,and this decision gives wealthy contributors an unfair
advantage over the average voter. We are already seeing the effects of this decision,as
enormous sums of money are being spent on national,state and local elections all around the
country. Since the Supreme Court is the court of last resort,the only way to address this
imbalance is through a Constitutional Amendment. I believe the citizens of Ashland would
welcome an opportunity to make their voices heard, and the only way this can happen is forthe
Council to put it on the ballot in the Fall elections. Please make it possible for the citizens of
Ashland to have an open discussion and vote on this matter in the Fall. I strongly urge you to
place this issue on the Agenda for your next Council meeti o giv Ashland's citizens an
opportunity to express their opinions.Thank you. �= l

Elizabeth R. Hallett
My name is Elizabeth R. Hallett. I live at 938 Mountain Meadows
Circle. I am 88 years old, attending my first City Council meeting.
am here on behalf of planet earth. She is withering due to outdated
policies of using, even raping, her for corporate profit. I am also here
for the hundreds of descendants represented here, unseen but very
real, including yours, and including my two great-grands.
Finally, I am here on behalf of the 5,000 amputees in the army
hospital in which I did nursing in 1945. They went to the defense of
democracy so that you could occupy those chairs and I could stand
before you and speak for the democracy for which they paid in
literally tons of their flesh and thousands of limbs.
If you are unable as a council to stand with us and the many U.S.
Senators who understand this crisis, it will be clear to us that BIG
MONEY has arrived here in Ashland through the so-called Ashland
League of Voters, in our view a euphemism for power hungry,
faceless corporate interests.
We all thank you for your service in representing us and for your
attention these past few minutes.

Main Findings
Quality of life is very significant in the decisions that residents make to move to and to
remain in Ashland.
Quality of life themes that were consistently present in focus groups, interviews, and
surveys:
1. Affordability
Widespread concern
Housing affordability is a more significant problem for those who are
younger than 45 years old, and for those who rent.
2. Jobs and Employment
Employees are seeking career opportunities and jobs with adequate pay.
Employers are seeking committed, full-time employees.
3. Economic Development
Overwhelmingly, respondents want to see the growth of existing
businesses and the encouragement of new small businesses.
4. Community
Sense of community and connectedness are important qualities for
Ashlanders.
5. Nature
Natural surroundings and resources are the most cited reasons for living
in Ashland.
6. Raising Children
Respondents cite the desirability of raising children in Ashland and
connect this to sense of community, quality education, safety, and natural
resources.

Ashland Daily Tidings
To the editor:
For too long the citizens of Ashland have lived with a contradiction of values. On the one hand,
we have a kind and most generous citizenry, opening up their hearts and their doors to those in
need. On the other we have a local government with closed minds, that closes all doors to those
who are poor and without permanent shelter.
In Ashland many venues offer help every week, from Uncle Foods to the Emergency Food
Bank, from the new day breakfast, which provides food, showers and other basic amenities,
to the free meals given at Lithia Park. Yet Ashland has a law which makes it impossible for a
person without permanent shelter to sleep within the city.
This law is known as "Camping Prohibited", or title 10 chapter 46 of the Ashland Municipal
Code. People other than myself, such as Ralph Temple, have shown why this ordinance
violates international law, our United States Constitution, and with decisions made in the court
of law. But first, let us examine its effects on the people.
One effect is an antagonism between the community and their elected representatives.
As the grassroots campaign Legalize Sleep is showing, Ashland citizens do not support the
City's treatment of their people who are poor and without permanent shelter. With City Council
considering a new resolution, known as an exclusionary zone, to increase the enforcement level
of certain ordinances (e.g. Camping Prohibited), this antagonism is again flaring to the forefront.
Another effect of this ordinance is displacement. Every night many of Ashland's roughly 200
homeless people migrate to the land just south of Ashland where they set up refuge in what
is known as "the watershed" or"BLM land." Their presence poses a health and safety risk
to all Ashland residents, due to fire and unsanitary conditions. Yet despite many attempts by
the authorities to rid this area of the poor seeking its refuge, they only succeed in temporarily
pushing this population further back into the forest, soon to return to their exact same campsites
just outside the city limits.
This hostility towards our poor happens all over the county. Just as recently as April 26th, the
Medford police swept the Bear Creek Greenway and dislocated countless numbers of the poor
who are already living in the most unsavory conditions.
This contradiction of values known as "Camping Prohibited" also has the effect of pushing
Ashland's poor to Medford, where some forms of shelter are provided by charity and religious
groups. This hurts both Ashland and Medford. Forcing people to emigrate for shelter puts
additional burdens on those who are most without resources. We in Ashland force those already
most disenfranchised to leave their friends, family, and any consistency of surroundings they
were holding on to. We also put the burden of helping those whom society has rejected onto
a city already in significant turmoil of its own. As many already know, Medford was named the
5th "brokest" city in the nation in a report done by "The Daily Beast" which used income, debt,
and unemployment to rate 30 cities.
There are too many effects of this treatment towards those who are struggling with poverty
to list here. Finally I will add the effect this criminalization of sleeping has on those charged
with such crimes. When one is in the midst of being tried, sentenced or processed, one's
life becomes subject to the law's dysfunctional bureaucracy. Using just one example; if one
must a judge tells you to be somewhere at a specific time and place, regardless of any other
commitments that would conflict, you are legally bound to be there. Looking for work, eating
a free meal, taking a shower and washing clothes are large tasks which often can only be
done at prescheduled times and dates. It also gives the recipient of this punishment a blight on
their record, lowering their ability to have a respectful resume when looking for work, and also
causing social ostracization.
A report by Paul Moss, David Berger and Ralph Temple of the former Southern Oregon
Chapter of the ACLU, titled "Decriminalizing Poverty: Reform of Ashland's Camping Ordinance,"
outlines a clear legal and moral argument for why the ordinance needs reform. It discusses
Supreme Court decisions such as Chicago v. Morales, which uphold the ability to loiter, and
Jones v. City of Los Angeles.
The Jones case, heard in 2007 by the 9th Circuit Court of Appeals, whose jurisdiction includes
Oregon......declared that a city that does not provide adequate shelters for the destitute cannot
constitutionally enforce against them a law prohibiting sitting, lying or sleeping in public
places." "The Jones opinion concluded that the anti-sleeping ordinance, as applied to homeless
persons, violates the 8th Amendment of the U.S. Constitution, which prohibits "cruel and
unusual punishments."
Ashland's ordinance also fails to recognize a crucial aspect of Oregon Revised Statutes
203.077 which states,"AII municipalities and counties shall: (1) Develop a policy that recognizes
the social nature of the problem of homeless individuals camping on public property."
Lastly, Ashland's "Camping Prohibited" ordinance is contrary to international law. "The
Universal Declaration of Human Rights, of which the United States is a signatory,
provides: "Everyone has the right to a standard of living adequate for the health and well-being
of himself and of his family, including food, clothing, housing..."
For the reasons I have stated above I, Keith Haxton, find this law to be unjust and therefore, I
do not recognize it as having legitimate authority. I am always willing to discuss these matters
with any interested party, and I hope to have much dialog. God bless.

Gerry Lehrburger/1639 Jackson Road/Addressed issues with the homeless and stated
exclusionary zones would not work, and citations and time in jail were ineffective. He
submitted into the record a document sharing solutions to the issue and photos of trash
left by transients in the watershed. Ecoli was prevalent in the watershed. He listed
the fires that occurred in that past associated with the homeless. He noted The Grove,
Pioneer Hall, and the Ashland Community Center were underutilized and other facilities
could absorb their events.

Randy Dollinger/240 Ohio Street/Supported the homeless in Ashland and all Americans.
Homelessness was a huge problem and the focus had been on a small hardcore group of homeless
people downtown that continue to cause problems. He questioned why the City could not just
enforce the laws already in effect instead of establishing an exclusionary zone. It seemed systematic
of a tendency currently sweeping the country that was rightwing and fear-based that he thought
Ashland community could challenge and stop.
Caren Caldwell/124 Ohio Street/Explained she was a longtime resident of Ashland and strongly
opposed any kind of exclusionary zone the Council might consider. She would be unhappy to
expose her children to the meanness and opposition to civil liberties that an exclusionary zone
represented.
Helga Motley/693 Clay Street/Spoke against establishing exclusionary issues. Targeting, defining,
and punishing people for having violations that accumulate and then not allowing them into
specific areas of the town felt like searching for people to target. Stray dogs seemed to receive
better treatment than some of the homeless people did. She encouraged compassion and a different
solution.
Brian Comnes/444 Park Ridge Place/Doubted an exclusionary zone would be more effective and
thought it would give the police more ways to harass people and only pick out a few high incident
repeaters. He noted 50-60 court cases of other municipalities that tried to criminalize homelessness and
how they lost in court every time. He would rather see the money the City would have to set aside to
defend this ordinance in court go towards positive programs that did something about the problem. He
thought it was an overreach and a bad idea.
James Henderson/1361 Quincy Street/Did not see the point in an exclusionary zone. There
were laws in place to do deal with repeat offenders. Another issue of concern was the sidewalk
restrictions that could have a negative impact on street musicians. He opposed sidewalk
restrictions and exclusionary zones.
Mountain aka Michael Mauro/2253 Hwy 99 North/Explained he was the RV Camp Host at Jackson
Well Springs and thought an exclusionary zone would create more problems. He cautioned about
the fires that occurred over the past two years and how everyone was liable for potential wild
fire. The best thing to do was take a positive directive,put people in safe places, and not have an
exclusionary zone.
Dot Fisher-Smith/945 Oak Street/Was embarrassed to live in a city that would have an exclusionary
zone and urged Council to refer the matter to the ad hoc committee. It was a transparent targeting of
homeless people. She read a statement from Jack Goodman on how Ashland community helped him get
out of homelessness. She believed there were positive solutions more congruent to the values espoused in
Ashland and urged Council to let a diverse group of stakeholders work towards a solution.
Suzie Aufderheide/321 North Mountain Avenue/Explained she frequently had homeless people
staying with her. She thought community could find a solution with the help of the City. She noted the
foreclosures and financial struggles people were experiencing and stressed the need to be compassionate.
Leigh Madsen/176 Orange Street/Agreed homelessness was a complex issue with many faces and
there would be challenges to overcome if the City decided to provide compassionate solutions. Ashland
was an educated diverse community. The very nature of an exclusionary zone threatened that diverse
nature. The people most likely to be excluded were the poor and the homeless, the most vulnerable of the
population. Ashland was endowed with a creative and critical thinking populous. The exclusionary zone
ordinance was copied from other cities. It had not faced significant legal challenge nor was it proven
successful. It would be wiser to engage Ashland's educated population to work in teams to address real
issues. Ashland deserved cutting edge, ahead of the curve outcomes for these complex issues. He urged
Council to invest their efforts in collaborative thinking, cooperative problem solving and avoid punitive
and demeaning ordinances.
Rich Rhode/124 Ohio Street/Explained he was the Regional Organizer for Oregon Action and was
very concerned about the exclusionary zone ordinance. He read the ordinance and was appalled by the
language. He observed the Council had the opportunity to address the critical problems the City faced by
referring solutions to an ad hoc committee.
Mollie Mustoe/724 '/2 Siskiyou Blvd/Was a Southern Oregon University (SOU) student and asked
Council to review the short-term alternatives for homelessness in Ashland. She wanted an ad hoc
committee that represented all the demographics within Ashland. The committee should address both
short-term and long-term solutions. There were alternatives that would support all citizens. She urged
Council to support those who have the weaker voice within the city, state, and society.
Sandra Coyner/1160 Fern Street/Expressed her frustration regarding the proposed exclusionary zone
ordinance. She hoped Council would establish a committee and work on solutions that could genuinely
help the homeless members of the community. She did not see evidence of a health or safety. She
was suspicious of a mindset that kowtowed to tourist sensitivities while not tolerating visitors with less
money. She agreed there was a possible issue with scofflaw behavior and hoped the City exhibited
similar concern for the tourists that tear up their parking tickets. Providing basic human necessities would
be a better solution to the"so called"crimes of sleeping and urinating.
Joaquin Saloma/Equated the exclusionary zone with tactics used in Ashland in the past and voiced
concern about the police allegedly targeting specific people as "special projects," and how the
exclusionary zone could empower those situations. He asked Council to think on the rights of the people
and hoped they would not take it to the level of an exclusionary ordinance.
Emery Way/1100 South Oakdale/Made an appeal to Council to have faith in the community. This was
a choice to build community or promote disunity. Many of the problems the proposed exclusionary zone
hoped to solve were problems sown by exclusion itself and would not be solved by deepening those lines
of division. This was an opportunity to unite not as homeless or homed but as human beings.
Ruth Coulthard/566 Faith Avenue/Worked as a coordinator at the emergency shelter during winter
and knew several homeless people on the top ten citation list. She thought people were projecting
a lot of fear on homeless people that she had not personally encountered. When the homeless were
treated with respect they respond in like and suggested respect be the method of interface with this
population. She shared her personal experience with one homeless individual named Zero and
noted how other homeless people supported him and cared for him like family. He left Ashland
knowing he had received the most citations, and was the biggest target for exclusion. She missed
him very much. Zero was a good and gracious man. She hoped Council would not project fears
and stereotypes on the homeless population. They were individuals and Council should make the
effort to interface with them.
Daniel Rueff/Expressed frustration towards Ashland leadership and stated homeless were
American citizens living in America. He shared experiences of his friends dying and being
murdered for sport because they were not valued and noted people who treated his friends as
criminals inadvertently caused that violence. He went on to accuse Council of violating the
constitution. He stated his Native American heritage and thought everyone else was illegal aliens
and should deport themselves back to their home countries.
Stephanie Joy/Partially quoted the following from Isaiah 10:1: "Woe to those who decree
iniquitous decrees and the writers who keep writing oppression. To turn aside the needy from
justice, and to rob the poor of God's people of their right. What will you do on the Day of
Judgment and the storm, which will come from afar? To whom will you flee for help and where
will you leave your wealth?"
Ryan Navickas/2060 Mill Creek Drive, Prospect/Explained why some of the unappealing people
living on the streets could not find work or get a home. He addressed those that believe a
crackdown would scare the homeless into a disciplined life or run them out of town and asked
Council to consider their individual fortune. He listed abusive issues and situations that often lead
people to homelessness and cited the exclusionary zone as another form of abuse against those that
most need a sympathetic heart, a warm place to sleep and a helping hand. He saw the proposed
ordinance as another part of the cycle of abuse and not a solution.
Sue Crader/79 Nutley Street/Worked with the Interfaith Care Community of Ashland (ICCA)
in the early 1990s. One of her truths was whatever a person puts out is what they receive. If she
treats people with dignity, respect and compassion, that is what she receives. The exclusionary
zone would create a path of anger and fear instead of compassion and help. She moved to Ashland
because it was progressive, worked towards creating positive change, and wanted Ashland to
continue on that path.

"Three strikes"is one too many.
This is public space and the notion of civility seems to get lost amongst these offenders. Manners in a civil society
matter. Manners are not about putting yourself at the center of attention but rather creating comfort and peace for
those around you.
It's hard to police manners, but civil behavior matters to me and I do not want to be held to the lowest form of
regard.
If you cannot act in a civil manner you do not deserve to use our public space.
City of Ashland, please help enforce public decency"
