Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a
reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance
(ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in
the ALUO 18.108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.

DECISION
The subject property is at 27 North Main Street, on the west side of the plaza mid-block of the plaza
businesses. The rear of the property is adjacent to the Calle Guanajuato and Ashland Creek. The property
is zoned Commercial - Downtown (C-1-D). The properties to the north and south are also zoned C-1-D
and those across Ashland Creek are zoned R-1-7.5.
The building was constructed in 1904 and is considered a Primary Contributing Structure in the
Nationally Registered, Downtown Historic District. The building was designed by Frank Clark and was
considered one of the more elaborately detailed commercial structures in the city. The original ground
floor storefronts have been altered significantly over the years the elaborate detailing on the second floor
remains essentially as is did upon the building's 1904 completion. Current uses within the building are
retail, restaurant, offices, art gallery and three residential units.
The subject building is two stories in height and was recently damaged in a fire, which was started in the
stairway. The stairway is along the southern most property line of the subject property and the northern
wall of the adjacent building. In 1997, a Site Review approval was given to the adjacent property to the
south, the Masonic Lodge building, which divided that building into multiple tenant spaces. Due to types
of use of that building and necessary existing requirements, the owner of the subject property and the
adjacent property owner worked together the provided cross easements, ingress, egress and emergency
exiting from the Masonic building into the subject building and utilizing the stairwell which was burned
in the fire.
The stairway had 25 risers with a small landing and doors approximately half way up the stairway. The
landing was far enough back from the public right-of-way and the sidewalk that is was difficult to
observe the activities happening on the and it had become a hang-out for transients. Following the fire

the property owner determined that since the stairs were going to have to be reconstructed they would
move the landing down five risers, towards the public sidewalk. This modification is being made so that
the landing will now be visible to the public right of way and the sidewalk and hopefully deter some of
the activities that were happening when the landing was less visible. This structural modification of the
stairway triggers Site Review approval according to Ashland Municipal Code 18.72.030.A.1.h. Any
exterior change to a structure, which is... a contributing property within a Historic District on the
National Register of Historic Places that requires a building permit.
The application is required to meet Site Design and Use standards for Basic and Detailed Site Review. It
must also comply with Historic District Design Standards and Downtown Design standards. The
structural modifications will not have significant impacts the existing historical structure. Other than the
stairway modification, following the fire it became evident that a `drop ceiling' and transom window had
been constructed across the historic opening of the stairway. This is further evidenced in historic
photographs following the buildings construction. Additionally, a large metal awning has been installed
across the stairway opening as well. In the reconstruction of the stairway, the awning is proposed to be
cut back, and end over the window of the adjacent business and the drop ceiling and resulting transom
will not be replaced. This modification will make, at least this small section of the ground floor more
historically compatible. The proposed stairway modification will not affect the height, mass, glazing, nor
will the rhythm of openings of the historic building facade be altered by the stairway change.
The Historic Commission reviewed the proposal at their May 2, 2012 meeting and had only a few
recommendations which have been incorporated into the conditions of approval. Those
recommendations are that the trim for the door match existing trims found in the historic structure and
that the stair rail not wrap around the front facade of the building but end / return at the base of the stair
as permitted by building code.
Staff is supportive of the proposed stairway landing and opening modification as proposed by the
applicant. The resulting product will be safer due to upgrades to the structure in compliance with the
current building codes, including the installation of a fire suppression system in the hallway of the
second floor. The modified landing relocation will hopefully defer some of the activity that was
occurring when the landing was out of sight from the public right-of-way. Lastly, the removal of the
drop ceiling, transom window and large awning that blocked the stairway opening will bring a portion of
the first floor of the structure more into compliance with the Downtown Design and Historic District
Design standards.
The criteria for Site Review Approval are described in AMC Chapter 18.72.070, as follows:
A. All applicable City ordinances have been met or will be met by the proposed development.
B. All requirements of the Site Review Chapter have been met or will be met.
C. The development complies with the Site Design Standards adopted by the City Council for
implementation of this Chapter.
D. That adequate capacity of City facilities for water, sewer, paved access to and through the
development, electricity, urban storm drainage, and adequate transportation can and will be
provided to and through the subject property.

The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2012-00440 is approved with the following conditions. Further, if any one or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2012-
00440 is denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here.
2) That the trim around the new doors within the stairway shall be consistent with the historic trim
around other doors and / or windows in building.

3) That the handrail in the stairway shall end at the base of the stairs and shall not wrap around the front
fayade of the structure(s) as permitted in the Oregon Structural Specialty Code and Federal American.

Ms. Gunter explained the trim will be required to match the original building and the handrails will end at the
bottom of the stairs without wrapping around to the outside of the building. The awning would also be shortened
so that it doesn't extend over the stairs. There was no owner or representative present and there was no one in
the audience wishing to speak. The public hearing was closed.
Mr. Skibby made a motion to recommend approval of the project as presented by staff. Mr. Swink seconded the
motion and it passed unanimously.
C. PLANNING ACTION: 2012-0265
APPLICANT: Ashland Food Cooperative
LOCATION: C-1- & C-1-D-zoned portions of the Historic Interest Area
REQUEST: A proposal to amend the Ashland Municipal Code as it relates to drive-up uses in Commercial
districts. Drive-up uses are currently a special permitted use in the C-1 zoning district, but only in the area east
of a line drawn perpendicular to Ashland Street at the intersection of Ashland Street and Siskiyou Boulevard.
Drive-up uses are currently explicitly prohibited in the Historic Interest Area as defined in the Comprehensive
Plan, The proposal is to provide exception language which would apply only to existing drive-up uses within the
Historic Interest Area and would allow them to relocate to a new site elsewhere within the Historic Interest Area
provided that they are located predominantly underground or otherwise screened from view from the public right-
of-way.
Chairman Shostrom asked if there were any conflicts of interest or exparte contacts. Ms. Law recused herself.
Ms. Gunter explained that the planner, Derek Severson, incorporated previous concerns and recommendations
of the Historic Commission such as a definition of underground, ventilation, ingress & egress to streets or alleys,
visibility and safety, and special permitted use. Planner, Mark Knox and Richard Katz, general manager of
Ashland Co-op discussed why they are asking for this Code Change which is to allow better use of the Bank
properties, such as Wells Fargo and Chase, in the historic downtown area. The original restrictions on drive ups
were based on air quality and vehicle centric use. But with the design of the buildings as done in the late 50's
through the 70's, they are incompatible with the historic downtown architecture and usage is limited. They are
asking that those buildings with existing drive-ups be able to re-locate or re-build creating a drive-up that is
underground and screened from view from the public right-of-way.
Mr. Knox pointed out an omission in the packet document on section 18.32.025 E.2.a. It should have "redevelop
onsite or" relocate to another site in the verbiage. Mr. Knox pointed out there were only 4 drive-ups in the
Historic District. There was discussion regarding "predominately screened".
There being no further questions of the applicants and no one in the audience wishing to speak, the public
hearing was closed.
Ms. Renwick made a motion to recommend supporting the proposed amendment with the addition of more
detailed performance standards which would be considered as part of the Site Review process including the
proposed language which allowed for relocation and redevelopment when compliant with the new standards.
Mr. Whitford seconded the motion and it passed unanimously.

In 1913 the two storefronts were modernized, with large plate glass windows below heavy
prismatic-glass transom bands as twin recesses flanking a central stairwell door that lead to
the upper, lodge-related, use. (Tidings, 25-August-1913) In 1929 the lodge was again
expanded, with the addition of a third floor over the original volume. Again designed by
architect Clark, this remodeling unified the facade and in large measure resulted in the
present stucco-clad exterior with rectangular window openings and a modest cornice line.
Construction was completed by late 1928.
In 1928 the storefronts were leased to both the Plaza Cafe and the Ashland branch of the
post office, both long-term tenants in the building. The Plaza Cafe substantially remodeled
its portion at the north of the first floor in 1950, installing a large neon sign over the
transom band and installing a coursed stone veneer. (Tidings, 12-May-1950) The post
office moved from its site on south of the first floor in 1954. (See Site ID #73.00) Other
changes to the south bay resulted in the present glass block and stone exterior. The Plaza
Cafe space was remodeled by the present jewelry shop in the late 1990s.
The Ashland Masonic Lodge Building represents a series of additions, remodeling and
alteration that effectively mirror of the history of that fraternal organization. The building
retains high integrity and effectively relates its historic period of development. The
Ashland Masonic Lodge Building was individually listed on the National Register of
Historic Places in 1992.

Clark, the Ashland Improvement Company Building is a two story brick building with
elaborate surface detailing on the second floor facade and a heavy projecting cornice band.
The developer, the Ashland Improvement Company, was headed by successful
businessman and civic leader Gwin S. Butler.
There are rumors of a new modern two story brick business block on the Atkinson
estate lots on Main street, to be connected with the Masonic and McCall bricks,
having a frontage of 40 feet ...the new block will cost in the neighborhood of

PROPOSED CHANGES TO THE BUILDING
The Ashland Improvement Company Building (27-29 N Main Street) was constructed with a stairway
leading from Main Street directly to the second floor of the building. During the 1960s to address
security concerns the current owner added a pair of doors at the stairway landing. More recently, this
pair of doors has led to the space becoming a hangout for loiterers and ultimately led to the fire that
recently damaged the building.
The owner wishes to alter the stairwell to make the space visually more secure, and at the same time
restore the stairway closer to what it looked like when during the early days of the building. This change
will involve moving the landing closer to the street, reinstalling doors at the landing that will be period
doors, replacing handrails, treads and risers that were damaged in the fire, and removing a permanent
awning installed midway up the opening.
The Owner is requesting approval of these small changes from the Ashland Landmarks Commission. We
base the approval for this change on the following criteria:

II-C-1 BASIC SITE REVIEW STANDARDS
II-C-1a ORIENTATION AND SCALE
The original stairway provided access to the upstairs offices in this building. In the original
construction the top of the stairwell opening was at the same height as the top of the adjacent
storefronts and the building had a horizontal line defined by a steel beam that established the upper line
of the two storefronts and the stairway. Over the years this line was lowered primarily by installing a
fixed canopy at approximately 8 feet above the sidewalk that hid all the parts of the building between
the bottom of the canopy and the sill of the second floor windows. Our hope is to once again open this
area up.
Also, by moving the stairway and the stairway landing forward and closer to the front of the building,
the entry to the second floor will become more prominent.

This proposed change will have no impact on noise and glare. However, it will make the building
front safer for both occupants and passers-by by eliminating a hiding place for loiterers. Also, the

The walls of the stairway are required by the building code to be of one hour construction.
Hence, the exterior walls will be finished in painted stucco inside the stairway. The exposed face of the
stairway will remain as currently constructed - brick and stucco on one side and stone on the other. In
addition, there will be painted panel doors with half high glass on the landing, painted gypsum board on
the ceiling and a period metal handrail on each side of the stairs.

Currently, the stairs are set back roughly the distance of one riser from the property line. To
increase the depth of the landing as much as possible, we propose to construct the first riser at the
property line.

to what it was in its early days. This part of the building did not have an awning.
