Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a
reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance
(ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in
the ALUO 18.108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.

DECISION
The subject property is a two-unit duplex located 50 feet east of the Allison and Union
intersection on the south side. The property is approximately 7,100 square feet in size, level, and
zoned R-2, Low-Density Multi-Family Residential. The subject tree is located in the rear yard of
the property between the parking area adjacent to the alley and an existing carport. There is also
a well-established White Oak and Cypress tree on the property, as well as many other small
ornamental trees throughout the yard.
The subject tree is an 18-inch Colorado Spruce tree that has a severe lean to the south abutting
the alley. The applicant stated that in its current location, that the tree is awkwardly formed and
has become too large for the space it occupies; making it difficult to park in the area provided
and impedes access to the carport behind the home. In purchasing the home after residing at the
property for 8 years as a tenant, the owner would like to make improvements to the property and
create a better functioning parking pad for herself and future tenants.
Tom Ford of Shasta View Tree Care stated in a letter that the tree is structurally compromised
due to the excessive lean and that parking area and the alley are significant targets should failure
occur. The Tree Commission reviewed the application at their June 7, 2012 meeting. They
concurred with the arborist's recommendation saying that Spruce trees are traditionally not
limbed-up because of the structural support the heavy branches provide to the tree. Therefore
removal is approved and mitigation shall be a Dogwood as proposed.
Removal will not have a significant negative impact on erosion, soil stability, or existing
windbreaks due to the site being fairly level and is located in an established neighborhood with j
homes and improved streets to City standards. Nor will removal have 'a negative impact on the
tree densities, sizes, canopies, and species diversity within 200 feet of the subject property since

there are numerous well-established trees on site and in the immediate vicinity of the subject
parcel. In staff's opinion, the potential of failure due to the- excessive lean is justification for
removal. Therefore, staff believes that the tree removal request meets the criteria of the
ordinance and is approved to be removed.
The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080, as
follows:
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are
satisfied. The Staff Advisor may require an arborist's report to substantiate the criteria for a
permit.
B. Tree that is Not a Hazard. The City shall issue a tree removal permit for a tree that is not a
hazard if the applicant demonstrates all of the following:
1. The tree is proposed for removal in order to permit the application to be consistent
with other applicable Ashland Land Use Ordinance requirements and standards. (e.g.
other applicable Site Design and Use Standards). The StaffAdvisor may require the
building footprint of the development to be staked to allow for accurate verification of
the permit application; and
2. Removal of the tree will not have a significant negative impact on erosion, soil
stability, flow of surface waters, protection of adjacent trees, or existing windbreaks;
and
3. Removal of the tree will not have a significant negative impact on the tree densities,
sizes, canopies, and species diversity within 200 feet of the subject property.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2012-00597is approved with the following conditions. Further, if any one or
more of the following conditions are found to be invalid for any reason whatsoever, then
Planning Action 2012-00597is denied. The following are the conditions and they are attached to
the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified
here.
2) That mitigation shall be a Dogwood or other similar tree planted within 180 days from the

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn
Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning
Division Staff's decision must be made in writing to the Ashland Planning Division within 12 days from the date of the mailing of final decision. (AMC
18.108.040)

TREE REMOVAL
18.61.080 Criteria for Issuance of Tree Rem, .i - Staff Permit
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The Staff Advisor may require an arborist's
report to substantiate the criteria for a permit.
A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and
warrants removal.
1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A
hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or
services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or
location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such
hazard or danger cannot reasonably be alleviated by treatment or pruning.
2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such mitigation
requirements shall be a condition of approval of the permit.
B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the
following:
1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance
requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental
Constraints. The Staff Advisor may require the building footprint of the development to be staked to allow for accurate verification of the
permit application; and
2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent
trees, or existing windbreaks; and
3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200
feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered
and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the
residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider
alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees, so long as the
alternatives continue to comply with other provisions of the Ashland Land Use Ordinance.
4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61.084. Such
mitigation requirements shall be a condition of approval of the permit.

Subject: Application for tree removal permit
My name is Mary Beth Lee, and I purchased the duplex at 540/542 Allison St. on April 13, 2012. 1 have
lived in the upstairs apartment at this address for more than 8 years. I seek to remove a large green
spruce growing on my property between my carport and my parking pads next to the alley. The following
information, submitted along with a site map, is intended to answer the 4 questions set out in 18.61.080
Criteria for Issuance of Tree Removal-Staff Permit under category B: Tree that is Not a Hazard.
The Colorado green spruce tree I refer to leans at a steep angle. The arborist who recently trimmed trees
away from the roof and structures also trimmed this tree-to have a place for wood chips, to regain use of
the parking pads, clear the tree from the carport roof, and improve access to the carport. The tree had
already been trimmed about 15 feet or more up the trunk on the yard side only. The recent cutting further
exposes the tree's structural deformity-a decided lean toward the driveway and the alley.
Behind the tree is an unsightly pile of tires and concrete debris that make up an informal retaining wall.
The vertical drop from the alley parking area to the main part of the yard bordering the tree is less than 3
feet. Within this drop are many feet of wasted space that could be converted to garden without impacting
my off-street parking areas. The property is well-endowed with trees, including an ancient white oak in the
backyard and a large cypress in the side yard that both tower over the 2-story house. A neighbor's
Norway spruce borders the property in the front yard. I value these trees and the smaller ornamental
trees on the property, which is why I hired professional help to trim them away from the building prior to
painting the house and removing moss from the roof.
The tree is awkwardly formed and too large for the space it occupies. It blocks light and competes for
water with the vegetable gardens and other plantings. I want to remove the tires and debris, build a low
concrete block retaining wall and a fence no taller than 6 feet. I will use the regained space for a shrub
border, a dogwood tree, a small garden area and a modest lawn building. These elements will provide
usability and privacy with less water consumption and more light.
I hope you will grant the tree permit so I can move forward with these plans.

the tree is highly visible from our property. We support the tree's removal because
of the safety hazard it poses as well as the sunlight it blocks to the garden areas of
our properties.
We can directly observe that the tree is a safety hazard to the off-street parking area
given its extensive leaning. The tree also appears old and brittle with the possibility
of limbs, cones, and other debris falling on cars parked in the parking area. If the
tree should fall it will block the alleyway and could potentially cause harm to other
neighbors.
The tree is also dramatically shades the gardening area on the property, without
providing any beneficial shade to the residence. It also presents maneuverability
issues with respect to the drive to the covered garage.
We are also excited about Mary Beth's proposed landscaping ideas. As an outdoor
enthusiast and communicative neighbor, Mary Beth's ideas for removing the rubble
and used-tire retaining wall, along with adding a smaller, more appropriate focal
specimen tree, expanding the gardens, and beautifying the yard we know will be
executed thoughtfully.
