On August 22, 2012, the Staff Advisor for the Ashland Planning Division administratively approved your
request for the following:
A Site Review approval to construct a 400 square foot Accessory Residential Unit in the rear yard of their
home at 117 Eighth Street. COMPREHENSIVE PLAN DESIGNATION: Low-Density Multi-Family;
ZONING: R-2; ASSESSOR'S MAP 39 lE 09AD; TAX LOT 8500
The Staff Advisor's decision becomes final and is effective on the 13ffi day after the Notice of Final
Decision is mailed.
Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a
reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance
(ALUO) 18.108:070(13)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in
the ALUO 18.108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that .
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.

DECISION
The subject property is located at the northwest corner of Eighth and C Streets, and has a paved
alley to the west. The property and surrounding uses are zoned R-2, Low-Density Multi-Family
Residential, and are located within the Railroad Addition Historic District. The parcel is a 10,642
square feet, rectangular in shape, and has an average slope of three percent to the north. The
Eighth Street right-of-way is 70 feet with an improved width of 33 feet, while the C Street right-
of-way is 70 feet, with an improved width is 27 feet. Both streets are improved with paving,
curbs, and gutters; but no sidewalks on either frontage.
The property contains a single-family residential home, a detached shop at the corner of C Street
and the alley, plus other small outbuildings. The existing simple single-story hipped-roof
vernacular cottage was built circa 1901, and is a known as the "Osmer and Lila Long House".
Survey documents say that although the house is "somewhat modified with replacement siding,
enclosed front porch, and aluminum slider windows... the Long House minimally reflects its
historic period of development"; and therefore is considered a historic-contributing resource. .
The application is for a 400 square foot Accessory Residential Unit (ARU) located in the rear
yard of the parcel adjacent to the alley. Site Review approval criteria requires that the proposed
use complies with all applicable land-use ordinances, including the Site Review Chapter (AMC
18.72) and the Site Design and Use Standards. The maximum permitted density of the parcel is
3.3 units. This would include the existing home, plus the proposed ARU less than 500 square
feet, which counts for .75 of a unit. In accordance with AMC 18.92, the primary dwelling
requires two parking spaces, and an ARU less than 500 square feet requires one parking space,
for a total of three parking spaces required. The parcel has one existing off-street parking space
east of the canoe shop adjacent to the alley. The parcel has a combined street frontage of 253
linear feet, which can easily accommodate the additional two on-street parking spaces to satisfy

the parking requirement. Three covered bicycle-parking facilities are proposed inside the existing
shop structure.
The existing landscaping on-site is well established with many mature trees and vegetation on-
site, including two 12-inch Hazelnuts and a 3-inch Pear tree which are closest to the proposed
unit. The applicant stated that the two Hazelnut trees are more like shrubs than trees, with many
branches steaming from a low trunk. Ashland Municipal Code (AMC) 18.61.200 requires a tree
protection plan in conjunction with the construction of a new dwelling in order to provide
protection of trees from potential construction impacts. The applicant stated that the 3-inch Pear
is so close to the unit, that standard protection fencing is not feasible due to the need for the
foundation the be installed within the drip line of the tree. As such, the applicant has proposed to
wrap protective material around the tree to ensure that it is not harmed during the construction of
the unit. Staff finds that due the small size of the tree, less than our code typically regulates, plus
its location, that traditional protection fencing would not work in this location and the applicants
proposal would satisfy the intent of the tree protection chapter.
The proposed unit will be a craftsman bungalow with its orientation towards the alley behind an
existing board batten fence. The unit will have four-inch hardi-plank siding with 5.5-inch wide
trim around the door, windows, and corners of the building. It will be painted Manzanita Green
with Rust-Red trim, Terra Cotta eaves and a dark green belly-band to match the main house. The
unit will also have double-hung windows, and a dark green standing seam metal roofing to match
the main house. The Historic Commission at their August Bch meeting discussed the proposed
standing seam roof, and felt although metal roofs are not historically compatible with the
neighborhood, the intent to match the existing primary dwelling is acceptable and ultimately
approved the roof choice. Otherwise, the Commission was pleased with the architectural design
of the unit is appropriate for the eclectic nature of the block.
The application addresses that adequate capacity of public services is available to the site. The
applicant will install new electric service to the new unit by utilizing the current 200 Amp service'
with a sub panel to the rear unit. Water and sewer lines are also proposed and identified on the
site plan provided. There is available water, storm drain, gas, and sanitary sewer service in the
adjacent public right-of-way of C Street as well as in the alley. The applicant has proposed to
construct a new trash and recycle enclosure between the proposed unit and the alley.
In staff's view, the proposed ARU meets the requirements of the Site Review chapter of the
ordinance, and is compatible with the eclectic character of the neighborhood.
The criteria for Site Review Approval are described in AMC Chapter 18.72.070, as follows:
A. All applicable City ordinances have been met or will be met by the proposed development.
8. All requirements of the Site Review Chapter have been met or will be met.
C. The development complies with the Site Design Standards adopted by the City Council for

D. That adequate capacity of City facilities for water, sewer, paved access to and through the
development, electricity, urban storm drainage, and adequate transportation can and will be provided
to and through the subject property. All improvements in the street right-of-way shall comply with the
Street Standards in Chapter 18.88, Performance Standards Options.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2012-01039 is approved with the following conditions. Further, if any one or
more of the following conditions are found to be invalid for any reason whatsoever, then
Planning Action 2012-01039 is denied. The following are the conditions and they are attached to
the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified
here.
2) That the plans submitted for the building permit shall be in substantial conformance with
those approved as part of this application. If the plans submitted for the building permit are
not in substantial conformance with those approved as part of this application, an application
to modify the current Site Review permit approvals shall be submitted and approved prior to
issuance of a building permit.
3) That the Applicant sign in favor of an LID for street improvements to both Eighth and C
Streets before the issuance of the building permit.
4) That all necessary building permits, including permits for the new electrical service to the
accessory residential unit, and system development charges for water, sewer, storm water,
parks, and transportation shall be paid prior to the issuance of a building permit.
5) That building permit submittals shall include:
a) That the building materials and the exterior colors shall be identified in the building
permit submittals for the review and approval of the Staff Advisor to demonstrate
compliance with Site Design and Use Standards requirements that the materials and
colors be compatible with the surrounding area.
b) That the exterior lighting shall be directed onto the property and shall not directly
illuminate adjacent proprieties. Exterior lighting details shall be provided on building
permit submittals.
c) Lot coverage. calculations including all building footprints, driveways, parking, and
circulation areas. Lot coverage shall be limited to no more than 65 percent as required in
AMC 18.24.
d) Solar setback calculations demonstrating that all new construction complies with Solar
Setback Standard A in the formula [(Height - 6)/(0.445 + Slope) = Required Solar .

6) That the tree protection fencing shall be installed according to the approved plan, and
inspected and approved by the Ashland Planning Department prior to site work, storage of
materials and/or the issuance of a building permit.

7) That prior to the issuance of a certificate of occupancy:
a) That the required bike parking shall be installed according to the approved plans.
b) That the installation of the Maple tree in front of the ARU be installed. according to the
approved plans.
c) That an opportunity to recycle site shall be located on the site, in conformance with
18.72.040 and in accordance with the approved plans.
d) That requirements of the Ashland Fire Department, including the address location and
access be completed prior to issuance of a Certificate of Occupancy.

APPROVAL OF MINUTES: The minutes of the June 6, 2012 Historic Commission meeting were reviewed. Mr. I
Whitford made a motion to approve them. Mr. Swink seconded the motion and the motion was approved
unanimously.

SUBJECT PROPERTY: 145 Alida St.
APPLICANT: Jim and Cheryl Levie
DESCRIPTION: A request for a Site Review approval to convert the southern portion of an 850 square foot
accessory structure in the rear yard, into a 450 square foot accessory residential unit with a 400 square foot attached
garage located at 145 Alida Street.
Mr. Levie explained they have already built the accessory structure and the garage with the intention of applying for
the CUP and turning it into an Accessory Residential Unit. There were no questions and no one in the audience
wishing to speak. The public hearing was closed. Mr. Whitford shared that he had seen the unit and it was very well
done. Mr. Whitford made a motion to recommend approval of the project as presented. Mr. Swink seconded the
motion and it passed unanimously.

Ms. Kencairn stated that her company had done the landscape plan but felt she would be able to review the project
without bias. The applicants and the other Commissioners had no concerns. Mr. Skibby stated he had spoken to the
property owner when he went out to take pictures but did not discuss the project.
Michael McKee, the architect, passed out some additional views of the proposed unit showing siding and trim detail
and colors. He said that a possible concern of the Historic Commission may be the standing seam metal roof
proposed, however he explained the property owners chose the material because it would match the existing
buildings on the property. Ms. Renwick stated she was concerned that approving the metal roof would set
precedence for using non-historic materials. Mr. Skibby suggested they recommend changing it but not require it.
Mr. Whitford felt because the structures are barely visible from the right-of-way, it would be preferable to have all the
buildings in the compound compatible.
Mr. Whitford made a motion to recommend approval of the project as presented. Although the Historic Commission
does not approve of a standing seam roof as a historically compatible material, they felt in this case it would be
appropriate to conform to the existing structures. Ms. Renwick seconded the motion and it was approved
unanimously.

DISCUSSION ITEMS: Due to the absence of several Commissioners, Barbara Christianson cancelled her
presentation on Ethics and Public Meetings. It will be rescheduled for September 5, 2012.
Enders Memorial Shelter - Mr. Pina shared with the Commissioners that the Parks Department would be stabilizing
the shelter by adding a new foundation system. He said the building permit would be reviewed by the Historic
Review Board when it is submitted to the Building Department.
Mr. Skibby asked about the status of the Vine Hotel project. Mr. Pina said it was approved by the Planning
Commission and the findings would be signed at the August 14, 2012 meeting.
