These changes are to correct mis-identification of species in the original application. In the original application an Incense cedar was mis-identified as a Sequoia and the alder trees were mis- identified as Red alder not White alder. The mitigation plan further calls for two shrub species that are not common to the Ashland area. Those species are sword fern and cluster rose. In the trees category, the changes proposed are to replace the Red alder (Alnus rubra) and Western red cedar (Thujia plicata) with White alder (Alnus Rhombifolia) and Incense cedar (Libocedrus decurrens). The size and quantities are to remain the same as originally specified. In the shrubs category, the changes proposed are to delete the cluster rose (Rosa Pisocarpa) (9 units) and increase the Nootka rose (Rosa Nutkana) quantity from 18 to 27 units. And, delete the Sword fern (Polystichum munitum) (21 units) and add that species quantity to the Snow-berry (Symphoricarpos albus) units bringing that quantity to 27 units. Size for the proposed shrubs to remain as originally specified. These changes are requested as the proposed species are more suitable to the Ashland climate and the proposed tree species replace the species that were removed. 19478 S. An emergency is defined in Oregon Administrative Rule 141-085-0510(29) as "circumstances that pose an immediate threat to public health, safety or substantial property including crop or farmland." Your request to replace undermined foundation with up to 3 cubic yards of concrete has been approved as an emergency authorization under ORS 196.810(4). This authorization expires September 21, 2012. In the performance of the emergency work by you and/or contractors, the following conditions must be followed: 1. All work shall be done from a dry position below the top of the bank unless otherwise approved in writing by the Department of State Lands. Effective work area isolation must be in place prior to start of work and maintained for at least 72 hours following the pouring of the concrete. All concrete forms must be removed from the area prior to re-introduction of water. 2. An Oregon Department of Fish and Wildlife fisheries biologist from Central Point must be contacted at least 48 hours prior to start of work authorized under this permit (541-826-8774). 3. The amount of material to be filled shall not exceed the minimum necessary to alleviate the emergency circumstances. However, up to 3 cubic yards of material are authorized for placement as needed. 4. Any excavated material shall be disposed of on upland and not be placed in wetlands, streams or other waters. 6. Inspection of the work may occur by the Department of State Lands and/or Department of Fish and Wildlife or other appropriate agency following the emergency, and project refinements may be required. 7. The Department of State Lands retains the authority to temporarily halt or modify the project in case of excessive turbidity or damage to natural resources. 8. This permit does not authorize trespass on the lands of others. The permit holder shall obtain all necessary access permits or rights-of-way before entering lands owned by another. 9. Permittee shall defend and hold harmless the State of Oregon, and its officers, agents, and employees from any claim, suit, or action for property damage or personal injury or death arising out of the design, material construction, or maintenance of the permitted improvements. 10. This authorization permits only the work described in the application. Any additional jurisdictional work will require a permit from the Department of State Lands. For Disaster Recovery Assistance, victims need to apply through the National Teleregistration Center at 1-800-462-9029/TTY 1-800-462-7585. The property contains a single structure on the lot known as Ashland Creek Inn, which has the Ashland Creek riparian corridor passing through the rear of the property. The subject parcel and uses to the north-northeast are zoned E-1, while the parcels to the south and west are zoned C-1., Uses across Ashland Creek to the east are zoned R-2. The request is to remove a leaning 25-inch D.B.H. Alder tree located on the bank of Ashland Creels. In conjunction with the Ashland Creek Restoration Project, a required 10-inch irrigation pipe is to be installed within the Alder's root zone: The application notes that this particular tree was not included in last year's removal request because the applicant thought the irrigation pipe could be installed without compromising the tree's stability. However, once the underlying blackberries and bamboo were removed from the area, the project manager felt that installation of the pipe would not be feasible without severely compromising the tree's structural integrity, causing the tree to become a hazard. The Tree Commission reviewed the application at their August 9, 2012 meeting. They concurred with Randy Manson of Upper Limb-It Tree Service that installation of the 10-inch irrigation pipe will cause significant structural damage to the subject tree, and removing it at this stage of the project is the best option. However, the Commission did feel that removal will have a negative impact on erosion, soil stability, and the flow of water within Ashland Creek due to the size and habitat this particular tree creates. However, given that there is an on-going restoration project in the immediate area, the previously submitted mitigation and re-planting plan will address any PA #2012-01121 70 Water St.,MP Page 1 i issues related to this removal request. As such, the Commission recommended that the applicant amend the previously submitted mitigation plan to include the size, species, and location of the mitigated tree. Staff fmds that given the circumstances and limited time that the project has to work within Ashland Creek as previously approved by the Oregon Department of Fish and Wildlife (ODFW), that removal of the Alder tree is approved, and the mitigation plan be amended to include the removal of this tree. The criteria for a Tree Removal Permit are described in AMC Chapter 18.61.080, as follows: An applicant for a Tree Removal Permit shall demonstrate that the following criteria are 5 satisfied. The StaffAdvisor may require an arborist's report to substantiate the criteria for a. permit. B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following. 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards. (e.g. other applicable Site Design and Use Standards). The StaffAdvisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2012-00897 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2012-00897 is denied. The Staff Advisor may require an arborist's report to substantiate the criteria for a permit. A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and warrants removal. 1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning. 2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental Constraints. The Staff Advisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance. 4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. However, the tree has a distinct lean towards the Inn across the stream. The proposed trenching on the up slope [south] side of the tree to a depth of 3' or more would require cutting most of the supporting roots opposite the direction of lean. this would result in the tree becoming a definite hazard to the Inn and its patrons and employees As there seems to be no viable alternative to the routing of the pipe, I strongly advise removing the Alder. Removal of the tree will not have a significant negative impact on erosion, soil stability, or the flow of surface waters. The stream restoration project will address these issues with the removal of the dam, new plantings of trees and shrubs, and modifications to the stream bed. The Alder will be replaced with as large a tree as practicable. Adjacent trees are expected to be little affected by the removal as there are many Alders along the stream and mortality is common. Since there are numerous Alders and a large Blk. Walnut within 200 ft. and since there will be many plantings on the adjacent stream banks removal of the tree will not have a significant impact on tree.densities, sizes, and species diversity.
