COMPREHENSIVE PLAN DESIGNATION: Suburban Residential; ZONING: R-1-3.5; ASSESSOR'S MAP 39 1E 11 CB; TAX LOT 4208 I SUBMITTAL DATE: November 15, 2012 DEEMED COMPLETE DATE: November 28, 2012 STAFF APPROVAL DATE: December 20, 2012 APPEAL DEADLINE: January 2, 2012 FINAL DECISION DATE: January 3, 2013 APPROVAL EXPIRATION DATE: January 3, 2014 DECISION The subject property is located south of Meadow Drive in the openspace along Clay Creek between the residences at 266 and 280 Meadow Dr. The subdivision was approved 1996 and the homes were constructed soon after. The subdivision developer also performed restoration of the Clay Creek channel as part of the subdivision open space improvements. The open space where the subject trees are located is approximately 8,800 square feet in area and has been landscaped with lawn, ornamental shrubbery and trees. A large portion of openspace is within the Water Resource Protection Zone (WRPZ) for Clay Creek. The designated WRPZ for Clay Creek is 30-feet from centerline of the street. One of the trees is within the WRPZ at 28-feet from centerline of the stream and the other two are outside of the WRPZ at 34 and 41 feet from the centerline of the stream. The WRPZ is intended to protect water courses from pollution and to preserve endangered species by buffering and separating adjacent land uses and activities that may impact the communities bodies of water and to reduce the risk to people and property resulting from inappropriate management of riparian areas. The protection and preservation of riparian vegetation including trees provide these protections including the need for increased erosion protection by the root structure of the trees and vegetation. Three Cottonwood trees proposed for removal. Two are 12-inches in diameter at breast height and one is 9.5-inches in diameter at breast height. The three trees are very tall, approximately 40-feet in height and are leaning towards the residence at 280 Meadow Dr. The trees have been reviewed by an independent arborist who is recommending removal for the safety of the adjacent residence and the public right-of-way. Hazard tree removals within WRPZ portions of properties are required to obtain a Tree Removal Permit in accordance with Ashland Municipal Code (AMC) 18.63.060, additionally, the property is j PA #2012-01612 270 Meadow Dr./adg Page 1 zoned R-1-3.5 and tree removal of trees greater than 6-inches in diameter at breast height also requires a tree removal permit. The applicant has not proposed to mitigate the tree removal. According to AMC 18.61.084 trees removed may be mitigated for. In this instance approximately 21, primarily cottonwood trees will remain on the 8,800 square foot lot. This portion of the creels is shaded through the open space lot, but the creek area through the entire subdivision has been virtually denuded of all riparian vegetation and is in a very unnatural state with the grass, the rockeries and the trees. A condition requiring the trees to be mitigated either with a two to one riparian suitable shrub selected from the City of Ashland Riparian plant list or a one to one tree replacement of the cottonwood trees with a riparian suitable species that will achieve similar size and stature at maturity has been added. The incorporation of these plantings may be made on any of the open space properties of the subdivision along the creels corridor. The stumps shall be left in place, the trees may possible stump sprout which will further enhance the WRPZ. The Tree Commission reviewed the application at their December 6th, 2012 meeting and commended the Parks department in anticipating future removals within the floodplain boundaries based upon the potential hazard to people, property, and infrastructure. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2012-01612 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2012-01612 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That the stump of the three trees removed shall be retained on site in order to retain soil stability provided by the intact root system. 3) The trees to be mitigated either with a two to one riparian suitable shrub selected from the City of Ashland Riparian plant list or a one to one tree replacement of the cottonwood trees with a riparian suitable species that will achieve similar size and stature at maturity. Pina presented the staff report and noted that the application was submitted by the Home Owners Association on behalf of the former home owner of the adjacent property (280 Meadow Dr.) Since that time, the new home owners wish to retain the trees and wondered if they could be preserved. Commissioner Roland stated that the three trees in question appear to be hazardous and recommends removal. Other Commissioners agreed that the trees should be removed, and suggested the HOA look into planting other species that thrive in wet soils (i.e. River Birch, Italian Alder, some j Ashes, etc) to mitigate the removal of Cottonwoods. Pina noted that because the trees in the open are specifically listed on the subdivision's landscape plan, that any future removals would need to come before the Tree Commission each time a tree(s) are to be removed, and that would present a good opportunity for the Commission to review each tree removed and make suggestions to which trees to mitigate with. The Staff Advisor may require an arborist's report to substantiate the criteria for a permit. A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and warrants removal. 1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning. 2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18,61.084. Such mitigation requirements shall be a condition of approval of the permit. B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental Constraints. The Staff Advisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance, 4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. MPE shares the expenses of maintaining this space with Ashland Meadows. The subject area, on the west side of the creek running through the open space, contains approximately 24 cottonwood trees; two dead trees have previously been removed. Three more trees, identified by the association's arborist, are leaning dangerously and present a hazard both to an adjacent house and to pedestrians. It is the association's intent to remove these three identified trees. The trees are respectively 28, 34 and 41 feet from the center line of the creek running through the open space. Because there are numerous cottonwood trees throughout this area, the association does not propose to plant any more trees. Meadowbrook Park Estate- - Cottonwoods 1 The homeowner at 280 Meadow Dr in Ashland, OR is concerned about several cottonwood (Populus trichocarpa) trees that are overhanging his home. We identified three that seemed the most likely to fail and damage his home. It is these three we are trying to get permission to remove for the Meadowbrook Park Estates Homeowners Association as they own the land these trees are on. The trees are 12", 12" and 9.5" DBH (diameter breast height) and approximately 70' tall. There are 25 trees of this species in an area of about .10 acres along with a couple other ornamental trees. This species of tree are notorious for shedding limbs, and breaking out the tops in wind storms. The removal of these trees will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and will not have a significant negative impact on tree densities, sizes, canopies and species diversities within 200 feet of property.
