Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use. Ordinance (ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO 18.108.070(B)(2)(c). An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow this Department to respond to the issue precludes an action for damages in circuit court. The park encompasses ,approximately 100 acres, and is primarily zoned R-1-7.5. Hazard tree removals within Ashland Parks and Recreation Department (APRD) properties are exempt in accordance with Ashland Municipal Code (AMC) 18.61.035 and 18.63.060; however require a permit in accordance with 18.60.40.B for tree removal in areas defined as Flood Plain Corridor Lands. Lithia Park and Calle Guanajuato are unique in that they encompass a large area with steep terrain, but also Ashland Creek, a significant riparian corridor ruining the length of the park. Because of the creek's floodplain boundaries, the standard hazard tree removal process is inefficient for the Parks department to remove hazardous trees that may cause harm to persons, or damage property or infrastructure. AMC 18.62.0302 defines as "The removal of three or more living trees of over six inches diameter at breast height (D.B.H.), or the removal of five percent of the total number of living (or dead trees) over six inches D.B.H., whichever is greater, on any lot within five year period, or any form of commercial logging". Based on this definition, the Parks,.Dept is requesting approval for a five-year hazard tree removal and maintenance plan. Currently there is no management plan in place for the Ashland Creek riparian zone. This plan includes provisions for landscape maintenance and hazard tree removals for Lithia Park, as well as Calle Guanajuato and OSF areas.. This project does not involve in-stream work, nor will local native plant species be damaged or removed. All of the proposed activities fall under APRD's Natural Resource Enhancement Plan and are not defined by Land Use Codes. PA #2012-01482 51 Pioneer/MP Page 1 APRD's long-term goal is to insure that Ashland Creek functions as a healthy riparian corridor and to minimize downstream flood risk from debris accumulation as it passes through Lithia .Park. In doing so, APRD strives to aesthetically stabilize the streambank, provide fish habitat diversity, provide more public space in designated areas, and to ultimately minimize flood risk from debris accumulation. The following list are tree removals that the Parks Department are anticipating within a five-year period from the entrance of the Calle Guanajuato on North Main, to the top of Lithia Park bounded.by the intersection of the streets Granite and Glenview: ® The Calle Guanajuato: Five trees within the next 5 years. After trees are established, periodic thinning and harvesting of mature trees is required to maintain health and growth of existing species whereas less competition provides healthier specimens, as well as the thinning of vines; invasive species, and thick undergrowth. ® The front of the park to the play rog und: Twelve trees within the next 5 years. Thinning or selectively harvesting fast growing trees (willows, cottonwoods, alders, and poplars) will remove captured nutrients in riparian zones and continue to promote growth. ® The playground to the Park Office: Fifteen trees within the next 5 years. Longterm maintenance promotes strong plants that can survive environmental stress and optimize nutrient uptake and storage. ® The Park Office to 440 Granite: Fifteen trees within the next 5 years. Roots systems of harvested trees are retained and continue to stabilize the soil while allowing trees to regenerate from sprouts. ® 440 Granite to the swim reservoir: Eighteen trees within the next 5 years. Trees along the riparian, corridor will be left for habitat along banks, but not within the channel margins, thus limiting flow conveyance which could raise flood elevations and pose a threat and risk of property damage to neighboring homes. APRD are considered stewards of our Parks, and therefore take the appropriate steps to ensure no potential hazards will affect either the individual plant/tree, or the general health of the park. Debris in Ashland Creels will be monitored and removed based upon the potential of blockage of bridges and culverts along the Ashland Creek riparian corridor. APRD`s best management practices involve periodic coppicing, thinning, and harvesting of dense growth along narrow channels that limit flow conveyance and could raise flood elevations; risking property damage from flooding. Trees located in- stream will be cut at the base so as to not disturb the substrate, and roots will be left intact to stabilize the bank and substrate. Erosion control will be utilized to protect against. contaminates into the stream. Removals will help in alleviating the potential of flooding and overall add to the protection and longevity of the riparian and flood corridor. APRD takes all costs into consideration and therefore will take all reasonable steps to reduce the adverse impact on the environment. Lithia Park contains many unique areas including historical groves, themed gardens, and open spaces that provide recreation for public use. Within the riparian area alone, there are thousands of trees to maintain and at times removal is necessary for public safety purposes. APRD proposes to mitigate the riparian habitat by only removing trees that pose a high degree of.hazard under flood situations. As such, APRD will always leave roots in place unless they pose a hazard, and selectively thin trees nearest_the stream channel. PA #2012-01482 51 Pioneer/MP Page 2 The Tree Commission reviewed the application at their December 6th, 2012 meeting and commended the Parks department in anticipating future removals within the floodplain boundaries based upon the potential hazard to people, property, and infrastructure. In staff's opinion, the proposed five-year hazard tree removal and maintenance plan provides the best "bang-for-the-buck" for the Ashland Parks and Recreation Department due to the unique nature of Lithia Park, the Calle Guanajuato, and the subsequent flood plain boundaries. Therefore, staff believes that the five-year plan meets th&'criteria of the ordinance and is approved. PHYSICAL & ENVIRONMENTAL CONSTRAINTS 18.62.040.1 Criteria for Approval A Physical Constraints Review Permit shall be issued by the Staff Advisor when the Applicant demonstrates the following: 1. Through the application of the development standards of this chapter, the potential impacts to the property and nearby areas have been considered, and adverse impacts have been minimized. 2. That the applicant has considered the potential hazards that the development may create and implemented measures to mitigate the potential hazards caused by the development. 3, ' That the applicant has taken all reasonable steps to reduce the adverse impact on the environment. Irreversible actions shall be considered more seriously than reversible actions. The Staff Advisor or Planning Commission shall consider the existing development of the surrounding area, and the maximum permitted development permitted by the Land Use Ordinance. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2012-01482is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2012-01482is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That the removal and maintenance plan is valid through December 31, 2017, at which the time the Ashland Parks and Recreation Department may request a renewal. meeting was called to order at 6:01 p.m. on December 6, 2012, in the Siskiyou Room in the Community Development and Engineering Services Building located at 51 Winburn Way, Ashland, Oregon. TYPE I REVIEW PLANNING ACTION: 2012-01612 SUBJECT PROPERTY.- 270 Meadow Drive APPLICANT: Meadowbrook Park Estates DESCRIPTION: A Tree Removal Permit to remove three Cottonwood trees in the open space adjacent to 270 Meadow Drive. Two trees are 12-inches in diameter at breast height and one is 9.5- inches in diameter at breast height. The trees have been reviewed by a certified Arborist and the aborist has determined that the trees are hazardous to the adjacent structure. COMPREHENSIVE PLAN DESIGNATION: Suburban Residential; ZONING: R-1-3.5; ASSESSOR'S MAP 9: 39 lE I ICB; TAX LOT 4208 All commissioners visited the site. Pina presented the staff report and noted that the application was submitted by the Home Owners Association on behalf of the former home owner of the adjacent property (280 Meadow Dr.) Since that time, the new home owners wish to retain the trees and wondered if they could be preserved. Commissioner Roland stated that the three trees in question appear to be hazardous and recommends removal. Other Commissioners agreed that the trees should be removed, and suggested the HOA look into planting other species that thrive in wet soils (i.e. River Birch, Italian Alder, some Ashes, etc) to mitigate the removal of Cottonwoods. Pina noted that because the trees in the open are specifically listed on the subdivision's landscape plan, that any future removals would need to come before the Tree Commission each time a tree(s) are to be removed, and that would present a good opportunity for the Commission to review each tree removed and make suggestions to which trees to mitigate with. Therefore, the Commission recommends approval as submitted. PLANNING ACTION: 2012-01482 SUBJECT PROPERTY. 51 South Pioneer / 45 Winburn Way APPLICANT: City of Ashland Parks DESCRIPTION: A request for Physical and Environmental Constraints (P&E) Permit for a five-year Maintenance Plan to remove hazardous trees along the Ashland Creek Riparian Corridor within Lithia Park and the Calle Guanajuato. COMPREHENSIVE PLAN DESIGNATION: City Park; ZONING: R-1-7.5; ASSESSOR'S MAP 39 lE 09; TAX LOTS 100 and 7500 Pina presented the staff report. Ann Thayer, Parks Horticulturist and Arborist reminded the Commission that we discussed this planning action briefly last meeting, but reiterated that because the Parks Dept. is a large property owner along Ashland Creek, that they are held to the same riparian restrictions as private property owners in accordance with both 18.62 and 18.63. Pina noted that under a "standard" Tree Removal process, the Parks Department would need to apply for each tree removal permit individually, and work, within certain time constraints to protect both the riparian edge and wildlife. AMC 18.62.030.2 defines Tree Removal as "The removal of three or more living trees of over six inches diameter at breast height (d. b. h), or the removal of five percent of the total number of living (or dead trees) over six inches d. b. h., whichever is greater, on any lot within five year period, or any form of commercial logging"; and therefore considered "Development" according to this Chapter. Therefore, based on this definition, staff felt that if the Parks Dept. can identify the number of hazard trees that is anticipated to be removed within a five-year period, that they would comply with the Physical and Environmental Constraints chapter in reducing the potential hazard of falling trees that could block the culverts or harming persons within the park. The Commission briefly discussed the proposal and recommended approving the action as submitted. DISCUSSION ITEMS Ann Thayer discussed with the Tree Commission for a second time the Arborist Report which recommends removing the two Liquidambars (Sweet Gums) trees within the Plaza. The Tree Commission noted that they had already seen and commented on the report when it was initially brought to them in August, and did not feel the need to re-discuss the removals again at this time. Pina noted that he has been in talks with fellow Planner Derek, Severson regarding the dead Cedar tree at 426 A Street that was conditioned to be retained throughout the development process. Now that the tree is dead, it would need to be replaced with a similar stature tree once mature. However the complication is that Cedars, and Conifers in general, are not approved as Street Trees and the specific location in underneath power lines, therefore a tree that reaches "similar stature once mature" would not be an appropriate tree in this location. Therefore staff would have to work, with the applicant in choosing an appropriate tree that would work well in that location and comply with the intent of the Planning approval. Through the application of the development standards of this chapter, the potential impacts to the property and nearby areas have been considered, and adverse impacts have been minimized. 2. That the applicant has considered the potential hazards that the development may create and implemented measures to mitigate the potential hazards caused by the development. 3. That the applicant has taken all reasonable steps to reduce the adverse impact on the environment. Irreversible actions shall be considered more seriously than reversible actions. The Staff Advisor or Planning Commission shall consider the existing development of the surrounding area, and the maximum permitted development permitted by the Land Use Ordinance, (ORD 2808,1997; ORD 2834,1998; ORD 2951, 2008) TREE REMOVAL 18.61.080 Criteria for Issuance of Tree Removal - Staff Permit An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The Staff Advisor may require an arborist's report to substantiate the criteria for a permit. A. Hazard Tree; The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and warrants removal. 1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning, 2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental Constraints, The Staff Advisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance. 4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. Ashland Parks and Recreation November 26, 2012 To the Planning Division: The following written findings is in response to a five-year tree tree maintenance plan for Lithia Park, Calle Guanajuato, and Oregon Shakespeare Festival (OSF) grounds; all which the Ashland Parks and Recreation Department (APRD) is responsible for maintaining. Portions of the subject properties are located within the Stream Protection Zone in accordance with Ashland Municipal Code (AMC) 18.63; and within both the FEMA 100-year Floodplain and the Ashland Creels Riparian Corridor in accordance with AMC 18.62. Applicable Planning Codes ® 18.61.080: Tree Removal Criteria ® 18.62.040.1: Physical Constraints Review Permit Criteria for Approval ® 18.63.060: Exempt Activities and Uses; ® 18.63.070: Limited Activities and Uses; ® 18.63.120: Mitigation Requirements: NARRATIVE The Ashland Parks and Recreation Department strives to provide safety and aesthetically pleasing Park settings, as well as protecting unstable creek banks in the inevitable occurrence of flood disasters. Because APRD will be responsible for the safety and well being of our citizens, APRD must provide maintenance safety standards within the public and easement properties maintained by APRD. Likewise, APRD is also committed to being stewards of the health and prosperity of our riparian corridors, which is why APRD is applying to establish a five-year tree maintenance plan for these properties. Currently there is no management plan in place for the Ashland Creek riparian zone. This plan includes provisions for landscape maintenance and hazard tree removals for the Lithia Park, as well as the Calle Guanajuato and OSF areas. Due to the small scale of our landscape and tree maintenance, most of the proposed activities are considered exempt in accordance with 18.63.060, including City Emergency Activities. However, because the areas are also within the Floodplain corridors in accordance with 18.62, this proposal addresses the flood prevention measures proposed in conjunction with hazard tree removals and vegetation maintenance. This i project does not involve in-stream work, nor will local native plant species be damaged or removed. All of the proposed activities fall under APRD's Natural Resource Enhancement Plan and are not defined by Land Use Codes. APRD's long term objective is to ensure that Ashland Creek functions as a riparian corridor as it passes through Lithia Park and along Calle Guanajuato. In doing so, APRD strives to aesthetically stabilize the streambank, add visual interest, provide fish habitat diversity, provide more public space in designated areas, and to ultimately minimize flood risk from debris accumulation. i i 1 The following is a list of tree removals that APRD is anticipating within a five-year time frame from the entrance to the Calle Guanajuato off North Main Street, heading south to the top of Lithia Park: 1. The Calle Guanajuato: proposed 5 trees to be removed in the next 5 years. Note: After trees are established, periodic thinning and harvesting of mature trees is required to maintain health and growth of existing species(less competition provide healthier specimens). The thinning of vines, invasive species, and thick undergrowth provides a view of the creek and a pleasing natural landscape is allowed for the enjoyment of the public. 2. The front of the park to the plgy round: proposed 12 trees to be removed in the next 5 years. Thinning or selectively harvesting fast growing trees (willows, cottonwoods, alders, and poplars) will remove captured nutrients in riparian zones and continue to promote growth. 3. The plgyground to the Park Office: proposed 15 trees to be removed in the next 5 years. Long term maintenance promotes strong plants that can survive environmental stress and optimize nutrient uptake and storage. 4. The Park Office to 440 Granite: proposed 15 trees to be removed in the next 5 years. Roots systems of harvested trees are retained and continue to stabilize the soil while allowing trees to regenerate from sprouts. 5. 440 Granite to the swim reservoir: proposed 18 trees to be removed in the next 5 years. Trees along the riparian corridor will be left for habitat along banks, but not within the channel margins. Reasons for this include limiting flow conveyance could raise flood elevations and pose a threat and risk of property damage to neighboring homes. A map and site plan indicating location of property boundaries, riparian corridor, and other pertinent information is included at the end of this document. FINDINGS, I 18.61.080. Tree Removal Criteria. 1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning. In accordance with Ashland Municipal Code (AMC) 18.61.042.1), Approval and Permit Required, Significant Trees greater than 18-inches D.B.H on lands under control of the City of Ashland requires a tree removal permit. Under this application, APRD is seeking approval to remove two hazard trees, a 27.5 Maple and 18.2 Alder, in addition to other trees projected for removal within the five-year timeframe. At the front of Lithia Park, along Ashland Creek, a Norway maple (Ater platanoides) is currently on the hazard tree removal list. Norway maples are considered heavy seeders and APRD strives to keep invasive tree species contained in order to reduce the spreading throughout the riparian corridor and heading downstream. The Norway maple's target zone is identified as the front lawn area of Lithia Park with an occupancy rate ranging from constant to frequent to space in winter months. A "target zone" is defined as a circle around the tree with a radius equal to about 1.0 to 1.5 times the height of the tree. Note dead wood in tree is brittle and may spread debris some distance beyond the tree. The tree hazards include: 1. Middle stem and fork dead 95% 2. Each stem contains cavities. Decay compromise wood strength. 3. Cracks and splits at branch/stem attachments 4. Larger stem has a strong lean over lawn area and flood wall. 5. Branching/stems occur from one point on tree (forked trunk) which marks a compromise in structure/ strength 6. Soils along Ashland Creek are loose granitic soils prone to tree upheavals. One third of the canopy is dead. The majority of the canopy now lies in the leaning stem. Reduction, or lightening of this stem will be unhealthy for the tree canopy (it will not leave enough resources for sustainability). This tree is unsafe for arborists to climb. Ashland Parks and Recreation will mitigate a native riparian tree such as Big Leaf Maple, White Alder or Oregon Ash. The White Alder, located within Lithia Park is considered irreparably hazardous. The target zone is a high use path and road within Lithia Park. The occupancy rate of this path is frequent use throughout the entire year. The White Alder tree hazards include: 1. Main stem is 95% dead 2. The canopy has cavities that could be an imminent threat should they fail. 3. -Borers in tree suggest failure throughout tree. 4. Soils are loose and granitic along the riparian zone As the canopy displays severe dieback, it is evident that this tree is a hazard along the main path in Lithia Park. Alder trees are fast growing and not long living trees. Ashland Parks and Recreation will mitigate a native tree suited to this location. Future tree removals within Lithia Park are primarily selected to decrease risks involving high use areas or any areas with targets. Trees that are evaluated as hazard trees will be removed and will be replaced with a tree selected for the site. APRD leaves snags for habitat whenever it is appropriate and a safe area to do so. It is critical to remove non-native trees and plant material that pose a threat to native habitat and future exponential seed dispersal rates within the riparian zones throughout the riparian systems in the Rogue Valley. The decisions made for the health of watercourses will take precedence which will include removal of non-native invasive species identified in both the Problematic/Invasive Plants Management Plan adopted by the Parks Commission in March 2011, and the Oregon State Department of Agricultural list of problematic j plants.. Decisions to remove invasive species shall not significantly compromise shading of the riparian zones. Decisions based on tree removals due to imminent danger of citizens, will be mitigated with planting of trees appropriate for the site. I Stream Productivity: The in-stream food chain is fed by sunlight, litter (leaves, needles and branches) that falls into the water and flying insects. The sunlight causes algae to grow on rocks. Insects eat the algae and plant litter; fish eat the insects and algae. Thinning helps achieve management goals, minimizing soil disturbance and gaining tree regeneration. 2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. Native and appropriately adapted species will be used. Natural vegetation will be monitored and appropriately manipulated to preclude unacceptable flood hazard. 18.62.040.1 Physical and Environmental Constraints 1. Through the application of the development standard of this chapter, the potential impacts to the property and nearby areas have been considered, and adverse impacts have been minimized. Management practices involving periodic coppicing, thinning and harvesting will be established where dense growth along narrow channels will limit flow conveyance and raise flood elevations, risking property damage from flooding. Our long term management goal is to insure that Ashland Creek functions as a riparian corridor as it passes through Lithia Park and past the Plaza businesses. Our objective is to minimize downstream flood risk from debris accumulation. Long term maintenance promotes strong plants that can survive environmental stress and optimize nutrient uptake. Thinning or selectively harvesting fast growing trees (willows, cottonwoods, alders, poplars, Oregon ash) will remove captured nutrients in riparian zone and continue to promote growth. The fast growing tree species tend to out-compete understory or .mid-size shrubs and trees, decreasing understory growth and diversity. The root systems of harvested trees are retained and continue to stabilize the soil while allowing trees to regenerate from sprouts. The tree removals within the riparian zone projects do not involve in-stream work, nor will local native plant species be damaged or removed. Lithia Park has a healthy stand of volunteer native trees along the corridor and APRD continues to re-plant native species of trees and shrubs along its riparian corridors. In following good stewardship, non-native and invasive species will be targeted for removal so as to not spread to other riparian areas downstream. The following will be applied for erosion control/runoff issues: 1. Checking erosion of sand, DG, soil and minimizing the transport of petro-chemicals into the creek. 2. Catch basins for sediment. 3. Exposed granite paths will be chipped or gravel applied. 4. Inspection to make sure preventative measures are in place prior to rainy season. 5. Bank stabilization plantings to discourage bank erosion. Debris management (pre-flood): Hazardous large wood debris will be removed from stream channel and bank prior to flood season (December). Hazardous large woody debris is defined as: 1. 4-12" width, 2/3 channel length 2. 12" + witdht, 1/2 channel length 2. The applicant has considered the potential hazards that the development may create and implemented measures to mitigate the potential hazards caused by the development. APRD are stewards of the Parks and open spaces within the City of Ashland and take the appropriate steps to ensure no potential hazards will be the effect of the plant/tree removals. Debris in Ashland Creek will be monitored and determined if it should be removed due to future blockage of bridges and culverts along Ashland Creek. Trees located in-stream will be cut at the base so as to not disturb the substrate. Roots left intact are necessary for the stability of the banks and substrate. Erosion control will be utilized to protect against contaminates into the stream. Removals will help in alleviating the potential of flooding and overall add to the protection and longevity of the riparian and flood corridor. 3. The applicant has taken all reasonable steps to reduce the adverse impact on the environment. Irreversible actions shall be considered more seriously than reversible actions. APRD takes all costs into consideration, including adverse impacts on the environment. Within Lithia Park, many unique areas containing historical groves, themed gardens and open spaces to provide recreation for public use. Many of these trees are exempt under 18.63060, Within the riparian area alone, there are thousands of trees to maintain and at times remove for public safety. APRD proposes to mitigate the degradation of the riparian habitat by the following: 1. Only remove trees posing a high degree of hazard under flood situations. Mitigate against removal via alternate methods (cabling bracing, pruning) 2. Always leave roots in place unless they pose an unacceptable hazard. 3. Selectively thin trees nearest the stream channel, favoring those located nearby but up-slope. 4. Stream channel shading should be considered with regard to any removal within stream corridor. 18.63.060 Water Resource Exempt Activities. 1. Vegetation Maintenance, Planting and Removal. a. Landscape Maintenance. Existing vegetation will be continually maintained, including being in accordance with weed abatement policies set by Ashland Fire and Rescue. c. Non-native, noxious and invasive vegetation removal. The removal/mowing of blackberries shall not occur between May 1St and July 31St to protect nesting birds. APRD requests that the following species be allowed for selection out of the riparian zones due to their invasive nature: American Ash, seeded varieties (Fraxinus americana) Amur Maple (Acer tataricum) Buckeye or Common Horse chestnut (Aesculus hippocastanum) Black Locust (Robinia pseudoacacia) English Hawthorn (Crataegus monogyna) European Filbert (Corylus avellana) Fruiting Cherry species (Prunus spp.) Fruiting Plums (Prunus spp.) Green Ash, seeded varieties (Fraxinus pennsylvanica) Mountain Ash (Sorbus aucuparia) Norway Maple (Acer platanoides) Norwegian Sunset Maple "Keithsform" (Acer truncatum x Acer platanoides) Pacific Sunset Maple "Warrenred" (Acer truncatum x Acer platanoides) Tree of Heaven (Ailanthus altissima) c. Tree pruning. Maintenance pruning of existing trees shall be kept to a minimum, meeting clearance for trails and shall be in accordance with the Tree Preservation and Protection Chapter 18.61. Under no circumstances shall the maintenance pruning be so severe that it compromises the tree's health, longevity, or resource functions (i.e. shade, soil stability, erosion control, etc.). e. Hazardous Tree Removal. A 5-year maintenance plan for Hazardous Tree Removal shall _ be processed under procedures and approval criteria described in the Tree Preservation and Protection Chapter 18.61. i. In-Channel Vegetation Removal. Debris in Ashland Creek will be monitored and determined if it should be removed due to future blockage of bridges and culverts along Ashland Creek. Trees located in-stream will be cut at the base so as to not disturb the substrate. Roots left intact are necessary for the stability of the banks and substrate, g. Routine planting.. The planting of local native plant species or the replacement of non- native, noxious and invasive plants with local native plant species, as identified on the City of Ashland's Local Native Plant Species List. Vegetation preservation (18.63.1200 mitigation shall be identified within the water resources protection zone. As invasive plant material is removed, native vegetation will be planted to replace the plant density for bank and erosion stability. h. Use of Hand-held Equipment or Machinery. The use of hand-held machinery (i.e. walk behind mowers, weed eaters) for vegetation maintenance and fire hazard prevention. i. Use of Power-Assisted Machinery. When larger machinery is necessary for removal or maintenance of trees with in the riparian corridor, soil compaction from equipment (bucket trucks) will be reduced by distributing the weight of equipment over a large area utilizing non-invasive materials such as plywood, mats, mulch, etc. whenever working within the riparian protection area. The use of power-assisted machinery will not be used within the October 31-May 1st (the wet months) boundary. 4. City Emergency Activities. Above all else, APRD must provide a safe and responsible environment for the welfare of all citizens. Because of this, ARPD will interfere when a tree or other natural hazard impacts the riparian corridor when it presents a potential imminent danger to public or private property. This will most likely be in the form of debris potentially blocking the nearby Winburn Way Street culvert and the Calle Guanajuato culvert. The creek and associated corridor will be monitored and determined if an action or event that presents imminent danger will be handled. In such an event, APRD will notify the Planning Department of activity so that it can be documented. 18.63.070. Water Resource Limited Activities and Uses. 4. Approval Standards for Limited Activities 1. All activities shall be located as far away from streams and wetlands as practicable, designed to minimize intrusion into the Water Resources Protection Zone and disturb as little of the surface area of the Water Resource Protection Zone as practicable. Because of the level of care that the vegetation will require within the riparian corridor, most of the work will be on such a small scale as it would be considered an exempt activity, and as such will not derogate the riparian protection area. However in all cases that require more heavy machinery or invasive procedures, protective measures will be taken to ensure that soils and roots are not negatively impacted, and that native plantings are preserved whenever possible. 2. The proposed activity shall be designed, located and constructed to minimize excavation, grading, area of impervious surfaces, loss of native vegetation, erosion, and other adverse impacts on Water Resources. _All work will be performed to restore and preserve the riparian habitat of Ashland Creek wherever possible. No impervious surfaces are proposed with the trail, nor loss of native vegetation, or negative impacts to the riparian corridor; just the maintenance of the trail easement and the associated riparian area. 3. On stream beds or banks within the bank full stage, in wetlands, and on slopes of 25% or greater in a Water Resource Protection Zone, excavation, grading, installation of impervious surfaces, and removal of native vegetation shall be avoided except where no r practicable alternative exists, or where necessary to construct public facilities or to ensure slope stability. APRD is not proposing to install impervious surfaces, significant grading, or native vegetation removal. 4. Water, storm drain and sewer systems shall be designed, located and constructed to avoid exposure to floodwaters, and to avoid accidental discharges to streams and wetlands. No water systems are proposed to be installed with this application. However with ongoing maintenance of the Ashland Creek riparian corridor, the safety of the Winbum Way Street culvert will be monitored to prevent flooding in the event of fallen trees or blockage. This includes selecting out trees within the creek culvert vicinity for the prevention of flooding blockage at those areas of crucial concern. 5. Stream channel repair and enhancement, riparian habitat restoration and enhancement and wetland restoration and enhancement will be restored through the implementation of a mitigation plan prepared in accordance with the standards and requirements in section 18.63.120. The ongoing maintenance and care is provided by the best practices standards by APRD. 6. Long term conservation, management and maintenance of the Water Resource Protection Zone shall be ensured through preparation and recordation of a management plan as described in section 18.63.120. C, except a management plan is not required for residentially zoned lots occupied only by a single-family dwelling and accessory structures. Because the property is held under a legal contract by the City to maintain, a legal contract is not necessary to ensure management will be adhered to. 18.63.120. Mitigation requirements. A. Vegetation Preservation and Construction Staging. As mentioned earlier in this document, the APRD utilizes best practices when working in forested and/or riparian areas. Work areas on the immediate site shall be identified and marked to reduce damage to trees and vegetation. Temporary construction fencing shall be placed at the drip line of trees bordering the work area. No equipment maneuvering, staging or stockpiling shall occur outside of designated work areas within the riparian protection zone. Trees will not be used as anchors for stabilizing equipment. And the stockpiling of soil, or soil mixed with vegetation, will not occur in the Water Resource Protection Areas on a permanent basis. When work is performed that is beyond that of exempt activities in accordance with 18.63.060, APRD will employ temporary erosion control measures installed to prevent encroachment and flow of runoff material or other debris into the Water Resource Protection Zone B. Options for Satisfying Restoration and Enhancement Requirements in Mitigation Plans. This application is for the maintenance and care of the APRD's Lithia Park and properties Maintained by APRD along Ashland Creek. No additional plantings or mitigation requirements are required or proposed at this time. APRD understands that any potential activity or use proposed that is beyond the scope of Exempt activities and those mentioned of the maintenance plan may be subject to further planning review in accordance with AMC 18.63 C. Management Plan. The ongoing maintenance and care is provided by best practices standards by APRD. Definitions Hazard trees are those that are dead or have branches that may fall in a path or public area. Hazard trees may have broken or hanging branches, split trunks or other conditions that may cause the tree or part of the tree to fail and cause damage. The tree manager/arborist is faced with making inspections and decisions on prioritizing hazard trees. An evaluation is made based on tree species, potential targets, and defects present to identify and document hazard trees. The corrective action will always be the decision of the tree manager/ arborist.
