Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO 18.108.070(B)(2)(c). An appeal may not be made directly to the Land Use Board of Appeals. Originally known as the Lithia Springs Hotel and later the Mark Antony, the ninc-story gothic bearing masonry structure was constructed in 1925 and was for a long time the tallest structure between Portland and San Francisco. The building is a primary contributing resource in Ashland's Downtown Historic District and was individually listed on the National Register of Historic Places in 1977. A complete certified rehabilitation was completed after the building was purchased by the current owners for unpaid taxes in 1998. Several wireless communication facilities already exist on the building, including those for Nextel, Verizon Wireless, Voice Stream (now T-Mobile), Master Towers/Sprint, Washington Oregon Wireless (WOW)/U.S. Cellular; and AT&T. The antennas and related wireless equipment are entirely integrated into and concealed by the architecture of the National Register-listed historic building, and each installation has been reviewed and approved by both the City of Ashland and the Oregon State Historic Preservation Office (SHPO). Within the C-1-D (Downtown) zoning district, the installation of wireless communication facilities on existing structures is subject to Conditional Use Permit approval as described in AMC 18.72.180.D. Subsequent additions of antennas by a provider are subject only to a'building permit review provided that the modifications do not increase the height of the installation by more than ten feet, that they do not alter the way the installation or the building itself relates to the applicable standards and approvals, and that they do not involve exterior changes to a National Register-listed building or contributing historic resource. In this instance, the addition of a new radio cabinet on the rooftop is considered an exterior modification to a National Register-listed historic building requiring a building permit, and as such the proposal is subject to Site Review approval as required in AMC 18.108.040.A.l.c.viii. The primary considerations for the application have to do with mitigating any adverse impacts of the new cabinet placement on the primary contributing historic building through the cabinet's placement, treatment and screening. PA #2012-00242 212 E Main/dds Page 1 As noted above, the application is a request for Site Review approval to allow the replacement of three existing antennas with three new antennas, and the addition of a new radio cabinet to the existing platform on the roof, The proposal is intended to upgrade the existing facilities to include `3G' wireless technology. The total number of antennas is not proposed to increase, and the antennas will continue to be completely camouflaged within the building architecture and behind its parapet. The proposed replacement antennas are to be in the same location as the existing antennas and will utilize the existing camouflaging. The application emphasizes that the antennas are not to be visible from surrounding public areas. This application modifies the previously approved Conditional Use Permit (42001-101) for Voice Stream, which was renamed T-Mobile in 2002. The application notes that as part of required federal permitting, the applicants have completed a National Environmental Policy Act (NEPA) Review filing for the proposed site modification which yielded a finding that the proposal met federal standards. The application includes a copy of these findings as Exhibit #3, The application further notes that the facilities are to be installed and maintained according to the requirements of the Building Code, and that .at the time of building permit application, written statements from the Federal Aviation Administration (FAA), Aeronautics Section of the Oregon Department of Transportation (ODOT), and the Federal Communications Commission (FCC) shall be provided to demonstrate that the proposal complies, or is exempt from, each agency's regulations. The material provided with the application include notice fiom the Federal Communications Commission (FCC) that the Oregon State Historic Preservation Office (SHPO) concurred with the applicants finding as part of their NEPA Review that the proposal would have no adverse effect either directly to the existing resource or in its visual appearance. A condition has been included below to require the applicants provide evidence of approval directly from SHPO, including any conditions placed upon the installation, prior to the issuance of a building permit. With regard to the proposed equipment cabinet installation, the application explains that the cabinet is to be located on an existing ten-foot by nine-foot platform on the fourth floor roof which holds T-Mobile's existing equipment and which was designed to accommodate a future cabinet. The new cabinet is described being 61- ,inches by 30-inches by 30-inches and having minimal visual impact, and a photo-simulation of the cabinet as it would appear when viewed from the adjacent public right-of-way is provided as the applicant's Exhibit #4. The cabinet appears to blend almost entirely with existing rooftop equipment due to its size, placement in a location designed for its eventual installation, and treatment with a color selected to blend with the hotel's existing exterior finish. The application also emphasizes that no increase in height of the installation or the building is proposed, and that no additional signage is proposed with the upgrade. The existing signage is noted as being limited to a contact sign consistent with the applicable WCF design standards. In considering the application, staff finds that the proposal remains is in keeping with the applicable city ordinances and the Site Review Chapter, and complies with the both the Site Design and Use Standards and the Development Standards for Wireless Communication Facilities found in AMC 18.72.180. Adequate capacity of city facilities is in place to serve the existing building and the approved wireless communication facility installation and will continue to serve the proposed replacement equipment. As such, it is staff s determination that the applicants have met the criteria for Site Review approval. Staff further finds that because the wireless communications facility installation will remain screened from view through the existing camouflaging measures and through the placement and treatment of the new equipment cabinet, that the proposal will not negatively impact either the Ashland Springs Hotel or the surrounding Downtown district. With the proposals of the applicant and the conditions attached to the approval detailed below, staff finds that the proposal complies with all applicable City ordinances. PA #2012-00242 212 E Mainldds Page 2 i The criteria for Site Review Apps oval are described in AMC Chapter 1..72.070, as follows: A. All applicable City ordinances have been met or will be met by the proposed development. B. All requirements of the Site Review Chapter have been met or will be met. C. The development complies with the Site Design Standards adopted by the City Council for implementation of this Chapter. D. That adequate capacity of City facilities far water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2012-00245 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2012-00245 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise modified herein, including but not limited to the proposed replacement antennas being located in place of existing antennas and continuing to utilize the camouflaging measures already approved and in place and that the equipment cabinet be as depicted in the applicants submittals including its size, placement and treatment. 2. That all requirements of the initial Conditional Use Permit approval (PA #2001-101) shall remain in effect unless otherwise modified herein. 3. That the applicants shall obtain a building permit. Prior to the issuance of a building permit, the applicants shall provide written statements from the Federal Aviation Administration (FAA), Aeronautics Section of the Oregon Department of Transportation (ODOT), and the Federal Communications Commission (FCC) to demonstrate that the proposal complies with, or is exempt fi•om, each agency's regulations. 4. The applicants shall provide a confirmation letter demonstrating that the proposal has been approved by the Oregon State Historic Preservation Office (SHPO). Prior to final inspection approval or use of the replacement wireless communication facilities, all SHPO requirements shall be met. Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. E E r 1f.1 I ~m ,1Mle Proposal T-Mobile proposes to upgrade its existing wireless site to include 3G wireless technology. The upgrade involves replacing three existing antennas with three new antennas. The total number of antennas will not increase. In addition, a new radio cabinet will be added to the existing platform on the roof. Plans depicting the proposed site design are provided as Exhibit 1 The antennas will continue to be completely camouflaged within the building and parapet. The proposed replacement antennas will be in the same location as the existing antennas and utilize the existing camouflaging. The replacement antennas will not be visible to surrounding public areas. An additional radio cabinet will be added on the roof. The cabinet is 61" tall by 30" wide by 30" deep. A picture of the cabinet is provided as Exhibit 2. 18.72.070 Criteria for Approval The following criteria shall be used to approve or deny an application: A. All applicable City ordinances have been met or will be met by the proposed development. Section 18.72.180(D) provides the design standard for wireless communication facilities. Below are findings related to the proposal's consistency with city requirements. 1. General Provisions a. All facilities shall be installed and maintained in compliance with the requirements of the Building Code. At the time of building permit application, written statements from the Federal Aviation Administration (FAA), the Aeronautics Section of the Oregon Department of Transportation, and the Federal Communication Commission that the proposed wireless communication facility complies with regulations administered by that agency, or that the facility is exempt from regulation. Findings: T-Mobile will be filing for a building permit. T-Mobile underwent a new NEPA frling for the proposed site modification. The NEPA filing concluded that proposal meets federal standard. The NEPA report is attached as Exhibit 3. Therefore, the criteria are met. b. All associated transmittal equipment must be housed in a building, above or below ground level, which must be designed and landscaped to achieve minimal visual impact with the SUrrounding environment. Findings: The proposed equipment cabinet will be located on the roof of the building on an existing platform that is holding T-Mobile's existing equipment. The new cabinet will have a very minimal visual impact. A photosimulation showing the proposed cabinet from the public right-of-way is attached as Exhibit 4. Therefore, the criteria are met. Site NnnibeTY003744A Site Name: Ashland Springs Findings of Fact i c, Wireless communication facilities shall be exempted from height limitations imposed in each zoning district. Findings: Wireless facilities are exempted from the height limit of the zone. Nevertheless, T-Mobile's equipment will not increase the height of the existing building. Therefore, the criteria are rnet. d. WCF shall be installed at the minimum height and mass necessary for its intended use. A submittal verifying the proposed height and mass shall be prepared by a licensed engineer. Findings: T-Mobile will continue to use its existing camouflaged antenna location. The equipment will be placed on the existing platform that was designed to accommodate a future cabinet. Therefore, the criteria are met. e. Signage for wireless communication facilities shall consist of a maximum of two non-illuminated signs, with a maximum of two square feet each stating the name of the facility operator and a contact phone number. Findings: T-Mobile current has a "con tact sign" consistent with city standards. No additional signage is proposed, Therefore, the criteria are rnet f Applicant is required to remove all equipment and structures from the site and return the site to its original condition, or condition as approved by the Staff Advisor, if the facility is abandoned for a period greater than six months. Removal and restoration must occur within 90 days of the end of the six month period. Findings: T-Mobile will comply with the removal requirement. Therefore, the criteria are met. 2. Preferred Designs a. Where possible, the use of existing WCF sites for new installations shall be encouraged. Collocation of new facilities on existing facilities shall be the preferred option. b. If (a) above is not feasible, WCF shall be attached to pre-existing structures, when feasible. c. If (a) or (b) above are not feasible, alternative structures shall he used with design features that conceal, camouflage or mitigate the visual impacts created by the proposed WCF. d. If (a), (b), or (c) listed above are not feasible, a monopole design shall be used with the attached antennas positioned in a vertical manner to lessens the visual impact compared to the antennas in a platform design. Platform designs shall be used only if it is shown that the use of an alternate attached antenna design is not feasible. e. Lattice towers are prohibited as freestanding wireless communication support structures. - Findings: T-Mobile will continue its existing camouflaged design, Therefore, the criteria are met-. Site Number. PO037ddA Site None: Ashland Springs Findings off act 3. Landscaping. The following standards apply to all WCF with any primary or accessory equipment located on the ground and visible from a residential use or the public right-of-way a. Vegetation and materials shall be selected and sited to produce a drought resistant landscaped area. b. The perimeter of the WCF shall be enclosed with a security fence or wall. Such barriers shall be landscaped in a manner that provides a natural sight obscuring screen around the barrier to a ininimum height of six feet. c. The outer perimeter of the WCF shall have a 10 foot landscaped buffer zone. d. The landscaped area shall be irrigated and maintained to provide for proper growth and health of the vegetation. e. One tree shall be required per 20 feet of the landscape buffer zone to provide a continuous canopy around the perimeter of the WCF. Each tree shall have a caliper of 2 inches, measured at breast height, at the time of planting. Findings: All of T-Mobile's wireless facility is located on top or within the building. Landscape screening is not required. Therefore, the criteria are rnet. 4. Visual Impacts a. Antennas, if attached to a pre-existing or alternative structure shall be integrated into the existing building architecturally and, to the greatest extent possible, shall not exceed the height of the pre-existing or alternative structure. b. Wireless communication facilities shall be located in the area of minimal visual impact within the site which will allow the facility to function consistent with its purpose. c. Antennas, if attached to a pre-existing or alternative structure shall have a non- reflective finish and color that blends with the color and design of the structure to which it is attached. d. WCF, in any zone, must be set back from any residential zone a distance equal to twice its overall height. The setback requirement may be reduced if, as determined by the Hearing Authority, it can be demonstrated through findings of fact that increased mitigation of visual impact can be achieved within of the setback area. Underground accessory equipment is not subject to the setback requirement. e. Exterior lighting for a WCF is permitted only when required by a federal or state authority. f. All wireless communication support structures must have a non-reflective finish and color that will mitigate visual impact, unless otherwise required by other government agencies. g. Should it be deemed necessary by the Hearing Authority for the mitigation of visual impact of the WCF, additional design measures may be required. Authorization to perform this project was given in the form of the T-Mobile Corporation purchase order number 4550767908. The NEPA review addresses whether the "facility" may have a significant environmental effect on eight actions or categories as outlined in the Federal Communications Commission (FCC) NEPA Rules [47 CFR Part I, Subpart 1, 1.1307 (a) (1) through (8)]. The eight actions include: wilderness areas; wildlife preserves; threatened-endangered species and critical habitats; historical properties; Indian religious sites; flood plains; surface features including wetlands deforestation, and water diversion; and high intensity white lights. The FCC NEPA Rules, however, categorically excludes from environmental processing projects where antennas will be mounted or collocated on an existing building or tower. The exclusion (47 CFR Part 1, Subpart 1, Section 1.1306 Note 1) reads as follows: The provisions of §1.1307(x) of this part requiring the preparation of Environmental Assessments (EAs) do not encompass the mounting of antenna(s) on an existing building or antenna tower unless §1.1307(a)(4) of this part is applicable. Such antennas are subject to §1.1307(b) of this part and require EAs if their construction would result in human exposure to radiofrequency radiation in excess of the applicable health and safety guidelines cited in §1,1307(b) of this part. The provisions of §1.1307 (a) and (b) of this part do not encompass the installation of aerial wire or cable over existing aerial corridors of prior or permitted use or the underground installation of wire or cable along existing underground corridors of prior or permitted use, established by the applicant or others. The provisions of §1.1307(a) and (b) of this part do not encompass the construction of new submarine cable systems. In addition, according to the Nationwide Programmatic Agreement For The Collocation Of Wireless Antennas (Collocation Agreement), dated March 16, 2001, antenna collocations on rooftops may occur without review under the consultation process set forth under subpart B of 36 CFR Part 800 if the building or structure is not over 45 years old, not registered as a national historic landmark or located within 250-feet of a historical district and the collocation licensee or tower owner has not received written notification of a public complaint turned into the Federal Communications Commission (FCC), Oregon State Historic Preservation Office (SHPO), or the Advisory Council on Historic Preservation (the Council). With respect to the conditions listed above, Adapt has determined that the host property building is 87 years old and is listed in the National Register of Historic Places. Since the project involves the collocation of antennas and equipment on an existing building known to be listed in the National Register of Historic Places, the proposed action requires section 106 assessment and form 621 submittal was triggered. These require consideration of the following NEPA issues: historical properties; Indian religious sites; and human exposure to radiofrequency radiation. 1.0 PROJECT DESCRIPTION The project site is located at 212 E Main Street Ashland, OR 97520 and is a roof top installation within downtown Ashland on the Ashland Springs Hotel. The Ashland Springs Hotel is a nine- story tower located in downtown Ashland. When it opened to the public in 1925, the hotel was known as the Lithia Springs Hotel. In 1961, the name was changed to The Mark Antony to capitalize on the success of the Oregon Shakespeare Festival. A 3998 renewal resulted in the name change to the Ashland Springs Hotel. At just over 120 feet in height, the Ashland Springs Hotel is the tallest structure in town. According to construction drawings (dated 10112111) the project is to replace three stealth antennas on the Ashland Springs Hotel. The original rehabilitation of the hotel was done with the intention of providing accommodation for cellular antennas; therefore, the antenna housings are invisible from the street. The replacement antennas would go in the existing antenna housings. Also proposed is an additional equipment cabinet to be added_ to an,._exi ng- equipment platform on the rooftop of the west wing. The ground elevation is 1940' AMI~+`,L' ahd- the height of tallest antenna is 119' (agl). (Appendix A-Project Location Maps; Appendix F Construction Drawings) 2.0 NEPA REVIEW ACTIONS G 1. May the facility affect districts, sites, buildings, structures, or objects significant in American history, architecture, archaeology, engineering or culture that are listed or are eligible to be listed in the National Register of Historic Places? No. Adapt completed a Section 106 Review of the National Historic Preservation Act of 1996 and 36 CFR 800 to assess whether the proposed facility will have an effect on properties listed on, or eligible for listing on, the National Register of Historic Places (NRHP). Historic Preservation Office (SHPO) that addressed the effect of the proposed undertaking on historic properties within direct and visual Areas of Potential Effect (APE). The review concluded there would be no adverse effect to historic properties within the APE for direct effects or visual effects. Adapt forwarded an FCC Form 621 (dated December 15, 2011) to SHPO with those conclusions. Julie Osborne (Historic Preservation Specialist) responded with a January 12, 2012 TCNS notice concurring with the conclusion that the proposed project would have "No Adverse Effect" on historic properties, eligible historic properties, or potentially eligible historic properties. As the project would not require ground disturbance, no archeological assessment was required or conducted. Additionally, no comment was received from Oregon SHPO archeologists within the standard 30 day response window. (Appendix B---SHPO Submittal & Response; Appendix C---Public Notice) 2. May the facility affect Indian religious sites? No. Section IV of the Nationwide Programmatic Agreement for Review of Effects on Historic Properties for Certain Undertakings Approved by the FCC (Nationwide Agreement) addresses the responsibility to carry out consultation with any Indian tribe that attaches religious and cultural significance to an historic property if the property may be affected by an FCC undertaking. On behalf of T-Mobile, Adapt notified the following tribes of the proposed rooftop antenna installation on November 25, 2011 (TCNS # 81052): 1. Fallon Paiute-Shoshone Tribe 2. Confederated Tribes of the John Day 3. Cow Creek Band of Umpqua Tribe of Indians F L ^ I-i 1 4. Siletz Tribe 5. Burns-Paiute 6. Klamath Tribes 7. Yakama Nation Six of the seven Indian tribes provided a reply via TCNS and email, or the tribe has a TCNS exclusion that has been satisfied. The Umpqua and Siletz tribes did not reply to the initial TCNS notification or to a second notification sent via U.S. Postal Service. Both tribes were subsequently referred to the FCC for government-to-government consultation in accordance with FCC-TCNS protocol. The Umpqua tribe followed up with a response of "no interest"via TCNS. The Siletz tribe did not provide a statement of interest to Adapt or the FCC within 20 calendar days of the government-to-government consultation and therefore T-Mobile has fulfilled its responsibility under Section IV of the Nationwide Agreement to carry out consultation with Indian tribes concerning the proposed undertaking. It should be noted that SHPO requires that during construction activities, if archaeological or historic materials are discovered, work in the immediate area must be discontinued, the area secured, and the appropriate Indian tribe(s) and SHPO notified. If not categorically excluded from routine environmental evaluation for RIF exposure, would the proposed facility potentially cause human exposure to levels of RF radiation in excess of the limits specified in the FCC's rules? (Appendix G--Site RF Analysis) 3.0 CONCLUSIONS In conclusion, it is Adapt's opinion the proposed T-Mobile facility will have no significant effect on above-ground or below-ground historical resources. Tribal consultation has been completed and none of the contacted tribes have requested further archaeological work be conducted at the site. As such, Section 106 requirements for the proposed T-Mobile site have been satisfied. 4.0 LIMITATIONS The Section 106 Review and tribal consultation is intended to satisfy T-Mobile's specific requests regarding scope of work and should not be solely relied upon to satisfy federal, state, or local permitting requirements. Further, the review questions apply only to the "facility" defined as the areas of the host parcel that T-Mobile will lease and develop such as a tower compound. This letter has been prepared for the exclusive use of T-Mobile and their agents for specific application to the project site. Use or reliance upon this report by a third is at their own risk. Primary work involved a historic resource survey of approximately 900 properties in Vancouver, WA. f. • '01 NMI mm The project (Adapt #OR1 1-1 7532-NEPA) is to replace cellular antennas on a building in Ashland, Oregon, as shown in Figures 1 through 3. The proposal is to replace three antennas hidden on the Ashland Springs Hotel. The original rehabilitation of the hotel was done with the intention of providing accommodation for cellular antennas; therefore, the antenna housings are invisible from the street. The replacement antennas would go in the existing antenna housings. Also proposed is an additional equipment cabinet to be added to an existing equipment platform on the rooftop of the west wing. A check of the Oregon Historic Sites Database for any resources in the area was performed on November 21, 2011, and there are hundreds of resources found within the half-mile vicinity. The building on which the antenna replacement is proposed is listed on the National Register. The Oregon SHPO requests a limited reconnaissance survey of the area to locate resources eligible for the National Register in addition to a check of the Oregon Historic Sites Database. A limited reconnaissance survey was therefore carried out by David Pinyerd, with the assistance of Bernadette Niederer, on November 22, 2011 We walked the APE to seek out any additional historic resources eligible for the National Register and the extent of the proposed project's visibility. Sample views were photographed towards the proposed project from throughout the APE and the photo locations are plotted on Figure 4. The antennas and equipment cabinet are shown in each photo with a red arrow pointing toward them (or a blue arrow if they are not visible). The APE was then constricted to just the building on which the project is proposed and the rear parking lot as the antennas would not be visible from the exterior and the equipment cabinet would not be visible due to other buildings and topography throughout most of the standard APE (Figure 5). The antenna replacement is proposed for downtown Ashland on the Ashland Springs Hotel. The project site is bounded by East Main Street on the north, South 1st Street on the east, Hargadine Street on the south, and South Pioneer Street on the west. All of the surrounding blocks are commercial, particularly along Main Street, with historic construction dating primarily to the 1920s. The Oregon Shakespeare Festival complex begins approximately 200 feet to the west. Topography slopes steeply from south to north. When it opened to the public in 1925, the hotel was known as the Lithia Springs Hotel. In 1961, the name was changed to the Mark Antony to capitalize on the success of the Oregon Shakespeare Festival. A 1998 renewal resulted in the name change to the Ashland Springs Hotel. The building was designed by architects Tourtellotte and Hummell entirely of reinforced concrete in an eclectic style that could be described as Art Deco, with elements of Romanesque, English Tudor, Gothic, and Neo-Classical Revival. It was intended to be the tallest building between Portland and San Francisco. Typical of some of J.E. Tourtellotte's later designs, such as the Boise Hotel (1930) and the Baker Hotel (1929), the Lithia Springs Hotel has a nine-story central tower with two short wings. The main entry is arched with inset windows, covered by a large canopy, and flanked by two round arches. The stucco of the first and second floors is scribed to resemble lightly rusticated cut stone. A strong belt course breaks the lower block from the remaining room floors. An elaborate parapet caps the building. Other decorative details include plaster eagles perched on pilasters to either side of the main entry, pronounced keystones, and flower roundels in the spandrels. Leaded stained glass is used in the upper windows and in the three arched openings along First Street. The most significant alteration to the building is the addition of a highly incompatible concrete and glass elevator shaft on the right side of the building c.1980. A mechanical court was added to the rear. The front canopy is also new, though compatible with the 1925 structure. Several of the ground floor doors are new, including a utility door separating the main tower portion from the right wing, a newer front door, and a remodeled entry on the left side. The Lithia Springs/Mark Antony/Ashland Springs Hotel was listed on the National Register of Historic Places in 1978. The proposal is to replace three antennas hidden on the building. The northeast antenna and the southeast antenna are hidden behind the parapet wall on the ninth floor. The northwest antenna is hidden behind a window of the fifth floor of the incongruous stair tower. The original rehabilitation of the hotel starting in 1998 was done with the intention of providing accommodation for cellular antennas; therefore, the antenna housings are invisible from the street. The replacement antennas would go in the existing antenna housings. They also propose to add a second equipment cabinet to an existing equipment platform on the rooftop of the west wing. All new conduit and cabling would be limited to the rooftops. Since this hotel is listed on the National Register, the building will only allow the most camouflaged cellular installations. This project conforms to that requirement and to the specifications within the December 2001 MOA.
