The Staff Advisor's decision becomes final and is effective on the 131h day after the Notice of Final Decision is mailed. Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance (ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in the ALUO 18.108.070(B)(2)(c). An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that issue. COMPREHENSIVE PLAN DESIGNATION: Low Density Multi-Family Residential; ZONING: R- 2; ASSESSOR'S MAP 39 IE 15AA TAX LOT 6200 SUBMITTAL DATE: September 5; 2012 DEEMED COMPLETE DATE: September 20, 2012 STAFF APPROVAL DATE: October 11, 2012 DEADLINE TO APPEAL (4:30 pan.): October 233 2012 FINAL DECISION DATE: October 24, 2012 APPROVAL EXPIRATION DATE: October 24, 2013 DECISION The subject property is located at 1860 Ashland Street, at the southeast corner of the intersection of ; Ashland Street and Sherwood Avenue. The project site consists of a single rectangular tax lot with an area of approximately 1.05 acres, approximately 100 feet of frontage along Ashland Street, and approximately 390 feet of frontage on Sherwood Avenue. The subject property is city-owned, and is the location of Ashland Fire Station #2 on the northern third of the property, with the remaining southern portion of the site containing Sherwood Park, a small neighborhood park with picnic areas and a playground. City-awned cemetery land is located immediately to the west of the site, across Sherwood Avenue, and to the north across Ashland Street. The subject parcel and surrounding properties immediately to the north, south, east and west are zoned Low Density Multi-Family Residential (R-2). Further to the cast, beginning at Park Street, properties along both sides of Ashland Street are zoned Employment (E-1). Further west, beginning at Normal Avenue, properties along both sides of Ashland Street are zoned Commercial (C-1). With the exception of this relatively small section of R-2 zoned property, the remainder of the Ashland Boulevard corridor to the east and west is located within the Detail Site Review Zone. In reviewing the history of applications for the subject property, staff noted the following recent approvals: PA-2009-00873 was a Site Review approval by the Planning Commission to allow the construction of a new 10,076 square foot two-story fire station building to replace the existing Eire Station #2, which was constructed in 1965. Also included were requests for Conditional Use Permit approval to modify the existing non-conforming use, a Variance to the front yard setback requirements along Ashland Street, an Exception to Street Standards, and the removal of one 12-inch diameter blue spruce tree. This approval included a condition that any signage comply with applicable sign regulations or that a separate Conditional Use Permit be obtained in keeping with the allowances for government signage. PA 92012-01269 1860 Ashland Street-Fire Station #2 Sign CUM& Page 1 r PL-2010-01156 was a ministerrar approval for an 18-month extension of Planning Action #2009-00873. PA-2011-01413 was an administrative approval of a request to modify the Site Review approval from PA- 2009-00873 for reconstruction of Fire Station #2. The modifications included: shifting the main entrance slightly to face Ashland Street, a reduction in building height from 29 feet to 26 feet, changes to the exterior including minor window changes and a change from brick veneer to stucco/concrete masonry unit construction, and the addition of some trees and shrubs to. the transition area between the existing park's sidewalk and the new building's south wall. Subsequent to the approval of these three actions, the building that previously housed Ashland Fire Station #2 since 1965 was demolished and a new building is under construction to replace it. There are no other planning actions of record for the site. The current application is a request for a Conditional Use Permit to install a 31 square foot wall sign with the words "Ashland Fire & Rescue Station No. 2" engraved in the concrete wall for the property located at 1860 Ashland Street. This sign would be similar to the one in place at Fire Station #1. An additional five-foot high informational ground sign is proposed for placement in the Ashland Street right-of-way. This sign will consist of two four-foot by five-foot panels connected at one end and separated on the other by no more than 22-inches. This sign is to allow for the placement of current relevant information or safety messages, Signs placed in the right-of-way by government entities are exempt from regulation under Section 15.96.156 of the "Sign Regulations" Ordinance. Consideration of the Conditional Use Permit requested here is limited to the single wall sign. The placement of the informational sign within the right-of-way will be subject to review and approval by the Oregon Department of Transportation and the City of Ashland's Public Works and Engineering departments. The installation of signage in residential areas is generally restricted under the "Sign Regulations" Ordinance (AMC 18.96). However, the ordinance includes provisions that allow governmental agencies to apply for Condition Use Permits to allow the placement of signage that does not conform with the standard sign regulations when it is determined that, in addition to the criteria for a Conditional Use Permit, the signage is necessary to further the agency's public purpose. These provisions have been used to allow signage at the Ashland Connliunity Hospital, Ashland Schools and Southern Oregon ! University in the past. In responding to the approval criteria for a Conditional Use Permit, the application notes that the Fire Station has been in place in this location since 1965, and the new building has been recently reviewed and approved by the Planning Commission. The application notes that the proposed ground sign is consistent with the approval, which included condition requiring that a Conditional Use Permit be obtained to allow the signage shown in the application under the code provisions for government signage. The application further notes that the new building represents a substantial aesthetic improvement over the 1965 building it replaces, that the wall sign will be engraved in the cast-in-place concrete wail at the front of the building similar to that a Fire Station No. 1, and that the ground sign will be designed in wood and metal to be architecturally compatible with the exterior materials used on the new building. E Ashland's two fire stations are staffed 24-hours a day and deliver fire suppression, emergency medical, disaster management, fire prevention and public education services, responding to over 3,000 calls a year in a service area that exceeds 650 square miles. The department's public education efforts include significant outreach focused on wildfire prevention and emergency preparedness through the Fire Wise Communities Program and Community Emergency Response Team (CERT). The application asserts that informational signage and signage clearly identifying the building as one of Ashland's two fire stations will further the agency's public purpose. PA #2012-01269 1860 Ashland Street-Fire Station #2 Sign CUP/dds Page 2 In considering the application, staff finds that the proposed wall sign is in keeping with the applicable city ordinances including approval criteria for both the "Sign Regulations" Ordinance and Conditional Use chapters, is architecturally compatible with the new building and surrounding area, and that in clearly identifying the new building as Fire Station No. 2 it will serve to further Ashland Fire and Rescue's public purpose. The criteria for Conditional Use Permit approval are described in AMC Chapter 18.104.050, as follows: A. That the use would be in conformance with all standards within the zoning district in which the use is proposed to be located, and in conformance with relevant Comprehensive plan policies that are not implemented by any City, State, or Federal law or program. B. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. C. That the conditional use will have no greater adverse material effect on the livability of the impact area when compared to the development of the subject lot with the target use of the zone. When evaluating the effect of the proposed use on the impact area, the following factors of livability of the impact area shall be considered in relation to the target use of the zone: 1. Similarity in scale, bulk, and coverage. 2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and mass transit use are considered beneficial regardless of capacity of facilities. 3. Architectural compatibility with the impact area. 4. Air quality, including the generation of dust, odors, or other environmental pollutants. 5. Generation of noise, light, and glare. I 6. The development of adjacent properties as envisioned in the Comprehensive Plan. 7. Other factors found to be relevant by the Hearing Authority for review of the proposed use. E E The criteria for Government Signs are described in AMC Chapter 18.96.150, as follows: Governmental agencies may apply for a Conditional Use to place a sign that does not conform to this Code when it is determined that, in addition to the criteria for a conditional use, the sign is necessary to further that agency's public purpose. (ORD 2951, amended, 0710112008) The application with the attached conditions complies with all applicable City ordinances. Planning Action #2012-01269 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action #2012- 01269 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise modified herein, including but not limited to the relocation of the street tree so that the tree is not adversely impacted by the proposed ground sign. That all requirements of the pfevious land use approvals (PA-2009-Ouo 13 and PA-2011-01413) shall remain in effect unless otherwise modified herein. 3. That the applicants shall obtain any required permits from the City of Ashland Public Works/Engineering Department and the Oregon Department of Transportation for the placement of signage in the Ashland Street/Highway 66 right-of=way. 4. That a sign permit shall be obtained for the new signage approved herein. The plans submitted for the sign permit application shall be in substantial conformance with those approved as part of this application. If the plans submitted for the sign permit are not in substantial conformance with those approved as part of this application, an application to modify this Conditional Use Permit approval shall be submitted and approved prior to issuance of a sign permit.
