RESOLUTION
Proposing an amendment to the Charter of the City of Ashland, Jackson
County, Oregon, by adding thereto Article XXXI, providing annual budget
estimate shall include item for City Band and that general tax levy
shall include not to exceed sic-tenths (.6) mills on the dollar for such
band requirements, which fund shall be deposited with the City Treasurer,
subject to the order of the Common Council; providing that such proposed
Charter amendment be submitted to the electors of said City for their
approval or rejection at a special election to be held on the 20th day of
May, 1938; further providing a ballet title for such proposed amendment and
declaring an emergency.
BE IT RESOLVED BY THF, MAYOR AND COMMON COUNCIL OF
THE CITY OF ASHLAND:
Section 1.
That an amendment to the Charter of the City of Ashland, Jackson
County, Oregon, be and the same is hereby proposed and referred for
submission to the legal voters of said City at a special election to be
held in said City on the 20th day of May, 1938, which Charter Amendment
to be so referred is as follows:

MAYOR AND COMMON COUNCIL
An Act
To amend an act entitled "An Act to amend an act entitled 'An Act
to incorporate the City of Ashland in Jackson County, Oregon, and to define
the power thereof', filed in the office of the Secretary of State February
21, 1889, and the acts approved February 25, 1895, amending the same,
filed in the office of the Secretary of State October 14, 1898, as amended
by an act filed in the office of the Secretary of State January 31, 1903,
and as amended by an act filed in the office of the Secretary of State
February 3, 1903, and as amended by an act filed in the office of the
Secretary of State February 10, 1905, and as amended by the legal voters
of said city at elections held subsequent to the year 1908 and to amend all
acts whether mentioned herein or not, amending said act, adopted by the
Legislative Assembly, or by the vote of the people.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ASHLAND,
OREGON
That an act entitled "An Act to amend an act entitled 'An Act to
incorporate the City of Ashland in Jackson County, Oregon, and to define
the power thereof, filed in the office of the Secretary of State,
February 21, 1889, and the acts approved February 25, 1895, amending
the same, filed in the office of the Secretary of State October 14, 18982
as amended by an act filed in the office of the Secretary of State
January 31, 1903, and as amended by an act filed in the office of the
Secretary of State February 3, 1903, and as amended by an act filed in
the office of the Secretary of State February 10, 1905, and as amended by
the legal voters of said City at elections held subsequent to the year
1908, and as amended by all acts whether mentioned herein or not, amending
said act, adopted by the legislative assembly or by the vote of the people",
be and the same is hereby amended by adding thereto Article XXXI to read
as follows:
ARTICLE XXXI
Section 1
At the time of making the tax levy for general City purposes each
year, the Common Council shall cause a careful estimate to be made of the
money required for the purpose of a City Bank for the ensuing year, such
estimate shall be presented and considered with the other items in the
annual budget and there shall be included in the general levy for the en-
suing year not to exceed six-tenths (.6) mills on the dollar for such band
requirements, which fund, when collected, shall be deposited with the
City Treasurer, subject to the order of the Common Council.
Section 2
That the same persons shall serve as judges and clerks for said
special election as shall serve as Judges and clerks for the primary
election held at the same time on the same day; that the respective polling
places lawfully designated for the said primary election are hereby
designated as the voting places for said special elections polls will be
open from eight o'clock in the forenoon to eight o1clock in the afternoon
on the date herein fixed for said election.
Section 3
That the ballot title of said measure so submitted to the electors at
such special election herein called shall be as follows;

Section 4
That the City Recorder is hereby requested and directed to give due
notice of such special election herein called as provided in the Charter
and ordinances of the City of Ashland, Oregon, that is to say, that this
Resolution be published in the Ashland Tidings, a newspaper of general
circulation, printed and published in said City, at least once ten days
prior to the date fixed herein for holding said election, and by posting
of this resolution in a conspicuous place in each ward in the City of
Ashland at least ten days before said special election.
Section 5
That as regards the holding of said election, it shall, in all
particulars, be conducted in conformity with Article IV of the Charter of
the City of Ashland.
Section 6
That inasmuch as the regular primary election for the electors of the
City of Ashland, Oregon, is to be held on May 20, 1938, and a material
saving of time and money can be made to the tax payers of the City of
Ashland by holding this special election in conjunction with said regular
primary election, it is deemed necessary for the peace, health, safety
and general welfare of the citizens of the said City of Ashland that an
emergency be, and the same is hereby declared to exist,.and this Resolution
shall be in full force and effect from and after its passage by the
Council and approval by the Mayor.
The foregoing Resolution was duly passed, under a suspension of the
rules, at a regular meeting of the Common Council held on the 19th day of
April, 1938, the vote being as follows:
Ayes: Six.
Nays: None.
