AN ORDINANCE OF THE CITY OF ASHLA14D WITHDRAW-
ING CERTAIN RECENTLY ANNEXED REAL PROPERTY
FROM JACKSON COUNTY FIP.E DISTRICT NO. 5.
(SLUSSER ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The following described real property situated in the
Cit~TsThland, Jackson County, Oregon, is hereby withdrawn from
Jackson County Fire District No. 5 pursuant to the provisions
of ORS 222.524. Said real property is described as follows, to wit:
Commencing at the Southeast corner of Donation Land Claim No. 45,
Township 39 South, Range 1 East, Willamette Meridian, Jackson
County, Oregon, thence West 196.68 feet, thence South 0012 West,
2135.70 feet to a 3/4" iron pipe monumenting the Northeast corner
of Kensington Subdivision in the City of Ashland, Jackson County,
Oregon, said Northeast corner further described as being the
Southeast corner of tract described in Volume 179, page 206 of
the Deed Records of Jackson County, Oregon, thence West, 400.00
feet to a 3/4" pipe monumenting the Northwest corner of said
subdivision, and the true point of beginning; thence along the
West line of said Kensington Subdivision, South 0007' East,
331.65 feet; thence West, 60.00 feet; thence North 45059'55" West,
73.83 feet to a 5/8" iron pin on that certain boundary line by
agreement described in Instrument No. 84-13764 of the Official
Records of Jackson County, Oregon; thence North 0007' West, 280.36
feet; thence East, 113.00 feet to the true point of beginning.
SECTION 2. The City of Ashland elects, pursuant to ORS 222.520(2),
to pay annually, as the bonds of Jackson County Fire District No. 5
that were outstanding on the effective date of this Ordinance, as
the same proportion of such outstanding bonds and interest thereon,
as the assessed valuation of that part withdrawn bears to the assessed
valuation of the entire district on the effective date of this
ordinance.
The foregoing ordinance was first read on the 19th of February,
1985, and duly PASSED and ADOPTED thi's ~6 day of March, 1985.
