Swanson, husband and wife 375 Old Green Springs Highway Ashland Oregon 97520 City of Ashland Oregon, BORROWER a municipal corporation, 20 East Main Street Ashland, OR 97520 CANCELLATION AND RELEASE: Reference is hereby made to that certain Promissory Note ("Promissory Note dated May 31, 1995, in the face amount of Three Hundred Sixty Thousand and no/100 Dollars, which promissory note was executed by then-Mayor of Ashland, Oregon, Catherine Golden, on behalf of Borrower and made payable to Lender. The Promissory Note was secured by a Trust Deed which was recorded as document #95-14482 on May 31, 1995 in the Official Records of Jackson County, Oregon and which concerned property at 560 Catalina Drive, Ashland, Oregon. Lender hereby acknowledges receipt of full payment of the Promissory Note, including all outstanding principal and all accrued and outstanding interest due as of the date of execution of this Cancellation and Release. Lender therefore releases Borrower from all obligations under the Promissory Note and cancels the Promissory Note. This cancellation and release shall be binding upon Lender's successors, legal representatives and assigns. Lender warrants that the Promissory Note has not been assigned, ceded, transferred or sold to a third party and warrants Lender's authority as note holder to issue this Cancellation and Release of the Promissory Note.
