Main Street Applicant: Crown Castle / Sprint Description: A request for Site Review approval for the replacement of three existing antennas with three new antennas, and the addition of two new cabinets to the existing platforin on the roof of the Ashland Springs Hotel for the property located at 212 East Main Street. The proposal is to upgrade the existing wireless communication facilities to include 4G wireless technology. The total number of antennas is not proposed to increase, and the antennas will continue to be completely camouflaged within the building and parapet. COMPREHENSIVE PLAN DESIGNATION: Downtown Commercial; ZONING: C-1-D; ASSESSOR'S MAP: 39 lE 09 BC; TAX LOT: 100 The Community Development Director's decision becomes final and is effective on the 13th day after the Notice of Final Decision is mailed. Approval is valid for a period of one year and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based, on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.108.070(B)(2)(c). B. Actions subject to appeal: 2. Type I Planning Actions. a. Effective Date of Decision. The final decision of the City for planning actions resulting from the Type I Planning Procedure shall be the Staff Advisor decision, effective on the IP day after notice of the. decision is mailed unless reconsideration of the action is approved by the Staff Advisor or appealed to the Commission as provided in section 18.108.070(B)(2)(c). b. Reconsideration. The Staff Advisor may reconsider Type I planning actions as set forth below. i. Any party entitled to notice of the planning action, or any City Agency may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for " reconsideration, which in the opinion of the staff advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. ii. Reconsideration requests shall be received within five (5) days of mailing. The Staff Advisor shall decide within three (3) days whether to reconsider the matter. iii. If the Planning Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten (10) days to affirm, modify, or reverse the original decision. The Staff Advisor shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. iv. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. c. Appeal. i. Within twelve (12) days of the date of the mailing of the Staff Advisor's final decision, including any approved reconsideration request, the decision may be appealed to the Planning Commission by any party entitled to receive notice of the planning action. The appeal shall be submitted to the Planning Commission Secretary on a form approved by the City Administrator; be accompanied by a fee established pursuant to City Council action; and be received by the city no later than 4:30 p.m. on the 12th day after the notice of decision is mailed. ii. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the city and whose boundaries include the site. iii. The appeal shall be considered at the next regular Planning Commission or Hearings Board meeting. The appeal shall be a de novo hearing and shall be considered the initial evidentiary hearing required under ALUO 18.108.050 and ORS 197.763 as the basis for an appeal to the Land Use Board of Appeals. The Planning Commission or Hearings Board decision on appeal shall be effective 13 days after the findings adopted by the Commission or Board are signed by the Chair of the Commission or Board and mailed to the Parties. . iv. The appeal requirements of this section must be fully met or the appeal will be considered by the city as a jurisdictional defect and will not be heard or considered. Originally known as the Lithia Springs Hotel, and later the Marl. Antony, the nine-story gothic bearing masonry structure was constructed in 1925 and was for many years the tallest structure between Portland and San Francisco. The building is considered a primary contributing resource in Ashland's Downtown Historic District, and was individually listed on the National Register of Historic Places in 1977. The application proposes to replace three existing wireless antennas with three new antennas of a slightly larger size; as well as consolidate three equipment cabinets into two. Two of the antennas are located behind an existing parapet on the Ninth floor roof, and are screened by architectural louvers. Due to the slightly larger size of the replacement antennas, approximately four square feet of the parapet below the louvers must be cut into and replaced with a Radio Frequency (RF) material. Because replacement necessitates an exterior change to a nationally recognized Historic Stricture, and requires a building permit, a Site Review is required in accordance with Ashland Municipal Code (AMC) 18.72.030.A. Several wireless communication facilities already exist on the building, including those for Nextel, Verizon, T-Mobile, U.S. Cellular, and AT&T; all of which are entirely integrated into the architecture of the building. The application proposes to replace. the removed portion of the parapet with an RF permeable canvas painted to match the buildings current color, and designed to mimic the architecture of the existing louver. l PA #2013-00664 212 E Main/MP Page 1 With regard to the proposed equipment cabinet installation, the application emphasizes the reduction in the number of cabinets. Both cabinets have been shown to have no visual impact, and a photo-simulation of the cabinet as it would appear when viewed from the adjacent public right-of-way is provided. Both cabinets will blend in with existing rooftop equipment due to its size, placement, and color treatment to blend with the hotel's existing exterior finish. Adequate capacity of city facilities are in place and will continue to serve the building and subsequent wireless communication equipment. The application .includes written approvals from the Federal Aviation Administration (FAA), Aeronautics Section of -the Oregon Department of Transportation (ODOT), the Federal Communications Commission (FCC), and the Oregon State Historic Preservation Office (SHPO). The primary. consideration for staff in reviewing the proposal has to do with mitigation of the cut into the historic resource through architectural screening and treatment. The Historic Commission Reviewed the proposal at their June 5, 2013 regular meeting, had no issue with the proposal, and recommended approval as submitted. Staff finds that since the new antennas will I continue to be completely screened within the building's parapet through architecturally sensitive materials, that the removal will not have an adverse impact on the historic resource, nor degradation of the historic district, and therefore remains consistent with applicable city ordinances and the Site Review Chapter. The criteria for Site Review Approval are described in AMC Chapter 18.72.070, as follows: A. All applicable City ordinances have been met or will be met by the proposed development. B. All requirements of the Site Review Chapter have been met or will be met. C. The development complies with the Site Design Standards adopted by the City Council for implementation of this Chapter. D. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. The application with the attached conditions complies with all applicable City ordinances. Planning Action 2013-00664 is approved with th_e following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then 'Planning Action 2013-00664 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise modified herein, including the replacement antennas being located in place of existing antennas, and continuing to utilize the camouflaging measures approved and depicted in the application document submitted with this application. Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above. Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the application. Specifically the proposal is to remove and replace three (3) antennas and remove three (3) equipment cabinets with the replacement of two (2) new. Two antennas are to be located behind the existing center louver. One antenna is located on the 9t" floor at the stairs tower. The equipment is located on the lower roof at the existing equipment location. A. All applicable City ordinances have been met or will be met by the proposed development. This is a proposal to upgrade and replace existing antennas with associated equipment. All applicable city ordinances will be met. B. All requirements of the Site Review Chapter have been met or will be met. This is a proposal to upgrade and replace existing antennas with associated equipment. The proposal is to replicate the exact existing conditions that have been previously proven to meet the all requirements of the Site Review Chapter. C. The development complies with the Site Design Standards adopted by the City Council for implementation of this Chapter. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. All improvements in the street right-of-way shall comply with the Street Standards in Chapter 18.88, Performance Standards Options. (Ord. 2655, 1991; Ord 2836 S6, 1999) The proposal is all located on the rooftop of the existing building. There will be no increased impact on City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage. Adequate transportation currently does and will be provided to and through the subject property. There is no proposed ROW impacts. 18.104.050 Approval Criteria A conditional use permit shall be granted if the approval authority finds that the proposed use conforms, or can be made to conform through the imposition of conditions, with the following approval criteria. A. That the use would be in conformance with all standards within the zoning district in which the use is proposed to be located, and in conformance with relevant Comprehensive plan policies that are not implemented by any City, State, or Federal law or program. The proposal is replace existing antennas with upgraded antenna models and associated equipment. The replacement is to be an exact replication of what has already been approved to be in conformance with all standards within the zoning district in which the use is proposed to be located, and in conformance with the relevant Comprehensive plan policies. B. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. The proposed antenna modification with associated equipment will create no increased impacts on the adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage. Adequate transportation currently is and will continue to be provided to and through the subject property. C. That the conditional use will have no greater adverse material effect on the livability of the impact area when compared to the development of the subject lot with the target use of the zone. When I evaluating the effect of the proposed use on the impact area, the following factors of livability of the impact area shall be considered in relation to the target use of the zone: 1. Similarity in scale, bulk, and coverage. The proposal is to remove three (3) antennas and replace with three (3) new. Two antennas are i located behind the center louver on the East side of the existing building; and one (1) antenna is located at the 9`h floor of the stairs tower. Behind the louver there will be 2 antennas removed and replaced with 2 new antennas. The existing antennas are 4' long and the new models are 6' long. Although they are taller than the existing antennas; once fitted, the antennas will have a Radio Frequency (RF) permeable canvas type material covering the antenna which will mimic the architecture of the existing louver. This material will not only be painted to match the existing building's color, but will also be designed to appear as matching construction. The existing co-axle cable trays will be used to run the cables to the associated equipment. i i At the 9t" floor of the stairs tower; one (1) 4' antenna will be removed and replaced with one (1) 6' antenna. This location is currently covered by an RF Transparent window. The existing RF Transparency will remain in place with no change. There will be no overall size increase to either of the proposed locations. 2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and mass transit use are considered beneficial regardless of capacity of facilities. The proposal is to upgrade an existing unmanned antenna facility. There will be no increased impacts on traffic and effects on surrounding streets. 3. Architectural compatibility with the impact area. The proposal is to replicate existing architecture and remain compatible with the existing conditions. 4. Air quality, including the generation of dust, odors, or other environmental pollutants. The proposal will not impact air quality, including the generation of dust, odors, or other environmental pollutants. 5. Generation of noise, light, and glare. i The proposal will not result in any increase in the generation of noise, light, and glare. 6. The development of adjacent properties as envisioned in the Comprehensive Plan. The proposal is upgrade an existing approved facility and will not impact the development of adjacent properties as envisioned in the Comprehensive Plan. 7. Other factors found to be relevant by the Hearing Authority for review of the proposed use. Three (3) equipment cabinets are proposed to be removed and replaced with two (2) new cabinets. The equipment area is currently located on the lower roof and visually obscured. The new cabinets will be located at the same location and will continue to be visually concealed. After review of the National Park Services 8 8 website we learned that the hotel was built 8 00 go in 1924-1925 just prior to the Great INVflog _ Depression. The hotel wasbuilt with the intention of it being a luxury hotel with 8 0 8 8 Q 8 first class accommodations. When the original plans ? for the hotel failed the Ligia Springs I was renamed as Mark Anthony in 1961 to capitalize on the Oregon Shakespeare Festival. In 1978 ill- fated renovation project contributed , to the down ward spiral and ' i i financial problems. In 1978 a new A{= owner came in and undertook extensive restoration of the 4. ` property. This renovation, under the National Parks Service's Certified Rehabilitation program for which 7j_ G4 s' the owners get a historic preservation tax credit, has returned .y the hotel to its original grandeur. It - - - - - is known now as the Ashland Springs Hotel but still has the old world charm it once had. In 2005-2006 a Memorandum of Understanding (MOU)was entered in between the Oregon State Historic Preservation Office, Mark Anthony Historic Property LLC, Nextel West Corp Inc, Us Cellular Operating Company of Medford, Washington Oregon Wireless Properties and Voicestream. This MOU included new antennas to be mounted outside of the existing structure. The MOU was signed by all parties and construction was approved. Crown Castle International in conjunction with Sprint intend on completing the same project description as in the original MOU. The proposed project includes the placement of three (3) new antennas. One (1) of the antennas will be on the northeast face to be hot swapped for side by side stage and use existing antenna and RRU pipe, two (2) of the antennas will be mounted on the Transparent Tower Top. A sketch of the proposed placement of antennas and equipment is shown to the right. GTI also received a copy of a Section 106 Review that was submitted to SHPO for a similar project in 2001. GTI received a copy of the SHPO response letter signed by Christine Curran stating "It appears that the proposed collocation will result in a "No Historic Properties Adversely Affected" determination under the conditions of the Memorandum of Agreement (MOA) is fully executed before any work may proceed." We believe that the proposed current project should fall under the same determination. Copies of the MOA and SHPO correspondence is attached to the document. The subject site is the existing Ashland Springs Hotel. The Ashland Springs Hotel (previously known as Mark Anthony Motor Hotel and Ligia Springs Hotel) has been listed on the National Register of Historic Places since March of 1978. After review of the National Park Services website we learned that the hotel was built in 1924-1925 just prior to the Great Depression. The hotel was built with the intention of it being a luxury hotel with first class accommodations. The building was designed by Touretellotte and Hummell entirely of reinforced concrete in an eclectic style with Romanesque, English Tudor, Gothic and Neo-Classical Revival elements. When the original plans for the hotel failed the Ligia Springs was renamed as Mark Anthony in 1961 to capitalize on the Oregon Shakespeare Festival. In 1978 ill-fated renovation project contributed to the down ward spiral and financial problems. In 1978 a new owner came in and undertook extensive restoration of the property. This renovation, under the National Parks Service's Certified Rehabilitation program for which the owners get a historic preseivation tax credit, has returned the hotel to its original grandeur. It is known now as the Ashland Springs Hotel but still has the old world charm it once had. In 2005-2006 a Memorandum of Understanding (MOU)was entered in between the Oregon State Historic Preservation Office, Mark Anthony Historic Property LLC, Nextel West Corp Inc, Us Cellular Operating Company of Medford, Washington Oregon Wireless Properties and Voicestream. This MOU included new antennas to be mounted outside of the y existing structure. The MOU was signed by all parties and construction was approved. Crown Castle International in conjunction with Sprint intend on completing the same a x~ project description as in the original MOU. No previously recorded archaeological or historic sites occur within the project area or the half mile radius of potential effect that would negatively impact the subject site. Finally, GTI notified the Tribal Historic Preservation Officers identified by the Federal Communication Commission (FCC) as having cultural affinity claims in this area and has not yet received any replies. The Confederated Tribes of the Grand Ronde Community of Oregon, Cow Creels Band of Umpqua Tribe of Indians, Siletz Tribal Council, Burns Paiute Tribe, Lamath Tribes, and the Yakaina. Nation were contacted in regards to this project. The appendix contains copies of the TCNS notification. Since thirty (30) days have not passed since the correspondence letters were sent, GTI is in the process of calling the Tribes to receive verbal confirmation. If any adverse responses are received, GTI will immediately contact the SHPO Office and an addendum Section 106 will be submitted. As a part of the archaeological study, a site file search was conducted within the database from the Oregon National Register List for Jackson County - Ashland as well as the Environmental Database Recovery (EDR) to determine the location and nature of any previously recorded archaeological sites, as well as to assess the level of previous archaeological work. No previously recorded archaeological or historic sites occur within the project area or the half mile radius of potential effect that would negatively impact the subject site. Finally, GTI notified the Tribal Historic Preservation Officers identified by the 5 Federal Communication Commission m (FCC) as having cultural affinity claims in this area and has not ' as yet received any s~ 5 8 3 IP 1L S > < replies. If any adverse responses are received, GTI will immediately contact the SHPO Office and an addendum Section 106 will be submitted. SUMMARY The proposed project for new telecommunication antennas to be located on the existing Ashland Spring Hotel roof top for the site known as Ashland Springs #874233, located at 212 East Main Street, Ashland, Jackson County, Oregon. It is known that the subject site, Ashland Springs Hotel (aka Mark Anthony Historic Property) has been listed on the National Register of Historic Places since 1978. An aerial photograph of the subject site is shown to the right. The Ashland Springs Hotel has had numerous alterations completed on the existing structure including telecommunication antennas back in 2001. A Memorandum of Understanding was completed between the Oregon State Historic Preservation Office, Mark Anthony Historic Property LLC, Nextel West Corp Inc, Us Cellular Operating Company of Medford, Washington Oregon Wireless Properties and Voicestream in 2005-2006. GTI and Crown Castle believe the proposed proj ect falls within the Memorandum.
