The property is zoned R-1-7.5, and slopes to the east-northeast at approximately ten percent. The property currently contains approximately 1,000 square feet of impervious surfaces on the lot consisting of patio space and small out buildings. Other than the subject tree, an existing Sycamore and small ornamental tree are placed along the north boundary line of the subject property. Morton Street is improved with curbs and gutters, but no sidewalks. The application is to remove a 19-inch D.B.H. Sweet Gum from the middle of the lot. The applicant's findings state there are broken limbs and. debris falling off of the tree, and poses a potential danger to the residences on either side of the tree if it were to fail. Additionally, the applicant asserts that future development is not possible with the tree in its present location. Due to the subject parcel being a vacant lot within the R-f zone,. and that the tree is defined as significant (greater than 18-inches D.B.H., a Tree Removal Permit-is required. i Staff conducted a site visit to inspect the tree. Although the tree appears to have not been maintained for sometime, it otherwise appears to be healthy. The Tree Commission at their February 7th meeting discussed the proposal, and noted that Sweet Gums are a species that has to be maintained throughout its life, and limb breakage is common of unmanaged Sweet Gums of this age, and is not necessarily indicative of being a hazard. Therefore the Commission did not feel the tree qualified as a hazard tree as proposed. The Commission also felt that without a development proposal, tree removal to make a lot more marketable is not the correct process, and therefore recommends denying the removal request. In staff's opinion, removal of the significant trees would have to go through the planning process whether development is proposed or not; and it would be onerous for the applicant apply for another tree PA 2013-00038 438 Morton SUMP Page 1 removal permit when development is finally proposed, especially when other Planning Actions are unlikely. However, in keeping with the spirit of the Commission's recommendation, staff conditions the request to not remove the tree until the issuance of a building permit. Mitigation shall also be required, but not until the issuance of a certificate of occupancy for the home. Removal of the Sweet Gum will not have a negative impact on erosion, soil stability, or flow of surface waters due to the parcel being relatively level. Nor will removal have a negative impact on the tree densities, sizes, canopies, and species diversity since the parcel is located in established neighborhood where many tree varieties are present in the surrounding area. Therefore, staff believes that the tree removal request meets the criteria of the ordinance and is approved to be removed following the conditions below. The criteria for a Tree Removal Permit are described in C Chapter 18.61.080, as follows: An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied The StaffAdvisor may require an arborist's report to substantiate the criteria for a permit. A Tree that is Not a Bazard.• The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards. (e.g. other applicable Site Design and Use Standards). The StaffAdvisor may require the building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. Planning Action 2013-00038 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2013- 0003 8 is denied. The following are the conditions and they are attached to the approval: i 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That the Sweet Gum shall not be removed until the issuance of a building permit. 3) Mitigation shall consist of planting a tree that equal or exceed the tree removed once mature on the lot prior to the issuance of a Certificate of Occupancy for the home. Tax Lot #10600 has always been a separate tax lot from #10500 but was part of that residence for many years. Tax lot #10500 was sold over a year ago and the sale did not include this tax lot nor the patio and/or other structures on it. So this tax lot is now considered a vacant lot in a residential neighborhood and the tree needs to be removed for the following reasons: II 1. This tree posses a potential danger and/or hazard to the residences and structures on either side of it. The tree is leaning toward the residence located at 43 8 Morton St., but because of it's height it would destroy either residence above or below. 2. Though the tree is alive there are broken limbs and debris that are currently breaking off and falling to the ground. This could cause a danger to anyone passing through this area. 3. Because of the tree's location, in the center of the lot, any current and/or future development of this lot is unattainable. 4. We are unable to obtain insurance on a vacant lot, so if something were to happen and someone or something is damaged by this tree we would personally be held liable and accountable.
