An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of

DECISION
The subject property is located on the east side of Helman Street, approximately 280 feet north of the
Orange Street intersection. The parcel is zoned R-1-5, approximately 32,600 square feet, slopes to east
at approximately nine percent, and has Ashland Creek running through the rear of the property.
Currently in place are the primary home, detached garage, and a small outbuilding located in the rear of
the property. Helman Street is improved with curbs and gutters, and curbside sidewalks along the
property's frontage.
The application is to remove a 14-inch D.B.H. Alder tree that is significantly leaning over Ashland
Creek. The applicant proposes to do this in two phases; the first of which is by removing the top of the j
tree. The applicant's findings assert that by removing the top of the tree will accomplish two goals; the
first is to preserve the riparian corridor as bank stabilization and fish habitat, while the other is to
preserve the life of the tree, albeit only temporarily, and to eliminate the potential hazard of the tree
falling onto the subject property. Also, removing only the top of the subject tree will also allow for
nearby Alder saplings to become more established, thus further stabilizing the bank from further erosion.
The Tree Commission at their February 7th meeting discussed the proposal, and noted that Alder's along
riparian areas tend to grow very fast, and often compete for resources. Therefore, the Commission
recommended removing the tree as proposed. Staff received one letter concerning the proposal, in which
they'asked the tree commission to deny the request. However in reading the letter, the neighbor seemed
to agree with the applicant's findings and intention to preserve the riparian habitat and ultimately the
integrity of the stream. In staff's opinion, removal of the Alder tree in phases preserves the riparian
corridor, while protecting property from the potential to fail onto the applicant's property. Due to many
trees being within the immediate vicinity of the property, mitigation shall not be required.

Removal of the Alder ixi-two phases will not have a negative impact on erosion, soil stability, or flow of
surface waters due to the remaining root structure currently holds a significant amount of bank in place. .
Nor'will removal have a, negative impact on the tree densities, sizes, canopies, and species diversity
since there are numerous tree species established along the stream corridor. Therefore, staff believes that
the tree removal request meets the criteria of the ordinance and is approved to be removed following the
conditions below.
The criteria for a Tree Removal Permit are described in AMC Chapter ~18.61.080, as follows: w
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied The
StaffAdvisor may require an arborist's report to substantiate the criteria for a permit.
A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates
that a tree is a hazard and warrants removal.
1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and
injure persons or property. A hazard tree may also include a tree that is located within public rights of way
and is causing damage to existing public or private facilities or services and such facilities or services
cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or
location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an
existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning.
2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC
18.61.084. Such mitigation requirements shall be a condition of approval of the permit.
Planning Action 2013-00055 is approved with the following conditions. Further, if any one or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2013-
00055 is denied. The following are the conditions and they are attached-to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified
here.

CALL TO ORDER -Ashland Tree Commission meeting was called to order at 6:00 P.m. on January 3,
2013, in the Siskiyou Room in the Community Development and Engineering Services Building located
at 51 Winburn Way, Ashland, Oregon.

DESCRIPTION: A request for a Tree Removal Permit approval to remove a 19-inch diameter
at breast height Sweet Gum tree placed on a vacant lot located between 430 and 438 Morton Street

Pina presented the staff report. Site visits were conducted by all. Although the subject tree appears to have
not been maintained for 'some time, it otherwise appears to be healthy. The Commission discussed the
proposal, and noted that Sweet Gums are a species that has to be maintained throughout its life, and limb
breakage is common of unmanaged Sweet Gums of this age, and is not necessarily indicative of being a
hazard. Therefore the Commission did not feel the tree qualified as a hazard tree as proposed. The
Commission also felt that without a development proposal, tree removal to make a lot more marketable is
not the correct process, and therefore recommends denying the removal request.

DISCUSSION ITEMS
The Commission discussed upcoming Arbor week events and the need to identify a school/organization to
donate a tree to. Perhaps this year, the Commission opens up the selection process to the individual
schools as an essay contest. Peddicord would develop a press release to notify the schools/organization of
the contest.

Subject Property 468 Helman Street
Thank you for the opportunity to comment on this proposed action.
Alder, especially large stems, are an excellent riparian shade and a source of coarse
woody material for recruitment into the stream. With the growing awareness of
riparian values and current efforts to restore fish habitat in Ashland Creek, I would
ask that the Commission deny the application. Since the tree leans over the creek
and away from the applicant's house, there is no compelling need to conduct the
work.
Irrespective of the decision, I would ask that the Commission remind the applicant
of the positive aspects of having a mature hardwood canopy over this stream.
Breakage and falling into the stream channel help stabilize the stream in the long
term and provide pooling, riffles, hiding, and support macro-invertebrate life that I
support the fish.
The Commission could please at the same time remind the applicant to keep the
sidewalk clear in front of his house. His plantings have made foot traffic difficult and
dangerous, especially for seniors who must rely on the sidewalk on this narrow
stretch of Helman Street. The Ashland Municipal Code addresses landowner
responsibility for maintaining pedestrian right-of-way. This property is not alone in
landowner negligence on Helman Street. I hope that the appropriate City body can
act to remind landowners to make their sidewalks fully accessible to those with
disabilities.
In summary, please don't prune the Creek, and please clear the sidewalk.

TREE REMOVAL
18.61.080 Criteria for Issuance of Tree Reme - Staff Permit
An applicant for a Tree Removal Permit shall demonstrate that the following criteria are satisfied. The Staff Advisor may require an arborist's
report to substantiate the criteria for a permit.
A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and
warrants removal.
1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A
hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or
services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or
location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such
hazard or danger cannot reasonably be alleviated by treatment or pruning.
2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such mitigation
requirements shall be a condition of approval of the permit.
B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the
following:
1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land U.se Ordinance
requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental
Constraints. The Staff Advisor may require the building footprint of the development to be staked to allow for accurate verification of the
permit application; and
2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent
trees, or existing windbreaks; and
3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200
feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered
and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the
residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider
alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees, so long as the
alternatives continue to comply with other provisions of the Ashland Land Use Ordinance.
4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61.084. Such
mitigation requirements shall be a condition of approval of the permit.

Application for artial Tree Removal @ 466 Heiman Street within the Water
Resource Protection Zone

Proposal
To top at between 10 and 15 feet in height an alder of approximately 14 inches dbh
along Ashland Creek that is leaning approximately 30 degrees out of plumb.
Since the tree shows no signs of budding out while the other alders in the vicinity are full
of catkins, it could be argued that the tree is dead. Closer examination shows that the
lower branches of the tree show signs of life, but due to its distressed condition, it is
slow to respond to the normal budding time. The upper portion of the tree, although not
accessible for direct observation, does not appear to be alive.
The reason for topping is to lengthen the life of the tree. Due to the lean of the tree and
with one side of the roots exposed and undercut by the Creek, the tree if left alone
would be expected to fall within a year. By removing the top, a great deal of weight and
leverage would be removed, slowing its inevitable toppling, and thus prolonging the life
of the tree. The cut would be made above several viable branches.
The tree's land side roots are currently holding a significant amount of bank in place.
Prolonging the life of the tree will maintain the bank integrity. There are nearby saplings
and if the tree remains in place for a few more years, these saplings would have time to
take the topped tree's place holding the bank in place. If the tree falls, the saplings are
likely to be damaged or killed. And prolonging the trees life means its root system will
continue to provide bank stabilization. The proposed action would be expected to
maintain the general topography more so than taking no action.

The tree currently leans directly over the landowner's picnic area, bench and creek
gathering place, thus it also constitutes a hazard.

The work would be done with a chainsaw. No other equipment would be used. All clean
up within the Water Resource Protection Zone would be done with a chainsaw and by
hand. No vegetation would be removed by the proposed activity. It is unlikely that any
vegetation would be significantly damaged as the area across the creek into which the
tree would fall consists mainly of large trees with little understory.
The tree is entirely on landowner's property and would fall entirely onto the landowner's
property.
The included photos are 1) of a close-up of the exposed roots and 2) of the entire tree
in foreground (the other leaning trees in the background are hung up in trees across the
creek, slowing their fall).
