PERMANENT BRIDGE EASEMENT
1. Grant of easement.
THE GRANTORS, Lloyd M. Haines; Mark S. Haines, and Lezlie Haines,
trustees of the Haines Family Trust; Gail R. Bleeker, trustee of the Gail R.
Bleecker Trust; and Judith R. Ginsburg-Brown, trustee of the Ginsburg-Brown
Loving Trust, their heirs of assigns, for and in consideration, of ten and no/100 dollars
($10.00), the receipt of which is hereby acknowledged and in further consideration of
the general public welfare and of the particular and special benefits accrued therefrom,
do by these presents grant and convey to,the City of Ashland, a municipal corporation
of the State of Oregon, Grantee, for the use of the public, an easement and privilege to
construct and maintain a bridge end-wall support structure along, across, and upon the
following described real property situated in the City of Ashland, together with the right
to enter upon said premises at any time with all necessary men, material, and
equipment for the purposes of constructing, inspecting, repairing, and maintaining the
same to wit:
See exhibit 'A' and 'B' attached hereto and incorporated by reference and made
part of this document as though fully incorporated herein.
2. Use of surface.
Grantor shall have the right to use the easement area for all purposes not
inconsistent with the uses and purposes of this easement, provided that Grantor shall
not build or erect any structure upon the easement area without the prior written
consent of Grantee.
3. Notice.
Grantee, its agents, independent contractors and invites shall, upon each
occasion that such bridge end-wall.is constructed, maintained, inspected, repaired,
reconstructed, or removed, provide grantors reasonable notice and shall restore the
premises of the Grantors as near to its original condition as.practicable.
4. Indemnification.
To the extent permitted by the Oregon Constitution; the City's charter, and within
the limits of the Oregon Tort Claims Act, the City shall defend and indemnify Grantor

against any liability for damage to life or property arising from the public's use of the
easement under this agreement. The City shall not be required to indemnify Grantor for
any such liability arising out of wrongful acts of the Grantor or the employees or agents .
of the Grantor.
5. Termination.
All rights hereunder shall cease if and when the easement area ceases to be
used for the specified purpose.
6. Prior Encumbrances.
This easement is granted subject to all prior easements or encumbrances of
record.

A permanent bridge easement over and through the following described tract:
BEGINNING AT the southwest corner of that tract described in Instrument Number 90-13239 of
the Official records of Jackson County, Oregon, located in the Northwest Quarter of Section 9,
Township 39 South, Range 1 East of the Willamette Meridian, in the City of Ashland, Jackson
County, Oregon, said corner also being a point on the northeasterly right of way line of Main
Street; thence North 32°30' East, along the southerly line of said tract, a distance of 3.39 feet, to
a point 3.00 feet northeasterly of, when measured at right angles to said northeasterly right of
way line; thence leaving said southerly line, North 29°50' West, 3.00 feet northeasterly of and
parallel to said right of way line, a distance of 39.72 feet, to a point on the southerly face of an
existing building; thence south 60°10' West, along said southerly face and its southwesterly
extension, a distance of 3.00 feet, to a point on said right of way line; thence South 29°50' East,
