AGREEMENT
This agreement made this 6 day of J„ng , 19_=, by and
between the City of Ashland,herein designated as the City, and the State of
Oregon, acting by and through the State Board of Higher Education for Southern
Oregon College, herein designated as the College.
Whereas it is the desire of the City to use swimming facilities for
limited use ir the Summer Recreation Program and whereas it is. the desire of
the College to cooperate in making its facilities available for this program,
now therefore:

I. Witnesseth:
1. Property leased: For and in consideration of these premises herein
contained, and all of the conditions, obligations, and commitments mutually

and respectively called for, the College does herewith allow the City to use
the Southern Oregon College pool, and the City does herewith accept and rent,

! for the period June 21, 1971 through July 30, 1971, for the days Monday
i
through Friday, approximately 10 hours per week to be scheduled. (See
attached schedule.)

2. Obligations of the College: The College agrees to provide the

dressing rooms and swimming pool at the above described address to include
i
the following:
a. Dressing room, locker and shower facilities but not to include
swimming suits or towels.
b. Swimming pool, related deck areas.
c. All utilities, under this agreement., to include heat, light and water.
d. Personnel for general building cleanliness but not to include any
i
person.involved in supervision of the locker room or the swimming

program. The pool manager, however, will be a person mutually
satisfactory to both parties.
i 3. Obligation of the City: The City will receive and care for all
t buildings and furnishings herein stated and will return to the College such
facilities in good condition with no more than reasonable wear to be, expected
to take place while in normal use during the daily instructional program.
In addition, the City will:
a. Provide all personnel for supervision of the locker rooms,
instruction of students, and other supervisory personnel as
' designated by the aquatics director.
b. Provide an adequate number of qualified lifeguards at all
times to give appropriate protection to those involved in

the program.

c. Provide appropriate liability insurance protection to all
participants in the swim program.
d. Provide appropriate liability insurance insuring third persons
i
against the negligent acts of the City of Ashland duly appointed
officials and employees acting in their official capacity as such.
e. Provide all instructional equipment to include kick boards, buoys,
ropes, etc. Exceptions to this provision must be cleared through
the Aquatic Director of the College.

f. Reimburse the College for any damage to building or equipment

j committed by participants in the swimming program.
f g. Provide an aquatics director who has faculty status in the Division
of Health and Physical Education and who has the approval of the

3 chairman of this division at the College.

h. Schedule use of pool in advance of publication with the adminis-
tration and the division chairman of the College.
4. Rental: The rental price for use of the above facilities with the
condition herein stated shall be $50.00 per day for the 6-week period or a
total of $1,500.00 for the summer, payable by the City to the College not later
than August 15, 1971.
IN WITNESS WHEREOF, the parties have duly executed this agreement this
day and year first written above.
