ASHLAND STREET TREE EASEMENT
1. Upon the following terms and conditions, Grantor grants to Grantee a perpetual easement for the
planting, care, maintenance and replacement of three trees on the land described below ('~ree
easement area").
2. The tree easement area is described as that portion of frontage of Grantor's property abutting
Ashland Street necessary to adequately plant, care and maintain the number of trees specified
above. The tree easement area shall not exceed five feet in length or width for each tree as
measured from or along the right-of-way line of Ashland Street. This grant of easement is subject to
all existing easements and rights-of-way of record. Grantor's property is within the City of Ashland,
Jackson County, Oregon and is described as:

3. This grant of easement shall be binding upon, and shall inure to the benefR of, Grantor and its
successors and assigns and Grantee and its assigns.

Commencing at a 1' pipe with 2~/~ "bronze cap monumenting the southeast corner of Donation
Land Claim No. 45 in Township 39 South, Range I East of the Willamette Meridian in Jackson
County, Oregon; thence North 0° 06' 06' East, along the east boundary of said Claim 1682.67 feet,
thence North 89° 38' 54' West 1150.63 feet to a found ~/~' iron pipe, thence North 89° 23' 38' West
115.0 feet to a q/a" iron pin and the true point of beginning; thence continue North 89° 23' 36' West
114.49 feet to a ¥,' iron pin set on the east line of Walker Avenue in the City of Ashland; thence
South 00° 11' 19' East, along said east line, 143.48 feet to a %' iron pin; thence continue South 00°
11' 19" East to a point which bears North 00° 11' 19' West 25.0 feet from the center line of the
Pacific Highway (now highway No. 66) pavement; thence South 89° 23' 45' East (record South 89°
26' East) 114.49 feet to a point which bears North 00° 11' 19' West 25.0 feet from the center line of
said Pacific Highway pavement; thence North 00° 11' 19" West 143.48 feet to the true point of
beginning.
