COMPREHENSIVE PLAN DESIGNATION: Commercial; ZONING: C-1; ASSESSOR'S MAP/TAX LOT(S): 39 lE 14A 2801 SUBMITTAL DATE: March 1, 2013 DEEMED COMPLETE DATE: March 11, 2013 STAFF APPROVAL DATE: April 3, 2013 APPEAL DEADLINE DATE: April 15, 2013 FINAL DECISION DATE: April 16, 2013 APPROVAL EXPIRATION DATE: April 16, 2014 DECISION: The subject parcel is a 23,654 square foot commercially zoned lot utilized as an ARCO service station, located at the southwest corner of Ashland Street and the southbound I-5 Freeway on- ramp. The site currently consists of a 1,800 square foot convenience store, a 1,176 square foot canopy, four dispenser pumps, and two small storage sheds placed at the rear of the property. The site is currently covered with 17,648 square feet of impervious surfaces, with the remaining 6,006 square feet in landscaping; all of which is located on the east side of the property. Twelve parking spaces are also located on the east side of the lot, and six trees have a DBH of six-inches or greater. Ashland Street, -an Arterial,. is fully improved to City and State Standards with the recent completion of Oregon Department of Transportation's (ODOT) freeway interchange proj ect. Recent improvements to Ashland Street now prohibit a left turn into the station heading westbound. Currently, the fuel tanker backs out onto Ashland Street with the assistance of employees flagging and stopping traffic. This practice has been deemed unsafe and unacceptable by BP West Coast. Therefore the application proposes to remove 2,235 square feet of landscaping and replacing it with asphalt pavement to allow for the fuel tanker to pull through the site, and loop around exiting the site in a forward manner. In doing so, the parking configuration will be modified; various outbuildings, trash enclosure, and mechanical systems will be relocated; and.the landscaping will be improved. The project does not propose to modify the convenience store or canopy structure;. or make changes to the existing driveway approaches. Ashland Municipal Code (AMC) 18.72.030.A.1.e states that "Expansion of parking lots, relocation of parking spaces on a site, or other changes which alters or affects circulation on adjacent property or a.public right-of-way'.' is subject to a Site Review Permit. The property's location has some of Ashland's highest design standards, and is subject to Basic Site Review, Detail Site Review, and Ashland Boulevard Corridor design standards. Due to the PA 42013-00266 2380 Ashland SUMP Page 1 nature of the business being a service station and its proximity to the freeway, the site and structure is somewhat unique not able to fully comply with a number. of design standards, therefore considered somewhat non-conforming with the underlying zoning overlays. Therefore landscaping and drainage treatments are heavily depended upon in reviewing the application. Now that the freeway interchange project is complete, staff finds that additional site improvements to the Ashland Street Corridor will not be required. Based on the 1,800 square foot convenience store, a total of five parking spaces are required, including one van accessible. The application proposes to retain two parking spaces immediately cast of the building, although re-orient the ADA space; and install the remaining three parking spaces within the `tanker loop' area east of the building. All parking stalls meet the standard size requirement of 9 by 18 feet, and complies with setback requirements of the Site Design and Use . Standards. In addition, two Green Vase Zelkova trees and other landscaping will be planted in two new landscape areas adjacent to the parking locations, exceeding shade requirements of one tree per seven parking stalls. Plus,, a 54-foot long, four-foot wide bio-swale along the northeastern edge of the parking lot to capture and infiltrate surface run-off will also be installed. Following development, site and parking lot landscaping will exceed 15 percent coverage. The applicants also propose to remove two Cedars with a DBH of six-inches or greater, and two below six-inches. Although the Tree Commission did not review the proposal, the applicant has proposed mitigation by planting four Western Red Cedars, in addition to reed grasses, Oregon Grape, and other ground coverings. Water conservation standards will also be employed. Staff feels that although the reduction of landscaping is necessary, the overall improvement in the quality of landscaping will be greatly improved on site, and meets the minimum requirement of the Site Design and Use Standards. The application also proposes to relocate the trash enclosure and storage building to the rear of the property. The applicant's findings assert that fire code for structures adjacent to property lines will be followed and incorporated into the design. The applicant has also recently obtained a new sign permit for the rebranding of the service station, and is currently in compliance with the Sign Code. In staff's view,. the applicant has made every attempt to mitigate the increase of pavement by improving the quality of landscaping adjacent to the parking areas and mitigating surface drainage through bio-swales and other natural features. Therefore, proposed garage meets the requirements of the Site Review chapter of the Ashland Municipal Code and Site Design and Use Standards. The criteria for Site Review approval are described in AMC Chapter 18.72.070 as follows: A. All applicable City ordinances have been met or will be met by the proposed development. B. All requirements of the Site Review Chapter have been met or will be met. C. The development complies with the Site Design Standards adopted by the City Council for implementation of this Chapter. NOTE. The following sections of the Site Design and Use Standards must be addressed in the written findings. OR 66 - Green Springs Highway). It's my understanding that the proposed site plan does not modify the existing road approaches (i.e. driveways) accessing Ashland Street. The site plan design shows truck off -tracking over curb, gutter and sidewalk. Any damage caused to the existing sidewalk, road approach or any appurtenance within the state highway right-of-way will be at the cost of the property owner. We recommend the following conditions of approval. 1. The applicant shall be responsible for any repair to curb, gutter and sidewalk within the state highway right-of-way. This being a direct cause from the newly designed off-tracking of vehicles as they enter and exit the site. 2. The Interstate 5 right-of-way fence shall be a minimum one (1) foot off the right-of-way line onto the applicant's property. 3. Enclosed please find the following application materials: 1. Completed Zoning Permit application 2. Two (2) Copies of Site Plan, Landscape and Irrigation Plans 11x17 format 3. Check in the amount of $1,207.00 ($982 plus .5% of $45,000=$225) 4. Two (2) copies of this transmittal letter containing a narrative of the project and findings of fact analysis of the code and ordinance compliance. Purpose of Application: This application is to allow a modification to permit existing site improvements, paving, landscaping, structure relocation, and demolition of unused structures, for the fuel tanker to access the site, u-turn and egress the site using a forward movement. Currently the tanker backs out onto Ashland Ave. with the assistance of the site employees flagging. This practice is deemed unacceptable for obvious safety reasons. The site plans submitted contains the necessary information on the required site data and following is an analysis of the site as required by the Site Review application: 18.32 C-1 Zoning/18.56 PP Pedestrian Overlay zone: The site is zoned C-1 in a (PP) Pedestrian Places Overlay zone, Ashland Corridor Ave a truck to the Pre-App business and C-1 n to the south surrounded by C- I used as 1 zoning to the west currently used as office. 18.32.025 Use: The use is an existing use in accordance with 18.32.025 C, however the Freeway Overlay zone is no longer shown in the current municipal code. It appears that the overlay may have changed to PP, rendering the site an existing non-conforming use. (B) Height no building structure proposed to be greater than 40 feet. No modification to these existing conditions is proposed. 18.92.080 Parking, Access and Circulation Design: Based on our square footage of 1800 square feet, 5 spaces are required and have been provided. The plans demonstrate compliance with the dimensions for stall size, aisle spacing and location. The accessible space was reconfigured to current standards and was placed to avoid surface obstructions. We are not proposing changes to the existing driveways as the tanker path was modified and demonstrated that safe egress could be accomplished without driveway modification. The curbing however was pulled back on site slightly to avoid deterioration from other users. SDUS Section II - Landscaping Requirements: Landscape area will exceed the 15% required by the SDSU despite the loss of nearly 2000 square feet. Additionally all parking areas will have a minimum of five feet of landscaping buffers between the space and the property line. All existing areas contain mature and established coverage and some modifications to existing areas are proposed. Four trees are proposed to be removed, some of which are not trees, but rather junipers. These trees will be replaced with four trees that meet the standards of this section of the SDUS. A tree removal permit will be sought for the removed trees. Shade trees for the parking areas meet the standard of one per seven stalls. Street trees in the modified areas are provided at a quantity of 8 for 136 feet of linear street frontage. Water conservation standards will be employed. 18.96 Sign Regulations: No sign changes are proposed. SDUS Section II Building Regulations: As we are not proposing new building area but simply relocating the accessory structure behind the building, we assume that compliance with the requirements of the SDSU will not be mandatory. We are proposing the construction of a wall on the south line to provide fire separation per the building code. Utilities: No changes are proposed to the existing utilities. Site Design Review Approval Criteria Written findings addressing compliance with the criteria in Chapter 18.72: A. All applicable City ordinances have been met or will be met by the proposed development. Response: To the best of our knowledge all applicable city ordinances have been met or will be met based on our above analysis. B. All requirements of the Site Review Chapter have been met or will be met. Response: To the best of our knowledge all requirements of the Site Review have been met or will be met based on our above analysis C. The development complies with the Site Design Standards adopted by the City Council for implementation of this Chapter. Response: The proposed improvements comply with the Site Design Standards with one exception, which is explained in the written findings required for an Exception to Chapter 18.72.090. D. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. All improvements in the street right-of-way shall comply with the Street Standards in Chapter 18.88, Performance Standards Options Response: No change in existing City facilities will be required nor are there any changes proposed to the utilities. Ashland Ave was recently improved by the ODOT project and requires no changes. Written findings addressing findings required for an Exception to standards in Chapter 18.72.090: A. There is a demonstrable difficulty in meeting the specific requirements of the Site Design and Use Standards due to a unique or unusual aspect of an existing structure or the proposed use of a site; and approval of the exception will not substantially negatively impact adjacent properties; and approval of the exception is consistent with the stated purpose of the Site Design and Use Standards; and the exception requested is the minimum which would alleviate the difficulty; or i Response: We are requesting an 18.72.090 Exception to the Site Design and Use Standards because the building is remaining in its existing condition, so there is a demonstrable difficulty in meeting the specific requirements of the SDUS. The existing building is in conformance with the then-existing design standards in place when it was approved, and requiring additional modifications to the building itself constitutes an unusually heavy burden of cost not commensurate with a scope of parking lot landscape and hadscape improvements to increase on-site delivery safety. Approval of the exception will not substantially negatively impact adjacent properties because the building's orientation, setback, height, materials and finishes, crime prevention through environmental design features and other current conditions largely conform to the design intent as described in the SDUS; approval of the exception is consistent with the stated purpose of the SDUS; and the exception requested is the minimum which would alleviate the difficulty. B. There is no demonstrable difficulty in meeting the specific requirements, but granting the exception will result in a design that equally or better achieves the stated purpose of the Site Design and Use Standards. Response: There is a demonstrable difficulty in meeting the specific requirements of the SDUS, as explained above. But because the building's orientation, setback, height, materials and finishes, crime prevention through environmental design features and other current conditions largely conform to the design intent as described in the SDUS, the result is a design that equally achieves the stated purpose of the SDUS Standards. Written findings required for a Tree Removal request in Chapter 18.61.080: A. Hazard Tree: The Staff Advisor shall issue a tree removal permit for a hazard tree if the applicant demonstrates that a tree is a hazard and warrants removal. 1. A hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely to fall and injure persons or property. A hazard tree may also include a tree that is located within public rights of way and is causing damage to existing public or private facilities or services and such facilities or services cannot be relocated or the damage alleviated. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard or a foreseeable danger of property damage to an existing structure and such hazard or danger cannot reasonably be alleviated by treatment or pruning. 2. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to AMC 18.61.084. Such mitigation requirements shall be a condition of approval of the permit. Response: No trees have been proposed to be removed because they are deemed a hazard. Mitigation is not required because no trees deemed hazards are proposed to be removed. B. Tree that is Not a Hazard: The City shall issue a tree removal permit for a tree that is not a hazard if the applicant demonstrates all of the following: 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Ashland Land Use Ordinance requirements and standards, including but not limited to applicable Site Design and Use Standards and Physical and Environmental Constraints. The Staff Advisor may require the. building footprint of the development to be staked to allow for accurate verification of the permit application; and 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks; and 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. Nothing in this section shall require that the residential density be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures or alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with other provisions of the Ashland Land Use Ordinance. 4. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to AMC 18.61.084. Such mitigation requirements shall be.a condition of approval of the perm it.
