Notice of Final Decision
On March 6, 2014, the Community Development Director approved the request for the following:
Planning Action: PA-2014-00132
Subject Property: 2 Bush Street
Applicant: David Collings
Description: A request for a Conditional Use Permit approval to utilize a 704 square
foot residential unit (Unit C) as a one-unit Travelers Accommodation, with the owner residing
on-site in the main residence (Unit A) located at 2 Bush Street. COMPREHENSIVE PLAN

The Community Development Director's decision becomes final and is effective on the 13`h day after the
Notice of Final Decision is mailed. Approval is valid for a period of one year and all conditions of
approval identified on the attached Findings are required to be met prior to project completion.
The application, all associated documents and evidence submitted, and the applicable criteria are
available for review at the Ashland Community Development Department, located at 51 Winburn Way.
Copies of file documents can be requested and are charged based on the City of Ashland copy fee
schedule.
Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a
reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO)
18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in ALUO
18.108.070(B)(2)(c). The ALUO sections covering reconsideration and appeal procedures are attached.
The appeal may not be made directly to the Oregon Land Use Board of Appeals.

SECTION 18.108.070(B)2 Effective Date of Decision and Appeals.
B. Actions subject to appeal:
2. Type I Planning Actions.
a. Effective Date of Decision. The final decision of the City for planning actions resulting from the
Type I Planning Procedure shall be the Staff Advisor decision, effective on the 13th day after
notice of the decision is mailed unless reconsideration of the action is approved by the Staff
Advisor or appealed to the Commission as provided in section 18.108.070(B)(2)(c).
b. Reconsideration. The Staff Advisor may reconsider Type I planning actions as set forth below.
i. Any party entitled to notice of the planning action, or any City Agency may request
reconsideration of the action after the decision has been made by providing evidence to the
Staff Advisor that a factual error occurred through no fault of the party asking for
reconsideration, which in the opinion of the staff advisor, might affect the decision.
Reconsideration requests are limited to factual errors and not the failure of an issue to be
raised by letter or evidence during the opportunity to provide public input on the application
sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a
decision.
ii. Reconsideration requests shall be received within five (5) days of mailing. The Staff Advisor
shall decide within three (3) days whether to reconsider the matter.
iii. If the Planning Staff Advisor is satisfied that an error occurred crucial to the decision, the
Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor
shall decide within ten (10) days to affirm, modify, or reverse the original decision. The Staff
Advisor shall send notice of the reconsideration decision to affirm, modify, or reverse to any
party entitled to notice of the planning action.
iv. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff
Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties
that requested reconsideration.
c. Appeal.
i. Within twelve (12) days of the date of the mailing of the Staff Advisor's final decision,
including any approved reconsideration request, the decision may be appealed to the Planning
Commission by any party entitled to receive notice of the planning action. The appeal shall be
submitted to the Planning Commission Secretary on a form approved by the City
Administrator, be accompanied by a fee established pursuant to City Council action, and be
received by the city no later than 4:30 p.m. on the 12th day after the notice of decision is
mailed.
ii. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing
shall be refunded. The fee required in this section shall not apply to appeals made by
neighborhood or community organizations recognized by the city and whose boundaries
include the site.
iii. The appeal shall be considered at the next regular Planning Commission or Hearings Board
meeting. The appeal shall be a de novo hearing and shall be considered the initial evidentiary
hearing required under ALUO 18.108.050 and ORS 197.763 as the basis for an appeal to the
Land Use Board of Appeals. The Planning Commission or Hearings Board decision on appeal
shall be effective 13 days after the findings adopted by the Commission or Board are signed
by the Chair of the Commission or Board and mailed to the parties.
iv. The appeal requirements of this section must be frilly met or the appeal will be considered by
the city as a jurisdictional defect and will not be heard or considered.

DECISION
The subject property is located on the alley portion of Bush Street, between North Main Street
and Central Avenue, and is within the Skidmore Academy Historic District. The approximately
6,790 square foot parcel contains a 3,000 square foot duplex, plus 704 square foot cottage and
attached garage behind (east) of the primary dwelling. According to our records, the property has
long been a three-unit, long-term rental prior to our modern zoning ordinances. A letter in the file,
notes that there is a "'minor' parking deficit at this location, but the grandfathered nature of the
property renders the property suitable for the continued use as a three-unit dwelling".
The application proposes to utilize only one of the three existing units, Unit C, as a Travelers
Accommodation unit, with the owner residing on-site in Unit A. In accordance with Ashland
Municipal Code 18.24.030.K, the property owner is required to live on-site, the structure be at
least 20 years old, be within 200 feet of an arterial or collector, provide a parking space per each
unit, plus two for the owners unit, and have an average area of 400 square feet per unit.
The maximum number of units allowed is calculated by dividing the total square footage of the
lot by 1800. This would allow up to four units (6,790/1800 = 3.77), however in this case, the
applicant is requesting to convert just one of the units into a travelers' accommodation. The
applicants have submitted materials to the Planning Department that demonstrated compliance
with the approval criteria within the Conditional Use Chapter of the Ashland Municipal Code,
including being within 200 feet of an arterial street, age requirements, owner occupancy, as well
as other pertinent information addressing the approval criteria noted in AMC 18.28.030.
Two off-street parking spaces are required for the primary dwelling, plus an additional parking
space for each accommodation unit. Unit B, which listed as approximately 342 square feet,
would require one additional space, for a total of four parking spaces required on-site. The

applicant's findings note there are currently two spaces provided within in the garage, one
outside, adjacent (east) of the garage, and one on-street.
The Historic Commission at their March 5, 2014 regular meeting had no recommendations
regarding the proposal, therefore approved the application as submitted. No exterior
modifications are proposed; thus, the proposed use will be architecturally compatible with the
surrounding neighborhood. Adequate capacity for water, sanitary sewer, storm drain and electric
facilities are already in place. The property has established landscaping and irrigation is in place
a-ad is in good condition. This portion of Bush Street is an alley with an average width of
approximately 17 feet. North Main Street, which is approximately 80 feet to the west, is
classified as an Arterial street, and is improved with curb-side sidewalks, curbs, and gutters.
In summary, given the predominant location of the property, and long established triplex use
with limited parking, staff believes utilizing one of-the existing units as a single Traveler's
Accommodation would lessen the overall parking demand by one to two vehicles, and will likely
result in more pedestrian activity. Therefore, staff believes the operation of a Traveler's
Accommodation will not have an adverse impact on the neighborhood. Additionally, with no site
modifications proposed, the change in use will have little effect on the existing development
pattern in establish historic neighborhood. Staff finds that the request for a two-unit Traveler's
Accommodation meets the approval criteria of the Ashland Municipal Code.
Approval Criteria for a Conditional Use Permit (18.104.050):
A. That the use would be in conformance with all standards within the zoning district in which the use is proposed to
be located, and in conformance with relevant Comprehensive plan policies that are not implemented by any City,
State, or Federal law or program.
B. That adequate capacity of City facilities for water, sewer, paved access to and through the development,
electricity, urban storm drainage, and adequate transportation can and will be provided to and through the
subject property.
C. That the conditional use will have no greater adverse material effect on the livability of the impact area when
compared to the development of the subject lot with the target use of the zone. When evaluating the effect of the
proposed use on the impact area, the following factors of livability of the impact area shall be considered in
relation to the target use of the zone:
1. Similarity in scale, bulk, and coverage.
2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and mass transit
use are considered beneficial regardless of capacity of facilities.
3. Architectural compatibility with the impact area.
4. Air quality, including the generation of dust, odors, or other environmental pollutants.
5. Generation of noise, light, and glare.
6 The development of adjacent properties as envisioned in the Comprehensive Plan.
7. Other factors found to be relevant by the Hearing Authority for review of the proposed use.
Approval criteria for a Travelers' Accommodation (18.24.030K):
1. That all residences used for travelers accommodation be business-owner occupied. The business-owner shall
be required to reside on the property occupied by the accommodation, and occupancy shall be determined as
the travelers' accommodation location being the primary residence of the owner during operation of the
accommodation. "Business-owner" shall be defined as a person or persons who own the property and
accommodation outright; or who have entered into a lease agreement with the property owner(s) allowing for the
operation of the accommodation. Such lease agreement to specifically state that the property owner is not
involved in the day to day operation or financial management of the accommodation, and that the business-

owner is wholly responsible for all operations associated with the accommodation, and has actual ownership of
the business. (ORD 2806 S1, 1997)
2. That each accommodation unit shall have 1 off-street parking space, and the owners shall have 2 parking
spaces. All spaces shall be in conformance with the requirements of the Off-Street Parking section of this Title.
3. That only one ground or wall sign, constructed of a non-plastic material, non-interior illuminated of 6 sq. ft.
maximum size be allowed. Any exterior illumination of signage shall be installed such that it does not directly
illuminate any residential structures adjacent or nearby the travelers' accommodation in violation of 18.72.110.
4. That the number of accommodation units allowed shall be determined by the following criteria:
a. That the total number of units, including the owner's unit, shall be determined by dividing the total square
footage of the lot by 1800 sq. ft. Contiguous lots under the same ownership may be combined to increase
lot area and the number of units, but not in excess of the maximum established by this ordinance. The
maximum number of accommodation units shall not exceed 9 per approved travelers' accommodation with
primary lot frontage on arterial streets. The maximum number of units shall be 7 per approved travelers'
accommodation with primary lot frontage on designated collector streets; or for travelers' accommodations
not having primary frontage on an arterial and within 200 feet of an arterial. Street designations shall be as
determined by the Ashland Comprehensive Plan. Distances shall be measured via public street or alley
access to the site from the collector or arterial.
b. Excluding the business-owner's unit and the area of the structure it will occupy, there must be at least 400
sq, ft, of gross interior floor space remaining per unit.
5. That the primary residence on the site be at least 20 years old. The primary residence may be altered and
adapted for travelers' accommodation use, including expansion of floor area. Additional structures may be
allowed to accommodate additional units, but must be in conformance with all setbacks and lot coverages of the
underlying zone.
6. Transfer of business-ownership of a travelers' accommodation shall be subject to all requirements of this
section, and subject to Conditional Use Permit approval and conformance with the criteria of this section. All
travelers' accommodations receiving their initial approvals prior to the effective date of this ordinance shall be
considered as approved, conforming uses, with all previous approvals, conditions and requirements remaining in
effect upon change of business-ownership. Any further modifications beyond the existing approvals shall be in
conformance with all requirements of this section.
7. An annual inspection by the Jackson County Health Department shall be conducted as required by the laws of
Jackson County or the State of Oregon. (Ord. 2776 S1, 1996)
8. That the property on which the travelers' accommodation is operated is located within 200 feet of a collector or
arterial street as designated in the City's Comprehensive Plan. Distances shall be measured via public street or
alley access to the site from the collector or arterial.
The application accompanied by the attached conditions meets all applicable criteria for Site
Review approval and a Conditional Use Permit for reconstruction of a non-conforming building.
Planning Action PA-2014-00132 is approved with the following conditions. Further, if any one
or more of the following conditions are found to be invalid for any reason whatsoever, then
Planning Action PA-2014-00132 is denied. The following are the conditions and they are
attached to the approval:
1) That all proposals of the applicant be conditions of approval unless otherwise modified
here.
2) That the approval shall be for one guest unit, one long-term unit, and one owner's unit
only; and that any future expansion of accommodation units, changes of business
ownership or manager-occupancy, or other modifications to the original proposal shall be
subject to the conditional use permit procedure.

3) That the business owner shall obtain a City of Ashland business license prior to operation
of the travelers' accommodation.
4) That only one wall or ground sign is permitted onsite in conjunction with the Traveler's
Accommodation. The sign shall be constructed out of a non-plastic material, and non-
internally illuminated with a maximum size of 6 square feet, and have a maximum
overall height of five feet. Any exterior illumination shall not direct light on any adjacent
residential uses. That a sign permit in compliance with Chapter 18.96 of the Ashland
Land Use Ordinance shall be obtained prior to the placement of any signage on the
property.
5) That 2 Bush St, Unit A must remain the primary residence (AMC 18.08.605) of the
business owner.
6) That advertisement for the Travelers Accommodation unit must include the City of
a land Planning Action number assigned to the land-use approval.

Mr. McKee spoke about specific materials.
Commissioner Shostrom suggested raised planters on either side of the post to define entrance the lower story is
devoid of the richness and rhythm that is evident on the upper floor, and suggested they add high windows to add a
human scale to the lower level. Mr. McKee stated they would like the additional windows on the SW elevation, and on
the East elevation.
Applicant Peter Brunner, Taylor Street, Ashland spoke about the proposal and the current building permit for the
existing home. Commissioner Skibby asked for comments from the audience, there was none.
Commissioner Skibby closed public hearing at 6:45 PM.
Commissioner Whitford motioned to approve as submitted, Commission Swink seconded the motion. All in favor and
the motion passed.

Ms. Gunter gave the staff report.
David Collins - 2 Bush, clarified only one unit would be used a traveler's accommodation. He will be living in the main
house - unit A. He plans on keeping the place nice and presentable. Skibby asked for comments from audience,
there was none.
Commissioner Skibby closed public hearing at 6:55 PM.
Commissioner Swink motioned to approve 2014-00132 as submitted, Commissioner Shostrom seconded the motion.
All in favor and the motion passed.
NEW BUSINESS:
A. Historic Preservation Week: The Historic Preservation Awards nomination list was whittled down to the most
likely candidates and then divided into three groups to be visited by the groups and photographed. The
groups reported back on which projects they are going to award for Historic Preservation.
The Commissioners will do the write up on the property. Staff will compile the list of winners and the details
of each permit. The write-ups are due the second week of April. The Commission discussed possible
individual award winners.
Photo and certificate will be the award for the winners. A photo album will be created from here on out
instead of photo collage.
Ashland Heritage Committee offered to host tour of Skidmore District (Granite, Baum to Almond, Briscoe) on
Friday.
Self-guided Mausoleum tour - Wednesday
Cyrus Emerson of the Ashland Heritage Committee volunteered to do some promotional ads for Historic Preservation
Month on KRSQ.
tMs. Gunter told the Commission of the Public Works Department plan to re-do the Chautauqua walkway. The electric
lines from NW Nature shop up to the first landing of bricks at Shakespeare need to be repaired and the walkway will
be affected by the excavation. The bronze letters will be replaced and it was suggested that this is a spot where one
of the Historic Markers plaques could be placed. The Commission requested to see plans for engineering plans
Chautauqua.

Written Findings Addressing Criteria for Travellers' Accommodations
1: The travellers' accommodation will be #2 Bush street unit C and I currently reside
in a small room in Unit A. I have given notice to the tenants in the rest of unit A that
they will need to move and that would leave the entire downstairs unit for myself.
This would also greatly improve the parking situation since there are currently
three cars and I have only one.
2: See the map provided for location of parking. Again, we would promote the
accommodation as pedestrian friendly and would limit the guest to one parking
space. This would decrease the overall parking burden as guests stay generally for
shorter periods and mostly on weekends. We will only accept two guests in the unit
at any time and only one car. Moreover, we are certain that some guests would fly
into the Medford or Ashland airports and would not need a car at all.
3: We will not post any signs and will only advertise (if at all) on the internet. Our
goal is to make ours guests feel so welcome and comfortable that they would want
to return to us for many years to come. We are hoping that our best advertising
would be through word-of-mouth and therefore no outside signage or
advertisement would be necessary.
4: Total number of and size of units shall not change. Unit C is planned for
accommodation use; county records indicate a square footage of 704 ft2 although
this may include a covered porch. This has proven adequate for over 30 years since
the house was remodeled. According to current standards over 500 ft2
requires an additional parking space. However we would impose a limit of one car
per visit as a contractual condition for our guests.
5: Primary residence is over 100 years old and remodeled in 1974

8: The property is within 200 feet of North Main. (see map)
Other:
We are aware of the requirements to apply for an annual business license, register
for the transient and occupancy tax, and have an annual inspection from the Jackson
County Health Department and will comply with these standards.

Written Findings for a Conditional Use Permit
A: A NI 3 6 'v
The property is located in an R-3 district and meets all the standards that this
zoning requires. We have no plans to make any changes to the house or the-
landscaping.
B:
Again, this property currently meets the requirements for adequate capacity of City
facilities for water, sewer, paved access, etc. No structural changes are planned.
Furthermore, as tenancy for the short-term rental would be somewhat seasonal and
likely more sporadic than a long-term rental, I believe that the average total number
of people living there at any one time would actually go down. This would mean less
use of city facilities (yet with an increase of city tax income through the hotel tax).
C:
We firmly believe that there would be no greater adverse material effect on the
livability of the impact area over the existing use of the property.
1: "Similarity in scale bulk and coverage". No changes will be made to the existing
house.
2: "Generation of traffic and effects on surrounding streets". I would expect less
noise and traffic as we plan promote the unit as "centrally located and within
walking distance to all downtown attractions". I personally find it a great advantage
to live within such a short distance to everything and I walk or bike just about every
chance I get. I believe that many of the guests would be of the same opinion.
3: "Architectural compatibility with the impact area", Again, no structural or
cosmetic changes are planned and the switch from long-term to short-term rental
should in no way alter any of these conditions.
4: "Air quality.... dust, odors, pollutants" There should be no changes in any of
these conditions and, in fact, we will enforce a "no smoking" policy.
5: "Generation of noise, light, and glare". I would, in fact, expect less noise as the
previous long-term tenant had a fully functioning outdoor bar in the backyard.
Although we were not pleased with this situation, it existed when we bought the
house. As we never heard any complaints from the neighbors we felt we had no
reason to have it removed until the tenant moved out. Guests will be treated as
visitors to my home and will be expected to act accordingly. The first house rule
would be to "respect the peighbors".

Dear Neighbors,
Let me introduce myself real quick, so ething I should have done a while ago. My
name is Sabine Schran-Collings. My husband, Dave and I purchased the property at
#2 Bush about a year and a half ago.
In May our tenant in unit C (the little carriage house) moved out and we started
fixing it up. Dave is now living on the property when he is not taking care of his
elderly parents.
Now we would like to start the application process with the City of Ashland for a
short-term rental permit, since the zoning is right, R3 residential, and we seem to
meet all the requirements we should qualify for a permit.
We just want to make this process transparent for everybody in the neighborhood
and assure you that a short-term rental situation would in no way be of any
disturbance to you. It would, by no means, increase the flow of traffic or create a
parking problem, since unit C has already a designated parking spot by the garages.
We are also planning on advertising the cottage in a way that emphasizes that it is
conveniently located within walking distance to downtown and the theatres. To
attract Shakespeare Aficionados from all over the United States that would fly in and
not even require a car at all during their stay.
I would also like to point out, that the noise level would absolutely not increase,
since our previous tenant, who moved out in May 2013 and had lived there for
several years, had a full functioning Bar in the back yard, with a open keg of beer
running at all times, not to mention the other full booze assortment. From the
amount of cigarette butts and empty bottles that we cleaned up, we can only
imagine, that there was a lot of partying and a lot of people coming and going.
We already have the Best Western right around the corner, the Ashland hostel right
across from us and the Main Street Inn as well. Would one more little unit really
make a difference in the neighborhood? To us it would be a tremendous help to pay
the bills without stepping on anyone's toes!
We want to do the right thing and I am certain, to legalize our short-term rental
situation, would be the best solution for everyone! The city of Ashland is such a
unique and progressive little town, that gives a lot to the people who have the
pleasure of living here. We have a very special community and such excellent
schools, the rest of Southern Oregon can only dream of. Dave and I would be very
happy to contribute and pay our dues in form of hotel taxes to help generate
revenue-for the city of Ashland to maintain our high standards! Wouldn't it be great
to make this a win-win situation for everyone!!
