request for the following:

The Staff Advisor's decision becomes final and is effective on the 13'' day after the Notice of Final
Decision is mailed.
Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a
reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance
(ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in
the ALUO 18.108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria-are available
for review at no cost at the Ashland Community Development Department, located at.51 Winburn Way.
Copies of file documents can be requested and are charged based on the City of Ashland copy fee
schedule.

DECISION
The subject properties are park lands known as Riverwalk, located west of North Mountain Ave and
north of Clinton Street; and North Mountain Park, located east of North Mountain Ave. Both
properties are within City Limits and have the Bear Creels, a significant riparian corridor ruining along
the City's northern boundary and through the respective parks. North Mountain Park also has Beach
Creek, an intermittent/ephemeral stream traversing north along the City Limits as it intersects with
Bear Creels. The two parks encompass approximately 26 acres, and is primarily zoned R- 1 -5.
Hazardous tree removals within Ashland Parks and Recreation Department (APRD) properties are
exempt in accordance with Ashland Municipal Code (AMC) 18.61.035 and 18.63.060; however
requires a Physical and Environmental Constraints (P&E) Permit for tree removal in areas defined as
Flood Plain Corridor Lands. AMC 18.62.030.Z defies a Tree Removal` as "The removal of one or,
more living conifers greater than two feet d. b. h.; or living broadleaf trees greater than one foot
d. b. h. Because the trees identified for anticipated removal are larger than the above distinction, the
Parks Dept is requesting approval for a five-year hazard tree removal and maintenance plan.
Currently there is no management plan in place for the Bear Creels riparian corridor. This plan includes
provisions for landscape maintenance and hazard tree removals for Riverwalk and North Mountain
Park. This project does not involve in-stream work, nor will local native plant species be damaged or
removed. All of the proposed activities fall under APRD's Natural Resource Enhancement Plan and
are not defined by Land Use Codes.

APRD's long-term goal is to insure that Bear Creek and Beach Creek functions as a healthy riparian
corridor and to minimize downstream flood risk from debris accumulation as it passes through North
Mountain Park. In doing so,. APRD strives to aesthetically stabilize the streambank, provide fish
habitat diversity, provide more public space in designated areas, and to ultimately minimize flood risk
from debris accumulation.

The following list is tree removals that the Parks Department is anticipating within a five-year period
from Riverwalk to and through North Mountain Park along Beach and Bear Creek flood zones:
® Riverwalk: proposed 5 trees to -be removed in the next 5 years within wetland areas, side
channels and Bear Creek.
a North Mountain Avenue (Bear Creek) to Rock Weirs: proposed 6 trees to be removed in the
next 5 years.
® Beach Creek. Lower Pond to Bike Path Culvert: proposed 5 trees to be removed in the next 5
years
a Bike Path Culvert to Pedestrian Bride from Mtn. Ave: proposed 3 trees to be removed in the
next 5 years.
APRD are considered stewards of our Parks, and therefore take the appropriate steps to ensure no
potential hazards will affect either the individual plant/tree, or the general health of the park. Debris in
Beach Creek and Bear Creek especially will be monitored and removed based upon the potential of
blockage of bridges and culverts along the Bear Creek riparian corridor. APRD`s best management
practices involve periodic coppicing, thinning, and harvesting of dense growth along narrow channels
that limit flow conveyance and could raise flood elevations; risking property damage from flooding.
Trees located in-stream will be cut at the base so as to not disturb the substrate, and roots will be left
intact to stabilize the bank and substrate. Erosion control will be utilized to protect against
contaminates into the stream. Removals will help in alleviating the potential of flooding and overall
add to the protection and longevity of the riparian and flood corridor. ,
APRD takes all costs- into consideration and therefore will take all reasonable steps to reduce the
adverse impact on the environment. North Mountain Park contains many unique areas containing
demonstration gardens; self- guided educational plant walks; themed gardens; historical features; open
spaces to provide recreation for public use; open lands to provide protected habitat; a playground area;
and 8+ acres of athletic fields for recreational use. Within the riparian area alone, there are thousands
of trees to maintain and at times require removal for public safety. APRD proposes to mitigate the
riparian habitat by 'only removing trees that pose a high degree of hazard under flood situations. As
such, APRD will always leave roots in place unless they pose a hazard, and selectively thin trees
nearest the stream channel.
The Tree Commission reviewed the application at their March 7, 2013 meeting and commended the
Parks department in anticipating future removals within the floodplain boundaries based upon the
potential hazard to people, property, and infrastructure.
In staff's opinion, the proposed five-year hazard tree removal and maintenance plan provides the best
"bang-for-the-buck" for the Ashland Parks and Recreation Depart ment due to the unique nature of
Riverwalk, North Mountain Park, and the subsequent flood plain boundaries. Therefore, staff believes
that the five-year. plan meets the criteria of the ordinance and is approved.

18.62.040.1 Criteria for Approval
A Physical Constraints Review Permit shall be issued by the Staff Advisor when the Applicant demonstrates the
following:
1. . Through the application of the development standards of this chapter, the potential impacts to the property
and nearby areas have been considered, and adverse impacts have been minimized.
2. That the applicant has considered the potential hazards that the development may create and implemented
measures to mitigate the potential hazards caused by the development.
3.. That the applicant has taken all reasonable steps to reduce the adverse impact on the environment.
Irreversible actions shall be considered more seriously than reversible actions. The Staff Advisor or Planning
Commission shall consider the existing development of the surrounding area, and the maximum permitted
development permitted by the Land Use Ordinance.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2013-00236is approved with the following conditions. Further, if any one or more of
the following conditions are found to be invalid for any reason whatsoever, then Planning Action
2013-00236 is denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise modified
here.
2) That the removal and maintenance plan is valid through April 1, 2018, at which the time the
Ashland Parks and Recreation Department may request a renewal.

Pina presented the staff report. Ann Thayer, Parks Horticulturist and Arborist, reminded the Commission
that the Parks Dept. went through a similar action last year in Lithia Park along Ashland Creek. In both
North Mountain park and in Riverwalk, the Parks Dept. is a large property owner along Bear Creek, and
are held to the same riparian restrictions as private property owners in accordance with both 18.62 and
18.63. Under a "standard" Tree Removal process, the Parks Department would need to apply for each tree
removal permit individually, and work within certain time constraints to protect both the riparian edge and
wildlife. By identifying the number of hazard trees that is anticipated to be removed within a five-year
period, the Parks Dept. would comply with the Physical and Environmental Constraints chapter in
reducing the potential hazard of falling trees that could block the culverts or harming persons within the
park. The Commission briefly discussed the proposal and recominended approving the action as
submitted.
DISCUSSION ITEMS
The Commission discussed upcoming Arbor week events and identified Garfield Park as the location to
plant three new trees after the park structure was replaced. In addition, the Tree of the Year winner is the
Oak tree at 1209 Iowa Street. Staff will work on notifying the property owner, submit a plaque order, and
draft up a press release.

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn
Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning
Division Staff's decision must be made in writing to the Ashland Planning Division within 12 days from the date of the mailing of final decision. (AMC
18.108.040)

The following written findings is in response to a five-year maintenance plan for North Mountain
Park and Riverwalk Park grounds; all which the Ashland Parks and Recreation Department
(APRD) is responsible for maintaining. Portions of the subject properties are located within the
Stream Protection Zone in accordance with Ashland Municipal Code (AMC) 18.63; and within
both the FEMA 100-year Floodplain and the Bear Creek and Beach Creek Riparian Corridor in
accordance with AMC 18.62.

NARRATIVE
The Ashland Parks and Recreation Department strives to provide safety and aesthetically
pleasing Park settings, as well as protecting unstable creek banks in the inevitable occurrence of
flood disasters. Because APRD will be responsible for the safety and well being of our citizens,
APRD must provide maintenance safety standards within the public and easement properties
maintained by APRD. Likewise, APRD is also committed to being stewards of the health and
prosperity of our riparian corridors, which is why APRD is applying to establish a five-year tree
maintenance plan for these properties.
Currently there is no management plan in place for this portion of the Bear Creek and Beach
Creek riparian zones. This maintenance plan includes provisions for landscape maintenance and
hazard tree removals for the North Mountain Park tax lot that APRD would be responsible for.
Due to the small scale of our landscape and tree maintenance, most of the proposed activities are
considered exempt in accordance with 18.63.060, including City Emergency Activities.
However, because the areas are also within the Floodplain corridors in accordance with 18.62,
this proposal addresses the flood prevention measures proposed in conjunction with hazard tree
removals and vegetation maintenance. This project does not involve in-stream work, nor will
local native plant species be damaged or removed. All of the proposed activities fall under
APRD's Natural Resource Enhancement Plan and are not defined by Land Use Codes.
APRD's long term objective is to ensure that both Beach Creek and Bear Creek functions as a
riparian corridor as it passes through North Mountain Park and Riverwalk. In doing so, APRD
strives to aesthetically stabilize the streambank, add visual interest, provide fish habitat diversity,
provide more public space in designated areas, and to ultimately minimize flood risk from debris
accumulation.
The following is a list of tree removals that APRD is anticipating within a five-year time frame
from the Riverwalk to and through North Mountain:
1. Riverwalk: proposed 5 trees to be removed in the next 5 years within wetland areas, side
channels and Bear Creek.
2. North Mountain Avenue (Bear Creel,,) to Rock Weirs: proposed 6 trees to be removed in the
next 5 years.
3. Beach Creek. Lower Pond to Bike Path Culvert: proposed 5 trees to be removed in the next
5 years .
4. Bike Path Culvert to Pedestrian Bridge from Mtn. Ave: proposed 3 trees to be removed in the
next 5 years.
A map and site plan indicating location of property boundaries, riparian corridor, trail placement,
and other pertinent information is included at the end of this document.
FINDINGS
18.61.080 Tree Removal Criteria.
1. 4 hazard tree is a tree that is physically damaged to the degree that it is clear that it is likely
to fall and injure persons or property. A hazard tree may also include a tree that is located
within public rights of way and is causing damage to existing public or private facilities or
services and such facilities or services cannot be relocated or the damage alleviated.. The
applicant must demonstrate that the condition or location of the tree presents a clear public
safety hazard or a foreseeable danger ofproperty damage to an existing structure and such
hazard or danger cannot reasonably be alleviated by treatment or pruning.
In accordance with Ashland Municipal Code (AMC) 18.61.042.1), Approval and Permit
Required, Significant Trees greater than 18-inches D.B.H on lands under control of the City of
Ashland requires a tree removal permit. Under this application, APRD is seeking approval to
remove a 22" DBH White Alder tree that is significantly leaning over existing public path (often
used for school children's educational visits), and is showing signs ofArmillarea, a fungus that
decays root systems. A decay column 6.5 ft. in length from the tree base is located on the
holding wood side of the tree. The opposite side (compression wood) has an old large wound
approximately 6 ft. from the ground. The signs of root rot on the holding side along with the
heavy lean, the loamy soil, and the proximity of the path indicate that tree removal is necessary.

The application also requests removal of a 15.2" DBH White Alder tree that has a heavy lean in
soft loamy riparian soils. Currently, this white alder is sharing rooting space with a second white
alder of similar size that had decay up 12' in the main stem causing a defect where the stem
broke out in October 2012 over a well traversed path. The existing nature of the lean of the
alder, the soil profile and the loss of the adjacent alder indicate that this tree has a great
likelihood of failure along this path in the near future.

Future tree removals within Riverwalk and North Mountain Park are primarily selected to
decrease risks involving high use areas or any areas with targets. Trees that are evaluated as
hazard trees will be removed and will be replaced with a tree selected for the site. APRD leaves
snags for habitat whenever it is appropriate and a safe area to do so. It is critical to remove non-
native trees and plant material that pose a threat to native habitat and future exponential seed
dispersal rates within the riparian zones throughout the riparian systems in the Rogue Valley.
The decisions made for the health of watercourses will take precedence which will include
removal of non-native invasive species identified in both the Problematic/Invasive Plants
Management Plan adopted by the Parks Commission in March 2011, and the Oregon State
Department of Agricultural list of problematic plants. Decisions to remove invasive species shall
not significantly compromise shading of the riparian zones. Decisions based on tree removals
due to imminent danger of citizens, will be mitigated with planting of trees appropriate for the
site. Two hazardous White Alder trees are also proposed in conjunction with this permit.
However in accordance with both 18.63.060, a tree that is in imminent danger to public or
private property is considered exempt as a City Emergency Activities.
18.62.040.1 Physical Constraints
AMC 18.62.040 states that the removal of one or more living conifers greater than two feet
d.b.h., or living broadleaf trees greater than one foot d.b.h is defined as Tree Removal and must
obtain a Physical and Environmental Constraints Permit.
1. Through the application of the development standard of this chapter, the potential impacts to
the property and nearby areas have been considered, and adverse impacts have been
minimized. The tree removals within the riparian zone projects do not involve in-stream
work, nor will local native plant species be damaged or removed. North Mountain Park has a
healthy stand of volunteer native trees along the corridor and APRD continues to re-plant
native species of trees and shrubs along its riparian corridors. In following good stewardship,
non-native and invasive species will be targeted for removal so as to not spread to other
riparian areas downstream.

2. The applicant has considered the potential hazards that the development may create and
implemented measures to mitigate the potential hazards caused by the development. APRD
is responsible for open space protection. APRD are stewards of the Parks and open spaces
within the City of Ashland and takes all costs into consideration, including adverse impacts
on the environment. APRD proposes to mitigate the degradation of the riparian habitat by the
following:
• Only remove trees posing a high degree of hazard under flood situations. Mitigate against
removal via alternate methods (cabling bracing, pruning)
• Always leave roots in place unless they pose an unacceptable hazard.
• Selectively thin trees nearest the stream channel, favoring those located nearby but up-
slope.
• Stream channel shading should be considered with regard to any removal within stream
corridor.
3. The applicant has taken all reasonable steps to reduce the adverse impact on the
environment. Irreversible actions shall be considered more seriously than reversible actions.
APRD takes all costs into consideration, including adverse impacts on the environment.
Within the North Mountain Park tax lot, many unique areas containing demonstration
gardens, self- guided educational plant walks, themed gardens, historical features, open
spaces to provide recreation for public use, open lands to provide protected habitat, a
playground area, and 8+ acres of athletic fields for recreational use. Many of these trees are
exempt under 18.63060. Within the riparian area alone, there are thousands of trees to
maintain and at times require removal for public safety.
18.63.060. Water Resource Exempt Activities.
1. Vegetation Maintenance, Planting and Removal:
a. Landscape Maintenance. Existing vegetation will,be continually maintained, including
being in accordance with weed abatement policies set by Ashland Fire and Rescue.
c. Tree pruning. Maintenance pruning of existing trees shall be kept to a minimum, meeting
clearance for trails and shall be in accordance with the Tree Preservation and Protection
Chapter 18.61. Under no circumstances shall the maintenance pruning be so severe that it
compromises the tree's health, longevity, or resource functions (i.e. shade, soil stability,
erosion control, etc.).
d. Non-native, noxious and invasive vegetation removal. The removal/mowing of
blackberries shall not occur between May 1St and July 31St to protect nesting birds.
APRD requests that the following species be allowed for selection out of the riparian
zones due to their invasive nature:
o American Ash, seeded varieties (Fraxinus arnericana)
o Amur Maple (Aces tataricum)
o Buckeye or Common Horse chestnut (Aesculus hippocastanum)
o Black Locust (Robinia pseudoacacia)
o English Hawthorn (Crataegus monogyna)
o European Filbert (Corylus avellana)
o Fruiting Cherry species (Primus spp.)
o Fruiting Plums (Prunus spp.)
o Green Ash, seeded varieties (Fraxinus pennsylvanica)
o Mountain Ash (Sorbus aucuparia)
o Norway Maple (Aces platanoides)
o Tree of Heaven (Ailanthus altissima)
e. Hazardous Tree Removal. A 5-year maintenance plan for Hazardous Tree Removal shall
be processed under procedures and approval criteria described in the Tree Preservation
and Protection Chapter 18.61.
£ In-Channel Vegetation Removal. Debris in Beach Creels will be monitored and
determined if it should be removed due to future blockage of bridges and culverts along
Beach Creels. Trees located in-stream will be cut at the base so as to not disturb the
substrate. Roots left intact are necessary for the stability of the banks and substrate.
g. Routine planting. The planting of local native plant species or the replacement of non-
native, noxious and invasive plants with local native plant species, as identified on the
City of Ashland's Local Native Plant Species List. Vegetation preservation (18.63.1200
mitigation shall be identified within the water resources protection zone. As invasive
plant material is removed, native vegetation will be planted to replace the plant density
for bank and erosion stability.
h. Use of Hand-held Equipment or Machinery. The use of hand-held machinery (i.e. walk
behind mowers, weed eaters) for vegetation maintenance and fire hazard prevention.
i. Use of Power-Assisted Machinery. When larger machinery is necessary for removal or
maintenance of trees with in the riparian corridor, soil compaction from equipment
(bucket trucks) will be reduced by distributing the weight of equipment over a large area
utilizing non-invasive materials such as plywood, mats, mulch, etc. whenever working
within the riparian protection area. The use of power-assisted machinery will not be used
within the October 31-May Ist (the wet months) boundary.
4. City Emergency Activities:
Above all else, APRD must provide a safe and responsible environment for the welfare of all
citizens. Because of this, ARPD will interfere when a tree or other natural hazard impacts the
riparian corridor when it presents a potential imminent danger to public or private property.
This will most likely be in the form of debris potentially blocking the Beach Creels culverts
and bridges. The creek and associated corridor will be monitored and determined if an action
or event that presents imminent danger will be handled. In such an event, APRD will notify
the Planning Department of activity so that it can be documented.

18.63.070. Limited Activities and Uses.
D. Approval Standards for Limited Activities:
1. All activities shall be located as far away from streams and wetlands as practicable;
designed to minimize intrusion into the Water Resources Protection Zone and disturb as
little of the surface area of the Water Resource Protection Zone cis practicable. Because
of the level of care that the vegetation will require within the riparian corridor, most of
the work will be on such a small scale as it would be considered an exempt activity, and
as such will not derogate the riparian protection area. However in all cases that require
more heavy machinery or invasive procedures, protective measures will be taken to
ensure that soils and roots are not negatively impacted, and that native plantings are
preserved whenever possible.
2. The proposed activity shall be designed, located and constructed to minimize
excavation, grading, area of impervious szafaces, loss of native vegetation, erosion, and
other adverse impacts on Water Resources. All work will be performed to restore and

preserve the riparian habitat of Beach Creek and Bear Creels wherever possible. No

impervious surfaces are proposed with the trail, nor loss of native vegetation, or negative
impacts to the riparian corridor; just the maintenance of the trail easement and the
associated riparian area.
3. On stream beds or banks within the bankfill stage, in wetlands, and on slopes of 25%
or greater in a Water Resource Protection Zone, excavation, grading, installation of
impervious surfaces, and removal of native vegetation shall be avoided except where no
practicable alternative exists, or where necessary to construct public facilities or to
ensure slope stability. APRD is not proposing to install impervious surfaces, significant
grading, or native vegetation removal.
4. Water, storm drain and sewer systems shall be designed, located and constructed to
avoid exposure to floodwaters, and to avoid accidental discharges to streams and
wetlands. No water systems are proposed to be installed with this application. However
with ongoing maintenance of the Beach Creek and Bear Creek riparian corridor, the
safety of the Beach Creek culverts and foot bridges will be monitored to prevent
flooding in the event of fallen trees or blockage. This includes selecting out trees within
the creek culvert vicinity for the prevention of flooding blockage at those areas of
crucial concern.
5. Stream channel repair and enhancement, riparian habitat restoration and enhancement
and wetland restoration and enhancement will be restored through the implementation
of a mitigation plan prepared in accordance 144th the standards and requirements in
section 18.63.120. The ongoing maintenance and care is provided by the best practices
standards by APRD.
6. Long term conservation, management and maintenance of the Water Resource
Protection Zone shall be ensured through preparation and recordation of a management
plan as described in section 18.63.120. C, except a management plan is not required for
residentially zoned lots occupied only by a single-family divelling and accessory
structures. Because the property is held under a legal contract by the City to maintain, a
legal contract is not necessary to ensure management will be adhered to.
18.63.120 Mitigation requirements. j
A. Vegetation Preservation and Construction Staging.:
As mentioned earlier in this document, the APRD utilizes best practices when working in
forested and/or riparian areas. Work areas on the immediate site shall be identified and
marked to reduce damage to trees and vegetation. Temporary construction fencing shall be
placed at the drip line of trees bordering the work area. No equipment maneuvering, staging
or stockpiling shall occur outside of designated work areas within the riparian protection
zone. Trees will not be used as anchors for stabilizing equipment. And the stockpiling of soil,
or soil mixed with vegetation, will not occur in the Water Resource Protection Areas on a
permanent basis. When work is performed that is beyond that of exempt activities in
accordance with 18.63.060, APRD will employ temporary erosion control measures installed
to prevent encroachment and flow of runoff material or other debris into the Water Resource
Protection Zone

B. Options for Satisfying Restoration and Enhancement Requirements in Mitigation Plans.
This application is for the maintenance and care of the APRD's North Mountain Park and
properties maintained by APRD along Bear and Beach Creeks. No additional plantings or
mitigation requirements are required or proposed at this time. APRD understands that any
potential activity or use proposed that is beyond the scope of Exempt activities and those
mentioned of the maintenance plan may be subject to further planning review in accordance
with AMC 18.63
C. Management Plan.
The ongoing maintenance and care is provided by best practices standards by APRD.
Because the property is held under the above standards, APRD feels that a 5 year
maintenance plan will be submitted.

2. Favor the healthy, native trees, create less competition for understory growth.
3. Provide shade and sun within riparian zone
4. Remove unhealthy trees in high use public areas that are hazard trees. In areas of less
risk to public, snags may be left for wildlife.
5. Pruning or harvesting for clearance of trees and shrubs for public safety and public
access.
6. Eliminate large woody debris (6" diameter and greater) within creek that contributes to
debris accumulation and risk of flood.
7. The thinning of vines and thick undergrowth to provide a better view or more
aesthetically pleasing natural landscape is allowed.
8. Leaf litter is not to be removed form creekside, with exception to hardscape features.
9. Natural vegetation or re-vegetated areas will be monitored and appropriately manipulated
to preclude unacceptable flood hazard.
Definitions
Hazard trees are those that are dead or have branches that may fall in a path or public area.
Hazard trees may have broken or hanging branches, split trunks or other conditions that may
cause the tree or part of the tree to fail and cause damage. The tree manager/arborist is faced
with malting inspections and decisions on prioritizing hazard trees. An evaluation is made based
on tree species, potential targets, and defects present to identify and document hazard trees. The
corrective action will always be the decision of the tree manager/ arborist.
Intent: To ensure the aesthetic development of all facilities and amenities including structures,
access, parking, trails and paths, and landscaping within lands set aside and to be used as open
space and/or for recreational facilities that will serve all residents of the city and visitors
Goals and Methods
For stream productivity, the in-stream food chain is fed by sunlight, litter (leaves, needles and
branches) that falls into the water and flying insects. The sunlight causes algae to gr014' on
rocks. Insects eat the algae and plant litter. Fish eat the insects and algae. Thinning helps
achieve management goals, minimizing soil disturbance. Thinning or selectively harvesting fast
grol4,ing trees (willows, cottonwoods, alders, and poplars) will remove captured nutrients in
riparian zones and continue to promote groiWh. Roots systems of harvested trees are retained
and continue to stabilize the soil while alloi4,ing trees to regenerate from sprouts.

Tree regeneration: Alders tend to out-compete understory or mid-size shrubs and trees. They
decrease understory growth and diversity. Long term maintenance promotes strong plants that
can survive environmental stress and optimize nutrient uptake and storage. Trees along the
riparian corridor will be left for habitat along banks, but not within the channel margins.
Reasons for° this include limiting flow conveyance could raise flood elevations and pose a threat
and risk ofproperty damage to neighboring homes.
Note: After trees are established, periodic thinning and harvesting of mature trees is required to
maintain health and growth of existing species(less competition provide healthier specimens).
The thinning of vines, invasive species, and thick undergrowth provides a view of the creek and a
pleasing natural landscape is allowed for the enjoyment of the public. A proposal for a 5 -year
maintenance plan will mitigate the physical restraints of the code. Sections of the North
Mountain Park Lot are as follows: (trees greater than 6') This shall constitute a S year
maintenance plan to ensure that North Mountain Park is covered under the permitted Land Use
Ordinance
