This is intended to meet condition number 2 of the attached findings for Planning Action #I'A-2013-01826. I anticipate that the excavation and plantings proposed in the mitigation plan will result in no net loss of floodway cross-section, and will improve flood resistance in this reach of the creek, as well as restore habitat and improve creek water quality. The mitigation proposed to prevent erosion will need to be properly installed. I request that final completion approval be conditioned on a final inspection by Public Works Engineering. If at the time of inspection, additional measures are necessary to insure that no adverse impacts are created, I will require that Northwest Biological to veriy that those measures are implemented. B. Actions subject to appeal: 2. Type I Planning Actions. a. Effective Date of Decision. The final decision of the City for planning actions resulting from the Type I Planning Procedure shall be the Staff Advisor decision, effective on the 13th day after notice of the decision is mailed unless reconsideration of the action is approved by the Staff Advisor or appealed to the Commission as provided in section 18.108.070(B)(2)(c). b. Reconsideration. The Staff Advisor may reconsider Type I planning actions as set forth below. i. Any party entitled to notice of the planning action, or any City Agency may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the staff advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. ii. Reconsideration requests shall be received within five (5) days of mailing. The Staff Advisor shall decide within three (3) days whether to reconsider the matter. iii. If the Planning Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten (10) days to affirm, modify, or reverse the original decision. The Staff Advisor shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. iv. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. c. Appeal. i. Within twelve (12) days of the date of the mailing of the Staff Advisor's final decision, including any approved reconsideration request, the decision may be appealed to the Planning Commission by any party entitled to receive notice of the planning action. The appeal shall be submitted to the Planning Commission Secretary on a form approved by the City Administrator, be accompanied by a fee established pursuant to City Council action, and be received by the city no later than 4:30 p.m. on the 12th day after the notice of decision is mailed. ii. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the city and whose boundaries include the site. iii. The appeal shall be considered at the next regular Planning Commission or Hearings Board meeting. The appeal shall be a de novo hearing and shall be considered the initial evidentiary hearing required under ALUO 18.108.050 and ORS 197.763 as the basis for an appeal to the Land Use Board of Appeals. The Planning Commission or Hearings Board decision on appeal shall be effective 13 days after the findings adopted by the Commission or Board are signed by the Chair of the Commission or Board and mailed to the parties. iv. The appeal requirements of this section must be fully met or the appeal will be considered by the city as a jurisdictional defect and will not be heard or considered. COMPREHENSIVE PLAN DESIGNATION: Suburban Residential; ZONING: R-1-3.5; ASSESSOR'S MAP: 39.1E 11CB TAX LOTS: 4208 SUBMITTAL DATE: November 25, 2013 DEEMED COMPLETE DATE: November 26, 2013 STAFF APPROVAL DATE: December 26, 2013 APPEAL DEADLINE DATE: January 07, 2014 FINAL DECISION DATE: January 08, 2014 APPROVAL EXPIRATION DATE: January 08, 2015 DECISION The subject property is located mid-block on the south side of Meadow Drive, within the Meadowbrook Park Estates subdivision, located west of Clay Street, in between East Main and Ashland Street. The 8,870 square foot parcel is the southernmost portion of the development's open space, and gently slopes to the north at approximately two-to-three percent. Clay Creek traverses through the middle of the site, and ultimately into Bear Creek to the north. There are approximately 30 trees on-site with a Diameter at Breast Height (DBH) of at least six-inches or greater, the majority of which are Cottonwoods and located almost entirely on the west side of the creek. The Meadowbrook Estates subdivision was approved as a Performance Standards subdivision in March 1990 (PA-90-043), and completed in four phases spanning approximately eight years. While previous approvals provided little information in terms of size- and species-specific landscape materials, cross-sections. provided did illustrate a clear riparian corridor with a mix of canopy and understory vegetation with a diverse selection of riparian plant species. Today, Clear Creek's Riparian corridor contains older, hazardous Cottonwoods with no understory forb or shrub layer to provide habitat for songbirds and other wildlife, limited floodplain function due to steep stream bank and no flood terrace, and significant presence of invasive species, including lawn, which continues to regenerate and undermine the health of the riparian corridor. Clay Creek is a Local Stream according to adopted Water Resources Protection map, which denotes a 40-foot buffer from centerline of creek, or 80-feet across the width of the channel. Therefore, in order to achieves the project's goals of removing the hazardous trees and restore the area, the applicant has proposed a Stream Enhancement and Restoration project for this section of Clay Creek, in accordance with AMC 18.63.070.B.1. The applicant's findings state the PA #2013-01826 December 26, 2013/MP Page 1 r, goal of the project is to create a multi-storied riparian forest with trees, shrubs, and ground cover that will supply a healthy ecosystem that increases stream shading, provide for bird and wildlife habitat, and establish a more natural stream bank and corridor. The Meadowbrook Park Estates (MPE) Home Owners Association (HOA) hired Northwest Biological Consulting (NBC) to further analyze the site in terms of functions, values, and objectives, and produce a Management and Mitigation Plan demonstrating compliance with the City of Ashland's requirements for a riparian enhancement plan. NBC conducted on-the-ground fieldwork/research, prepared maps and cross-sections, and produced a plan for the enhancement and mitigation of the site. NBC also worked with the HOA to create a long-term management/maintenance plan for the site. The submitted report describes the existing and proposed functions and values of the Clay Creek Riparian Zone, and addresses riparian enhancement and mitigation requirements for the property. This restoration project does not propose adding impervious surfaces, but does require in-stream work that will occur completely within the riparian corridor to achieve the project goals. In order to minimize downstream aquatic impacts, the project will occur during the winter when TID water is turned off, and there in little to no flow within the streambed. The applicant has verified with State and Federal agencies that no permits are required for this level of stream enhancement. Access to the project area will be from Meadow Drive; however, the applicant did not provide a specific Construction Staging Plan indicating where materials and equipment will be staged during installation. Therefore staff will require a plan addressing all staging standards listed in AMC 18.63.12.A prior to commencement of the project. No utilities will be disturbed in the proposed project work area. The project is anticipated to remove approximately 1,500 square' feet of lawn area, and create flood plain terraces at 30-36 inches high in order to mitigate any potential flood inundation. Both sides of the bank will be heavily planted with 100 percent native vegetation once the project is complete. An erosion and sediment control plan has been submitted with the application. All conditions of these plans shall be implemented and in place per recommendations of Northwest Biological Consulting (NBC) and the applicant. The request to remove 25 diseased and dying Cottonwood on the west side of the creek triggers a Physical and Environmental Constraints Permit for tree removal. That applicant's findings assert the trees are an extreme hazard due to rotting root structures in weak soil, are significantly leaning towards the home to the west, 280 Meadow Drive, and that removals are necessary to accommodate the required cross-sectional configuration to achieve the project goals. The Tree Commission at their December 5, 2013 meeting discussed the proposal, and recommends approval as submitted. All removals will conform to the necessary steps required for utilizing heavy machinery within the riparian corridor, and in accordance with the planting and landscape plan. All mitigation for this project include restoration plantings to be installed at a 1:1.5 ratio. The applicant has exceeded this requirement by proposing to plant 20 trees of various species and sizes, 100 percent native shrubs and understory vegetation, and removing flood barriers such as the fence across that flood channel. The applicant has demonstrated substantial compliance with the standards listed in 18.63.120.B2, the Alternative option for satisfying restoration and enhancement requirements. The Mitigation PA #2013-01826 December 26, 20131W Page 2 { and Management Plan provides a complete assessment of the protection zone and its features and structures, establishes clear and directive objectives for mitigation, and supports the findings with landscape and grading plan. The end result of this project will ultimately be a positive environmental benefit and contribute to the overall health of the riparian corridor. Flood passage will be improved, sediment transport will be balanced, and aquatic habitat will be greatly enhanced. Staff would like to commend the applicant in recognizing the importance of riparian habitats and the benefits they add to their subdivision's open space, and going above and beyond the typical application in seeking to enhance the corridor's functions and values. In our view, the application is likely to serve as a model for future enhancement projects processed under AMC 18.63.070.B.1. Therefore, staff believes the application meets and exceeds the regulatory standards of both the Physical and Environmental Constraints and Water Resource Protection ordinance. Two (2) copies of written findings addressing the following criteria from Chapter 18.63.070.D; WATER RESOURCE PROTECTION A Water Resource Permit shall be issued by the Staff Advisor when the Applicant demonstrates the following: 1. All activities shall be located as far away from streams and wetlands as practicable, designed to minimize intrusion into the Water Resources Protection Zone and disturb as little of the surface area of the Water Resource Protection Zone as practicable. 2. The proposed activity shall be designed, located and constructed to minimize excavation, grading, area of impervious surfaces, loss of native vegetation, erosion, and other adverse impacts on Water Resources. 3. On stream beds or banks within the bank full stage, in wetlands, and on slopes of 25% or greater in a Water Resource Protection Zone, excavation, grading, installation of impervious surfaces, and removal of native vegetation shall be avoided except where no practicable alternative exists, or where necessary to construct public facilities or to ensure slope stability. 4. Water, storm drain and sewer systems shall be designed, located and constructed to avoid exposure to floodwaters, and to avoid accidental discharges to streams and wetlands. 5. Stream channel repair and enhancement, riparian habitat restoration and enhancement and wetland restoration and enhancement will be restored through the implementation of a mitigation plan prepared in accordance with the standards and requirements in Section 18.63.120. 6. Long term conservation, management and maintenance of the Water Resource Protection Zone shall be ensured through preparation and recordation of a management plan as described in Section 18.63.120.C, except a management plan is not required for residentially zoned lots occupied only by a single-family dwelling and accessory structures. (Ord 3000, Added, 1211512009) Two (2) copies of written findings addressing the following criteria from Chapter 18.62.040.1; PHYSICAL & ENVIRONMENTAL CONSTRAINTS A Physical Constraints Review Permit shall be issued by the Staff Advisor when the Applicant demonstrates the following: 1. Through the application of the development standards of this chapter, the potential impacts to the property and nearby areas have been considered, and adverse impacts have been minimized. 2. That the applicant has considered the potential hazards that the development may create and implemented measures to mitigate the potential hazards caused by the development. 3. That the applicant has taken all reasonable steps to reduce the adverse impact on the environment. Irreversible actions shall be considered more seriously than reversible actions. The Staff Advisor or Planning Commission shall consider the existing development of the surrounding area, and the maximum permitted development permitted by the Land Use Ordinance. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That a professional, registered Engineer provide letter of support to staff demonstrating that floodplain corridor will not result in an increase in flood levels during the occurrence of the base flood discharge prior to commencement of work. 3) That confirmation of approval from State and Federal authorities to be filed with the Planning Division so as to approval to the file. 4) That the tree protection and erosion control plan in accordance with submitted plans be in place and inspected by the Planning Division prior to any on-site construction or site disturbances. 5) That tree removal within the Clay Creek protection zone will conform to the requirements of using power-assisted machinery within the riparian corridor in accordance with 18.63.060.1.1 6) That the applicant shall provide staff with an irrigation plan schedule that includes provisions for short-term care and maintenance as proposed by the applicant. COMPREHENSIVE PLAN DESIGNATION: Low-Density Multi-Family; ZONING: R-2; ASSESSOR'S MAP: 39 lE 09BA TAX LOTS: 8900 Severson gave a brief report outlining the nature of the request, noting that the applicants had initially been interested in simply removing trees but after learning of applicable regulations relative to maintaining the siginificant natural features identified as part of the original Performance Standards Subdivision and regulations seeking to avoid adverse impacts to flood plain corridor lands and stream bank water resource protection the proposal had evolved to a restoration project to remove lawn and non-native vegetation, redefine the stream channel, and replant the riparian corridor with typical native riparian trees, shrubs and ground covers to re- establish the key riparian functions of the corridor. Severson noted that this was the first project to utilize new code provisions which allow fee waivers for stream restoration projects not associated with development, and suggested that the project was likely to be put fort as an example for similar projects in the future. John and Stephanie Bullock, homeowners from 280 Meadow Drive and members of the homeowners assocation, spoke on behalf of the applicants. Mr. Bullock provided background about the project and noted that the association had budgeted funds for the project and was committed to its completion if approved. They noted that the project will be completed in stages over five years, and will involve work by the applicants themselves, Northwest Biological, the arborist and Lomakatsi Restoration. Roland noted that following previous contact with the Commission by the applicants, he had made a site visit and observed the trees. He indicated that in his assessment, the trees were time- bombs, and he noted that they had observable fungal growth, "stove-piping" of the trunks into the soil with no observable root mass, and seemed likely to die and fall. He questioned whether the applicants had considered leaving any snags standing for habitat, but the applicants suggested that virtually all of the trees were leaning to some degree and posed a hazard that they felt was inappropriate given the nature of the area as subdivision open space. They also noted that removing the trees as proposed had substantial cost savings, but that leaving some standing only to have to remove them at some unknown point in the near future would substantially increase the cost of the already expensive project. Albert Pepe, a neighbor of the project who resides in the Wingspread Mobile Park, noted that he received the notice and was concerned, without having details, about substantial tree removal. Severson provided a complete copy of the application materials for his review, and briefly recounted the key details of the proposal. Pepe indicated that after hearing the details of the project it was much better than he had feared. Roland and Neff indicated that they felt this was a great project. Neff added that it would likely require significantly less watering and maintenance than the current landscaping. Commissioners discussed irrigation, noting that it would not be advisable to use drip irrigation for the new trees and that pop-up heads would be better. They questioned why irrigation details were not included, and advised the applicants that the trees should be planted on mounds and heavily mulched. Neff also noted that the included details about providing an educational plaque explaining the merits of the project on-site was terrific. j Neff moved, and Roland seconded, to recommend approval of the project as proposed, with a note that irrigation details should be provided before the project begins. The motion carried unanimously. DISCUSSION ITEMS Tree of the Year: Severson noted that the Cottonwood on Clay Street had won in the voting by roughly a three-to-one margin. It was removed and in the process, the arborist noticed that other cottonwoods were diseased and/or dying. The owner of the adjacent property, the home at 280 Meadow, approached the Meadowbrook Park Estates (MP E) Home Owners Association (HOA) to request that the diseased and dying trees be removed. Several were leaning over his house; others were in the area where children play. The HOA submitted a request to the Ashland Planning Department to remove the 25 trees at 270 Meadow Drive in-the common area to protect property and ensure the safety of residents. After speaking with City staff, the HOA learned that removing the cottonwood trees would require a modification to the subdivision's approval due to the trees being within the Clay Creek riparian corridor and a significant feature in the neighborhood. At the pre-application meeting on June 19, 2013, the City staff informed the HOA of an exemption that allowed fees to be waived if the HOA did a stream enhancement plan coupled with the proposed tree removal. To do this, a Biological/Riparian specialist was needed to develop aplan based on existing conditions and desired outcomes. The HOA hired Northwest Biological Consulting (NBC) to further analyze the problems in the area and to determine the Water Resources requirements for restoration/enhancement of Clay Creek's riparian zone, and create a riparian enhancement plan. NBC did the required fieldwork/research, prepared maps and cross-sections, and produced a plan for the enhancement and mitigation of the site. NBC also worked with the HOA to create a long term management/maintenance plan of the site. The following is the report prepared by Northwest Biological Consulting and Suzanne Marshall (HOA Representative) that describes the existing and proposed functions and values of the Clay Creek Riparian' Zone and addresses riparian enhancement and mitigation requirements for the property. n 18.63.120 Mitigation Requirements Alternative Option a. Assessment of Water Resources Protection Zone Structures, Functions and Values The subject parcel at 270 Meadow Drive is 8,870 square feet and is in the southern-most portion of the MPE subdivision'open space. Clay Creek traverses through the lot, with 25cottonwood trees on site, all located on the west side of the creek. Clay Creek passes under Meadow Drive and on through the subdivision and into Bear Creek to the north. The closest structure, a house, at 280 Meadow Drive, is approximately 42 feet to the west of the creek, just outside of the 40 foot buffer, and most potentially affected by'tree removal.. Clay Creek enters the open space property from the adjacent Wing-Spread mobile home village and flows through the site at an approximate slope of 2-3%. The width of the channel varies from 6 feet at the upstream end to 18 feet at the bridge. The creek length is approximately 100 feet through this section of the MPE subdivision. The creek appears stable and hydrology of the creek is supported primarily by return irrigation flows in the growing season (April-October) which is approximately 2-3 Cubic Feet a Second (cfs). Storm water runoff also feeds the creek during storm events and the creek has a small amount of base flow from upstream spring sources. The creek has been modified through time and in its current configuration both banks are armored with heavy angular rock and the creek bottom is also armored with rock to prevent down-cutting. The existing 25 cottonwoods provide shade and riparian habitat but there is a lack of multi-storied trees and shrubs within the riparian zone (Figures 1-5)). The functions and values of the existing creek and riparian zone are: 1) Provides creek shading to help cool creek water. 2) Older, even age cottonwoods with no forb or shrub layer provides for limited habitat for songbirds and other wildlife. 3) Provides limited floodplain function due to steep stream bank and no flood terrace. 4) Provides open space for the neighborhood. 5) Contains numerous old cottonwood trees that are at risk of falling over. 6) Functions and values somewhat limited by the presence of invasive species which continue to regenerate in the riparian zone. The functions and values of the proposed creek and riparian zone are: 1) Will provide a denser riparian vegetation zone that will increase stream shading in time. 2) Will create-a multi-storied- riparian forest with trees, shrubs, and ground cover that will provide good songbird and other wildlife habitat. i i i 3) Will create floodplain terraces that will help slow down flood water and prevent bank erosion and maintain stream bank stability. 4) Creates a stable stream channel that will not erode. 5) Provides an educational opportunity for the neighborhood to join in the planting and maintenance of the created riparian zone and creek channel. 6)' Removal of 25 hazard cottonwood trees will remove the risk of damage to property and people. 7) Removal of much of the sod grass and replacement with native ground cover will require less fertilizer and other chemicals. . 8) Provide open space that is part of a native riparian zone & can create a demonstration model of riparian restoration that could be.applied to other HOA property downstream. 9) Removal of invasive species that are found in the creek and along the creek banks. 1.0). Provide an overall Ecological Lift compared to the existing condition. b. Objectives and Standards of Mitigation Objectives: Remove 25 hazard cottonwood trees and restore and enhance the Stream Bank Protection Zone to provide 100% native forbs, shrubs, trees and to lower stream temperature, improve water quality of Clay Creek, provide flood plain connectivity with terraces and provide habitat for songbirds and other wildlife. More details are: 1) Lawn grass, noxious weeds, and invasive plants will be removed and replanted with 100% native forbs, shrubs, and trees. 2) Twenty five hazard cottonwood trees will be removed. 3) Stream terraces and walls will be constructed to help reduce flood damage 4) Work in Clay Creek will be done during December-March when the TID water is turned off, and there is little or no flow in the streambed. Only hand work below ordinary high water is allowed without a state or federal permit. 5) Trees and shrubs will within 5 years provide a partial shade canopy to help lower stream temperature. As the vegetation matures it will provide progressively more shade. 6) The new plantings will prevent soil erosion into Clay Creek and improve water quality. 7) Removal of approximately 1500 square feet of lawn grasses will eliminate the need for fertilizers and other chemicals and intense irrigation and thereby enhance water quality. 8) A 30 to 36 - inch rock wall on the east side and the west side of the stream will be built to create a flood terraces and a place to plant much of the riparian vegetation. 9) Removal of the old, solid wooden six foot fence to align with the rock walls will be done 10) Within one year 90% of the plants will be established. 11) Site visits by the NBC Project Biologist will occur before and after the growing season with documentation to City staff. C. Mitigation Site/Grading Plan The following are steps for grading the mitigation site (Figures 2 & 3). 1) The 25 hazard cottonwood trees will be removed. 2) Silt fence and other erosion control measures will be installed along the edge of the creek prior to any ground disturbing activities. Sterile straw will be placed on all disturbed ground areas to help control runoff from a rain event. 3) Sod and invasive plants will be removed as indicated on the grading plan 4) Rock armoring along the stream bank will be temporarily removed. 5) All of the West area and part of the East area will be cleared and grubbed to remove the numerous cottonwood roots & stumps that are present, especially along the West bank. 6) Excavation for two stream terraces and building of two rock walls 7) Rebuild the rock armoring along the stream banks 8) Import amended soil and spread, shape, and grade as necessary 9) Plant the riparian vegetation and install deer protection as necessary 10) Install the irrigation system to supply water to the newly planted riparian zone d. Landscape Plan The Landscape Plan to some extent will model the native plant community that historically existed along this reach of Clay Creek. The Stream Bank Protection Zone and the Wetland Protection Zone both will be re-planted with 100% native trees, shrubs, and forbs in accordance with local, state, and federal approved management plans. The following plants will be included: Sedges and rushes, Snowberry, Indian Rhubarb, Red Twig Dogwood, var. Keisii, Mock Orange, Ocean Spray, Vine Maple, Oregon Grape, Knickinick, Currant, Douglas Spirea, Big Leaf Maple, Ponderosa Pine, Incense Cedar, Douglas Fir, White Oak, Crab Apple, and Madrone. Planting should begin in the spring of 2014, as soon as the grading and site preparation. is complete. The riparian planting will be done at one time and some limited supplemental planting is expected from time to time to replace plants that did not survive (See Figures 2-5). The plant coverage in five years will have at least 90% survival and be robust and healthy. C. Management Plan 1. The Mitigation Plan. The implemented and approved mitigation plan will be planted and ready for inspection in the spring of 2014.. It is anticipated that City staff will inspect immediately after the initial planting is compete, then annua_I for the first five years. 2. Identification of Water Resources and Water Resource Protection Zone management practices to be conducted and proposed intervals. Clay Creek, which is considered a Local Stream according to the City's Water Resources Protection Zone Map, is in the water resource zone at the site at 270 Meadow Drive. 3. The following statements. The MPE HOA understands and agrees to the following: There shall be no alteration of the Water Resource Protection Zones as delineated and shown on the attached plan. (See Figure 5) There shall be no alteration of the size, shape or design of an approved Water Resource Protection Zone without prior approval by the City of Ashland. There shall be no amendment.or change to this Management Plan without prior approval of the City of Ashland. 4. Provisions for the ongoing removal and management of noxious or invasive vegetation and debris. The MPE, the Project Biologist and the HOA's Landscaper will meet immediately after the plantings are complete and discuss the proper maintenance and care required for the new plantings. The MPE HOA will require that weeding and noxious/invasive vegetation will be surveyed for and removed each March, July, and October of every year. This will be done by the landscaper company employed by the HOA. 5. Provisions for the protection of protected plant and animal species in accordance with recommendations from applicable state and federal agencies. No Permits are required from Federal or State. agencies to plan and implement the riparian enhancement project. All stream work will occur above the Ordinary High Water (OHW) zone which does not require regulatory permits. Best Management Practices (BMP'S) will be employed to control erosion. Proper fencing will be used to protect the initial plantings from deer and protection will be maintained as needed. _ I i I i To our knowledge no endangered or threatened species are present in the project area and no negative impacts from the project are anticipated. However; the new plantings will attract songbirds to the area which will be a positive benefit of the riparian enhancement project. 6. Specific provisions for city enforcement of the management plan. At any time that the proposed alterations in the area are not developing and planted in accordance to the plan, the City staff will be notified and may inspect the area. 7. Any additional measures deemed necessary to protect and maintain structures, functions, and values of the Water Resource Protection Zone 9e.g. signage delineating preservation boundaries) Removal of the cyclone gate across Clay Creek that was placed by Wingspread Mobile Home Park. The City Planning office said they will speak with Wingspread management to get the gate removed. A plaque setting out the reasons and advantages of riparian repair and enhancement projects. Residents and visitors will be able to learn about the project and why it was done. S.Provisions for the perpetual protection and maintenance of the Water Resource and Water Resource Protection Zone including but not limited to the followng: a. See b. below. b. The MPE HOA already owns the property at 270 Meadow and has CC&Rs which govern the site, the landscaping, the stream within the Water Resource Protection Zone c. The Meadowbrook Park Estates HOA (MPEHOA) has carefully considered the potential impacts of the removal of the hazardous cottonwood trees to 270 Meadow Drive, the MPEHOA common area, clay Creek, and adjacent properties. The common area at 270 Meadow will be the only area with tree removal followed by a riparian repair and enhancement of Clay Creek. Adjacent properties will not be affected except for the increased safety with the dead trees removed. The MPEHOA neighborhood will be improved by the healthier riparian area and the restored habitat due to the new 100 percent native planting of trees and shrubs. 2. The MPEHOA has considered the potential hazards of the development by applying to remove the dead and dying hazardous cottonwoods and planning a riparian enhancement project for Clay Creek designed by NW Biological. During the project erosion control to protect the stream and banks will be followed. The new design will include 100 percent native species of plants--trees and shrubs-- thereby re-placing the non- native lawn grass and other invasive species. 3. The implementation plan for MPEHOA common area at 270 Meadow Drive as presented in the accompanying document will improve and enhance the riparian corridor and minimally impact the area as much as possible with the net result of a healthy riparian area that will have native plants that will hold soils in place and prevent erosion, filter sediments and pollutants, and allow rain to soak into the soil, producing cooler, cleaner water in Clay Creek. Additional benefits include improved habitat for native songbirds. 18.63.070.® Approval Standard for Limited Activities and Uses within Water Resource Protection Zones 1. The purpose of the riparian enhancement project following the removal of the cottonwoods at 270 Meadow Drive in the MPEHOA is to rehabilitate and enhance the riparian corridor. Thus, the enhancement plan designed by NW Biological will involve work in the stream and riparian area. The plan will disturb the riparian area as little as possible with all erosion measures used to protect the water and the banks. Intrusion into the Water Resources Protection Zone will be minimized and the surface area of the Water Resource Protection zone will be disturbed as little as practicable for this enhancement project. i 2. The proposed activity at 270 Meadow Drive in the MPEHOA will be designed, located and constructed to minimize excavation, grading, area of impervious surfaces, loss of native vegetation , erosion, and other adverse impacts on Water Resources. The only native plants to be impacted will be the cottonwood trees that will be removed. However, the Clay Creek riparian area will be replanted with 100 percent native shrubs and trees, thereby improving the riparian corridor. 3. The streambed and banks of Clay Creek at 270 Meadow Drive within the bank full stage, in wetlands, and on slopes of 25% or greater in a Water Resource Protection Zone, excavation, grading, installation of impervious surfaces and removal of native vegetation will be avoided except where no practicable alternative exists, or where needed to construct public facilities or to ensure slope stability. Minimal grading will be needed to achieve efficient stream flow and good flood capacity, and improved slope stability--a positive improvement to the current channelized stream. Only the native cottonwoods will be removed. The current non-native lawn grass and invasive species will be re-placed by 100 percent native trees and shrubs thus improving the riparian area at 270 Meadow Drive. No impervious surfaces will be installed. 4. Water, storm drain, and sewer systems will not be affected by this project. 5. NW Biological developed the mitigation and enhancement plan. See it for specifics, procedures, and details. 6. The long term conservation, management and maintenance of the Water Resource Protection Zone of Clay Creek will be ensured through preparation and recording of the management plan designed by NW Biological--see the accompanying document for details. The MPEHOA has begun consultation with its landscaping service, U. S.
