The data and radio network connections must be supported 24 hours a day and 7 days a week to support police operations. At this time Hunter Communications is the only known company that can provide and support these two network connections. The Ashland Police Department intends to enter into a 36 month contract for the data network connection and a 36 month contract for the radio network connection. BACKGROUND AND POLICY EUPLICATIONS: The Ashland Police Department has been contracting with Hunter Communications for these services for approximately 10 years. Diligent efforts were made by City staff to locate additional service providers, but once again found that Hunter Communications is the only service provider that can provide these support services in this area. Section 2.50.090 ]Exemptions from Formal Competitive Selection Procedures All Public Contracts shall be based upon Competitive Sealed Bidding (Invitation to Bid) or Competitive Sealed Proposals (Request for Proposal) pursuant to ORS 279A - 279C and the Model Rules except for the following: F. Sole Source Procurements - a public contract in which the Department Head finds in writing that there is only one provider of a product or service of the quality and type required available. 1. Sole-source procurements shall be awarded in accordance with ORS 27913.075 and all other applicable provisions of law. FISCAL IMPLICATIONS: Funds are budgeted annually for these services. The contract for the radio network connection is $864.00 per month for a total cost of $31,104.00 for 36 months. And, the contract for the data network connection is $648.00 per month for a total cost of $23,328.00 for 36 months. The total amount for both of the 36- month contracts is $54,432.00. STAFF RECOMMENDATION AND REQUESTED ACTION: Staff recommends that Council approve the two contracts with Hunter Communications for data Page 1 of2 CQTY OF ~5.,t~ network and radio network connection. Diligent efforts were made by City staff to locate additional service providers, but once again found that Hunter Communications is the only service provider that can provide these support services in this area Findings: /The findings below must include actual information supporting the determinationl Form #5- Sole Source-Goods and Services-Less than $100,000, Page 1 of 2, 2/1312014 Market'i[8esearch Overall finding: fln accordance with ORS 279B. 075, these are the examples of findings that should be addressed. Select at least one of the fzndinas and prepare the determination as it specifically relates to the goods or services being procured More than one finding can be addressed. The findings are as follows. The IT Department was able to identify only two companies who could provide this type of data communication service to the sites required: Hunter Communications and Charter Business Communications. o Hunter was the original provider who set up the original service and has been supplying it continuously for the past 10+ years. o For the purposes of this contract, Charter Communications was deemed unresponsive. After two initial phone calls, establishing that this was a type of service that they might be interested in providing, Charter failed to respond to any fiuther telephone calls, and the business phone number they provided us now says that the "number has been changed or disconnected." Pursuant to ORS 279B.075 (2)(a): Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source. N/A Pursuant to ORS 2798.075 (2)(b): Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source. Currently, Hunter Communications is the only service provider that can provide these suppoit services in this area Pursuant to ORS 2798.075 (2)(c): Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project. N/A Pursuant to ORS 2798.075 (2)(d): Any other findings that support the conclusion that the goods or services are available from only one source. See market research findings above.
