Applicant: Geoffrey & Elizabeth Holland Description: A request for Physical Constraints Review Permit for development in Hillside Lands for the property located at 355 Ashland Loop Road. The Planning Director has determined the proposed development is not subject to the Development Standards for Hillside Lands because the slope based on the natural grade of the property at the area if the proposed addition is less than 25%. The Development Standards for Hillside Land apply to lands with slopes 25% and greater. The applicant has submitted a survey establishing the natural grade at 23%. COMPREHENSIVE PLAN DESIGNATION: Rural Residential; ZONING: RR.5; ASSESSOR'S MAP: 391E 16BA; TAX LOT: 1201 The Community Development Director's decision becomes final and is effective on the 13th day after the Notice of Final Decision is mailed. Approval is valid for a period of one year and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.108.070(B)(2)(c). The parcel is approximately 25,000 square feet in size and is zoned Single Family Residential. The subject site is part of the Viewpoint Subdivision. The property has a 3,789 square foot single family home and garage on the site that was constructed in 1997. There are a number of trees on the parcel, no tree removal is proposed as part of this application. The applicant has proposed a 666 square foot addition to the lower level of the home. When the subdivision was created, building envelopes were provided; the proposed addition is within the approved building envelope. A Physical & Environmental Constraints Review permit for development in the Hillside Zone is required if it is found that the parcel has a natural grade with slopes of 25 percent and greater. According to the maps, on file with the City, the parcel has and average slope of 25 percent. The applicant has hired an Oregon licensed surveyor and the surveyor determined the natural grade of the property is 23 - 24 percent. The Planning Director has determined that the proposed development is not subject to the Development Standards for Hillside Lands because the slope is based on the natural grade of the property, which is less than 25 percent. There are portions of the site, which have slopes greater than 25 percent, but those areas will not be impacted by the development. The existing house was built in 1997. The addition shall be all on the lower floor level, at the northeast corner of the house. The "roof' over the addition shall be a roof deck, with the finished deck elevation at the same level as the existing deck at the upper floor. The construction of the project shall be wood framing over a concrete foundation and concrete block foundation wall. The roof shall be a wood-framed, nearly-flat roof deck. The intention with this project is to create a sense of integrity with the existing home. Therefore, we shall use the same exterior materials, windows and doors. The exterior materials will consist of exposed concrete block at the foundation level, horizontal lap wood siding at the living space level, clad wood windows and doors, wood and metal guardrails and wood or tile decking. The new decking over the addition will be over a single ply roof membrane, which will not be visible. The volume of the addition fits nicely under existing and new decking, which also helps to maintain a sense of integrity with the shape of the existing house. The site for the existing home was determined to need a Physical and Environmental Constraints Permit under the Hillside Lands portion of the City of Ashland Land Use Ordinance Chapter 18.62. In accordance with the requirements for this permit, an application was made and the permit granted. As a part of this process a building envelope was created and a tree inventory made and documented. Please find included in this application the location of the Building Envelope (see the attached Site Plan) and a separate tree inventory, as of 1989. The trees on this site are forest trees. The only difference from the inventory taken twenty-five years ago, is that the remaining trees are larger than indicated. We are proposing to take out only four trees, which are located "under" the addition and noted on the tree inventory. All other trees on the site will be protected and saved. The proposed addition is within the earlier defined Building Envelope. An analysis of the slope of the land we are proposing to build over was done by the Owner. (See attached.) His findings were that the land the addition would occupy slopes between 22% and 25%, with an average slope of 23%. 1 t Because the Physical and Environmental Constraints permit was obtained for the original construction, because we are proposing an addition within the approved Building Envelope, because we are saving all the existing trees but four, because there will be no cut and fill necessary for this addition, and because the average slope we will build upon is less than 25%, we are requesting that the process of obtaining a new Physical and Environmental Constraints permit be waived for this proj ect.
