Notice of Final Decision
On March 15, 2013, the Staff Advisor for the Ashland Planning Division administratively approved your
request for the following:
A minor land partition to create two parcels for the properly located at 380 Clay Street. One parcel (Parcel
1) will be retained as a dedicated City of Ashland park; the other parcel (Parcel 2) is zoned for future
residential development as low-density, multi-family residential (R-2 zoning). The application does not
include any requests for tree removals. Any future tree removal will be considered as part of the future
development proposal. There are no development proposals at this time.

The Staff Advisor's decision becomes final and is effective on the 13th day after the Notice of Final
Decision is mailed.
Prior to the final decision date, anyone who was mailed this Notice Of Final Decision may request a
reconsideration of the action by the Staff Advisor as set forth in the Ashland Land Use Ordinance
(ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in
the ALUO 18.108.070(B)(2)(c).
An appeal may not be made directly to the Land Use Board of Appeals. Oregon law states that failure to
raise an objection concerning this application, by letter, or failure to provide sufficient specificity to afford
the decision maker an opportunity to respond to the issue, precludes your right of appeal to LUBA on that
issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of
appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to
proposed conditions of approval with sufficient specificity to allow this Department to respond to the
issue precludes an action for damages in circuit court.
The application, all associated documents and evidence submitted, and the applicable criteria are available
for review at no cost at the Ashland Community Development Department, located at 51 Winburn Way.
Copies of file documents can be requested and are charged based on the City of Ashland copy fee
schedule.

DECISION
The subject property is located approximately mid-block on the east side of the lower portion of
Clay Street, north of Ashland Street, and is zoned for Low Density Multi-Family residential
development (R-2). The properties to the east, west and south are also zoned R-2 and the
property to the north is outside of City limits but within the Urban Growth Boundary.
The partition request is for the approximately four (4) acre L-shaped parcel located on lower
Clay Street to create two lots. Parcel 1, would consist of the 3.18 property which has been
dedicated q.s park land. Parcel 2, would be 0.92 acres in size and would be available for
development consistent with the R-2 zone and the Resolution 2011-006 which discusses the
requirements for partition.
The Parks Department will undertake a Master Planning process for Parcel 1 in association with
the YMCA Park, which is to include the installation of a permanent multi-use pathway to replace
the temporary pathway that was previously installed. When development on Parcel 2 is proposed
it will be subject to the Site Design Review Standards for multi-family development.
The properties are adjacent to Clay Street, Villard and Engle Streets, public utilities are in place
and available to service both of the parcels. Water, sanitary sewer, storm drain infrastructure and
electric were extended for the recent development of the adjacent Jackson County Housing
Authority property to the north of the subject property.
Villard and Engel Streets were constructed to half-street improvements including curbs, gutters,
storm drain facilities, planting strip and public sidewalk on the north and west sides of the street:

In order to complete these streets to the City Street Standards for a neighborhood street a portion
of both property frontages, will need to be dedicated as additional public right-of-way or a public
pedestrian access easement as necessary to accommodate future sidewalk improvement at their
respective time of development. A condition to this effect has been added.
A street reservation area will provided along the north property line to enable the installation of a
future street, with a goal of maintaining the potential for an additional east-west connection
between Clay Street and Tolman Creek Road. A new street is not proposed at this time.
Additionally,' dedication of the right-of-way area necessary for a new alley connection from the
end of McCall Drive to the intersection of Villard and Engle Streets is proposed as part of the
partition. Sidewalks along Engle Street will be installed along the frontage of Parcel 1 upon
development of the park property. The utility and sidewalk installation is dependent on the. final
design of the multi-family development for Parcel 2 and the master park plan for Parcel 1, and
those improvements are best installed at the time of those developments.
There are a number of large stature trees on the proposed Parcel 2 which will not be impacted as
part of the partition. The future development of the site will be required to address the applicable
standards for multi-family development, including but not limited to Multi-Family Site Review,
Tree Removal and Tree Protection and Preservation requirements. Additionally, the existing
structures on the proposed Parcel 2 will require demolition permits.
The proposed partition is fairly straightforward and will not have physical impacts the existing
property. The subject property has not been partition in the last 12 months, and the proposed
partitioning here is not in conflict with any applicable laws, ordinances or resolutions. At the
time of future development, the utility and street infrastructure will be completed for each of the
parcel. The development of Parcel 2 will require further review and noticing for the multi-family
site review as required by Ashland Municipal Code. The future purposes of the subject property j
will not be impeded by the proposed partition. Therefore, the proposed Minor Land Partition
complies with the minimum requirements in accordance with 18.76, and hereby approved.
The criteria for a Minor Land Partition are described in AMC Chapter 18.76, as follows:
A. Tlie future use for urban purposes of the remainders of the tract will not be impeded.
B. The development of the remainder of any adjoining land or access thereto will not be
impeded.
C. The tract of land has not been partitioned for 12 months.
D. The partitioning is not in conflict with any law', ordinance or resolution applicable to the
land.
E. The partitioning is in accordance with the design and street standards contained in the
Chapter 18.88, Performance Standards Options. (Ord 2836 S8, 1999)
F. When there exists adequate public facilities, or proof that such facilities can be provided,
as determined by the Public Works Director and specified by City documents, for water,
sanitary sewers, storm sewer, and electricity.

G. When there exists a 20 foot wide access along the, entire street frontage of the parcel to
the nearest fully improved collector or arterial, street, as designated in the
Comprehensive Plan. Such access shall beimproved with an asphaltic concrete pavement
designed for the use of the proposed street. The minimum width of the street shall be 20-
feet with all work done under permit of the Public Works Department
1. The Public Works Director may allow an unpaved street for access for a minor land
partition when all of the following conditions exist:
a. The unpaved street is at least 20 feet wide to the nearest fully improved collector
or arterial street.
b. The centerline grade on any portion of the unpaved street does not exceed ten
percent.
2. Should the partition be on an unpaved street and paving is not required, the applicant
shall agree to participate in the costs and to waive the rights of the owner of the
subject property to remonstrate both with respect to the owners agreeing to
participate in the cost of full street improvements and to not remonstrate to the
formation of a local improvement district to cover such improvements and costs
thereof. Full street improvements shall include paving, curb, gutter, sidewalks and
the under grounding of utilities. This requirement shall be precedent to the signing of
the final survey plat, and if the owner declines to so agree, then the application shall
be denied.
H. Where an alley exists adjacent to the partition, access may be required to be provided
fi°om the alley and prohibited from the street. (amended Ord. 2757, 1995)
The application with the attached conditions complies with all applicable City ordinances.
Planning Action 2013-00104 is approved with the following conditions. Further, if any one or
more of the following conditions are found to be invalid for any reason whatsoever, then
Planning Action 2013-00104 is denied. The following are the conditions and they are attached to
the approval:
1) All proposals of the applicant shall be conditions of approval unless otherwise modified here.
2) That a final survey plat shall be submitted within 12 months and approved by the City of
Ashland within 18 months of this approval.
3) That the requirements outlined in Resolution 2011-006 shall be adhered to. as part of this
partition.
4) That a 20-foot wide right-of-way for the completion of the McCall Drive alley improvements
shall be provided for on final survey plat.
5) That a 20-foot wide access easement and future street reservation area shall be provided
along the northern most edge of Parcel 2 connecting to the existing easement on the property
to the east.
6) That the easements for any public and private utilities shall be indicated on the final survey
plat as required by the Ashland Engineering Division.

7) That the dedication of public right-of-way or public pedestrian easement as necessary to
accommodate future sidewalk installation be provided at the time of future development of
Parcel 1 and Parcel 2.
8) That a final utility plan for the parcels shall be submitted for review and approval by the
Planning, Engineering, and Building Divisions prior to signature'of the final survey plat. The
utility plan shall include the location of connections to all public facilities including the
locations of water lines and meter sizes, fire hydrants, sanitary sewer lines, storm drain lines
and electric services.
9) That a Demolition / Relocation Review Permit shall be applied for and approved prior to the
removal of any structures necessary to develop the property.
10) That a Site Review application shall be made for the future development of Parcel 2 (380
Clay Street).
11) That the public alley improvements connecting to McCall Drive shall be installed in
accordance with the Resolution 2011-06.
12) That the applicable conditions of PA2009-00043 including but not limited to the following
shall be adhered too.
a) At the time that Lot #1 (herein known as Parcel 1) is developed, engineered
construction drawings for the project addressing the design and installation of
public multi-use pathways, fence and gates from the subject property to the City
of Ashland Parks/Ashland Family YMCA Soccer Fields shall be provided: The
design of any multi-use pathways shall. be in accord with City Local Street
Standards, reviewed by the Director of the Ashland Parks Department, and
approved by the Staff Advisor prior the installation of improvements associated
with the development of Lot #1 (Parcel 1),
b) That the owner of Lot 41 (herein known as Parcel 2) shall remain responsible for
the pruning and continual monitoring of the remaining poplar tree. The owner of
Lot #2 (Snowberry Brook, 39 lEl 1C 2501) shall be responsible for the
maintenance of their storm water detention facilities, including for bio-swales to
be installed in the Clay Street park row planting strip.

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn
Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning
Division Staff's decision must be made in writing to the Ashland Planning Division within 12 days from the date of the mailing of final decision. (AMC
18.108.040)
The ordinance criteria applicable to this application are attached to this notice. Oregon law states that failure to raise an objection concerning this
application, by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes your right of
appeal to the Land Use Board of Appeals (LUBA) on that issue. Failure to specify which ordinance criterion the objection is based on also precludes your
right of appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with
sufficient specificity to allow this Department to respond to the issue precludes an action for damages in circuit court.

MINOR LAND PARTITION CRITERIA
Section 18.76.050 Preliminary Approval
An application for a preliminary partition shall be approved when the following conditions exist:
A. The future use for urban purposes of the remainder of the tract will not be impeded.
B. The development of the remainder of any adjoining land or access thereto will not be impeded.
C. The tract of land has not been partitioned for 12 months.
D. The partitioning is not in conflict with any law, ordinance or resolution applicable to the land.
E. The partitioning is in accordance with the design and street standards contained in the Chapter 18.88, Performance Standards Options.

F. When there exists adequate public facilities, or proof that such facilities can be provided, as determined by the Public Works Director and specified by City
documents, for water, sanitary sewers, storm sewer, and electricity.
G. When there exists a 20-foot wide access along the entire street frontage of the parcel to the nearest fully improved collector or arterial street, as
designated in the Comprehensive Plan. Such access shall be improved with an asphaltic concrete pavement designed for the use of the proposed street.
The minimum width of the street shall be 20-feet with all work done under permit of the Public Works Department.
1. The Public Works Director may allow an unpaved street for access for a minor land partition when all of the following conditions exist:
a. The unpaved street is at least 20-feet wide to the nearest fully improved collector or arterial street.
b. The centerline grade on any portion of the unpaved street does not exceed ten percent,
2. Should the partition be on an unpaved street and paving is not required, the applicant shall agree to participate in the costs and to waive the rights of
the owner of the subject property to remonstrate both with respect to the owners agreeing to participate in the cost of full street improvements and to
not remonstrate to the formation of a local improvement district to cover such improvements and costs thereof. Full street improvements shall include
paving, curb, gutter, sidewalks and the undergrounding of utilities. This requirement shall be precedent to the signing of the final survey plat, and if
the owner declines to so agree, then the application shall be denied.
H. Where an alley exists adjacent to the partition, access may be required to be provided from the alley and prohibited from the street.

The request is for a Minor Land Partition of a city owned approximately four (4) acre parcel
located on lower Clay Street to create two lots. Each lot will comply with the applicable
standards as set forth in the applicant's written finds provided below.
BACKGROUND INFORMATION:
In November 2008 the City of Ashland, City Council approved the acquisition of a 10-acre
property on Clay Street in partnership with the Housing Authority of Jackson County (HAJC).
The property was subsequently partitioned to provide four (4) acres for development of a 60 unit
affordable rental complex owned and operated by HAJC. The remaining area comprised of a
City of Ashland owned wetland area, rights-of-ways for streets (both installed and future) and
the remaining four (4) acres which is proposed to be partitioned at this time.
In February 2011, the City Council adopted Resolution 2011-06 which outlined the terms of the
land partition and Parks Department's acquisition of 3.18 acres of the four (4) acre Clay Street
property. The Park portion is to expand and enhance the adjacent City owned YMCA Park. The
remaining .92 acres will be available for future residential development consistent with the
underlying Multifamily zoning (R-2).
PROPOSAL I
The applicant proposes a minor land partition of

The subject property is located approximately Viliard St. Partition

zoned for Low Density Multi-Family i

residential development (R-2). The properties to the east, west and south are also zoned R-2, and
the property to the north is outside of City limits but within the Urban Growth Boundary. This
property along the northern boundary of the subject property has a comprehensive plan
designation of Suburban Residential and when annexed into the city limits is expected to be
zoned R-1-3.5..
The subject property is L-shaped, the property extends to the east away from Clay Street, wraps
behind the HAJC property and is adjacent to the YMCA Park to the east. Villard Street is to the
north of the property and Engle Street is to the east of the subject property. The north boundary
of the subject property adjoins a 4.80 acre parcel which is outside of City limits but within the
City of Ashland Urban Growth Boundary. The southern property line adjoins three parcels with
single family residences and the end of the Barkley Square (McCall Drive) subdivision. The
proposed partition will be at the intersection of Villard and Engle Streets.
There are currently at 1053 square foot vacant house built in approximately 1890, a dilapidated
farmhouse, a barn, and shed located on proposed Parcel 2. These structures are not proposed to
be removed or modified as part of the partition proposal. It is anticipated that future development
will necessitate the removal of the structures as a separate action.
The property slopes approximately 3 - 6 percent from south to north. With the location of
Villard Street to the north of Parcel 2, future residential development will comply with the solar
setback ordinance as the new structures will be allowed to shade across the 50-foot street right-
of-way.
There are 14 trees greater than six inches in diameter at breast height (DBH) on the subject
property. No tree removal is requested as part of the partition request. Any tree removal
ultimately associated with the future development of multifamily housing, or further subdivision
of Parcel 2, would require a tree removal permit to be processed and reviewed as part of the
development proposal at that time.
In originally acquiring the property, the Council requested that a street reservation area be
provided along the north property line to enable the installation of a future street, with a goal of
maintaining the potential for an additional east-west connection between Clay Street and Tolman
Creek Road. As indicated on the attached Exhibit A, a future street reservation area has been
delineated along the north property line to retain this potential connection. No new street is
proposed at this time. Delineation and dedication of the right-of-way area necessary for a new
alley connection from the end of McCall Drive to the intersection of Villard and Engle Streets is
proposed as part of the partition. The alley improvements however will be installed at the time of
the development of Parcel 2.

A temporary multi-use pathway for cyclists and pedestrians was installed by the HAJC to
provide access from Engle Street to YMCA Park. The Parks Department will undertake a Master
Planning process for Parcel 1 in association with the YMCA Park, which is to include the
installation of a permanent multi-use pathway.
The utilities necessary to service both parcels are available in the adjacent right-of-ways and will
be installed at the time of the development of the parcels. Additionally, the sidewalks along
Villard Street is to be installed at the time of development of Parcel 2. Sidewalks along Engle
Street will be installed along the frontage of Parcel 1 upon development of the park property or
as indicated in the previously mentioned master plan for the park property once completed. The
utility and sidewalk installation is dependent on the final design of the multi-family development
for Parcel 2 and the master park plan for Parcel 1, and those improvements are best installed at
the time of those developments.
The existing conditions of approval for the original 10-acre subdivision remain in effect (see
attached).
FINDINGS OF APPROVAL
SECTION 18.76.050 Preliminary Approval
An application for a preliminary partition shall be approved when the following conditions exist:
A. The future use for urban purposes of the remainder of the tract will not be impeded.
The proposed partition allows for the expansion of the City YMCA Park by 3.18 acres. The
partition also allows for the development of a vacant, multi-family zoned property into
approximately 18 units. The partition allows for the development as the property as envisioned in
the Comprehensive Plan, the adopted Open Space Plan, and Resolution 2011-06 as approved by
the City Council.
B. The development of the remainder of any adjoining land or access thereto will not be
impeded.
No impediments will be created by the partition. Engle Street provides future access to the
property to the north. The street reservation area along the North property line provides a
potential future access to and through the 3.18 acre parcel owned by the Parks Department
(Parcel 1). The future alley connection to McCall Drive will provide an additional access for the
.92 acre portion of the property (Parcel 2) and complete a neighborhood circulation connection
as identified in the draft 2012 Transportation System Plan.
C. The tract of land has not been partitioned for 12 months.

The property has not been partitioned in the past 12 months.
D. The partitioning is not in conflict with any law, ordinance or resolution applicable to
the land.
The proposed partition is in compliance with all laws, ordinances, and regulations applicable to
the land.
E. The partitioning is in accordance with the design and street standards contained in
the Chapter 18.88, Performance Standards Options.
Sidewalks are installed along the Clay Street frontage. The future sidewalks, driveway access
points, and other street improvements are to be installed at the time of the future development.
The locations of said improvements are integral to the development.
F. When there exists adequate public facilities, or proof that such facilities can be
provided, as determined by the Public Works Director and specified by City
documents, for water, sanitary sewers, storm sewer, and electricity.
Adequate public facilities are in place to serve the proposed parcels.
An eight (8) inch sanitary sewer line is in place within the Clay Street right-of-way. The sewer
line is sufficient to provide service to the new development.
There are eight inch water mains in both Clay Street and Villard Street. When Villard and Engle
Streets were installed 18 water services were stubbed to the subject property.
Upon future development Storm drainage can be directed to the new storm drain lines which
then filter through the wetlands along the north property line of the HAJC complex. The storm
drainage may also be directed into the improved green street storm water features along Clay
Street. Both facilities have capacity to service the new development.
G. When there exists a 20-foot wide access along the entire street frontage of the parcel
to the nearest fully improved collector or arterial street, as designated in the
Comprehensive Plan. Such access shall be improved with an asphaltic concrete
pavement designed for the use of the proposed street. The minimum width of the
street shall be 20-feet with all work done under permit of the Public Works
Department.
1. The Public Works Director may allow an unpaved street for access for a minor land
partition when all of the following conditions exist:
a. The unpaved street is at least 20-feet wide to the nearest fully improved
collector or arterial street.

b. The centerline grade on any portion of the unpaved street does not exceed
ten percent.
Not applicable. The streets which provide access to the subject property (Clay Street and
Villard) are paved, public streets.
2. Should the partition be on an unpaved street and paving is not required, the
applicant shall agree to participate in the costs and to waive the rights of the
owner of the subject property to remonstrate both with respect to the owners
agreeing to participate in the cost of full street improvements and to not
remonstrate to the formation of a local improvement district to cover such
improvements and costs thereof. Full street improvements shall include paving,
curb, gutter, sidewalks and the undergrounding of utilities. This requirement shall
be precedent to the signing of the final survey plat, and if the owner declines to so
agree, then the application shall be denied.
Clay Street is fully improved across the frontage of the parcel. Villard and Engle Streets are
partially improved. Pavement, curb and gutter were installed at the time of the development
of the HAJC property to the north. A seven (7) foot parkrow, and five (5) foot sidewalk will
be provided at the time of the development of the parcels. Approximately ten (10) feet of
right-of-way exists between the curb and the property line along Villard and Engle Streets.
As part of the partition the additional two - three feet of necessary right-of-way or public
access easements for sidewalk and parkrow installation will be dedicated on the final survey.
Additionally, utilities are available to service the parcel. These utilities will be extended to
the parcels at the time of the development of the site.
H. Where an alley exists adjacent to the partition, access may be required to be provided
from the alley and prohibited from the street.
.The alley connection to McCall Drive is proposed to be platted as part of the partition and will be
installed at the time of development of Parcel 2.
The proposed partition request is consist with Resolution 2011-06 authorizing a land transfer
between the City of Ashland and the Ashland Parks Department Relating to the dedication of a
portion of the property located at 380 Clay Street. No site improvements will occur until either
the Parks Department Master Planning effort is complete for parcel 1, or the development
application for Parcel 2 is processed.

A RESOLUTION AUTHORIZING A LAND TRANSFER
BETWEEN THE CITY OF ASHLAND A THR ASHLAND
PARKS DEPARTMENT RELATING TO THE DEDICATION
OF A PORTION OF''I HE PROPERTY LOCATED AT
380 CLAY STREET FOR PARK PURPOSES.
Recitals:
A. The City of Ashland (hereinafter "City) has acquired property at 380 Clay Street, which is
identified in the 2000-2012 Open Space Master Plan.
B. The Ashland Parks Department (hereinafter "Department") desires to own, operate, and
maintain parks and open space as identified in the 2000-2012 Open, Space Master Plan.
C. The City desires to divest itself of ownership, development, management, and financial
responsibility of approximately 3.18 acres of the subject property.
D. The Department's acquisition of this property will enable it to address the Comprehensive
Plan goal of providing the people of Ashland with a variety, quantity and quality of parks, open
space, trails and visual resources sufficient for the community's needs.
THE CITY OF ASHLAND RESOLVES AS FOLLOWS:
SECTION 1. Land Transfer. The City agrees to transfer to the Department approximately 3.18
acres of land, referenced as "City Parks 3.18 acres" in Exhibit A, which is attached and
incorporated herein by this reference. The City shall retain approximately 0.92 acres of land,
referenced as "City of Ashland 0.92 acres" in Exhibit A, and f acre of wetlands referenced as
"City Parks (wetland) 1 acre." in Exhibit A.
SECTION 2. Payment Terms.- The Department shall pay a total of $1,350,000. The Department
shall make payments of $208,000 per year beginning in fiscal year 2010-2011, and continue to
pay such amount on an annual basis until paid in full: All annual payments are based on the
City's fiscal year.
SECTION 3. Infrastructure Improvements. In addition to payment for purchase of the
property, the Department agrees to pay 50% of the total cost for all shared infrastructure and
planning actions. Specifically, the Department agrees to pay for 50% of the total cost to the City
of the right turn lane from Clay onto Ashland Street including sidewalk and Curb improvements
on Clay Street. The Department's payment for these infrastructure improvements will be
approximately $34,406. However, the City and the Department will each be solely responsible
for any infrastructure that is required for permitted activities that "shall occur exclusively on the
City's or the Department's property. Therefore, the City will be solely responsible for necessary
improvements and permits required to develop the property it is retaining, and the Department

shall be solely responsible for necessary improvements and permits to develop the transferred
property.

SECTION 4. Maintenance of Wetland. The City. shall retain the wetland; however, the City
and the Department agree to share the maintenance of the area referenced as "City Parks
(wetland) 1 acre." The City and the Department shall discuss the maintenance schedule and cost
each fiscal year. The City and the Department shall delegate to the City Administrator and the
Parks Director the authority to determine a maintenance schedule each year.
SECTION 5. Partition of Property. The City and the Department shall file and pursue to
approval, including any appeals, an application to partition the Property so that at least two legal
parcels are created. The City parcel shall constitute approximately 37.5% of the land area, and
the Department parcel shall constitute, approximately 62.5% of the land area of the parent parcel.
The parties may agree to create a discrete third parcel for the wetland area to facilitate continuing
maintenance. This future land division will be in substantial conformity with the site layout plan,
including but not limited to future street reservation area, alley extension, and pathways
development, as indicated in Exhibit A. The City and Department shall be jointly responsible for
permit fees associated with a land use application including surveying and engineering costs
associated with the partition.
SECTION 6. The land transfer shall reserve to the City parcel the full residential dwelling
potential of the parent parcel. Any additional units which may be obtained by amendment to the
outline plan, by density bonuses, transferable development rights or any other means, shall be
reserved to the City.
SECTION 7. The City, or subsequent developer of the 0.92 acre property, and the Department
shall be jointly responsible to construct and fund the installation of an alley connection from
Villard and Engle Streets to the existing McCall Drive alley terminating along the south property
line. Construction costs associated with the extension of McCall Drive Alley shall be divided
equally between the City and the Department.
