COMPREHENSIVE PLAN DESIGNATION: Low-Density Multiple Family Residential; ZONING: R-2; ASSESSOR'S MAP: 391 E09DB ; TAX LOT: 14300 The Community Development Director's decision becomes final and is effective on the 13th day after the Notice of Final Decision is mailed. Approval is valid for a period of one year and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.108.070(B)(2)(c). B. Actions subject to appeal 2, Type I Planning Actions. a. Effective Date of Decision. The final decision of the City for planning actions resulting from the Type I Planning Procedure shall be the Staff Advisor decision, effective on the 13th day after notice of the decision is mailed unless reconsideration of the action is approved by the Staff Advisor or appealed to- the Commission as provided in section 18.108.070(B)(2)(c). b. Reconsideration. The Staff Advisor may reconsider Type I planning actions as set forth below. i. Any party entitled to notice of the planning action, or any City Agency may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the staff advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised.by.letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. ii. Reconsideration requests shall be received within five (5) days of mailing. The Staff Advisor shall decide within three (3) days whether to reconsider the matter. iii. If the Planning Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten (10) days to affirm, modify, or reverse the original decision. The Staff Advisor shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. iv. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. C. Appeal. i. Within twelve (12) days of the date of the mailing of the Staff Advisor's final decision, including any approved reconsideration request, the decision may be appealed to the Planning Commission by any party entitled to receive notice of the planning action. The appeal shall be submitted to the Planning Commission Secretary on a form approved by the City Administrator, be accompanied by a fee established pursuant to City Council action, and be received by the city no later than 4,30 p.m. on the 12th day after the notice of decision is mailed, ii. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the city and whose boundaries include the site. iii. The appeal shall be considered at the next regular Planning Commission or Hearings Board meeting. The appeal shall be a de novo hearing and shall be considered the initial evidentiary hearing required under ALUO 18.108.050 and ORS 197.763~as the basis for an appeal to the Land Use Board of Appeals. The Planning Commission or Hearings Board decision on appeal shall be effective 13 days after the findings adopted by the Commission or Board are signed by the Chair of the Commission or Board and mailed to the parties. iv. The appeal requirements of this section must be fully met or the appeal will be considered by the city as a jurisdictional defect and will not be heard or considered. COMPREHENSIVE PLAN DESIGNATION: Low-Density Multi-Family; ZONING: R-2; ASSESSOR'S MAP: 39 1E 09 BD ; TAX LOT: 14300; SUBMITTAL DATE: May 11, 2014 DEEMED COMPLETE DATE: June 6, 2014 STAFF APPROVAL DATE: June 25, 2014 APPEAL DEADLINE: July 7, 2014 APPROVAL EXPIRATION DATE: July 10, 2013 DECISION The subject property is located on the north side of Siskiyou Boulevard, between Sherman and Morton Streets. The parcel and surrounding uses are zoned R-2, Low-Density Multi-Family, and is located within the Siskiyou-Hargadine Historic District. The 6,726 square foot property contains an existing 1,160 square foot home, and a detached accessory unit less.than 500 square feet accessed off the alley. Siskiyou Street is classified as an Arterial Street, and is fully improved with sidewalks, curbs, gutters, park rows, and street trees. A50-foot parking bay is directly adjacent to this property on Siskiyou, and timed for 4-hour parking from 8 am to 8 pm. According to the City's historic resource inventory, the Nels Thompson Rental house was most likely built in 1906, and used as a rental property with many predominant tenants throughout the years. The house is notable for its finely detailed central gable, with fan light decoration surrounding the central louvered vent. Other elements include a wide frieze below the boxed soffit, and crowns on several window surrounds and the character defining three-window grouping that dominates the fagade. With these elements, the Thompson house effectively relates to its original design and appearance during its period of significance, therefore considered a Historic Contributing resource.. i In 1991; staff approved the conversion of a garage into detached living space, however subsequent to receiving final building inspections; a kitchen was illegally installed thereby converting its use into an j unpermitted independent residential unit. In 2000, the proposed unit was granted Site Review approval for the conversion of an existing structure into a legal, second residential unit on the property (PA- 2000-116). The application proposes to utilize the detached apartment as a one-unit Travelers Accommodation unit, with the owners residing on-site in the main home. Ashland Municipal Code 18.24.030.K. requires that Travelers Accommodations be "business-owner" occupied In accordance with Ashland Municipal Code 18.24.030.K, the property owner is required to live on-site, the structure be at least 20 PA-2014-00831 657 Siskiyou Blvd./MP Page 1 years old, be within 200 feet of an arterial or collector, provide a parking space per each unit, plus two for the owners unit, and have an average area of 400 square feet per unit. The maximum number of units allowed is calculated by dividing the total square footage of the lot by 1800. This would allow up to four units (6,726/1800 = 3.74), however, the applicant is proposing to utilize just the detached apartment as a travelers' accommodation. The applicants have submitted materials to the Planning Department that demonstrated compliance with the approval criteria within the Conditional Use Chapter of the Ashland Municipal Code, including being within 200 feet of an arterial street, age requirements, owner occupancy, as well as other pertinent information addressing the approval criteria noted in AMC 18.28.030. The Historic Commission at their June 4, 2014 regular meeting had no recommendations regarding the proposal, therefore approved the application as submitted. No exterior modifications are proposed; thus, the proposed use will be architecturally compatible with the surrounding neighborhood. Adequate capacity for water, sanitary sewer, storm drain and electric facilities are already in place. The property has established landscaping in place in good condition. In summary, given the location of the property, staff believes utilizing the existing apartment as a single Traveler's Accommodation would likely result in more pedestrian activity. Therefore, staff believes the operation of a Traveler's Accommodation will not have an adverse impact on the neighborhood. Additionally, with no site modifications proposed, the change in use will have little effect on the existing development pattern in establish historic neighborhood. Staff finds that the request for a two-unit Traveler's Accommodation meets the approval criteria of the Ashland Municipal Code. Approval Criteria for a Conditional Use Permit (18.104.050): A. That the use would be in conformance with all standards within the zoning district in which the use is proposed to be located, and in conformance with relevant Comprehensive plan policies that are not implemented by any City, State, or Federal law or program. B. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. C. That the conditional use will have no greater adverse material effect on the livability of the impact area when compared to the development of the subject lot with the target use of the zone. YPlien evaluating the effect of the proposed use on the impact area, the following factors of livability of the impact area shall be considered in relation to the target use of the zone: 1. Similarity in scale, bulk, and coverage. 2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and mass transit use are considered beneficial regardless of capacity of facilities. 3. Architectural compatibility with the impact area. 4. Air quality, including the generation of dust, odors, or other environmental pollutants. 5. Generation of noise, light, and glare. 6 The development of adjacent properties as envisioned in the Comprehensive Plan. 7. Other factors found to be relevant by the Hearing Authority for review of the proposed use. Approval criteria for a Travelers' Accommodation (18.24.030K): 1. That all residences used for travelers accommodation be business-owner occupied. The business- PA-2014-00831 657 Siskiyou Blvd./W Page 2 owner shall be required to reside on the property occupied by the accommodation, and occupancy shall be determined as the travelers' accommodation location being the primary residence of the owner during operation of the accommodation. "Business=owner" shall be defined as a person or persons who own the property and accommodation outright; or who have entered into a lease agreement with the property owner(s) allowing for the operation of the accommodation. Such lease agreement to specifically state that the property owner is not involved in the day to day operation or financial management of the accommodation, and that the business-064,ner is wholly responsible for all operations associated with the accommodation, and has actual ownership of the business. (ORD 2806 SI, 1997) 2. That each accommodation unit shall have 1 off-street parking space, and the owners shall have 2 parking spaces. All spaces shall be in conformance with the requirements of the Off-Street Parking section of this Title. 3. That only one ground or wall sign, constructed of a non plastic material, non-interior illuminated of 6 sq. ft. maximum size be allowed. Any exterior illumination of signage shall be installed such that it does not directly illuminate any residential structures adjacent or nearby the travelers' accommodation in violation of 18.72.110. 4. That the number of accommodation units allowed shall be determined by the following criteria: a. That the total number of units, including the owner's unit, shall be determined by dividing the total square footage of the lot by 1800 sq. ft. Contiguous lots under the same ownership may be combined to increase lot area and the number of units, but not in excess of the maximum established by this ordinance. The maximum number of accommodation units shall not exceed 9 per approved travelers' accommodation with primary lot frontage on arterial streets. The maximum number of units shall be 7 per approved travelers' accommodation with primary lot frontage on designated collector streets; or for travelers' accommodations not having primary frontage on an arterial and within 200 feet of an arterial. Street designations shall be as determined by the Ashland Comprehensive Plan. Distances shall be measured via public street or alley access to the site from the collector or arterial. b. Excluding the business-owner's unit and the area of the structure it will occupy, there must be at least 400 sq. ft. of gross interior floor space remaining per unit. 5. That the primary residence on the site be at least 20 years old. The primary residence may be altered and adapted for travelers' accommodation use, including expansion of floor area. Additional structures may be allowed to accommodate additional units, but must be in conformance with all setbacks and lot coverages of the underlying zone. 6 Transfer- of business-ownership of a travelers' accommodation shall be subject to all requirements of this section, and subject to Conditional Use Permit approval and conformance with the criteria of this section. All travelers' accommodations receiving their initial approvals prior to the effective date of this ordinance shall be considered as approved, conforming uses, with all previous approvals, conditions and requirements remaining in effect upon change of business-ownership. Any further modifications beyond the existing approvals shall be in conformance with all requirements of this section. 7. An annual inspection by the Jackson County Health Department shall be conducted as required by the laws of Jackson County or the State of Oregon. (Ord. 2776 SI, 1996) 8. That the property on which the travelers' accommodation is operated is located within 200 feet of a collector or arterial street as designated in the City's Comprehensive Plan. Distances shall be measured via public street or alley access to the site from the collector or arterial. The application accompanied by the attached conditions meets all applicable criteria for Site Review approval and a Conditional Use Permit for reconstruction of a non-conforming building. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action PA-2014-00831 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant be conditions of approval unless otherwise modified here. 2. That the approval shall be for one guest unit, and one owner's unit only; and that any future expansion of accommodation units, changes of business ownership or manager-occupancy, or other modifications to the original proposal shall be subject to the conditional use permit procedure. 3. That the business owner shall obtain a City of Ashland business license prior to operation of the travelers' accommodation. 4. That only one wall or ground sign is permitted onsite in conjunction with the Traveler's Accommodation. The sign shall be constructed out of a non-plastic material, and non- internally illuminated with a maximum size of 6 square feet, and have a maximum overall height of five feet. Any exterior illumination shall not direct light on any adjacent residential. uses. That a sign permit in compliance with Chapter 18.96 of the Ashland Land Use Ordinance shall be obtained prior to the placement of any signage on the property. 5. That the applicant apply for a new address for the Accessory Unit that meets City of Ashland requirements. 6. That 657 Siskiyou Blvd. must remain the primary residence (AMC 18.08.605) of the business owner. 7. Although of uncertain history, the design and scale are typical of those in-fill structures built in the district after WWII. A single-story volume comprised of several gable volumes, this structure in notable for a small projecting porch canopy. Siding, trim, and windows are consistent with the presumed original construction and the house is accordingly counted as a historic contributing resource. 28.00 Survey #344 NELS THOMPSON RENTAL HOUSE 1 19060 657 SISKIYOU BLVD 391E09AC 13400 STYLE: OTHER: VERNACULAR, HIPPED-ROOF COTTAGE HISTORIC CONTRIBUTING A small single-story hipped cottage with entrant porch, this structure was probably built circa 1906 after the lot was purchased by Nels Thompson, a carpenter. Thompson and his wife Anna lived at several different Siskiyou Boulevard addresses and likely used this property as a rental. In 1910 Louis and Jessie Dodge rented the property., Mr. Dodge was a part of his father's longtime Ashland furniture and mortuary firm, J. P. Dodge and Sons. In 1919 Thompson sold the house to R. S. Comstock (JCD 125:145). In 1948-1949 the house was owned and occupied by C. 1. J. and Minnie Porter (JCD 277:625). The Thompson House is notable for its finely detailed central gablet, with fan-light decoration surrounding a central louvered vent. Other early elements include the wide frieze below a boxed soffit, crowns on several window surrounds and the character-defining three-window grouping that dominates the fagade. AMERICANMOv.: BuNGALow HISTORIC CONTRIBUTING A fine one and one-half story gabled bungalow with a large shed dormer and full-width porch, the Nels Thompson Rental House 2 was built after 1907 and stood by 1911, according to Sanborn Fire Insurance Maps. Thompson, who owned other rentals in this block, purchased the property following tax foreclosure against an earlier owner, J. L. Coburn. Thompson sold the house to Elda Anderson in 1923. By 1942 Mrs. Anderson, then listed as the widow of Herman O., was living at 685 Siskiyou and this property was owned and occupied by Joseph H. and Frances G. Hardy, who owned the Ashland Groceteria (JCD 189:404). The Hardy's remained here through at least through 1949 but by the mid-1950s were living on Granite Street. Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winbum Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above. Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Documentl CONDITIONAL USE PERMITS 4 18.104.050 Approval Criteria A conditional use permit shall be granted if the approval authority finds that the proposed use conforms, or can be made to* conform through the imposition of conditions, with the following approval criteria. A. That the use would be in conformance with all standards within the zoning district in which the use is proposed to be located, and in conformance with relevant Comprehensive plan policies that are not implemented by any City, State,-or Federal law or- program. B. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation can and will be provided to and through the subject property. C. That the conditional use will have no greater adverse material effect on the livability of the impact area when compared to the development of the subject lot with the target use of the zone. When evaluating the effect of the proposed use on the impact area, the following factors of livability of the impact area shall be considered in relation to the target use of the zone: 1. Similarity in scale, bulk, and coverage. 2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and mass transit use are considered beneficial regardless of capacity of facilities. 3. Architectural compatibility with the impact area. 4. Air quality, including the generation of dust, odors, or other environmental pollutants. 5. Generation of noise, light, and glare. 6. The development of adjacent properties as envisioned in the Comprehensive Plan. 7. Other factors found to be relevant by the Hearing Authority for review of the proposed use. TRAVELER'S ACCOMODATIONS 18.24.030.K Approval Criteria K. Traveler' s accommodations, subject to the following: 1. That all residences used for travelers accommodation be business-owner occupied. The business-owner shall be required to reside on the property occupied by the accommodation, and occupancy shall be determined as the travelers accommodation location being the primary residence of the owner during operation of the accommodation. "Business- owner" shall be defined as a person or persons who own the property and accommodation outright; or who have entered into a lease agreement with the property owner(s) allowing for the operation of the accommodation. Such lease agreement to specifically state that the property owner is not involved in the day to day operation or financial management of the accommodation, and that the business-owner is wholly responsible for all operations associated with the accommodation, and has actual ownership of the business. (ORD 2806, 1997) 2. That each accommodation unit shall have 1 off-street parking space, and the owners shall have 2 parking spaces. All spaces shall be in conformance with the requirements of the Off-Street Parking section of this Title. 3. That only one ground or wall sign, constructed of a non-plastic material, non-interior illuminated of 6 sq. ft. maximum size be allowed. Any exterior illumination of signage shall be installed such that it does not directly illuminate any residential structures adjacent or nearby the traveler's accommodation in violation of 18.72.110. 4. That the number of accommodation units allowed shall be determined by the following criteria: a. That the total number of units, including the owner's unit, shall be determined by dividing the total square footage of the lot by 1800 sq. ft. Contiguous lots under the same ownership may be combined to increase lot area and the number of units, but not in excess of the maximum established by this ordinance. The maximum number of accommodation units shall not exceed 9 per approved travelers accommodation with primary lot frontage on arterial streets. The maximum number of units shall be 7 per approved travelers accommodation with primary lot frontage on designated collector streets; or for traveler's accommodations not having primary frontage on an arterial and within 200 feet of an arterial. Street designations shall be as determined by the Ashland Comprehensive Plan. Distances shall be measured via public street or alley access to the site from the collector or arterial. b. Excluding the business-owner's unit and the area of the structure it will occupy, there must be at least 400 sq. ft. of gross interior floor space remaining per unit. 5. That the primary residence on the site be at least 20 years old. The primary residence may be altered and adapted for traveler's accommodation use,.including expansion of floor area. Additional structures may be allowed to accommodate additional units, but must be in conformance with all setbacks and lot coverages of the underlying zone. 6. Transfer of business-ownership of a traveler's accommodation shall be subject to all requirements of this section-and conformance with the criteria of this section. All traveler' s accommodations receiving their initial approvals prior to the effective date of this ordinance shall be considered as approved, conforming uses, with all previous approvals, conditions and requirements remaining in effect upon change of business-ownership. Any further modifications beyond the existing approvals shall be in conformance with all requirements of this section. 7. An annual inspection by the Jackson County Health Department shall be conducted as required by the laws of Jackson County or the State of Oregon. 8. We live on the premises and already operate the cottage as a 6 month full time rental. The primary residence is way over 20 years old and meets size requirements. (see plans) CUP and Residential Character- The Vacation Rental would help maintain the historic main house. Which needs plumbing work, painting, gutters, and interior improvements. The accommodation would not detract from the residential flavor of the block. It is on the alley and out of view. There are also two other accommodations on the block, of which ours would be the least visible. The block is full of rentals and rental cottages. (see plans) Parking- We have 3 parking spots on the alley and two spots out front on Siskiyou Blvd. (see plans) Vehicle trips with a Traveler's Accomodation would be less due to the fact that we are within walking distance of downtown and Shakespeare Festival. People rent our place so they don't have to drive. This is a huge plus over a full-time summer renter, who would be using the car more frequently. Landscaping Requirements- The Landscaping between the front home and Siskiyou Blvd would not need any changes. We have very mature trees out front that almost totally hide the house. I prune these trees regularly, keep a nice front yard mowed, upkeep bushes and shrubs in front of the house, and plant flowers in the front beds by the fence. No irrigation would need to be put in, as we already have it in place. The wood fence looks nice and complements the historic nature of the property. (see Pics) Signs - There will be no signs visible on Siskiyou Blvd. We have a very small sign on the parking spot in the alley on the fence stating "Maggies Cottage Parking". ( see pic) Neighborhood Outreach- Neighbors in our vicinity are operating rentals presently also and are on good terms with us. There would be little affect on them due to traffic or noise.
