AMENDMENT OF RESTRICTIVE COVENANT
City of Ashland is the owner of the land described in Jackson County Doc. 70-12161,
which it acquired in conjunction with a grant from the U.S. Department of Housing and Urban
Development ("HUD"), under Open-Space Land Project Number Ore. OSC-40 (DL).
The City of Ashland has received permission from HUD and does hereby amend the
Declaration by the City of Ashland of Restrictions described as Jackson Co. Doc. 70-12161 as it
applies to properties described in EXHIBIT A, by removing said restrictive covenant, which
specifically states:
"That the sale, lease, mortgaging or creation of other indebtedness or other transfer of this
land or any interest therein is subject to the prior approval of the Secretary of the
Department of Housing and Urban Development."
The intent of removing this restrictive covenant is to negate its effect and possible cloud
to title of the properties described in EXHIBIT A, or to any property to which such properties
maybe included or incorporated. Except as modified above, the terms of Jackson County Doc.
70-12161 shall remain in full force and effect.
