Dear Gus:
Enclosed herewith please find Resolution which has heretofore been
duly passed by the Board of Directors of the Talent Irrigation District
wherein they agree to deliver five acre feet of the water heretofore
purchased by the City of Ashland to Fred C. Homes at the headgate or,
his property.
The Irrigation District wish that Mr. Homes would make payment for his
proportionate share of the maintenance to the City of Ashland and they
will annually bill us for our share of the maintenance on the whole 800
acre feet which we had heretofore purchased.
Since we have built a measuring device whereby your clients, Fred C.
Homes and Susanne Homes Carter, secure their agreed portion of one-fifth
of the present aggregate flow of said spring, and as the installation of
this device together with the enclosed Resolution from the Board of
Directors of the Talent Irrigation District, accomplish in effect the
purposes outlined in our stipulation, we trust that it will be satis-
factory to your clients for us to draw up a satisfaction and agreement
whereby this performance may be accepted in lieu of the performance out-
lined in the stipulation. Thereupon the suit may be dismissed without
prejudice.
