Dear Gus:
I wish to apologize for not informing you sooner rela-
tive to the progress in the Homes case. We have pre-
pared and recorded an assignment of the City's rights
in and to the five acre feet of Talent Irrigation Dis-
trict water, subject to the terms of the contract here-
tofore made between the Talent Irrigation District and
the City of Ashland. This assignment was made in tripli-
cate and one copy thereof, duly signed by the Mayor and
Recorder pursuant to action of the Common Council, has
been sent to Mr. Homes.
We are now in communication with the State Engineer's
office relative to a certificate of water right to be
issued M:,-. Homes through the Talent Irrigation District,
and will advise you within a short time as to the outcome
of these negotiations.
In passing, it might be well to state that the State En-
gineer's office is very willing to cooperate with us in
securing this certificate and have outlined the procedure
which they consider best to protect the interests of both
your client and the City of Ashland.
