CITY 0RDINANCR- 110. 393.
An ordinance granting a right of way to the Oregon and
California Railroad Company, across "A" Street in the City of Ash-
land, Oregon, whereby said company may extend its present warehouse
.spur or side track in Ashland yards westerly to lot 5, Block 22.

is Lereby granted to the Oregon and California Railroad Company,
a corporation, its successors and assigns, for the period of ten
years from and after the approval of this ordinance, and no lmnger,
for extending its present warehouse spur or side track in the
Ashland yard to lot 5, Block 22 in said City, and to maintain, use
and keep in repair its railroad track across said street, to and
on said lot 5 in Block 221 in said city, provided, that in case the
grade of the sVeet shall be hereafter changed by said city, in the
manner provided in its charter, the grade of such track crossing
shall be changed by said company at its own expense, to conform to
sudh changed ' grade.
Provided further, that the cars upon said crossing shall not
be allowed to stand on xxxkoxnhxtrxxtxthHxxtxxxt such crossing in
such a manner as to unreasonably obstruct the use of said street by
vehicles or pedestrians.
Section 2,.
It is understood that the city in granting this privilege ex-
0 reserves the right to pave, Macadamize or repair any portion
of said street and to lay s~!!wer, gas, or water mains under such crossing,
such. work to be clone so as to.injure the track as little as possible,
and the right is reserved by said city to alter or change the grade of
said street at any time subject to the provisions of its charter.
Should the grantee hereof fail to comply with nny of the terms
or conditions of this ordinance, then and in that event this franchise
and all rights hereby granted shall immediately become null. and void.
Section B.
This ordinance shall take effect and be in force upon the expiration of

The foregoing ordinance wzs adopted by the common council of the
Cite of Ashland, under suspension of the ruler, two-thirds voting in
favor thereof, at an adjourned regular meeting held on the 29th
