On April 15, 2015, the Community Development Director approved the request for the following:

The Community Development Director's decision becomes final and is effective on the 12t" day after the
Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of
approval identified on the attached Findings are required to be met prior to project completion.
The application, all associated documents and evidence submitted, and the applicable criteria are
available for review at the Ashland Community Development Department, located at 51 Winburn Way.
Copies of file documents can be requested and are charged based on the City of Ashland copy fee
schedule.
Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a
reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) .
and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). The
ALUO sections covering reconsideration and appeal procedures are attached. The appeal may not be
made directly to the Oregon Land Use Board of Appeals.

SECTION 18.5.1.050 Type I Procedure (Administrative Decision with Notice)
E. Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to
subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision.
F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below.
1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action
after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no
fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision.
Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence
during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity
to respond to the issue prior to malting a decision.
2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall
decide within three days whether to reconsider the matter,
3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the
decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse
the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any
party entitled to notice of the planning action.
4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the
reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration.
G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following:
1. Who May Appeal. The following persons have standing to appeal a Type I decision.
a. The applicant or owner of the subject property.
b. Any person who is entitled to written notice of the Type I decision pursuant to subsection
18.5.1.050.B.
c. Any other person who participated in the proceeding by submitting written comments on the application to the
City by the specified deadline.
2. Appeal Filing Procedure.
a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.G.1, above, may
appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of
this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community
organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the
hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded.
b. Time for Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of
decision is mailed.
c. Content of Notice of Appeal. The notice of appeal shall be accompanied by the required filing fee and shall
contain.
i. An identification of the decision being appealed, including the date of the decision.
ii. A statement demonstrating the person filing the notice of appeal has standing to appeal
iii. A statement explaining the specific issues being raised on appeal.
iv. A statement demonstrating that the appeal issues were raised during the public comment period.
d. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a
jurisdictional defect and will not be heard or considered.
3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before
the Planning Commission. The appeal shall not be limited to the application materials, evidence and other
documentation, and specific issues raised in the review leading up to the Type I decision, but may include other
relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument
concerning any relevant ordinance provision.
4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type 11 public hearing procedures,
pursuant to section 18.5.1.060, subsections A - E, except that the decision of the Planning Commission is the final
decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the
adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of
Appeals, pursuant to ORS 197.805 - 197.860.

DECISION
The application involves a request for Site Review approval and a Conditional Use Permit to operate a
theater / performing arts center at 722 Jefferson.
The subject site is located on a .64-acre property (27,878 square feet in area) approximately 245 feet
south of the intersection of Washington Street and Jefferson. The property is zoned E-1, Employment.
Development on the subject property requires Site Review approval and is subject to the Basic Site
Review Standards, however with the current proposal no exterior changes to the exterior of the building
or to the site are proposed beyond the installation of signage and as such, the review here is limited to
the proposed use and associated impacts, including parking and noise, as they relate to the Site Review
and Conditional Use Permit approval criteria.
The proposed to utilize one, approximately 3,000 square feet of the approximately 12,000 square foot
building as a performance arts theater. The application notes that they have been allocated 32 parking
spaces by the applicant to accommodate the theater use.
Shows are proposed to be scheduled during night time hours, from 7:30 p.m. to 10:30 PM Thursday
through Sunday with a Sunday 2:00 PM matinee. The application proposes to accommodate up to 75
attendees, and at a requirement of one parking space per 4 attendees, 19 parking spaces are required to
accommodate this use. There are other businesses in the building but their hours are typically 8:00 AM
- 5:00 PM Monday through Friday. Additionally, there is 187 feet of uninterrupted curb frontage which
provides for eight additional parking spaces. The combination of the available on-street parking and the
spaces provided for in the parking lot, is sufficient to cover the full parking demand for the proposed
theater use.
One letter was received during the public comment period addressing the parking concerns of the
business located at 710 Jefferson which runs 24-hr a day / seven day a week operations regarding

parking concerns. Staff finds that the applicant has sufficiently addressed the required number of
parking spaces for the 75 seat theater on-site. The letter also has a concern regarding the lack of physical
separation between his property and the subject property and has had issues with the property owner
regarding maintenance issues and with a previous tenant of this space. He is requesting a fence be
installed along the property line. Staff has provided a copy of the letter to the applicant but does not find
that the impacts from the proposed theater warrant a fence along the shared property line.
In Staff s opinion, the approval criteria for Site Review and Conditional Use Permit approval are met by
the proposal. There are no exterior changes proposed to the existing building or site and public facilities
are already in place serving the building. The application has demonstrated that the parking demand is
met for the proposed use.
The criteria for Site Design Review from AMC 18.5.2.050 are as follows:
A. Underlying Zone: The proposal complies with all of the applicable provisions of the underlying
zone (part 18.2), including but not limited to: building and yard setbacks, lot area and
dimensions, density and floor. area, lot coverage, building height, building orientation,
architecture, and other applicable standards.
A Overlay Zones: The proposal complies with applicable overlay zone requirements (part 18.3).
C. Site Development and Design Standards: The proposal complies with the applicable Site
Development and Design Standards of part 18.4, except as provided by subsection E, below.
D. City Facilities: The proposal complies with the applicable standards in section 18:4.6 Public
Facilities and that adequate capacity of City facilities for water, sewer, electricity, urban storm
drainage, paved access to and throughout the property and adequate transportation can and will
be provided to the subject property.
The criteria for Conditional Use Permit Review from AMC 18.5.4.050 are as follows:
A Conditional Use Permit shall be granted if the approval authority finds that the application meets all
of the following criteria, or can be made to conform through the imposition of conditions.
1. That the use would be in conformance with all standards within the zoning district in which the
use is proposed to be located, and in conformance with relevant Comprehensive plan policies
that are not implemented by any City, State, or Federal law or program.
2. That adequate capacity of City facilities for water, sewer, electricity, urban storm drainage,
paved access to and throughout the development, and adequate transportation can and will be
provided to the subject property.
3. That the conditional use will have no greater adverse material effect on the livability of the
impact area when compared to the development of the subject lot with the target use of the zone,
pursuant with subsection 18.5.4.050.A.5, below. When evaluating the effect of the proposed use
on the impact area, the following factors of livability of the impact area shall be considered.in
relation to the target use of the zone.
a. Similarity in scale, bulk, and coverage.
b. Generation of taff c and effects on surrounding streets. Increases in pedestrian, bicycle,
and mass transit use are considered beneficial regardless of capacity of facilities.
C. Architectural compatibility with the impact area.

d. Air quality, including the generation of dust, odors, or other environmental pollutants.
e. Generation of noise, light, and glare.
f. The development of adjacent properties as envisioned in the Comprehensive Plan.
g. Other factors found to be relevant by the approval authority for review of the proposed
use.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action PA #2015-00382 is approved with the following conditions. Further, if any one or more
of the following conditions are found to be invalid for any reason whatsoever, then Planning Action PA
#2015-00382 is denied. The following are the conditions and they are attached to the approval:
1) That all proposals of the applicant, including but not limited to the hours of operation, occupant
load, alcohol-free operation, hiring of licensed/bonded security for performances, and closure of
doors during performances shall be conditions of approval unless otherwise specifically modified
herein.
2) That plans submitted for building permit shall be in substantial conformance with those approved
as part of this application. If the plans submitted for the building permit are not in substantial
conformance with those approved as part of this application, an application to modify the
Conditional Use Permit approval shall be submitted and approved prior to issuance of a building
permit.
3) That all requirements of the Building Department shall be satisfactorily addressed prior to
occupancy or commencement of the use, including but not limited to that any building permit
plans must be drawn by an Oregon-licensed design professional, must include a means of egress
and egress lighting, that stage curtains meet requirements for smoke density and flame spread,
and that access to bathrooms shall remain available during business hours.
4) That all requirements of the Fire Department shall be satisfactorily addressed prior to occupancy
or commencement of the use, including approved addressing and occupant load.
5) That the applicants shall obtain a City of Ashland business license prior to commencement of the
use of the space as a theater.
7) That a sign permit shall be obtained prior to installation of an y new signage. Signage shall meet
the requirements of Chapter 18.96, and sign permit applications shall be reviewed by the Historic
Commission's Review Board prior to issuance.

Per conditional use permit application cited above, there are some
inaccuracies in the applicant's information.
The Maranatha plant (A RTE Food Production Facility) next door at 710
Jefferson Street is a 24/7 operation with 15-20 on staff at all times,
including the hours of operations stated in the application.
This will cause issues with parking, as we have a limited number of spaces
on site, and a few we lease from the 693 Washington Street property.
Usually we have 5-7 employee cars parked on the street. Also, there is a
24 hour '"no parking zone" that must be left open to allow large tractor
trailers to access the property.
A second concern is the lack of physical separation by means of a fence
between the properties. The property owner has been slow in the past to
remedy issues as a neighbor. Most recently, we removed a tree from his
property that had fallen against our building. We have a bench for
employees on that corner of the building, we view smoking and smoking
materials littering the area as a sanitation issue. I would propose that the
owner physically separate the area with a fence.
Thank you for your consideration of our concerns. We would welcome the
theater to the area, with a few considerations to our issues.

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn
Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning
Division Staff's decision must be made in writing to the Ashland Planning Division within 12 days from the date of the mailing of final decision. (AMC
18.108.040)
The ordinance criteria applicable to this application are attached to this notice. Oregon law states that failure to raise an objection concerning this
application, by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes your right of
appeal to the Land Use Board of Appeals (LUBA) on that issue. Failure to specify which ordinance criterion the objection is based on also precludes your
right of appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with
sufficient specificity to allow this Department to respond to the issue precludes an action for damages in circuit court.
A copy of the application, all documents and evidence relied upon by the applicant and applicable criteria are available for inspection at no cost and will be

What I love about theatre is belonging to something and coming together to create something
from nothing and getting to know people from all walks of life. This theatre is Hope to so, so

many. I am pushing the actors every rehearsals to go to that real place of truth and feeling. You
know the only way an actor can go there is if they feel comfortable and supported and safe
enough to go there and this is what we need to create. An environment where we are all safe
to be ourselves. No judgment. A place where we can all come to laugh, cry, find hope and love. I
The art community needs to expand beyond the downtown area of Ashland and we have an
amazing opportunity to expand the art community to the South side of Ashland.

No major changes will be needed to the lobby area and the warehouse section (theatre) will
only need to have platforms brought in to create a stage and chairs on risers will serve as a
place for the audience. Curtains will be hung to create wings for offstage and lighting will need
to be hung to light stage. Everything will be easy to strike and setup in the beginning so we can
adjust and adhere to needs of the show being produced at the time.
As it was assessed in a prior document by the city there are 32 parking space, which divides into
6-7 space per unit. Considering our hours of operation for shows taking place in the late hours
of the evening from 7:30 p.m. -10:30 p.m., none of the other businesses will be in operation
and so conflict for parking should not be a problem. Shows also only generally take place on
Thursday - Sunday, Sunday usually being a 2 p.m. matinee, again not likely to interfere with any
other business.
We would most likely be interested at some point in joining LEED, but this is not one of our
primary concerns in the beginning.
We are not looking to make any changes to the landscaping except cleaning and continuing to
maintain.

Our proposal for Thanks for the Memories Theatre Company is to hold theatrical performances
within the facility located at 722 Jefferson Street year round. We have registered our business
through the Oregon Secretary of State and our registry number is 99538192, as well as
obtaining our business license through the City, which is currently classified as a home business
at 689 Siskiyou Blvd., but will be switched to the 722 Jefferson Street location. Our customer
number for our business license is 021535 and the Activity # is 00041115. The business has
been registered with the Department of The Treasury and our employer identification number
is 46-4700185. Our BIN # through the Department of Revenue is 16350887.
Utilities to the facility are provided through the City of Ashland and Avista. There is a gutter
system that leads from the roof to the ground that provides runoff for precipitation.
Transportation to and from the facility is accessible, but not provided.
The building itself will not change, merely its use. The traffic to and from the area will increase
especially during the time of evening performances from 8 p.m. -11 p.m. and on Sundays from
2 p.m. - 5 p.m. With this increase of pedestrian traffic it will provide additional business for the
surrounding area as well, especially hotels, motels, inns and restaurants. Structural changes will
not be made. Air quality will not be affected by what we are doing in any way and noise, light
and glare will increase during the evening hours between 7 p.m. and 11 p.m. and Sundays from
1 p.m. to 5 p.m. There will also be rehearsals held Mon. - Sun. in the evenings, but will be
substantially less impactful than a show. Increase in light and disturbance to other businesses
will be minimal, other than possibly the added noise of actors, singing and music. Outside
lighting would increase for parking and safety of patrons around the walkways and in the front
and rear of the building.
Bicycle parking will be provided in front of the building via a bike rack that can accommodate up
to five bicycles. Around the rear of the building is a loading dock that can serve as a covered
area for bikes to be parked. A dumpster is provided at the rear of the facility for garbage and a
recycle bin is onsite to provide recycling, that can be moved curbside on days of recycling.

The theatres capacity is set to be able to seat 75 patrons for a performance. There is rear
building parking as well as curbside and side building parking. Depending on what the need is
and what the city would allow, handicapped specific parking in the front of the building may be
needed to be designated. The parking as assigned to the building is non-specific according to
the property owner and it is based on a first come first serve basis. Ashland Cross Fit operates
out of the unit located at 726 Jefferson on Friday evenings, but classes are small in size and
three to four parking spots are needed at the most. All other days do not conflict with Ashland
Cross Fits hours. The other two spaces see one or two people on a regular basis and one or two
parking spaces are utilized for this. MaraNatha is a food distributor and the crew does work
intermittent shifts, but they only utilize one to two curbside parking spots. The area has a very
low traffic flow at the moment and by adding a theatre to the area would give a higher traffic
flow, especially during the later hours of the evening which leads to a safer environment.
The entrance to the building, or main area of flow, will be through the door located off
Jefferson Street. There is a sidewalk that leads to the front that will be illuminated, and is ADA
accessible. The entrance is about 5 feet from curbside and 15 from the side of the building.
It is our understanding that the building owner is responsible for landscaping, as we are merely
renters, but we are willing to make any improvements needed.
The only outside lighting to be added will be low wattage path lights to illuminate the sidewalk.
There is light from the street lamp and a lamp mounted above the door that provide additional
lighting. String lights will be placed around windows and doors to the front of the building.
Currently the facility has no exit signs, but they have been ordered, illuminated Exit signs with
back up batter power for front and rear exits. There is no sprinkler system within the facility at
this times, but fire extinguishers will be mounted for every 75 feet of travel distance.
Door signage will be used in the beginning stages and before any changes are made to this, or
we expand beyond that the City will be notified. We would like to be allowed to place a
sandwich board sign off of Ashland Street and Washington Street to be able to guide patrons to
our location. We will obtain whatever permit needed for this and a rendering of our logo is
attached to give you an idea of the sign design.
It is our hope that by providing this theatre with regular patronage, that surrounding businesses
will see an increase in their businesses. We are looking to partner with as many City of Ashland
businesses as we can to get them additional traffic, customers and overall business. We want to
be an added staple of the community and provide Ashland with a much needed year-round,
established community theatre.
We are not planning on adding a stage of any sort. We will be presenting shows without a
raised stage, in a black box theatre environment. Platforms may be utilized to raise certain
parts of the stage at times, but will have the ability to be moved freely. The seating setup will

not be made of risers, but rather chairs that can conform to several configurations. Renderings
and photographs will gladly be provided to be sure that at no point in time are we obstructing
an emergency exit, or causing an unsafe environment to our actors, crew and patrons.
The bathrooms have ADA bars installed and the theatre will have a year-round insurance policy
that will have us insured up to 1 million dollars. (Please feel free to request our insurance policy
number or a copy of the document).
