Notice of Final Decision
The Ashland Planning Commission has approved the request for the following:
Planning Action: #2014-00737
Subject Property: Oak Street Right-of-Way, between Lithia and Main
Applicant: Rogue Valley Growers and Crafters Market
Description: A request to modify the existing Conditional Use Permit approval (PA #2011-
153) for the Rogue Valley Growers and Crafters Market's closure of one block of Oak Street in the
downtown, between Lithia Way and East Main Street, for the weekly Saturday Market. The specific
modifications requested are: 1) To allow vendors to sell the same goods as are sold at their other markets
in the Rogue Valley, with the exception of hot prepared foods. This would allow the sale of goods
grown, produced, prepared or crafted by RVG&CM members who are farmers, ranchers, food processors
and crafters. The vendors are currently limited to fresh fruit, vegetables, flowers, bedding plants, meat,
eggs, cheese, bread, pasta, dog bones, and jam, and are not to sell prepared food; 2) To allow the
market's season and hours to mirror their other markets in the Rogue Valley, which run from March
through November, and to begin the street closure at 6:30 a.m. The market is currently limited to a May
through November season, and the Saturday closure is from 7:00 a.m. to 2:00 p.m. 3) Alter the market
booth configuration to create a sidewalk access point between vendor booths at the entrance to the
alleyway on the west side of Oak Street in order to better accommodate pedestrian and wheelchair traffic
to adjacent businesses. COMPREHENSIVE PLAN DESIGNATION: Commercial Downtown;
ZONING: C-1-D; ASSESSOR'S MAP: N/A - Right-of-Way; TAX LOT: N/A - Right-of-Way
The Planning Commission's decision becomes final and is effective on the 13th day after the Notice of
Final Decision is mailed. Approval is valid for a period of 1 year and all conditions of approval identified
on the attached Findings are required to be met prior to project completion.
The application, all associated documents and evidence submitted, and the applicable criteria are
available for review at the Ashland Community Development Department, located at 51 Winburn Way.
Copies of file documents can be requested and are charged based on the City of Ashland copy fee
schedule.
This decision may be appealed to the Ashland City Council if a Notice of Appeal is filed prior to the
effective date of the decision and with the required fee ($325), in accordance with Chapter 18.108.110(A)
of the Ashland Municipal Code. The appeal shall be limited to the criteria listed in Chapter 18.108.110 of
the Ashland Municipal Code, which is also attached. The appeal may not be made directly to the Oregon
Land Use Board of Appeals.

SECTION 18.108.110 Appeal to Council.
A. Appeals of Type 11 decisions shall be initiated by a notice of appeal filed with the City Administrator.
The standard Appeal Fee shall be required as part of the notice. All the appeal requirements of
Section 18.108.110, including the appeal fee, must be fully met or the appeal will be considered by
the city as jurisdictionally defective and will not be heard or considered.
1. The appeal shall be filed prior to the effective date of the decision of the Commission.
2. The notice shall include the appellant's name, address, a reference to the decision sought to be
reviewed, a statement as to how the appellant qualifies as a party, the date of the decision being
appealed, and a clear and distinct identification of the specific grounds for which the decision
should be reversed or modified, based on identified applicable criteria or procedural irregularity.
3. The notice of appeal, together with notice of the date, time and place to consider the appeal by the
Council shall be mailed to the parties at least 20 days prior to the meeting.
4. A. Except upon the election to re-open the record as set forth in subparagraph 4.13. below, the
review of a decision of the Planning Commission by the City Council shall be confined to the
record of the proceeding before the Planning Commission. The record shall consist of the
application and all materials submitted with it; documentary evidence, exhibits and materials
submitted during the hearing or at other times when the record before the Planning
Commission was open; recorded testimony; (including DVDs when available), the executed
decision of the Planning Commission, including the findings and conclusions. In addition,
for purposes of City Council review, the notice of appeal and the written arguments submitted
by the parties to the appeal, and the oral arguments, if any, shall become part of the record of
the appeal proceeding.
B. The Council may reopen the record and consider new evidence on a limited basis, if such a
request to reopen the record is made to the City Administrator together with the filing of the
notice of appeal and the City Administrator determines prior to the City Council appeal
hearing that the requesting party has demonstrated:
a. That the Planning Commission committed a procedural error, through no fault of the
requesting party, that prejudiced the requesting party's substantial rights and that
reopening the record before the Council is the only means of correcting the error; or
b. That a factual error occurred before the Planning Commission through no fault of the
requesting party which is relevant to an approval criterion and material to the decision; or
c. That new evidence material to the decision on appeal exists which was unavailable,
through no fault of the requesting party, when the record of the proceeding was open, and
during the period when the requesting party could have requested reconsideration. A
requesting party may only qualify for this exception if he or she demonstrates that the
new evidence is relevant to an approval criterion and material to the decision. This
exception shall be strictly construed by the Council in order to ensure that only relevant
evidence and testimony is submitted to the hearing body.
Re-opening the record for purposes of this section means the submission of additional
written testimony and evidence, not oral testimony or presentation of evidence before the
City Council.
C. Oral argument on the appeal shall be permitted before the Council. Oral argument shall be
limited to ten (10) minutes for the applicant, ten (10) for the appellant, if different, and three
(3) minutes for any other Party who participated below. A party shall not be permitted oral
argument if written arguments have not been timely submitted. Written arguments shall be
submitted no less than ten (10) days prior to the Council consideration of the appeal. Written
and oral arguments on the appeal shall be limited to those issues clearly and distinctly set
forth in the Notice of Appeal; similarly, oral argument shall be confined to the substance of
the written argument.

D. Upon review, and except when limited reopening of the record is allowed, the City Council
shall not re-examine issues of fact and shall limit its review to determining whether there is
substantial evidence to support the findings of the Planning Commission, or to determining if
errors in law were committed by the Commission. Review shall in any event be limited to
those issues clearly and distinctly set forth in the notice of appeal. No issue may be raised on
appeal to the Council that was not raised before the Planning Commission with sufficient
specificity to enable the Commission and the parties to respond.
E. The Council may affirm, reverse, modify or remand the decision and may approve or deny
the request, or grant approval with conditions. The Council shall make findings and
conclusions, and make a decision based on the record before it as justification for its action.
The Council shall cause copies of a final order to be sent to all parties participating in the
appeal. Upon recommendation of the Administrator, the Council may elect to summarily
remand the matter to the Planning Commission. If the City Council elects to remand a
decision to the Planning Commission, either summarily or otherwise, the Planning
Commission decision shall be the final decision of the City, unless the Council calls the
matter up pursuant to Section 18.108.070.B.5.
F. Appeals may only be filed by parties to the planning action. "Parties" shall be defined as the
following:
1. The applicant.
2. Persons who participated in the public hearing, either orally or in writing. Failure to
participate in the public hearing, either orally or in writing, precludes the right of appeal
to the Council.
3. Persons who were entitled to receive notice of the action but did not receive notice due to
error.

RECITALS:
1) The property involved is one block of Oak Street public right-of-way between East Main Street and
Lithia Way, located within the C-1-D Commercial Downtown zoning district. The applicants are
requesting to modify the existing Conditional Use Permit approval (PA #2011-00153) for the Rogue
Valley Growers and Crafters Market's closure of one block of Oak Street in the downtown for their
weekly Saturday Market. The specific modifications requested are: 1) To allow vendors to sell the same
goods as are sold at their other markets in the Rogue Valley, with the exception of hot prepared foods:
This would allow the sale of goods grown, produced, prepared or crafted by RVG&CM members who
are farmers, ranchers, food processors and crafters. The vendors are currently limited to selling only
fresh fruit, vegetables, flowers, bedding plants, meat, eggs, cheese, bread, pasta, dog bones, and jam,
and are not to sell prepared food; 2) To allow the market's season and hours to mirror their other markets
in the Rogue Valley, which run from March through November, and to begin the street closure at 6:30
a.m. The market is currently limited to a May through November season, and the Saturday closure is
from 7:00 a.m. to 2:00 p.m. 3) To alter the market's approved booth configuration to create a sidewalk
access point between vendor booths at the entrance to the alleyway on the west side of Oak Street in
order to better accommodate pedestrian and wheelchair traffic to adjacent businesses.
2) The criteria for a Conditional Use Permit are as follows:
A. That the use would be in conformance with all standards within the zoning district in which the use
is proposed to be located, and in conformance with relevant Comprehensive plan policies that are not
implemented by any City, State, or Federal law or program.

B. That adequate capacity of City facilities for water, sewer, paved access to and through the
development, electricity, urban storm drainage, and adequate transportation can and will be provided
to and through the subject property.
C. That the conditional use will have no greater adverse material effect on the livability of the impact
area when compared to the development of the subject lot with the target use of the zone. When
evaluating the effect of the proposed use on the impact area, the following factors of livability of the
impact area shall be considered in relation to the target use of the zone:
1. Similarity in scale, bulk, and coverage.
2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and
mass transit use are considered beneficial regardless of capacity of facilities.
3. Architectural compatibility with the impact area.
4. Air quality, including the generation of dust, odors, or other environmental pollutants.
5. Generation of noise, light, and glare.
6. The development of adjacent properties as envisioned in the Comprehensive Plan.
7. Other factors found to be relevant by the Hearing Authority for review of the proposed use.
3) The Planning Commission, following proper public notice, held a Public Hearing on June 10, 2014 at
which time testimony was received and exhibits were presented. The Planning Commission approved the
application, subject to conditions pertaining to the appropriate development of the site.
Now, therefore, the Planning Commission of the City of Ashland finds; concludes and recommends as
follows:

SECTION 2. CONCLUSORY FINDINGS
2.1 The Planning Commission finds that it has received all information necessary to make a decision
based on the Staff Report, public hearing testimony and the exhibits received.

2.2 The Planning Commission finds that the proposed modification of the Rogue Valley Growers and
Crafters Market's existing approval requires a Conditional Use Permit because it involves modification of a
temporary, seasonal use within the C-1-D zoning district. Conditional Use Permits of this nature are
reviewed to ensure that they will have no greater adverse material effect on the livability of the impact area
than would development of the subject property according to the target use of the zoning district. Given that
the nature of the request (a seasonal, outdoor Saturday market within the downtown) the primary areas of
concern typically focus on the generation of traffic and parking impacts, air quality, noise, light and glare. A
Conditional Use Permit for a temporary use could be approved administratively through a "Type I"
procedure, however given that the proposal involved a change in the scope of products to be offered from the
applicants' original, self-imposed limitations and that subsequent to the applicants' notifying neighboring
businesses of the proposed modifications a number of comments expressing concern were submitted, the
Staff Advisor opted to schedule the matter for a public hearing as allowed in AMC 18.108.040.A.7.
The Planning Commission further finds that the request for a Conditional Use Permit to operate a weekly
Saturday growers and crafters open air market on Oak Street, between Lithia Way and East Main Street was
approved administratively through Planning Action PA #2011-00153. That approval included a condition
that after the first full season of operations, the applicants and city planning staff would conduct a meeting
with interested neighboring residents and business owners to debrief on the season and identify any issues
that may come to light after a full season of operations before the Conditional Use Permit was allowed to
continue for additional seasons. This meeting was held on February 12, 2012 after proper notice, but only
the applicants, neighboring business owner Alex Amarotico of Standing Stone Brewing Company, and city
planning staff were in attendance. Amarotico spoke in strong support of the market continuing, and no other
business owners or residents were in attendance although the minutes noted that staff had received e-mails
and phone calls from Hanson Howard Gallery, Ashland Mountain Supply, Thread Hysteria and Northwest
Nature Shop expressing general support of the market's continued operation in this location. The Planning
Commission finds that the existing Conditional Use Permit has continued in good standing and remains in
effect, and that consideration of the current request is limited to the modifications of the existing approval
requested by the applicant and not in revisiting the merits of the original approval or altering its parameters.
2.3 The Planning Commission finds that the first requested modification would allow vendors to sell the
same goods as at their other markets in the Rogue Valley, with the exception of hot prepared foods. This
would allow the sale of goods "gr°own, produced, pr°epar ed or crafted by RVG&CM members 1,Vho are
far°mer°s, rancher°s, food processors and cr°after°s." The vendors are currently limited to selling only' ftesh
fruit, vegetables, flowers, beddingplants, meat, eggs, cheese, bread, pasta, dog bones, andjam," and are not
to sell prepared foods. The Planning Commission further finds that the current limitations were self-
imposed by the applicants in the 2011 application to avoid selling products which might directly compete
with downtown businesses and to encourage customers who were already downtown for the market to
continue on to shop or dine at nearby downtown businesses.
The Planning Commission finds that public markets are generally beneficial uses which bring with them a
sense of greater vitality and which enliven a city's downtown core. The Commission further finds that in
administratively approving the applicants' Conditional Use Permit in 2011, staff found that the location was
well-suited for a market, and that it would benefit neighboring businesses and their employees, residents and
the community at large by providing convenient access to healthy, fresh locally grown food while energizing
the area and hopefully generating "spill-over" sales to neighboring businesses.

The Commission notes that the application includes a petition in favor of the requested changes signed by a
number of Ashland business owners or their authorized representatives, including: Caldera Tap House, Tabu,
Tree House Books, Oberon's, Loft, Martolli's, Agave, Deli Downstairs, Lounge South, Mix Sweet Shop,
Noble Coffee, The Black Sheep Pub, Pasta Piatti, Sesame, Northwest Nature Shop, Standing Stone, the
Ashland Independent Film Festival, Papaya Living and Harvey's Place. The Commission also notes that
after being made aware of the proposed modifications, representatives of surrounding businesses including
Ashland Wine Cellar, the Stop and Shop market, Paddington Station, the Paddington Jewel, Emz Blendz
Soap Company, All's Well Herb Shoppe, Rocky Mountain Chocolate Factory, Paris Green, Art F/X,
Frederica Lawrence Fine Clothing, Reds Threads, Hanson Howard Gallery, Bella Terra Fine Jewelry,
Nimbus, and the Book Exchange signed a petition asking that the market be limited to selling only produce
and agricultural items and that the market day be moved to Sundays rather than Saturdays. Some of those in
opposition also provided letters expressing concern over there being "no limits" on products that could be
sold at the market, and that selling crafts would compete directly with adjacent businesses selling natural,
hand-crafted products such as soaps and candles.
The Commission finds that while the application materials submitted did not include the Rogue Valley
Growers and Crafters Market's guidelines, in reviewing materials available on-line from their web-site
http://www.rvgrowersmarket.com and provided by staff, these guidelines generally require that: no less than
60 percent of the products offered at the market shall be agricultural in nature; that all crafts are to be made
by a member with a purpose or theme interactive with agriculture and composed of predominantly locally
grown agricultural products or by-products; and that crafts must be handmade, grown or gathered by the
member, and hand-crafted components must dominate any commercial components used. Any commercial
components must be transformed in away that makes the work unique. Based on these guidelines, it seems
clear that while the current request proposes to modify the allowed product offerings at the market, the
products offered under the market would be limited to those of a predominantly agricultural character which
would prevent the offering of a broad range of retail items such as books that were a concern expressed by
some in opposition.
In considering the request, the Commission finds that the market's presence in the downtown poses a
delicate balance as evidenced by the number of nearby businesses in support and in opposition to the
proposed changes. While farmers' markets bring many benefits, they also bring vendors downtown who
have the advantages of using public right-of-way with none of the brick=and-mortar costs of established
neighboring businesses in competing for what are often limited customer dollars. The Commission finds
that the current limitations on product offerings originally proposed by the applicants were in recognition of
this delicate balance, and that any change in this balance merits careful consideration. The Planning
Commission finds that there is room to allow a broader range of agricultural items and their by-products
while limiting some direct competition with downtown businesses that would result from the sale of non-
agricultural crafted items at the market. The Commission accordingly finds that the products offered for sale
at the Saturday Market shall be allowed to include goods grown, produced, prepared or crafted from locally
produced agricultural products by Rogue Valley Growers and Crafters Market members who are farmers,
ranchers, food processors and crafters. This would allow the sale of fruits, vegetables, plants and meats
grown and raised by members as well as other agricultural items or their crafted byproducts including honey,
bee's wax candles, and yarn. Food items, other than hot foods, which feature local agricultural products
among their ingredients would be allowed, but the sale of items not made from locally produced agricultural
products such as pottery, exotic wood products like cutting boards, jewelry, etc. would be prohibited.

2.4 The Planning Commission finds that the second requested modification includes two component
requests. The first would allow the market's season to mirror the applicants' other markets in the Rogue
Valley, which run from March through November, and the other would allow the approved street closure to
begin at 6:30 a.m. so that vendors could begin unloading their materials earlier in the morning.
The Planning Commission finds that the market is currently limited to a May through November season, and
that the proposed modification would allow them to begin the market two months earlier, in March. The
Commission finds that an earlier season might bring more people to the downtown at a slower time of year,
and would be beneficial in that sense, and would also allow for a degree of consistency for the applicants'
advertising throughout the region.
With regard to an earlier start to the street closure, the Planning Commission finds that during testimony at
the hearing it was noted that there are a number of upstairs apartments on this block and that residents could
be adversely impacted by the generation of noise from vendors unloading prior to 7:00 a.m. The Planning
Commission finds that there is insufficient evidence in the record to demonstrate that an earlier street closure
and the resultant generation of noise from the unloading of vendor vehicles before 7:00 a.m. would be
adequately mitigated.
2.5 The Planning Commission finds that the third and final requested modification, which would allow
alteration of the market's approved booth configuration to create a sidewalk access point between vendor
booths at the entrance to the alleyway on the west side of Oak Street in order to better accommodate
pedestrian and wheelchair traffic to adjacent businesses, was proposed as a result of concerns expressed by
neighboring businesses last season that the continuous booth configuration originally approved effectively
cutoff market customers from access to the sidewalk and adjacent businesses. The Commission finds that
this change was actually.implemented last season is response to those concerns, has worked well, and has
been included in the request here to formalize the modification. The Commission finds that the change is
beneficial in helping the market better relate to the sidewalk and adjacent businesses and therefore merits
approval.
SECTION 3. DECISION
3.1 Based on the record of the Public Hearing on this matter, the Planning Commission concludes that
the component requests to modify the existing Conditional Use Permit approval (PA #2011-00153) for the
Rogue Valley Growers and Crafters Market to allow the market's season to mirror other markets in the
Rogue Valley which run from March through November, and to allow the market's approved booth
configuration to create a sidewalk access point between vendor booths at the entrance to the alleyway on the
west side of Oak Street in order to better accommodate pedestrian and wheelchair traffic to adjacent
businesses, is supported by evidence in the record.
The Planning Commission further concludes that with regard to the market's allowable vendor offerings that
the products offered for sale at the Saturday Market shall be allowed to include goods grown, produced,
prepared or crafted from locally produced agricultural products by Rogue Valley Growers and Crafters
Market members who are farmers, ranchers., food processors and crafters. This would allow the sale of
fruits, vegetables, plants and meats grown and raised by members as well as other agricultural items or their
crafted byproducts including honey,.bee's wax candles, and yarn. Food items, other than hot foods, which
feature local agricultural products among their ingredients would be allowed, but the sale of items not made

from locally produced agricultural products (such as pottery, exotic wood products like cutting boards,
jewelry, etc.) would be prohibited.

The Commission further concluded that the request to begin the street closure at 6:30 a.m. to allow earlier
unloading of market wares by vendors could have adverse negative impacts to apartment dwellers on the
block in generating noise before 7:00 a.m. and that this component of the request was not supported by
evidence in the record. The Commission denied this component of the modification request.
Therefore, based on our overall conclusions, and upon the proposal being subject to each of the following
conditions, we approve Planning Action #2014-00737. Further, if any one or more of the conditions below
are found to be invalid, for any reason whatsoever, then Planning Action #2014-00737 is denied. The
following are the conditions and they are attached to the approval:
1) That the proposals of the applicants shall be conditions of approval unless specifically modified
herein. These proposals include but are not limited to that the market season may extend on
Saturdays from March through November, that no hot prepared foods will be offered by market
vendors, and that the market booth configuration may be altered as described in the application.
2) That the products offered for sale at the Saturday Market shall be allowed to include goods grown,
produced, prepared or crafted from locally produced agricultural products by Rogue Valley Growers
and Crafters Market members who are farmers, ranchers, food processors and crafters. This would
allow the sale of fruits, vegetables, plants and meats grown and raised by members as well as other
agricultural items or their crafted byproducts including honey, bee's wax candles, and yarn. Food
items, other than hot foods, which feature local agricultural products among their ingredients shall be
allowed. The sale of craft items not made from locally produced agricultural products (such as
pottery, exotic wood products like cutting boards, jewelry, etc.) shall be prohibited.
3) That all conditions of Planning Action 42011-00153 shall remain in effect unless specifically

SUBJECT PROPERTY: Oak Street right-of-way, between Lithia and Main
OWNERS: Rogue Valley Growers and Crafters Market
DESCRIPTION: A request to modify the existing Conditional Use Permit approval (PA #2011-153) for the
Rogue Valley Growers and Crafters Market's closure of one block of Oak Street in the downtown,
between Lithia Way and East Main Street, for the weekly Saturday Market. The specific modifications
requested are: 1) To allow vendors to sell the same goods as are sold at their other markets in the
Rogue Valley, with the exception of hot prepared foods. This would allow the sale of goods grown,
produced, prepared or crafted by RVG&CM members who are farmers, ranchers, food processors and
crafters. The vendors are currently limited to fresh fruit, vegetables, flowers, bedding plants, meat,
eggs, cheese, bread, pasta, dog bones, and jam, and are not to sell prepared food; 2) To allow the
market's season and hours to mirror their other markets in the Rogue Valley, which run from March
through November, and to begin the street closure at 6:30 a.m. The market is currently limited to a May
through November season, and the Saturday closure is from 7:00 a.m. to 2:00 p.m. 3) Alter the
market booth configuration to create a sidewalk access point between vendor booths at the entrance to
the alleyway on the west side of Oak Street in order to better accommodate pedestrian and wheelchair

Staff Report
Associate Planner Derek Severson provided an overview of the applicant's request. He explained the Rogue Valley
Growers and Crafters Market (RVGCM) currently operates from May to November, 7 am to 2 pm, and under their
current approval are limited on the types of products they can sell, The RVGCM has requested a modification to their
existing conditional use permit to: 1) allow vendors to sell a wider variety of foods with the exception of hot prepared
foods, 2) to begin the street closure at 6:30 and run from March through November, and 3) alter the booth
configuration to create a sidewalk access point between vendor booths at the entrance to the alleyway on the west
side of Oak Street.
Mr. Severson displayed a photo of the booth configuration that allows access to the sidewalk and explained the
RVGCM have been setting up in this manner and staff supports it. He added this modification memorializes what
they are currently doing. Regarding their second request to operate from March through November and to begin the
street closure at 6:30 am, Mr. Severson stated staff has no issues with this, however staff did receive a letter from a
resident who lives in the apartment above Art FX who objected to the earlier start time. Mr. Severson stated the item
that will likely get most of the discussion tonight is what products the vendors are permitted to sell. Currently the
RVGCM is limited to fresh fruit, vegetables, flowers, bedding plants, meats, eggs, cheeses, breads, pastas, dog
bones, and jams. The RVGCM has requested vendors be allowed to sell the same goods as in their other markets,
with the exception of hot prepared foods, which would equate to up to 40% of their offerings being crafts and
prepared foods. Mr. Severson commented on the potential impacts to existing businesses and stated staff is
recommending the market be limited to no more than 25% of booths that sell crafts and prepared foods.
Applicant's Presentation
Lori Hopkinson) RVGCM General Manager/4444 W Griffin Creek Rd, Medford/Provided an overview of the
RVGCM organization and cited their bylaws, market guidelines, and mission statement. Ms. Hopkinson stated the
RVGCM would like to establish an additional sidewalk access point at the entrance of the alley. She stated the
proposed wheelchair accessible entrance would easily accommodate pedestrian traffic to adjacent business and
would encourage cross over sales. She stated the market is also requesting to modify their season of operation to
mirror that of the other RVGCM locations, which would allow for a more coordinated season. Lastly, they are
requesting the language in the conditional use permit be changed to allow the same composition of diversity of goods

as in their other markets. Ms. Hopkinson stated there is room for all and competition is part of doing business. She
explained the market imposes its own rules and policies and stated limiting the market's goods is based on
unfounded fears. Ms. Hopkinson stated 25% is an arbitrary number and remarked that the charm of the market
comes from its diversity. She provided a list of the types of products that are restricted under their current approval,
and commented that the market brings a lot of foot traffic to the area and draws shoppers to downtown merchants.
Questions of the Applicant
Ms, Hopkinson was asked why the market is requesting a 6;30 am start time and she explained that this would allow
vendors more time to set up their product displays.
Ms. Hopkinson stated for the record that she is a part-time clerk for the City of Ashland Municipal Court.
Ms, Hopkinson clarified the market's bylaws state 60% of the goods are agriculturally related items and 40% are
crafts and processed foods, and therefore of their 30 spaces at the Oak Street location 18 booths would be grower
spaces and 12 would be crafters and food processors. She clarified food processors include krauts, hummus, ciders,
coffee, tea, nuts, and cooking oils. Ms. Hopkinson requested the RVGCM be allowed to operate under their own
guidelines and stated it would hurt the diversity of the market if these limitations were imposed.
Public Testimony
Bill Francis/40 Van Ness/Stated he has a small business selling pottery and sells at the downtown market, He
stated this business has become his sole source of income and he could not have done this without the RVGCM. He
noted he is also a member of the artisans market, however he earns the same selling for four hours on Oak Street as
an entire weekend on the Calle, Mr. Francis stated the market is an attraction for both locals and visitors and urged
the Commission to support the diversity the market is requesting.
Abby Hogge/1700 Parker/Stated she was last year's downtown market manager and stated diversity is critical for its
success. She stated they need to appeal to a wide customer base and it is a delicate balance of serving both locals
and tourists. Ms. Hogge noted the market is required to maintain a 60% ratio of growers and 40% non-growers. She
stated hummus, salsas, salts, teas, and sauerkraut vendors are classified as non-growers and under the current
conditional use permit are not permitted. She stated of the 30 booth spaces typically only 5 or less consist of crafts
and urged the Commission to approve the modifications being requested.
Monica Rey/12310 Ramsay Rd, Gold Hill/Stated she is the current president of the RVGCM and commented that
outdoor markets allow the public to connect with their local food sources and create a positive atmosphere. She
stated the market brings in large numbers of people, some of whom spread out into neighboring businesses, Ms. Rey
stated the market has been an incubator for many local businesses who have used this venue as a springboard to
bigger and better things and encouraged the Commission to approve their request.
Roy Laird/419 Willow/Stated he is the co-owner of the Book Exchange across the parking lot from Oak Street and
stated he supports RVGCM; however the current location of the market has had an impact on his business. He
explained business is down 10% on Saturdays and expressed concern with how the expanded season will impact his
business. Mr. Laird stated the market should be located in a more suitable location that won't have an impact on the
downtown brick and mortar businesses.
Ken Silverman/25 E Main/Stated he is the owner of Nimbus and agreed with the previous speaker. Mr. Silverman
stated he supports crafters and attends the Tuesday market regularly, however this is an issue of fairness. He stated
the market takes up parking and blocks the Oak Street businesses and it is difficult to get to their stores because it is
so crowded. He recommended the market be moved to a different location and noted the difficulties in being a
successful retailer in this town.
Jeffrey Compton/1770 Acorn/Stated he is the owner of Rocky Mountain Chocolate Factory and while he supports
the growers market, their numbers are down 30% on the days the market operates, He stated they have had to lay
off one of their Saturday employees because of the market and recommended the market be moved to a more

suitable location, such as the high school or middle school,
Stacy VanVoorhees/514 Laurel/Stated she is the manager of the Saturday Ashland market and read aloud a
scenario depicting a mother shopping with her three children. She stated the market serves the entire community and
stated they aim to offer a wide diversity of goods that provide for people's needs, both nutritional and otherwise.
Lanita Witt/658 Shale City Rd/Stated she represents Willow Witt Ranch and stated they have been selling their
meat products at the market for six years. She stated she supports buying and eating local and does not understand
why other businesses oppose the market.
Elizabeth Bretko/103 SW Fourth, Grants Pass/Stated she is a tea brewer and also farmer and seasonal food
processor. Ms. Bretko stated the Ashland Saturday market is a crucial part of her business and accounts for 60% of
her total sales. She stated the market has been a springboard for her to open a brick and mortar business in Grants
Pass and voiced her support for the market's downtown location.
David French/176 Meadow View, Phoenix/Stated he owns Griffin Creek Roasters and understands the challenges
that brick and mortar retailers have. He stated it is a symbiotic relationship between the City, vendors, and patrons
and stated the Ashland community supports the market incredibly well, He stated the market brings people into the
downtown core and stated the market's request to create sidewalk access to the local businesses is a sign that they
want to be good partners. He added from a marketing standpoint, it makes sense to have the same starting and
ending dates as the other markets.
Jo Cullumbine/837 Tyler Creek/Voiced her disappointment to hear that this market is in jeopardy and that certain
crafters may be excluded even though those that are permitted also compete with nearby businesses. She stated the
market draws visitors to town and they explore streets and shops that they may have otherwise never seen, and
asked the Commission to do the right thing and accept the modifications.
Jerry Painter/940 SW Sixth/Stated he is a food vendor with the RVGCM and is unable to participate in the Ashland
Saturday market. He questioned the downtown businesses' resistance and stated the City of Medford requested that
the market set up downtown, Mr. Painter stated studies have shown that markets downtown help the businesses, and
while business may be down, the general poor economy is to blame not the location of the market.
Ruby Painter/940 SW Sixth/Voiced support for the market and noted the importance of having diversity so that
young people can get ideas of what is possible.
Angelika Curtis/14356 Highway 62, Eagle Point/Stated she is the owner of the Oregon Bistro and Wildbee Honey
Farm, and they are growers, farmers, beekeepers and crafters. Ms. Curtis stated she has been full time with the
market for 17 years and is one of the vendors prohibited from selling at the Saturday market. She stated they have
an eight acre farm, country store, hundreds of beehives and bottling facility, and have lots of expenses just like brick
and mortar businesses. She stated the vendors act as greeters and direct a lot of people to local businesses and
services, and she does not believe there is any direct competition between her beeswax candles and the other
nearby businesses.
Alex Amaroticoll01 Oak Street/State he is the owner of Standing Stone Brewery and fully supports the market on
Oak Street and their requests to modify their conditional use permit, He stated the market gives them a direct link to
local products and adds great vitality. He agreed that this comes with inconvenience to some, but the benefits
outweigh this. He added he would welcome prepared foods and craft beers, even though this would be in direct
competition with his business.
Laruel Alexander/2862 Griffin Creek, Medford/Sated this is her twentieth year with the market and she sells
bedding plants. Ms. Alexander stated she has been to many markets and the most vibrant ones are located
downtown. She stated she sells to both locals and tourists and often holds plants for people while them shop and eat
downtown. She agreed that parking in Ashland can be difficult, but hopes they can continue to be good neighbors

with the downtown businesses,
Applicant's Rebuttal
Lori Hopkinson/Stated the market only operates 26 Saturdays a year and they are only there a fraction of the time
compared to the existing businesses. She stated they bring a lot of foot traffic and business to the area and believes
this is a great walkable location for patrons. Ms. Hopkinson stated the majority of their products are related to
agriculture and are made by farmers, and only a small percentage are crafts,
Questions of Staff
Staff was asked how they arrived at the 25% to 75% ratio for goods, Mr. Molnar stated 25% was used as a starting
point for discussion. He stated the City has been a longtime supporter of the market, however staff has received
several calls and letters expressing concern and stating sales have gone down since the market started operating at
this location. He stated the City is essentially the landlord because of the market's location in the right of way, and so
staff felt they had an obligation to take those issues seriously.
Staff was asked whether the Commission has the ability to change the market's location or day of operation, Mr.
Molnar stated this is not under their purview this evening and would need to be dealt with through a different hearing.
Mr. Severson highlighted the eleven items that were clearly articulated in the market's original application. He added
at that time there were a lot of assurances made by RVGCM to the downtown merchants when that application was
first approved.
Commissioner Kaplan closed the record and the hearing at 8:35 p.m.
Deliberations and Decision
Commissioner Dawkins shared his concerns with the market selling items that are not food based and selling goods
that compete with the businesses that are already there. Commissioner Peddicord commented that some of the most
prominent businesses downtown are restaurants and questioned why they would prohibit crafts when food would
remain. Dawkins pointed out that no hot food would be allowed. Commissioner Brown remarked that when the
RVGCM first came to downtown there were negotiations made with the City and the businesses, and he sees no
reason to change the conditions of their original approval, Commissioner Miller voiced support for modifying the other
elements of their request (the months of operation, 6;30 am street closure, and pedestrian sidewalk access).
Commissioner Mindlin commented that this is a complex issue and they need to find a solution that works for
everyone, She stated the market wanted to be in that location and it has worked out very well for them, but it seems
that it is having a negative impact on the surrounding businesses, She suggested that perhaps there is a better
location that should be considered, but noted that this is not under their purview. Mindlin agreed with Miller and
supports the approval of the other requested modifications and stated she would be comfortable with a compromise
that permitted the sale of food items but keeps out the crafts, Commissioner Peddicord stated if the Commission is
concerned with competition then they should be concerned about extending the market's season. Commissioner
Brown agreed and added that an earlier start time would be an inconvenience to apartment renters. Commissioner
Kaplan stated it is not clear whether the applicants and the City were on the same page when the original list of items
was approved. Mr. Severson commented that he is not sure if the current board and management are aware of all
the outreach that was done by the previous RVGCM manager. He clarified that list of items was intended to be a
definitive list of the goods that would be sold and was offered as assurance to the neighboring businesses.
Commissioner Dawkins noted his desire to find an appropriate balance and suggested limiting the market to goods
that are food/agriculturally based. It was suggested that the group separate out the requested modifications and
handle each item individually.
Commissioners Miller/Dawkins m/s to approve the alteration of the market booth configuration to create a
sidewalk access point between the Vendor booths to allow easier access. Roll Call Vote: Commissioners
Brown, Mindlin, Peddicord, Miller, Dawkins and Kaplan, YES. Motion passed unanimously.

Dawkins, Miller, Peddicord, Mindlin and Kaplan, YES. Commissioner Brown, NO. Motion passed 5.1.
Commissioner Miller motioned to allow the street closure to begin at 6:30 am. Motion died due to lack of a
second.
Commissioner Mindlin/Dawkins m/s to allow vendors to sell the same variety of goods sold at their other
markets in the Rogue Valley, with the exception of hot prepared foods and crafted goods. This would allow
the sale of goods grown, produced, or prepared by RVGCM members who are farmers, ranchers, and food
processors. DISCUSSION: Commissioner Mindlin stated her intent is to strike a balance and stated she would be
open to an amendment that would include more agricultural products.

farmers, ranchers, food processors and crafters. The prohibition on hot prepared foods will not be

provided an overview of the project site, existing residence, and surrounding area. She noted there are three trees
proposed for removal and clarified the existing single family residence will be incorporated into the development of
Lot 1. She stated the new units will face east and each will have an attached vehicle garage and a rear yard patio
area; and the applicants have proposed a pedestrian walkway to connect the development to the public sidewalk
system on Iowa Street, Ms. Gunter stated the application meets the criteria and staff is recommending approval,
Ms. Gunter highlighted a proposed condition that requires the garages to be for vehicular parking and not for storage.

Whenever my husband and I travel we like to seek out the weekend markets
in towns and cities and notice that most towns have them and they add so much to
the community spirit. It's a place for locals and tourists to come together and listen
to music and spend the morning looking at crafts and produce."'Since Ashland is all
about community I am saddened to hear this market may be stopped. As a seller
who was asked to stop coming to the Saturday Market, it is disturbing that this could
happen to a select few. Certain crafters were excluded while other could still attend
even though their crafts also competed with local stores. The soap store that started
this complaint was also, at that time, a member of the Grower's and Crafters Market
and no one tried to get her excluded from our market even though there were
already several competitors. Her store opens at 11am and the market closed at fpm
so I was only there for two hours and only got to attend the market one or two days
a month.
Many locals and tourists who have contacted me and asked why I stopped
coming were very upset that this happened and said they love coming to town and
picking up handcrafted gifts and also shopped at the local stores because they were
here when otherwise they would not have been in town that early in the day.
Growers and Crafter's Markets are an asset to the community and help to
draw visitors to town. They explore streets and shops that they may otherwise
never see. This market helps to make Ashland special. Please do the right thing and
accept the modifications.

I am Monica Rey, the current president of the RVGCM. As a founding member and one
of the first vegetable vendors at our initial Ashland location under the bridge on Water
Street, I want to thank you and the City of Ashland for our many years of cooperation
and presence here.
Outdoor markets like ours allow the general public to connect with their local food
sources and come in contact with agriculture and nature. They create an instinctively
positive atmosphere and relationship in a city setting.
I understand the concerns of the adjacent businesses, but think that the market brings
in large numbers of people, some of whom will spread out to neighboring businesses. In
a free enterprise society, healthy competition creates a stronger desire in consumers to
buy more! We want to do our best to encourage the growth of commerce for our
neighbors at the market.
The market has been and is an incubator for many businesses who have used our venue
as a springboard to bigger and better things. We ask that you please consider our
request as a reasonable adjustment of wording to better enable us to know how we are
to function.

My name is Abby Hogge and I was last year's downtown market manger.
Diversity within a market is critical for its success. In order to draw the
most customers to the market we need to appeal to the widest
customer base, and at the unique location of downtown, this means the
delicate balance of serving both locals AND tourists. Our markets are
required to maintain a 60% ratio of growers. Those 40% non growers
equates to only 12 booth spaces. Of those 12 booth spaces, most will
consist of artesian foods such as flavored salts, hummus, &,A z d kC r6a1 A 6 b6AA1 i
sauerkraut. Of the total 30 booth spaces -typically or less consist
of crafts.
Its also important to note that many of our farmers also sell farm direct
foods such as salsas, pesto, and honey
I believe that eliminating these 12 vendors will create a market which is
unappealing to tourists and our neighboring merchants will lose out on
the crossover traffic.
There is a symbiotic relationship between market and store front and
they are all crucial for the success of a thriving downtown economy and
unique atmosphere.
I urge you to approve the CUP modifications for the sake of all
stakeholders in the downtown core.

Being one of the largest property owners being affected by the Oak Street Closure, we have
concerns about you approving the conditional use permit for the Growers Market:
When the Growers Market was first proposed we were assured that our parking lot for the Liquor
Store and adjoining businesses would be monitored by them and none of their customers would
be allowed to park in our lot. That has not and is not being done. They also promised not to
allow any vendor to compete with any of our established businesses.
Saturday is the busiest shopping day of the week. You are already allowing them to take away
parking on this day, and now to allow them to compete with our established businesses does not
seem fair. These businesses have to operate year around. They have to pay for water, sewer,
electricity, license fees, taxes, rent, and employee costs just to open their doors.
We need these businesses to be successful for our Downtown District to be viable.
Our other concern is access for fire trucks to our buildings.

Problems with Oak Street Saturday M
Saturday afternoon before the matinee is a busy time downtown and already draws a lot of tourist traffic.
The market increases traffic from locals which does not generally benefit downtown businesses. The locals come
downtown specifically for the market and then leave.
The market creates a need for more parking spaces downtown while it removes existing parking spaces on Oak Street
from use.
Creates pedestrian and auto traffic congestion.
Blocks the shops on Oak Street from view and diverts pedestrian traffic away from store fronts.
Blocks the main exit from the bank drive through.
Market customers and vendors illegally park in the bank parking lot.
Vendors set up umbrellas and standing signs in the walkway/ fire lane in front of their booths.
All of the vendors have other options on Saturday morning.
As members of RVGCM they can set up in Medford m. , 5.
Some of the vendors are members of the Grants Pass Saturday Market.
Several of the vendors do in fact set up booths in Ashland, and/or Medford and/or Grants Pass.
Some of the crafters are members of the Lithia Artisans Market and can set up on the Calle.
Plus some of the growers sell their produce at the Coops in Ashland and Medford.
Unlike the shop owners the market vendors are not required to have an Ashland business license.
There are vendors that sell pr(-----' foods goads that are in direct competition with she Pucks and
Mix.
'his is a less than ideal location for growers because the traffic is
predominantly tourists and tourists generally don't buy produce or plants.
Ironically this is a lucrative location for crafters because of the tourist traffic, but crafters are limited in their set up.

Saturday Growers Market
It is my understanding that our local growers intend to show up in numbers
in an attempt to drown out the downtown shops at your next meeting.

Please know that no one opposes the growers market but the location and
timing (on Saturday) has shown to be harmful to our business. We have layed off
one Saturday employee due to a 30% drop in sales during and right after market
hours. This is not because of cabbage and carrot sales; the market is not abiding by
the current guidelines and are now asking for changes that would allow them to set
up on my "door step" and sell, fudge? caramel apples? ice cream?
Rogue Valley Growers Market is a business granted special right to rent out
public space to the growers. I would like to see them find a long term home that
does not negatively affect others. Perhaps we could look into the Ashland High
School or Middle School offering their parking lot for rent on Saturdays where
they can provide ample parking, water, electric and customer bathrooms. Maybe
some of the students would be willing to facilitate and manage this, putting some
of the booth rental money into the school!

We are opposed to the requested expansion of the Saturday Rogue Valley Growers
& Crafters Market on Oak Street
1) It would not be fair for the market vendors to sell ready to eat sweets in
competition of our business one half block away without having to abide by
the same laws our business is held to.
a) We pay for and abide by the requirements of a business license in the
City of Ashland to do business.
b) We pay for and abide by the requirements of the county health
department license to serve ready to eat food.
c) We pay for and abide by the requirements of the county weights and
measures department license to accurately sell products by weight.
d) We accurately keep detailed records of prepared food and beverage
sales and collect the required city tax of 5%, prepare the reports and
pay the money to the city.
e) We pay the City of Ashland street users fee.
2) It would not be fair to existing Ashland retail businesses to allow market
vendors to sell competing products during our most prime sales days and
time. Small business in Ashland has to budgeted on an annual basis. We
use the money earned on the busy summer Saturdays to employees during
the slow winter months.
3) Parking for our customers will be even more scarce.

4) We are already prohibited from bringing supplies to our business on
Saturdays from lam to 2pm. It would be a burden to lengthen that time.

5) This market was originally approved with the condition that after the first
full season of operations, prior to the beginning of the 2012 season, the
applicants and City planning staff shall conduct a meeting with interested
neighboring residents and business owners for the purpose of review for
continuing for additional seasons. This review has never happened.
6) The market is not operating in compliance with current provisions and are
now asking for changes to suit their needs without consideration to existing
businesses. As a result, our sales are down 10% during market hours. Our
sales are up seasonally 20% for an effective net loss of 30% to 35%.
Although we love the growers market, just like everyone, expanding the market
scope of sales and time of day just isn't fair at this location.

I am opposed to the increase in hours, months
and products for the Rogue Valley Growers and Crafter's
Market on Oak Street. Ashland is a tough environment for a
retail business to succeed 365 days a year. This is due to very
high rent, operational expenses as well as low traffic in the off
season. Being in business for 41 years, I am well aware of this.
The market needs to complement the local retailers instead of
competing.They need to not carry similar products. Presently
they are operating in a prime location at the most important
time of the week. This creates added parking problems as well
as safety and fire concerns. It was originally intended as a
temporary event with a review a year later. I 'am not aware of
ever being asked as to their impact on our sales.

Alex Amarotico, Standing Stone/Stated he is very supportive of the Growers Market and noted they have expanded their hours
and now serve breakfast on the days the market in open. He suggested expanding the market further to the Plaza or perhaps the
Wells Fargo parking lot.
Heidi Dawn, Growers Market Manager/Stated she canvassed the surrounding businesses twice and shared Nimbus's suggestion
to limit the growers market to agricultural products (no woodworkers, etc, that would compete with downtown merchants). She
commented on keeping the growers and crafters markets separate and stated the market in Eugene works very well with the two
markets side by side on different streets. She asked staff whether the market could expand its hours to 2 pm, or if that is not
possible perhaps a 1:30 closing time which is consistent with the other markets. She also noted the Wells Fargo bank has
expressed concern with market patrons parking in their parking lot and would like better signage.
No other business owners or residents were in attendance, but Severson noted that he had received e-mails and phone calls from
Hanson Howard Gallery, Ashland Mountain Supply, Thread Hysteria and Northwest Nature Shop expressing their general support
of the market operating in this location.

neighborhood meeting to discuss the first season of operations of
the Saturday Rogue Valley Growers and Crafters Market on Oak
Street. This meeting will be held from 3:00 to 4:00 p.m. on
Tuesday, February 21st in the Community Development &
Engineering Services building's Siskiyou Room at 51 Winburn
Way, and is intended to give neighboring property owners,
businesses and residents a chance to identify and discuss any
issues with the market's first season of operations on Oak Street
last summer.
The market was approved in the Oak Street location in March of
1 1 N1 VA 2011, and had previously been at Lithia and First Streets since
2008. The approval here included a requirement for a
neighborhood meeting to help identify and address any issues
that might come up after a full season of operations in the new
location prior to the commencement of the second season in May
2012.

Background - History of Application
In April of 2011, planning staff administratively approved a request for a
Conditional Use Permit to operate a weekly Saturday growers and crafters open air
market on one block of Oak Street, between Lithia Way and East Main Street. This,

approval involved a street closure between 7:00 a.m. and 2:00 p.m. (The applicants
had previously operated a similar Saturday market in a private parking lot at 175
Lithia Way from 2008-2011, and also operate the Tuesday inarket on Wightinan
and East Main Streets in Ashland., and Thursday and Saturday markets in Medford
as ivell.)
There are no other planning actions of record for this property, although this
block has seen closures for street fairs of similar scope and logistics for annual
city-sponsored Car Free Day events since 2005.
Detailed Description of the Site and Proposal
Site Description
The property involved is one block of Oak Street right-of-way between East Main
Street and Lithia Way located within the C-1-D Commercial Downtown zoning
district. The area proposed for closure encompasses approximately .19 acres and
has a length of approximately 200 feet and a curb-to-curb width of approximately
45 feet. The closure is proposed to be limited to the street right-of-way, with the
sidewalks on both sides to remain unobstructed and open to pedestrian traffic
during the street closure. A 15-foot clear width will also be maintained between the
two rows of vendor booths to accommodate pedestrian circulation and emergency
vehicle access. The existing right-of-way is paved, with curbs, gutters and
sidewalks in place, and while there are street trees in place within sidewalk tree
wells, there are no natural features within the area proposed to be closed for the
market.
Previous Approval (PA#2011-153)
The applicants' current Conditional Use Permit allows the operation of an outdoor
farmers market on Saturdays from 7:00 a.m. to 2:00 p.m. during the months of May
through November on a closed portion of the Oak Street right-of-way. As currently
approved, no prepared food is to be available at the market. The original
application noted that vendors in the downtown location would be limited to selling
"fresh fruit, vegetables, flowers, bedding plants, meat, eggs, cheese, bread, pasta,
dog bones, and jam," and that aside from monthly market cooking demonstrations
by local chefs, there was to be no cooking on site and no prepared foods offered for
sale. These limitations were self-imposed by the applicants in their original
application as a means of encouraging market patrons to make their way to nearby
restaurants for a meal or extend their shopping into the downtown core.
Under the current approval, vendors are to arrive no earlier than 7:00 a.m. to begin
off-loading vehicles, and those vehicles are to be off-loaded and parked elsewhere
by 8:30 a.m. Booths will be set up for opening by 9:00 a.m., and the market will
operate from 9:00 a.m. until 1:00 p.m. Vendors are to take down their booths and
clean the site, with the street to re-open by 2:00 p.m. The applicants are responsible
for leaving the area clean and disposing of any market waste off-site.

The market has been in operation under these parameters since the 2011 approval,
and the applicants are now requesting to modify their Conditional Use Permit. The

R Project Impact
The proposal requires a Conditional Use Permit approval since it involves a temporary,
seasonal use and the associated outdoor display of commodities within the C-1-1) zoning
district. Conditional Use Permits of this nature are reviewed to ensure that they will have
no greater adverse material effect on the livability of the impact area than would
development of the subject property according to the target use of the zoning district.
Given that the nature of the request (a seasonal, outdoor Saturday market within the
doi,mtown) the primary areas of concern typically focus on the generation of traffic and
parking impacts, air quality, noise, light and glare.
In accordance with Chapter 18.108, Conditional Use Permits for temporary uses may be
approved administratively through a "Type I" procedure however given that the proposal
involves a change in the scope of products to be offered from the applicants' original, self-
imposed limitations and that subsequent to the applicants notifying neighboring businesses
of the proposed modifications, but prior to their making formal application, a number of
continents expressing concern were submitted to staff, staff opted to schedule the request
for a public hearing.
First Proposed Modification - Product Offerings
The first, and most significant of the proposed modifications, is to allow vendors to sell the
same goods as are sold at their other markets in the Rogue Valley, with the exception of

hot prepared foods. This would allow the sale of goods "grown, produced, prepared or
crafted by RVG&CM members who are farmers, ranchers, food processors and crafters."
The vendors are currently limited to selling only "fresh fruit, vegetables, flowers, bedding
plants, meat, eggs, cheese, bread, pasta, dog bones, and jam," and are not to sell prepared
foods. The current limitations were self-imposed by the applicants in the 2011 application
to avoid selling products which might directly compete with downtown businesses and to
encourage customers who were already downtown to shop to continue on to nearby
downtown businesses.
The application concludes that the "Saturday Market is beneficial to the Ashland
community as a whole. The central location encourages non-vehicular traffic and makes it
accessible by foot, bicycle or car to residents and visitors alike. It will also stimulate
downtown businesses by bringing more pedestrians into the Plaza and Main Street area.
Markets support small farmers and keep dollars circulating in the local economy; they
promote health and well-being of the citizenry and inspire pride of place." The application
includes a petition in favor of the requested changes signed by a number of Ashland
business owners or their authorized representatives, including: Caldera Tap House, Tabu,
Tree House Books, Oberon's, Loft, Martolli's, Agave, Deli Downstairs; Lounge South,
Mix Sweet Shop, Noble Coffee, The Black Sheep Pub, Pasta Piatti, Sesame, Northwest
Nature Shop, Standing Stone, the Ashland Independent Film Festival, Papaya Living and
Harvey's Place.
After being made aware of the proposed modifications, but prior to the applicants'
submittal of a formal application, representatives of surrounding businesses Ashland Wine
Cellar, Stop and Shop, Paddington Station, the Paddington Jewel, Emz Blendz. Soap
Company, All's Well Herb Shoppe, Rocky Mountain Chocolate Factory, Paris Green, Art
F/X, Frederica Lawrence Fine Clothing, Reds Threads, Hanson Howard Gallery, Bella
Terra Fine Jewelry, Nimbus, the Book Exchange signed a petition which was submitted to
staff asking that the market not only be limited to selling only produce and agricultural
items, but that the market be moved to Sundays rather than Saturdays. Some of those in
opposition also provided letters expressing concern over there being "no limits" on
products that could be sold at the market, and that selling crafts would compete directly
with adjacent businesses selling natural, hand-crafted products such as soaps and candles.
Staff believes that public markets are generally beneficial uses which bring with them a
sense of greater vitality and enliven a city's downtown core. In approving the applicants'
Conditional Use Permit in 2011, staff found that the location seemed well-suited for a
market, and that it would benefit neighboring businesses and their employees, residents and
the community at large by providing convenient access to healthy, fresh locally grown food
while energizing the area and hopefully generating "spill-over" sales to neighboring
businesses.
For staff, the market's presence in the downtown poses a delicate balance as evidenced by
the number of nearby businesses in support and in opposition to the proposed changes.
While farmers markets bring many benefits, they also bring vendors downtown who have
the advantages of using public right-of-way with none of the brick-and-mortar costs of
established neighboring businesses in competing for limited customer dollars. Staff
believes that the current limitations on product offerings originally proposed by the

applicants were in recognition of this delicate balance, and that any change in these
offerings needs to be carefully considered.
While the application materials submitted did not include the Rogue Valley Growers and
Crafters Market's guidelines, in reviewing materials available on-line from their web-site
ht~- r dt.com staff have noted that these guidelines generally require
that:
® No less than 60 percent of the products offered at the market shall be agricultural in
nature.
® All crafts are to be made by a member with a purpose or theme interactive with
agriculture and composed of predominantly locally grown agricultural products or by-
products.
® Crafts must be handmade, grown or gathered by the member, and hand-crafted
components must dominate any commercial components used. Any commercial
components must be transformed in a way that makes the work unique.
Based on these guidelines, it seems clear that while the current request proposes to modify
the allowed product offerings at the market, the products offered would be limited to those
of a predominantly agricultural character. This would prevent the offering of a broad range
of retail items such as books that were a concern expressed by some in opposition, and in
staff's view allowing some measure of handmade crafts associated with the general
agricultural character of the market seems appropriate. The key question comes back to
the delicate balance discussed above and whether allowing up to 40 percent of the product
offerings at the market to be non-agricultural in nature, or more specifically allowing up to
12 of the typical 30 booths to offer craft items or prepared foods, maintains that balance.
Given the limited area of the market on Oak Street and the proximity, concentration and
nature of surrounding businesses, staff believes that 40 percent may shift that balance too
heavily toward crafts and foods, and would recommend that the Commission allow no
more than 25 percent of market vendor offerings in the Oak Street location to be crafts or
prepared foods, and that at least 75 percent of the vendor offerings be agricultural items.
Staff also believes that the Commission should consider whether it wishes to prohibit the
sale of craft items in the market which would directly compete with the offerings of
existing businesses on this block of Oak Street.
Second Proposed Modification - Market Season and Hours
The second requested modification is to allow the market's season and hours to mirror the
applicants' other markets in the Rogue Valley. This would allow a March through
November season, rather than the current May through November season for the Saturday
market, would begin the street closure at 6:30 a.m. rather than the current 7:00 a.m.
In staff's view, and earlier season might bring more people to the downtown at a slower
time of year, and would be beneficial. Staff sees no significant issues with either of these
modifications provided that the street continues to be re-opened in a timely manner by 2:00
p.m.

Third Proposed Modification - Booth. Configuration
The final proposed modification is to alter the market booth configuration to create a mid-
market sidewalk access point between vendor booths at the entrance to the alleyway on the
west side of Oak Street in order to better accommodate pedestrian and wheelchair traffic to
adjacent businesses.
This modification resulted from concerns expressed by neighboring businesses last season
that the continuous booth configuration originally approved effectively cut off access to the
sidewalk and adjacent businesses. This change was implemented last season is response to
those concerns, and has been included in the request here to formalize the modification. In
staff's view, this change was beneficial in helping the market better relate to the adjacent
businesses and should be continued.
M Procedural - Required Burden of Proof
The criteria for Conditional Use Permit approval are detailed in AMC 18.104.050 as follows:
A. That the use would be in conformance with all standards within the zoning district in
which the use is proposed to be located, and in conformance with relevant Comprehensive
plan policies that ore not implemented by any City, State, or Federal law or program.
B. That adequate capacity of city facilities for water, sewer, paved access to and through the
development, electricity, urban storm drainage, and adequate transportation can and will
be provided to and through the subject property.
C. That the conditional use will have no greater adverse material effect on the livability of the
impact area when compared to the development of the subject lot with the target use of
the zone. When evaluating the effect of the proposed use on the impact area, the
following factors of livability of the impact area shall be considered in relation to the
target use of the zone:
1. Similarity in scale, bulk, and coverage.
2. Generation of traffic and effects on surrounding streets. Increases in pedestrian,
bicycle, and mass transit use are considered beneficial regardless of capacity of
facilities.
3. Architectural compatibility with the impact area.
4. Air quality, including the generation of dust, odors, or other environmental
pollutants.
5. Generation of noise, light, and glare.
6. The development of adjacent properties as envisioned in the Comprehensive Plan.
7. Other factors found to be relevant by the Hearing Authority for review of the
proposed use.

IV. Conclusions and Recommendations
The Rogue Valley Growers and Crafters Market has operated.a Saturday Market on a closed block
of Oak Street on Saturday mornings since receiving administrative approval in 2011. That
approval included conditions proposed by the applicants limiting their hours, season and offerings

and detailing a proposed market lay-out. Now in their fourth season at this location, the applicants
have requested three modifications to their approval:
1) To allow vendors to sell the same variety of goods sold at their other markets in the Rogue
Valley, with the exception of hot prepared foods. This would allow the sale of goods
grown, produced, prepared or crafted by RVG&CM members who are farmers, ranchers,
food processors and crafters. (The vendors are cztrrently limited to selling only f°esh fruit,
vegetables, foli)ers, beddingplants, meat, eggs, cheese, bread, pasta, dog bones, and jam,
and are not to sell prepared food )

For staff, the market's presence in the downtown must strike a delicate balance. While staff
generally supports the market and believes that it brings many benefits, we also recognize that it
brings vendors downtown who have the advantages of using public right-of-way with none of the
brick-and-mortar costs of neighboring businesses in competing for increasingly limited customer
dollars. Staff believes that the current limitations on product offerings originally proposed by the
applicants were in direct recognition of this delicate balance. The applicants' own guidelines seek
to maintain a predominantly agricultural character to the valley's markets and their offerings, and
require that at least 60 percent of the offerings be agricultural products. The key question comes
back to that delicate balance, and whether allowing up to 40 percent of the product offerings at the
market to be non-agricultural in nature (i.e. crafts and prepared foods) maintains that balance.
Given the limited area of the market on Oak Street and the proximity, concentration and nature of
surrounding businesses, staff believes that 40 percent may shift that balance too heavily toward
crafts and foods, and would accordingly recommend that the Commission allow no more than 25
percent of market vendor offerings in the Oak Street location to be crafts or prepared foods, and
that at least 75 percent of the vendor offerings be agricultural items. Staff also believes that the
Commission should consider a prohibition on the sale of craft items which would directly compete
with the offerings of the existing businesses on this block of Oak Street.
Should the Commission concur with staff, we would recommend that the flowing conditions be
attached to the approval.

Guidelines for Grousers
The Grower Jury Committee will evaluate all new grower/vendor products to be sold at
market. A jury review will ensure products meet the market product guidelines and
criteria. The goal is to support new growers while also balancing market diversity for
economic viability of all participating growers. All new growers admitted will be subject
to a one season trial period; status will be reviewed after that time. The jury's product
review is based on the following market standards:
Criteria for vendor selection for jury review
1. All Farm Products* and plants sold at market must be 100% grown and harvested by
a RVGCM member and have a fresh and healthy appearance.
2. Bedding and landscape plants and flowers must be propagated by the vendor from
seed, cuttings, bulbs, plugs or plant divisions and must be grown by the vender and must
have been under the vendor's control. All plant growers must have a nursery license. Two
copies must be submitted with Grower Application.
3. All Grower/Vendor applicants agree to a farm check to verify products are grown at
farm locations listed on their application.
4. Upon the setup of new grower's first day at market, a committee or board member
will visit your booth to review your product, booth presentation, and answer any
questions you may have about market. All applicable licenses, certifications and
"Growing Practices" sheet (growing methods disclosure statement), must be posted in
plain sight.
5. All Grower/Vendor applicants may not knowingly sell produce or seeds at market
that are derived from GMO's (Genetically Modified Organisms).- Growers are
obligated to notify the market manager immediately if your non-GMO status changes.

subject property for closure to motor vehicles consists of one block of the Oak Street right-of-way,
between Lithia Way and East Main Street, which has previously been closed to conduct the annual Car
Free Day event and associated street fair. The area for closure encompasses approximately .19 acres and
has a length of approximately 200 feet and a curb-to-curb width of approximately 45 feet. The closure is
limited to the street right-of-way, with the sidewalks on both sides remains unobstructed and open to
pedestrian traffic during the street closure. A 15-foot clear width is maintained between the two rows of
vendor booths to accommodate pedestrian circulation and emergency vehicle access. The existing right-
of-way is paved, with curbs, gutters and sidewalks in place, and while there are street trees in place
within sidewalk tree wells, there are no natural features within the area closed for the market.
The Rogue Valley Growers & Crafters Market (RVGCM) had been operating under the current CUP since
the approval dated April 2011. In order to better represent the organization's diversity in products and to
benefit neighboring local businesses, this proposal is for a modification of the current CUP.
RVGCM would like to request a change in the wording of the CUP to have the CUP clearly recognize that
the Saturday growers and crafters market site, have the same composition in diversity of goods as
offered in the other markets operated by Rogue Valley Growers & Crafters Markets (with the exception
of hot-prepared foods) Rather incongruous to the principal description in the CUP for the growers and
crafters market, one sentence mentioned in previous permit, taken literally allows only 11 articles in the
whole of market. By recognizing the diversity and seasonality, additional items as permitted by the
bylaws (goods grown, produced, prepared or crafted by its members who are farmers, ranchers, food
processors and crafters) may be sold at the market.
Rogue Valley Growers & Crafters Market seeks to correct or amend three things within its Conditional
Use Permit
1. To be granted permission, in future years, to have cohesion with its other markets and mirror the
season & hours of the weekday market (as of this application, March-Nov).
2. Permit a change to the wording in the CUP to recognize that the Saturday Market site may have the
same composition in diversity of goods as offered in the other markets operated by Rogue Valley
Growers & Crafters Markets (with the exception of hot-prepared foods)
3. RVGCM proposes to establish an additional sidewalk access point at the entrance of the alleyway on the
north side of Oak Street. By creating an additional access point, RVGCM recognizes the mutually beneficial
relationship between market and neighboring storefronts. The proposed wheelchair accessible entrance
will easily accommodate pedestrian traffic to adjacent businesses and encourage cross over sales.
18.104.050 Approval Criteria
A. That the use would be in conformance with all standards within the zoning district in which the
use is proposed to be located, and n conformance with relevant Comprehensive Plan policies that
are not implemented by any City, State, or federal law or program.
The proposed market use would result in the temporary erection of canopies for the sale of
market goods; and parking for market vendors and customers. The market conforms, to all
standards of the C-1
Retail Employment District. See previous discussion on parking.

B. That adequate capacity of City facilities for water, sewer, paved access to and through the
\ E
development, electricity, urban storm drainage, and adequate transportation can and will be
provided to and through the property.
Infrastructure is in place to support this use. Water and electricity is being provided by Standing
Stone Brewery and city storm water drains are in place for the minimal gray water (approximately
10 gallons per market) from cut flower buckets. Fire Marshal Margueritte Hickman has certified that
there is adequate space for a 15-foot wide fire lane through the site and the market will vigorously
maintain this space. As previously mentioned, public bathroom facilities on Calle Guanajuato are a
short walk away and will also be available at Standing Stone Brewery.
C. That the conditional use will have no greater adverse material effect on the livability of the impact
area when compared to the development of the subject lot with the target use of the zone. When
evaluating the proposed use on the impact area, the following factors of livability of the impact area
shall be considered in relation to the target use of the zone:
1. Similarity in scale, bulk, and coverage
The market use will be similar in bulk, scale, and coverage to the high-intensity use of the
parking lot.
2. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle,
and mass transit use are considered beneficial regardless of facilities
The location is between two major arterials, Lithia Way and E. Main St. Anticipated traffic
will be similar to high intensity use of the bank parking lot. The location is centered in an
area of residential use surrounding the commercial core of the city and it is not
unreasonable to expect that a large proportion of visitors will walk or bike to the market. At
this time RVTD has limited service i n the area of the Plaza on Saturdays.
3. Architectural compatibility with the surrounding area
This criterion is not applicable since the proposed use is temporary. Canopies will be
erected for a maximum of 6 hours per week from spring through fall.
4. Air quality, including the generation of dust, odors, or other environmental pollutants
The odors generated by the market will be primarily those of flowers, plants, and
vegetables. No hot food concessionaire vendors will be attending this market.
5. Generation of noise, light, and glare
Vendors will begin setting up at 6:30am and be gone by 2pm. Market rules prohibit the use
of generators. Noise will be limited to human voices, light truck loading and unloading, and
acoustic music during market hours. No amplified sound will be allowed. No lights will be
needed since the market operates in daylight.

6. The development of adjacent properties as envisioned in the Comprehensive Plan
The area on both sides of Oak St is already fully developed with no further changes
anticipated.
7. Other factors found to be relevant by the Hearing Authority for review of the proposed use:
Tree Protection as required by this section (AMC 18.61.230) is applicable to any planning
action or building permit.
The trees within the site are located on the map. They are protected from vehicle damage
by the existing curbs and no unloading of vendor supplies to the sidewalk area will be
allowed. No signage will be allowed to be placed on the trees. There will be no
construction activity related to the proposed use and so no impact on the trees is
anticipated.
Public Safety in regard to street closure.
ODOT is aware of the proposal and the intent to erect barricades at each end of the
street which will direct all traffic to proceed either down Main St. or Lithia Way. Citing
the City of Ashland's Right-of-Way Street Closure Permit, Type-III barricades will
be placed and removed by the market manager. Additional issues will be addressed as
required.
18.72.070 Criteria for Approval
The following criteria shall be used to approve or deny an application:
A. All applicable City ordinances have been met or will be met by the proposed development
B. All requirements of the Site Review Chapter have been met or will be met
C. The development complies with the Site Design Standards adopted by the City Council
for implementation of this Chapter
D. That adequate capacity of City facilities for water, sewer, paved access to and through
the development, electricity, urban storm drainage and adequate transportation can
and will be provided to and through the subject property. All improvements in the
street right-of-way shall comply with the Street Standards in Chapter 18.86,
Performance Standards Options (Ord. 26SS, 1991; Ord. 2836 S6, 1999)
Conclusion
We believe the Saturday Market is beneficial to the Ashland community as a whole. The central
location encourages non-vehicular traffic and makes it accessible by foot, bicycle, or car to
residents and visitors alike. It will also stimulate downtown businesses by bringing more
pedestrians into the Plaza and Main St area. Markets support small farmers and keep dollars
circulating in the local economy; they promote the overall health and well-being of the citizenry
and inspire pride of place. We are gratified by the support of the community and the neighbors in I
the area of this location and look forward to continuing to provide a wide array of sustainably
grown, prepared and crafted goods.

Dear Derek Severson,
My name is Emily Whitlock and I am the owner of Emz Blendz Soap Company at 93 Oak Street. We have
been an established business in the same location for over ten years. We sell naturally handcrafted
soaps, bath products, candles and handmade crafts including jewelry and gifts. Almost every single
product we sell in our store is handmade by us.
I'm writing to you about a concern with The Growers Market that sets up in-front of our storefront every
Saturday from May through November. Today, I received a letter from The Growers Market stating that
they will be working to revise their Conditional Use Permit so that they will have no limits on the types of
crafts and other products that they are allowed to sell with the exception of ready-to-eat foods.
I assume that surrounding restaurant businesses do not want The Growers Market to sell read-to-eat
foods because it directly impacts their businesses. I feel that the same guidelines should be (as they
already are in the current CUP) made for business like ours who sell crafts and naturally handcrafted
products specifically because the Market sets up directly in-front of our store-front.
I have brought this to their attention each year and although I was told that they would follow the
guidelines set in their original CUP, each year I have to ask them not to sell similar products that I sell in
my store such as handcrafted soap, candles and other similar bath products. I'm quite certain that other
business owners in the surrounding area would appreciate it if The Growers Market would abide by the
original permit which states that:
vendors are to sell fresh fruit, vegetables, flowers, bedding plants, meat, eggs, cheese, bread,
pasta, dog bones, and jam, and no sale of prepared foods or on-site cooking other than cooking
demonstrations.
I want it to be made clear that I am in support of The Growers Market as an agricultural market. I
appreciate your help very much. I simply would like the same considerations to be made for my business
as the surrounding restaurants. I am not comfortable with a revised permit that gives no limit to the
types of products that they can sell and I am quite certain that several other businesses feel the same.

I am responding to your letter regarding changes to

local business owner in Ashland. My business is
located on Oak St. I am opposed to the Growers Market
changing to a no-limits permit. This could be
difficult for local merchants. I don't feel that it
is right for merchants who are paying premium
downtown rents to have to compete for business

Dear Mr. Severson,
I would like to voice my opposition to the modifications listed in a letter
received from the RVGCM dated 3/1/14. The "no limitations" on
products offered is of great concerns to me. As owner of a 43 year old
retail business in Ashland who pays high downtown rent in excess of
$50,000 yearly selling used books I fear that without limitations a street
vendor could begin selling retail products, like books, and have little to
pay in rent or space fee.
This just seems blatantly unfair. Their proposal states that on 60% of
offered products have to be agricultural. The other 40%, 1 assume,
would be unlimited. While I support a growers and crafters market I
don't want to see it become a sidewalk sale for non-business owners or
a flea market if you will.
In addition, they state that "in the future" they want to expand to
weekdays and I find this intolerable because of the difficult parking
situation downtown. The RVGCM should be looking for a larger
location that does not block street access. What's next? Closing the
plaza? Closing E.Main St.?
Their proposal is vague and non-specific. They should have limitations E
and a specific list of goods they will allow. I noticed them selling

products in direct competition with business on Oak St.and not abiding

A further note, we already have Guanajuato Way open market and the

on Oak St. This is grossly unfair to the rest of us business owners.
This is becoming a circus!
Please no perpetual sidewalk sales. Actually I'd like to see them off the
street altogether... find a new space.

P.S. Since writing this letter a petition has come to my attention. I find
most other businesses are being hurt financially on Saturdays. I did an
analysis on my own business comparing Saturday sales in 2012 and
2013, May to October with Saturday sales in 2009 and 2010 same
months and found a 15% decrease in 2012 and 9% decrease in 2013.

Problems with Oak Street Saturday `Market-
Saturday afternoon before the matinee is a busy time downtown and already draws a lot of tourist traffic.
The market increases traffic from locals which does not generally benefit downtown businesses. The locals come
downtown specifically for the market and then leave.
The market creates a need for more parking spaces downtown while it removes existing parking spaces on Oak Street
from use.
Creates pedestrian and auto traffic congestion.
Blocks the shops on Oak Street from view and diverts pedestrian traffic away from storefronts.
Blocks the main exit from the bank drive through.
Market customers and vendors illegally park in the bank parking lot.
Vendors set up umbrellas and standing signs in the walkway/ fire lane in front of their booths.
All of the vendors have other options on Saturday morning.
As members of RVGCM they can set up in Medford on Saturday morning.
Some of the vendors are members of the Grants Pass Saturday Market.
Several of the vendors do in fact set up booths in Ashland, and/or Medford and/or Grants Pass.
Some of the crafters are members of the Lithia Artisans Market and can set up on the Calle.
Plus some of the growers sell their produce at the Coops in Ashland and Medford.
Unlike the shop owners the market vendors are not required to have an Ashland business license.
There are vendors that sell-prepared foods-suchas-baked goods that are in direct competition with-shops like Pucks and
M ix.
the RVGCM gives preference to growers but this is a less than ideal location for growers because the traffic is
predominantly tourists and tourists generally don't buy produce or plants.
Ironically this is a lucrative location for crafters because of the tourist traffic, but crafters are limited in their set up.
A better location for the growers and for local bus orr?ers wQuJ.d be in a large open space away from downtown.

When the original application was submitted it included comments from the City of Hillsboro and Lincoln City regarding
the effects of markets on local businesses.
If you check the websites for these markets you will find that the Lincoln City Market is on a Sunday and appears to be
set up in -a park or brassy area.
Hillsboro is set up on what looks like a wide boulevard. There aren't booths close to the sidewalks or blocking any

I haven't seen the letter that the Market sent to the neighboring
businesses around Oak Street, but it has begun to generate a lot of
comments, concerns and questions back to me. I'm attaching a couple
of letters and a petition from business owners; I've also had several
phone calls in the same vein.
If you have a copy of the letter you sent, it would help for me to get a
copy since it seems to be creating some confusion as to whether it was
from the city and whether there is a proposal actually under review now.
I'll continue to add the letters and e-mails I'm receiving to the market
file, and to send them to you as well.

The Rogue Valley Growers & Crafters Market is interested in implementing modifications to the Market CUP to reflect a more accurate
representation of our organization. The Market's general set-up will be the same this season. The arrangement is designed to appear
dense and intentional, yet still allow access for emergency vehicles. We hope the below modifications will clarify the make-up of our
association and will continue on the path of creating a more symbiotic, mutually beneficial relationship with neighboring businesses.
Having a positive effect on the livelihoods of small local businesses in the Rogue Valley continues to be important to the Rogue Valley
Growers & Crafters Market. As stated in prior communications; as a small business ourselves, we feel the crunch of big box competitors
around us and feel a solidarity in the mutual strength of local businesses.
This 2014 Season, the Market is seeking to clarify the following:
1. RVGCM will have an open air Market between the hours of 8:30 AM and 1:00 PM Saturdays with approximately 30 vendor spaces.
The Market will operate in 2014, from May 3 - October 25. However, at some point in future years, the Saturday Market may like
to adopt a coordinated schedule to coincide with the weekday Market schedule and operate March through November.

Department will send a notice of complete application to surrounding
property owners and place signs up on the block to let people know of
the request. Once the complete application is noticed, there's a
two-week comment period where anyone can submit comments or
identify concerns with the proposal. After the comment period,
Planning staff will review the application and the comments received
and make a decision. Notice of that decision is mailed to those who
provided comments, and there's a 13-day appeal period where parties
can request a public hearing before the Planning Commission.

I'm writing to you about a concern with The Growers
Market that sets up in-front of our storefront every Saturday from May
through
November. Today, I received a letter from The Growers Market stating
that they
will be working to revise their Conditional Use Permit so that they will
have limits on the types of crafts and other
products that they are allowed to sell with the exception of ready-to-eat
foods.
I assume that surrounding restaurant businesses do
not want The Growers Market to sell read-to-eat foods because it
directly impacts
their businesses. I feel that the same guidelines should be (as they
already
are in the current CUP) made for business like ours who sell crafts and
naturally handcrafted products specifically because the Market sets up
directly
in-front of our store-front.

and although I was told that they would follow the guidelines set in their
original CUP, each year I have to ask them not to sell similar products
that
sell in my store such as handcrafted soap, candles and other similar

Oak St. I am opposed to the Growers Market changing to
a no-limits permit. This could be difficult for local
merchants. I don't feel that it is right for merchants
who are paying premium downtown rents to have to
compete for business against the Growers Market! It in
my opinion should stay agriculture based, unless they
were to move away from downtown area.
