Notice of Final Decision
On February 20, 2015, the Community Development Director approved the request for the following:

The Community Development Director's decision becomes final and is effective on the 13th day after the Notice of
Final Decision is mailed. Approval is valid for a period of one year and all conditions of approval identified on the
attached Findings are required to be met prior to project completion.
The application, all associated documents and evidence submitted, and the applicable criteria are available for
review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents
can be requested and are charged based on the City of Ashland copy fee schedule.
Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of
the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.108.070(B)(2)(b) and/or file an appeal to the
Ashland Planning Commission as provided in ALUO 18.108.070(B)(2)(c). The ALUO sections covering
reconsideration and appeal procedures are attached. The appeal may not be made directly to the Oregon Land Use
Board of Appeals.

SECTION 18.108.070(6)2 Effective Date of Decision and Appeals.
B. Actions subject to appeal:
2. Type I Planning Actions.
a. Effective Date of Decision. The final decision of the City for planning actions resulting from the Type I
Planning Procedure shall be the Staff Advisor decision, effective on the 13th day after notice of the
decision is mailed unless reconsideration of the action is approved by the Staff Advisor or appealed to
the Commission as provided in section 18.108.070(B)(2)(c).
b. Reconsideration. The Staff Advisor may reconsider Type I planning actions as set forth below,
i. Any party entitled to notice of the planning action, or any City Agency may request reconsideration
of the action after the decision has been made by providing evidence to the Staff Advisor that a
factual error occurred through no fault of the party asking for reconsideration, which in the opinion
of the staff advisor, might affect the decision. Reconsideration requests are limited to factual errors
and not the failure of an issue to be raised by letter or evidence during the opportunity to provide
public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the
issue prior to making a decision,
ii. Reconsideration requests shall be received within five (5) days of mailing. The Staff Advisor shall
decide within three (3) days whether to reconsider the matter.
iii. If the Planning Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff
Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide
within ten (10) days to affirm, modify, or reverse the original decision. The Staff Advisor shall send
notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of
the planning action.
iv. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor
shall deny the reconsideration request. Notice of denial shall be sent to those parties that
requested reconsideration.
C. A eal.
i. Within twelve (12) days of the date of the mailing of the Staff Advisor's final decision, including any
approved reconsideration request, the decision may be appealed to the Planning Commission by
any party entitled to receive notice of the planning action. The appeal shall be submitted to the
Planning Commission Secretary on a form approved by the City Administrator, be accompanied by
a fee established pursuant to City Council action, and be received by the city no later than 4:30
p.m. on the 12th day after the notice of decision is mailed.
ii. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing
shall be refunded. The fee required in this section shall not apply to appeals made by
neighborhood or community organizations recognized by the city and whose boundaries include
the site.
iii. The appeal shall be considered at the next regular Planning Commission or Hearings Board
meeting. The appeal shall be a de novo hearing and shall be considered the initial evidentiary
hearing required under ALUO 18.108.050 and ORS 197.763 as the basis for an appeal to the Land
Use Board of Appeals. The Planning Commission or Hearings Board decision on appeal shall be
effective 13 days after the findings adopted by the Commission or Board are signed by the Chair of
the Commission or Board and mailed to the parties.
iv. The appeal requirements of this section must be fully met or the appeal will be considered by the
city as a jurisdictional defect and will not be heard or considered.

DECISION:
The application is a request for a Site Review approval to add approximately 200 square feet to
the rear of the existing building to add storage area for the property at 485 A Street. Additionally,
the existing porch facing Fourth Street is proposed to be extended across the fagade of the
existing structure including the new addition. No additional modifications to the site beyond the
proposal are being considered with this application, and any future development or modification
of the site would require a separate Site Review application.
The subject property is located on the northwest corner of the intersection of A Street and Fourth
Street, within the Railroad Addition Historic District and just south of the Southern Pacific
Railroad right-of-way. The lot itself was part of the Southern Pacific Railroad property that was
partitioned in 1993, and comprises approximately 14,982 square feet in area. The site is
relatively flat and has no significant natural features. The eastern portion of the site currently
contains a mixed-use building oriented toward Fourth Street. The building has served as a yoga
studio and retail space for some time, and is considered "non-historic/non-contributing" in the
Railroad Addition Historic District inventory document. This building was originally constructed
in 1995 at 1,104 square feet, and was supplemented with an addition consisting of 924 square
feet of downstairs commercial space and 924 square feet of upstairs residential space that was
approved as part of Planning Action #2000-120. The proposed Site Review approval to enclose
a .small porch area at the rear of the property to additional office area (PA2011-0244).
The proposal is to add approximately 200 square feet to the north side of the existing building.
Additionally, the existing front porch will be extended across the fa9ade of the building to the
north. The applicant has proposed to construct the addition and porch extension with the same
materials including siding, window and door materials that match the existing structure. The
existing structure and site complies with the Site Review chapter and the Site Design and Use

Standards and the proposed addition will also comply. Utilities exist on the parcel to serve the
existing uses and the proposed addition 200 square feet.
There are 16 parking spaces not including the on-street spaces to serve the existing and proposed
future uses of the site. Access from the parking area is a raised sidewalk extending from the rear
to the sidewalk along Fourth Street, and a trash and recycling enclosure is situated on the
property's northwest corner. Vehicular access to the parking lot is from A Street via a 20-foot
wide driveway located adjacent to the driveway serving the Grange Co-Op to the west.
Overall site and parking lot landscaping meet or exceed required coverage percentages. Access
to existing and future buildings will be from a five-foot walkway along the south and east
perimeters of the parking lot. Covered bicycle parking for four bicycles are provided at the
southeast corner of the lot, with two bicycle spaces located adjacent to the plaza space at the
corner of Fourth and A Streets.
A Street is an Avenue or Collector Street; and Fourth Street is a Neighborhood Street. Both are
paved, with curbs and gutters in place in the vicinity of the subject property, and sidewalks are
installed along the subject property's frontages to satisfy conditions of the previous planning
approval. Utilities including water, sanitary sewer, storm drainage and electric are in place on
the property and in the adjacent rights-of-way to serve the project.
The Historic Commission considered the request at their February 4, 2015 meeting.
Commissioners noted that the applicant's efforts in the past have been generally well-
received. The Commission recommended approval of the request.
The criteria for Site Review approval are described in AMC Chapter 18.72.070 as follows:
A. All applicable City ordinances have been met or will be niet by the proposed
development.
B. All requirements of the Site Review Chapter have been met or will be n7et.
C. The development complies with the Site Design Standards adopted by the City
Council for implementation of this Chapter.
D. That adequate capacity of City facilities for water, sewer, paved access to and
through the developnent, electricity, urban storm drainage, and adequate
transportation can and will be provided to and through the subject property.
The application with the attached conditions complies with all applicable City ordinances.
Planning Action #2014-02206 is approved with the following conditions. Further, if any one or
more of the following conditions are found to be invalid for any reason whatsoever, then
Planning Action #2014-02206 is denied. The following are the conditions and they are attached
to the approval:
1) That all proposals of the applicants shall be conditions of approval unless otherwise modified
herein.

2) That all conditions of Planning Action #2000-120 and 2007-00579 shall remain in effect
unless specifically modified -herein.

3) That prior to the issuance of a building permit:
a) The plans submitted for the building permit shall be in substantial conformance
with those approved as part of this application. If the plans submitted for the
building permit are not in substantial conformance with those approved as part of
this application, an application to modify the Site Review shall be submitted and
approved prior to issuance of a building permit.
4) That the exterior siding, windows, doors, porch railing material and colors shall match the
existing structure.

APPROVAL OF MINUTES:
Mr. Whitford motioned to approve minutes from January 7, 2015. Mr. Swink seconded. Mr.
Giordano abstained. No one opposed.
PUBLIC FORUM:
There was no one in the audience wishing to speak.
COUNCIL LIAISON REPORT:
Mr. Skibby introduced Ms. Voisin to the Commission. Ms. Voisin gave the council liaison report. She
stated that the City Council discussed the welcome center at ODOT but clarified that no decision was
made. Ms. Voisin noted that there was a study session, regarding a group of citizens that would like
to start a Culture of Peace Commission. She announced that they are meeting with the City Council
and discussing how to move forward with this. She also noted that the City Council passed a height
restriction, to be raised to 55 feet, in the D-1 & C-1 zones(downtown and some historic). The fire
chief expressed concern regarding this change as they only have aerial ladders that reach up to two
stories high. The City Council will be looking into this issue. Ms. Voisin went on to say that, on
February 17, 2015, the City Council will be discussing hanging baskets on the downtown streetlights
and they will also be giving a risk management report. She announced that the annual presentation
to City Council, from the Historic Commission is April 21, 2015. They will also be discussing quorum
requirements for City Commissions at this time. Ms. Voisin also added that the Police Department
gave an update on the Hannah Thomas-Garner case. She reported that the City is looking for and
recruiting for a Chief of Police. She added that the budget process is beginning and they will start
discussing it on Feb 19, 2015.

Ms. Gunter gave the staff report on PA-2014-02206.
Mr. Skibby opened the public hearing to the applicant.
Mr. Steve Hoxmeier, of 485 A Street, presented to the Commission. Mr. Hoxmeier stated that
nothing has changed since his submittal and this was the same plan that was presented earlier to
the commission.
Mr. Skibby closed the public hearing and opened up to the commission for comments.
Mr. Whitford motioned to approve PA-2014-02206 and Ms. Renwick seconded. No one opposed.

Ms. Renwick reported on the project at 270 N. First Street. She stated that they have roofed the
front porch in metal.
C. Historic Preservation Week
Ms. Gunter gave the Commission an update on Historic Preservation Week. She conveyed to the
commissioners that they should divide up the list of nominees and report back on what should be
removed or added. They discussed the different awards and possible award recipients.
Nominations need to be finalized for the March meeting. Mr. Skibby pointed out that he would like
the walking tour to be a different neighborhood, possibly Downtown.

DISCUSSION ITEMS:
A. Chautauqua Square: (Terry/Carol)
Mr. Skibby reported on the Chautauqua Square fountain. He presented pictures of the fountain to
the Commission. He stated that the fountain is in pretty bad condition (water leakage and
maintenance of the marble are big factors) but that the city would like to save the gargoyle piece off
the fountain. Mr. Skibby pointed out that the decision to save it is up to OSF and their lease says
that they can do whatever they want with the fountain. Ms. Voisin reported that the lease says that
if OSF asks for removal of the fountain then they have to pay for it. She also pointed out that the
responsible party for upkeep of the fountain was OSF and they did not maintain it at all. According
to Ms. Voisin, the cost would be around $2,000 to $3,000 to remove it, Ms. Voisin suggested to the
Commission that they send emails of support to City Council if they would like to keep the fountain.
She added that if needed, they could make a bid on the fountain but they would have to remove it
themselves. Mr. Giordano asked for an extension on the date for salvage (date for salvage is by
4pm on February 12, 2015) and would like it to be relocated. Mr. Shostrom suggested that they

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn
Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a
notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the
comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the
application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning
Division Staffs decision must be made in writing to the Ashland Planning Division within 12 days from the date of the mailing of final decision. (AMC
18.108.040)
The ordinance criteria applicable to this application are attached to this notice. Oregon law states that failure to raise an objection concerning this
application, by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes your right of
appeal to the Land Use Board of Appeals (LUBA) on that issue. Failure to specify which ordinance criterion the objection is based on also precludes your
right of appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with
sufficient specificity to allow this Department to respond to the issue precludes an action for damages in circuit court.
A copy of the application, all documents and evidence relied upon by the applicant and applicable criteria are available for inspection at no cost and will be

D. That adequate capacity of City facilities for water, sewer, paved access to and through the development, electricity, urban storm
drainage, and adequate transportation can and will be provided to and through the subject property. All improvements in the
street right-of-way shall comply with the Street Standards in Chapter 18.88, Performance Standards Options.

We, Steve and Kathy Idoxmeier, the applicants, would like to submit the amended application for
Planning Action 42014-02206.
We propose to add 200 sq ft. to the north side of the Ashland Yoga Center. This 8 ft. extension
(8' x 23') will provide additional storage space for both the Center and personal use. Storage for '
equipment, lockers, & supplies.

The "attic" area of this extension will provide additional storage for, and accessed by the upstairs,
1-bedroom apartment. Tenants have often commented on the lack of adequate closet space. The extra
storage unit will be welcomed immensely.

The proposed addition will have the minimal visual impact on the neighborhood. Beyond
construction, no one may be aware of any change! The changes in the submitted elevation revisions
are very subtle. The East, north, and west elevations are shown as Oxisting, and as proposed. They may
seem old but they are accurate and to scale. They provide correct representations of the proposed
addition.
From the east, the building is shown to be longer, and shows a smaller, auxiliary entrance off of the
4`h St. porch. This entrance certainly is not necessary for the new storage area, however, it is proposed
for future (lobby) potential.
From the north, the elevation drawing reflects the completed, (and originally intended), design.
Two small windows have been added.
The change in the west elevation is only noticeable from the rear of the parking lot.
Landscaping areas have more than met the required minimums, as previous approved plans have
shown. Total area of landscaping at 4,000+ sq ft is about 25-30% of total lot area.
This 200 sgft. Addition may require an additional parking space. Fortunately, the parking lot is
presently designed to accommodate a much larger building,
The energy demands generated by this expansion will be limited to 3-4 extra lights and 6-8 outlets.
All components of the addition - siding, windows , doors, trim, paint, and roof shall match that of the
existing building.

Incompleteness Determination
Dear Steve and Kathy:
I have reviewed your application received on December 22, 2014 for a Commercial Site Review located
at 485 A Street. After examining the materials presented, I have determined that the application is
incomplete because the information listed below was not provided. Incomplete applications are subject
to delay in accordance with ORS 227.178. The application cannot be further processed and deemed
complete until the missing information is submitted or the applicant indicates that the missing
information will not be provided.
The following items should be addressed by January 22, 2015, if the application is to be included on the
February 4th Historic Commission agenda.
1. Written Findings - Written findings addressing the criteria of approval from the Site Design
and Use Standards and the Historic District Design Standards are required to be submitted with
the application. The written findings are the applicant's burden of proof to demonstrate how the
proposal complies with the criteria. Please see page 3 of the pre-application conference for the
Site Review criteria. I have enclosed the pre-application conference document. The other criteria
are available in the Site Design and Use Standards handbook. They can be found on the City of
Ashland website at http://www.ashland.or.us/Files/SDUS-Revised-6.1.2012.pdf
2. Elevations of proposed modification - It is difficult to discern from the information submitted
what the proposal is for. It is unclear from the documents submitted if the addition is going to
look the same as the existing structure (N elevation has same windows in the drawing as
existing). The plans submitted have an old approval stamp from the City of Ashland; it is unclear
if these are to depict what exists or what is proposed.
There is a porch rail shown across the front of the building adjacent to the existing porch but the
footprint of the building is not being modified to accommodate a porch. Is a covered front porch
proposed?
