18 This case came before the court by plaintiff's motion for general judgment by
19 default and the records and files herein, which reveal that an order of default was entered
20 on August 12, 2015, and the court being fully advised in the premises; now, therefore,
21 IT IS HEREBY ORDERED AND ADJUDGED, that plaintiff, CITY OF ASHLAND, is granted
22 general judgment against the above enumerated defendants F.D. MILLION and LEONA
23 SPENCER or LEONA SPENCER MILLION, Deceased; their Unknown Heirs and Devisees, as

I A. Plaintiff is the owner in fee simple of the property as described in the legal
2 description attached hereto as Exhibit "A", and entitled to possession thereof, free of any
3 estate, title, claim, lien, or interest of defendants or those claiming under defendants and
4 quieting title in the premises in plaintiff;
5 B. Defendants and those claiming under defendants are enjoined from asserting
6 any estate, title, claim, lien, or interest in the Contested Piece or any portion thereof; and
7 C. Costs and disbursements incurred herein in this matter are not awarded to
8 any party.

A strip of land 20 feet wide in Lot 1, Block 23 of the Chitwood Tract in the City of Ashland,
Jackson County, Oregon, cited as an exception and reservation in the deed recorded in Volume
52 at Page 560 of Deed Records, Jackson County, Oregon, more particularly described as
follows:
Beginning at the northwest corner of Lot 1, Block 23 of the Chitwood Tract in the City of
Ashland, Jackson County, Oregon; thence South 66° 51'58" East, 88.59 feet along the northerly
line of said Lot 1 to the northerly extension of the line of the boundary line agreement recorded
in Document No. 79-21486, Official Records, Jackson County, Oregon; thence South
340101 8"West, 20.38 feet along said Line and its extension to a point 20 feet right angle distance
from the northerly line of said Lot 1; thence North 66°51'58" West, 84.71 feet parallel with and
20 feet distant from said northerly line to the westerly line of said Lot 1; thence North 23°11'57"
East, 20.00 feet along said westerly line to the Point of Beginning.
The basis of bearings for this description is the Map of Survey filed as Survey No. 11988 in the
office of the Jackson County Surveyor.
