CITY ORDINANCE NO. 359,
An ordinance levying an assessment of damages and benefits to
accrue from the widening; of Granite Street between High Street and
Main Street, in the City of Ashland, Oregon.

WHEREAS, heretofore, to wit: On the 11th day of dune, 1908,
a board of Viewers, duly appointed and qualified to view the pro-
posed widening of Granite Street, between high Street and Plain St.,
did, in pursuance of such duty file with the City Recorder a report
'making an assessment of damages and benefits incident to such
widening of said street and said report was approved by the common
council on the 16th day of June, 1908, and
WHEREAS , after due notification by publication of the asessment
of damages and benefits made in said report, G. W. Burke, a property
`i owner aggrieved by such assessment did, within twenty days after filing of the report of said viewers, make objection to the assess-
ments and the awards therein and apply for a heaing and app raismert
by the common council of said City of Ash;and, and
WHEREAS, the said common council did, in pursuance of law in such
cases made and provided, view such proposed widening of Granite
Street on the 9th day of July, 1908, and did make assessment of the

damages and benefits incident to the widening of said Granite Street
in the same manner as required of the Board of Viewers, two-thirds
of the cou.:cil agreeing thereon, and did file their report with the
City Recorder on the 10th day of July, 1908, and
'"o'HEREAS, such report was duly considered and ratified by UB
council at the regular meeting of said common council on the 4th
,day of August, 1908, now therefore,

Section 1.
That there be and is hereby levied against the several pieces of
property the special assessments for the differenbe of damages
sand benefits as set fortis in,sai.d report of the common council
acting as a Board of Viewers;,th i e said property is hereby more
specifically described, togeth~r with the name or names of the owner

i Section 4.
Whereas, it is important that the section of Granite Street,
as aforesaid shall be widened as soon as practicable in order that
the residents on the west side of said street may have constru ted
a sidewalk, continuous with that in front of the Ellen TI. Wagner
lot, it is the judgment of the common council that an emergency
exists and that it is necessary for the public safety, peace and
health of the people of the City ofnAshland that this ordinance
shall become immediately operative.
Therefore, this ordinance shall take effect and be in force
immediately upon its adoption by the council and approval by the
mayor.
Th- foregoing ordinance wa:= adopted by the common council of
the City of Ashland at an adjourned regular meeting, under sus-
pension of the rules, two-thirds voting i favor thereof, on the
18th day o4 August, 1908, by a vote of in favor thereof
and none against the same.

Said assessment of the differences of benefits and damages
shall be collectible and payable within ten days of the date of
of the approval oft this ordinance and notice thereof to bhe
z, 'person or persons so assessed, and if unpaid at the expiration

'of thirty days from the date of said notice, said assssment shall
be docketed as a lien upon the property and interest shall be
charged thereon at the rate of 6 % per annum from the date of such
notice and such liens shall be collected in the manner provided
for in sections 1 and 2 of Article 12 of the Charter of the City

The city recorder is hereby directed to make a tender of
the amount of damages as awarded by the common council acting as

owners of the property damaged as full payment for such dameg es
