P, N ORDINP, NCE KlqENDING CHAPTER 4.26 OF THE ~SHL~ND
MUNiCiPaL CODE CONCERNING THE USE OF TRKlqSPORTAT~ON
UTILITY FEES.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. Section 4.26.010 of the Ashland Municipal Code is
hereby amended by adding a new sentence which shall read as
follows:
"The Council further finds that bicycle paths are also an
integral and essential part of the transportation network,
and that a portion of such funds may also be used for
construction of bikeways either within or adjacent to
existing public streets, or off of public streets."
SECTION 2. Section 4.26.020 of the Ashland Municipal Code is
hereby amended by amending the second sentence thereof to read as
follows:
"Such fee shall be established in such amounts which will
provide sufficient funds to properly maintain local streets
and to provide for bikeways throughout the city."
SECTION 3. The last sentence of Section 4.26.020 of the Ashland
Municipal Code is hereby amended by adding after the words "local
streets," the phrase "and constructing bikeways."
SECTION 4. The second sentence of Section 4.26.030 of the
Ashland Municipal Code is hereby amended by adding thereto the
following phrase:
"and for the construction of bikeways."
SECTION 5. The last sentence of Section 4.26.030 of the Ashland
Municipal Code is hereby amended to read as follows:
"All funds collected pursuant to the provisions of this
Chapter for operation, administration, maintenance of
streets, and for bikeway construction shall be separately
designated as such and shall be used solely for those
purposes, except that not more than one-sixth (1/6) of such
funds may be used for bikeway construction."
SECTION 6. The last sentence of Section 4.26.090 of the Ashland
Municipal Code shall be amended by inserting after the word
"city", the phrase "and the construction of bikeways,".
The foregoing ordinance was first read on the 5th day of
December, 1989, and duly PASSED and ADOPTED this 19th day of
December, 1989.
