Both parties wish to develop their respective properties and collaborate with each other in meeting the side setback requirements it relates to setback standards as regulated within the Ashland Municipal Code, Section 18.3.9.070 B. AGREEMENT: The Parties recognize and agree that it is to their mutual benefit to work together to insure the setback standards, specifically the separation distance between the future buildings, are complied with regardless of the Parties construction timeframe. The Parties agree to keep buildings below twenty (20) feet in average building height as prescribed in Ashland Municipal Code, Section 18.3.9.070 B with a side yard setback along the lot line adjoining said parcels, to be equivalent to the proportionate height of each proposed dwelling as calculated by City of Ashland planning standards. If both buildings are 20 feet in average height each building would have a setback of 5 feet. If for whatever reason, either building's average height is greater than twenty (20) feet the setback will be increased proportionately by a calculation of of the respective dwelling height. Ayala's building plans are currently approved by the City of Ashland and average out to 20 feet in height and provide the respective five (5) foot setback.
