Mountain Applicant: Ashland High School Description: A Variance request to reduce the side yard setback along South Mountain Street to accommodate an expansion of the high school's sport fields. As presented the bleachers for the "visitor's section" encroach upon the side yard setback. COMPREHENSIVE PLAN DESIGNATION: Multi-Family Residential; ZONING: R-2; ASSESSOR'S MAP: 39 lE 09DA; TAX LOT: 100; 6200. The Community Development Director's decision becomes final and is effective on the 12'' day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). The ALUO sections covering reconsideration and appeal procedures are attached. The appeal may not be made directly to the Oregon Land Use Board of Appeals. Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below. 1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: 1. Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property: b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 18.5.1.050.B. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing Procedure. a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.G.1, above, may appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b. Time for Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. Content of Notice of Appeal. The notice of appeal shall be accompanied by the required filing fee and shall contain. i. An identification of the decision being appealed, including the date of the decision. ii. A statement demonstrating the person filing the notice of appeal has standing to appeal. iii. A statement explaining the specific issues being raised on appeal. iv. A statement demonstrating that the appeal issues were raised during the public comment period. d. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before the Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type II public hearing procedures, pursuant to section 18.5.1.060, subsections A - E, except that the decision of the Planning Commission is the final decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of Appeals, pursuant to ORS 197.805 - 197.860. SUBMITTAL DATE: October 8, 2015 DEEMED COMPLETE DATE: October 16, 2015 STAFF APPROVAL DATE: November 16, 2015 FINAL DECISION DATE: November 30, 2015 APPROVAL EXPIRATION DATE: May 30, 2017 DECISION The application involves two lax lots, 100 and 6200, in the 391E 09DA Assessor's map. Ashland School District owns the site and it is where the Ashland High School is located. In total the two tax lots are approximately 702,072 square feet or 16 acres. The property has frontage on Morse Avenue to the west, Siskiyou Boulevard to the south and South Mountain Avenue to the east. As the subject properties are the site of Ashland High School, there are many buildings of various mass and scale and several parking lots. The site is located within the R-2, low-density multi-family zoning district and abuts the R-3 zoning district to the east and north. There are no applicable overlays affecting the site. The application is for a Variance to standard setbacks. The school district is in the process of upgrading their sports field (soccer/football) to current National Federation of State High School Association standards, which dictate soccer and football field widths. The applicants have researched different options to meet their needs and have decided on a 65-yard wide field that will allow room for visitor stands. However, where the visitor stands are proposed encroaches in the 10-foot required side yard setback adjacent to a public street, thus the need for a Variance. Citing existing improvements, the need for emergency service vehicle routes, location of utilities, safety offsets for playing fields and field dimension standards, the application states the Variance is necessary because the Land Use Ordinance does not account for such unique circumstances. Furthermore, the applicant desires to have an ADA accessible, elevated visitor bleacher. The application includes dimensions of the bleachers and the applicant states the product they would like is the smallest available on the market. As proposed, the bleachers would encroach three feet, nine inches (3'9") into the standard side yard setback. The aforementioned circumstances lead Staff to believe that the application satisfies the first two approval criteria. The application includes an argument that the benefit of expanding the sports field and providing visitor bleachers is a net benefit to the community. "Year-round availability for youth athletics" and "economic impact in visitor spending" are the reasons the applicant claims the "proposal's benefits will be greater than any negative impacts." Staff believes that the applicant's proposal is de minimus in regards to the development of adjacent properties and their associated uses. The neighbors have been accustomed with the high school's sport field being across the street for many years. Additionally, no comments were received during the notice period, which leads Staff to believe there were no significant concerns PA #2015-01935 201 South Mountain Ave/zgh Page 1 amongst neighbors with the applicant's proposal. Therefore, Staff has determined the application complies with the third approval criterion. Sport fields on the Ashland High School property are an established use. Though the upgrade to a new soccer and football field may not be required, the upgrade is a move that will bring the high school's fields into national standards and provide equal access to a quality sport field. Furthermore, the district wants to accommodate spectator seating for the community and their visitors. Staff has determined the applicant's proposal is not self-imposed, and, therefore, complies with the fourth approval criterion. ! The approval criteria for a Variance are described in AMC Chapter 18.5.5.050.A, as follows: 1. The variance is necessary because the subject code provision does not account for special or unique physical circumstances of the subject site, such as topography, natural features, adjacent development, or similar circumstances. A legal lot determination may be sufficient evidence of a hardship for purposes of approving a variance. 2. The variance is the minimum necessary to address the special or unique physical circumstances related to the subject site. 3. The proposal's benefits will be greater than any negative impacts on the development of the adjacent uses and will further the purpose and intent of this ordinance and the Comprehensive Plan of the city. 4. The need for the variance is not self-imposed by the applicant or property owner. For example, the variance request does not arise as result of a property line adjustment or land division approval previously granted to the applicant. Planning Action #2015-01935 complies with all applicable City ordinances with the imposition of the conditions attached below. Therefore, Planning Action #2015-01935 is approved. If any one or more of the following conditions are found to be invalid, for any reason whatsoever, then Planning Action #2015-01935 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2. That storm water from all new impervious surfaces and runoff associated with peak rainfalls must be collected on site and channeled to the City storm water collection system (i.e., curb gutter at public street, public storm pipe or public drainage way) or through an approved alternative in accordance with Ashland Building Division policy BD-PP-0029. On-site collection systems shall be detailed on the building permit submittals. 3. That the plans submitted for the building permit shall be in substantial conformance with those approved as part of this application. Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above. Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. A. Overview Ashland School District (ASD) is proposing to improve Walter A. Phillips field located on their campus at 201 S. Mountain Avenue with a new synthetic turf soccer/football surface. Part of the proposed field improvements include bringing the facility up to current National Federation of State High School Associations (NFHS) standards which dictate combined soccer and football field widths. ASD initially researched providing a 70 yard wide soccer field which is preferable, but that layout would have eliminated the visitor stands altogether. By compromising with a 65 yard wide soccer field, we're able to provide visitor stands; however, there becomes a conflict with safety offsets from the playing field. ASD is proposing to shrink the elevated visitor bleachers by half to reduce the encroachment into the setback. The existing visitor stands are 10 rows and approximately 14'-2" tall from the concrete slab they sit on. The proposed improvements reduce the stands to only 5 rows and 10'-10" in height. This proposal would remove the front 12'-6" of the existing concrete slab to accommodate the safety zone, however, the reduced bleacher footprint would require an addition to the back of the existing concrete slab of 4'-6". See the attached drawings for additional information regarding demolition, construction and proximity to the property line. The 4'-6" extension would extend into the existing 10'-0" Mountain Avenue property line setback, and by placing bleachers on that slab it requires a Type 1 Variance request as summarized in our pre-application meeting with you on August 21, 2015. The proposed improvements will be constructed on Tax Lots 100 and 6200 in Township 39 South, Range 1 East, Sections 09DA and 09AD respectively. Tax Lots 100 and 6200 are zoned R-2 (Multi- Family Residential) and Table 1 - Subject Property Details below provides some additional detailed information. Applicable Review Criteria This Type 1 Variance Application will be reviewed by the City of Ashland, Department of Community Development for conformance with the COAMC; the following provisions of the City of Ashland Municipal Code (COAMC) pertain to this project: • COAMC Section 18.5.5.050 - Variance Approval Criteria C. Description of Conformance with Applicable Review Criteria A description of the applicable provisions specified in the COAMC and how the proposed project conforms to the applicable provisions follows: C.1. COAMC Section 18.5.5.050 - Variance Approval Criteria The above referenced Section of the COAMC states: A. The approval authority through a Type 1 or Type 11 procedure, as applicable, may approve a variance upon finding that it meets all of the following criteria. i 1. The variance is necessary because the subject code provision does not account for special or unique physical circumstances of the subject site, such as topography, natural features, adjacent development, or similar circumstances. A legal lot determination may be sufficient evidence of a hardship for purposes of approving a variance. 2. The variance is the minimum necessary to address the special or unique physical circumstances related to the subject site. 3. The proposal's benefits will be greater than any negative impacts on the development of the adjacent uses and will further the purpose and intent of this ordinance and the Comprehensive Plan of the City. 4. The need for the variance is not self-imposed by the applicant or property owner. For example, the variance request does not arise as result of a property line adjustment or land division approval previously granted to the applicant. B. In granting a variance, the approval authority may impose conditions similar to those provided for conditional uses to protect the best interests of the surrounding property and property owners, the neighborhood, or the City as a whole. C.I.I. Conformance with Al Existing improvements within the private property generate our constraints with this proposal. The existing covered home grandstands and snack/restroom building are permanent structures that cannot feasibly be relocated. The existing buildings combined with emergency service vehicle routes and utilities provide a stationary point to begin dimensionally laying out the playing field and visitor stands to the east (towards Mountain Avenue). 45 Hawthorne Street, Suite 5, Medford, OR 97504 • T. 541.500.8588 2 Grants Pass • Klamath Falls • Medford • Oregon Cihj The proposed 65 yard soccer field width combined with minimum safety offsets limits the available space between the playing field and the westerly Mountain Avenue right-of- way line to an average of 22'-6". With a 10' property line setback from Mountain Avenue, that limits the available space to 12'-6". ASD has elected to pursue this variance request because they feel that ADA accessible elevated visitor bleachers are in the best interest of the community and surrounding areas (see C.1.3 below for additional information). Throughout our design approach, we have limited the ADA accessible elevated visitor bleacher to the smallest available unit on the market (see C.1.2 below for additional information) which is 5 rows of seating at 157'-6" in length. That provides an available 433 standard seats with 6 ADA wheelchair compliant stations. C.1.2. Conformance with A2 As stated above, a 70 yard wide soccer field is the preferred width. We've worked with ASD and community members to compromise with a 65 yard soccer field width to limit our variance request. We have selected the smallest available ADA accessible elevated visitor bleacher offered in the high capacity bleacher market. The proposed 5 row elevated bleachers have a depth of 16-2". Our variance request is to construct a 4'-6" concrete pad extension towards Mountain Avenue to provide an overall pad width of 16-0". We feel this is the necessary minimum width to mount the bleachers on. It is also a possibility that the existing bolt together visitor stands can be modified to the general size noted above. This option will be investigated as a cost saving idea. Based on the attached drawings, the proposed 16'-0" concrete slab/bleacher combination creates a minimum 3'-1" encroachment on the southern end and a maximum 3'-9" encroachment on the northern end. C.1.3. Conformance with A3 Without approval of this variance request, it is likely that dedicated visitor seating would be eliminated. By providing elevated visitor stands, spectators are treated to optimum viewing angles of the entire field. By improving the playing field to a synthetic surface, the available uses year-round drastically increase. This is a great benefit to the community, particularly in youth athletics. Ashland High School is also noted throughout the State to provide top notch visitor facilities. By continuing this tradition and bringing visitors to the community during contests, tournaments, etc. the City of Ashland should continue to see an economic impact in visitor spending. When people travel to a destination, the money left behind is new to the market. These dollars will produce an economic impact. Sports events have become an increasingly effective and dependable way to produce visitor spending. Conformance with A4 The need for this variance is not self-imposed. This proposal accommodates an existing established use (football) on the site. One of the major benefits of this proposal is to combine the soccer programs home playing field with Walter A. Phillips field. In doing so, the soccer programs are able to enjoy better visibility from the community, a better playing surface, home and visitor seating, and equal quality facilities to all community programs to match other schools within the region. Ashland School District is installing a new field to repair/reduce some exaggerated slope issues (injury avoidance), dramatically reduce irrigation water usage, provide a safe and useable surface for year-round activities, and reduce use of potentially harmful pesticides and fertilizers while significantly decreasing maintenance costs. As stated within C.1.2, a 70 yard wide soccer field is the preferred width. We've worked with ASD and community members to compromise with a 65 yard soccer field width to limit our variance request. In addition to the size of the playing field, proper safety offsets (10'-0" all around) are necessary from the perimeter out-of-bounds lines to spectators, fences or any other objects to ensure safety of users and onlookers. The existing available width to accommodate improvements is 202'-6" and the proposed soccer field width combined with the safety offsets is 215-0". C.1.5. Conformance with B It is understood that if a variance is granted that the City of Ashland may impose additional conditions to the approval. The proposed concrete slab does not generate the setback encroachment which triggered this variance request. The elevated visitor bleachers are the governing factor in this case and are a "bolt together" unit, essentially making them a movable/removable object. This provides both the Ashland School District and the City of Ashland the most flexibility in the future. D. Summary Overall, we feel this variance request is very minimal and will have little impact to the surrounding neighborhood. A. Overview Ashland School District (ASD) is proposing to improve Walter A. Phillips field located on their campus at 201 S. Mountain Avenue with a new synthetic turf soccer/football surface. Part of the proposed field improvements include bringing the facility up to current National Federation of State High School Associations (NFHS) standards which dictate combined soccer and football field widths. ASD initially researched providing a 70 yard wide soccer field which is preferable, but that layout would have eliminated the visitor stands altogether. By compromising with a 65 yard wide soccer field, we're able to provide visitor stands; however, there becomes a conflict with safety offsets from the playing field. ASD is proposing to shrink the elevated visitor bleachers by half to reduce the encroachment into the setback. The existing visitor stands are 10 rows and approximately 14'-2" tall from the concrete slab they sit on. The proposed improvements reduce the stands to only 5 rows and 10'-10" in height. This proposal would remove the front 12'-6" of the existing concrete slab to accommodate the safety zone, however, the reduced bleacher footprint would require an addition to the back of the existing concrete slab of 4'-6". See the attached drawings for additional information regarding demolition, construction and proximity to the property line. The 4'-6" extension would extend into the existing 10'-0" Mountain Avenue property line setback, and by placing bleachers on that slab it requires a Type 1 Variance request as summarized in our pre-application meeting with you on August 21, 2015. The proposed improvements will be constructed on Tax Lots 100 and 6200 in Township 39 South, Range 1 East, Sections 09DA and 09AD respectively. Tax Lots 100 and 6200 are zoned R-2 (Multi- Family Residential) and Table 1 - Subject Property Details below provides some additional detailed information. C.I.I. Conformance with Al Existing improvements within the private property generate our constraints with this proposal. The existing covered home grandstands and snack/restroom building are permanent structures that cannot feasibly be relocated. With a 10' property line setback from Mountain Avenue, that limits the available space to 12'-6". ASD has elected to pursue this variance request because they feel that ADA accessible elevated visitor bleachers are in the best interest of the community and surrounding areas (see C.1.3 below for additional information). Throughout our design approach, we have limited the ADA accessible elevated visitor bleacher to the smallest available unit on the market (see C.1.2 below for additional information) which is 5 rows of seating at 157'-6" in length. That provides an available 433 standard seats with 6 ADA wheelchair compliant stations. C.1.2. Conformance with A2 As stated above, a 70 yard wide soccer field is the preferred width. We've worked with ASD and community members to compromise with a 65 yard soccer field width to limit our variance request. We have selected the smallest available ADA accessible elevated visitor bleacher offered in the high capacity bleacher market. The proposed 5 row elevated bleachers have a depth of 15-2". Our variance request is to construct a 4'-6" concrete pad extension towards Mountain Avenue to provide an overall pad width of 16-0". We feel this is the necessary minimum width to mount the bleachers on. It is also a possibility that the existing bolt together visitor stands can be modified to the general size noted above. This option will be investigated as a cost saving idea. Based on the attached drawings, the proposed 16'-0" concrete slab/bleacher combination creates a minimum 3'-1" encroachment on the southern end and a maximum 3'-9" encroachment on the northern end. C.1.3. Conformance with A3 Without approval of this variance request, it is likely that dedicated visitor seating would be eliminated. By providing elevated visitor stands, spectators are treated to optimum viewing angles of the entire field. By improving the playing field to a synthetic surface, the available uses year-round drastically increase. This is a great benefit to the community, particularly in youth athletics. Ashland High School is also noted throughout the State to provide top notch visitor facilities. By continuing this tradition and bringing visitors to the community during contests, tournaments, etc. the City of Ashland should continue to see an economic impact in visitor spending. When people travel to a destination, the money left behind is new to the market. These dollars will produce an economic impact. Sports events have become an increasingly effective and dependable way to produce visitor spending. Conformance with A4 The need for this variance is not self-imposed. Proper safety offsets from playing fields to spectators, fences or any other objects combined with regulation playing field widths are the driving factor. ASD is being proactive in meeting these standards by providing a safe and functional facility for the community and the field users. C.1.5. Conformance with B It is understood that if a variance is granted that the City of Ashland may impose additional conditions to the approval. The proposed concrete slab does not generate the setback encroachment which triggered this variance request. The elevated visitor bleachers are the governing factor in this case and are a "bolt together" unit, essentially making them a movable/removable object. This provides both the Ashland School District and the City of Ashland the most flexibility in the future. D. Summary Overall, we feel this variance request is very minimal and will have little impact to the surrounding neighborhood.
