COMPREHENSIVE PLAN DESIGNATION: Low Density Multi-Family Residential; ZONING: R- 2; ASSESSOR'S MAP: 39 lE 14CA; TAX LOTS: 7800, 7807, 7806 and 7805. The Community Development Director's decision becomes final and is effective on the 12"' day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below. 1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider the matter. I' 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse' the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: I., 1. Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 18.5.1.050.13. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing Procedure. a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.51.050.G.1, above, may appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b. Time for Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. Content of Notice of Appeal. The notice of appeal shall be accompanied by the required filing fee and shall contain. i. An identification of the decision being appealed, including the date of the decision. ii. A statement demonstrating the person filing the notice of appeal has standing to appeal. iii. A statement explaining the specific issues being raised on appeal. iv. A statement demonstrating that the appeal issues were raised during the public comment period. d. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before the Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type II public hearing procedures, pursuant to section 18.5.1.060, subsections A - E, except that the decision of the Planning Commission is the final decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of Appeals, pursuant to ORS 197.805 - 197.860. SUBMITTAL DATE: December 21, 2015 DEEMED COMPLETE DATE: December 31, 2015 STAFF APPROVAL DATE: January 19, 2016 DEADLINE TO APPEAL (4:30 p.m.): February 1, 2016 FINAL DECISION DATE: February 2, 2016 APPROVAL EXPIRATION DATE: February 2, 2017 DECISION The application is a request for a tree removal permit to remove six ponderosa pine trees and one Atlas cedar from the properties located at 903/905 Bellview Avenue and 2350/2370 Siskiyou Boulevard. The ponderosa pines are across the site's Siskiyou Boulevard frontage and located between the building envelope for 903/905 Belleview Avenue structure and Siskiyou Boulevard. The application identifies the ponderosa pines as ranging from eight to 14 inches diameter at breast height (DBH) and 25 to 30 feet in height. The Atlas cedar is located in the southeast corner of the building envelope for 903/905 Bellview Avenue on the Bellview Avenue side of the property. The application identifies the Atlas cedar as 15 inches DBH and 40 feet in height. All of the trees proposed from removal are described as in moderate condition. The site is at the southwest corner of the intersection of Bellview Avenue with Siskiyou Boulevard. The site is comprised of four tax lots with a combined total area of .24 acres. The lots are zoned Low Density Multi-Family Residential (R-2). Siskiyou Boulevard and Bellview Avenue provide pedestrian access and the driveway accessing Bellview Avenue provides vehicular access. The site received subdivision and site design review approval as part of Phase 2 of the West Bellview Subdivision in 1996 (PA96-107). Two buildings with two units in each building were approved on the subject site. The subject site is comprised of four tax lots. The application includes a Tree Protection Plan by Madara Design Inc. dated 12/2/15 and received as part of the application on 12/21/15. According to this tree protection plan, five of the ponderosa pines (tree # 3-7) are located in a cluster on the site's Siskiyou Boulevard frontage. The application identifies the cluster of trees reason for removal as for the betterment of the other trees. One individual ponderosa pine near the cluster is identified for removal (tree #8) and described as leaning precariously and unstable. The application states that the proximity of the Atlas cedar (tree #11) to construction requires removal. Four trees along the Siskiyou Boulevard frontage are identified for retention (tree #1, 2, 9, 10) including a 34 inch DBH giant sequoia, an 11 inch DBH Norway spruce, a 20 inch DBH Jeffery pine and a 16 inch Siberian elm. The tree protection plan identifies tree protection fencing located at the drip line of each of the four trees identified for preservation. PA #2015-02381 903/905 Bellview Ave. and 2350/2370 Bellview Ave./n h Pace 1 11 The approval criteria to remove trees that are not a hazard require that the removal of the tree will not have significant negative impacts on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. The remaining trees on the property are located evenly across the Siskiyou Boulevard frontage and will continue to serve the purposes of stabilizing soil, protecting other trees, dissipating rainfall, and serving as windbreaks. In addition, the criteria require that the removal of the trees will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity with 200 feet of the subject property. The Clay Creek corridor is located approximately 100 feet west of the site and includes a variety of species and sizes of trees. Finally, the approval criteria allow that mitigation be provided for the removed trees and a condition has been added to that effect. The Ashland Tree Commission reviewed this request at their regular meeting on January 7, 2016. The Commission recommended approval of the removal of the ponderosa pines, but did not recommend approval of the Atlas cedar. The Tree Commission recommended installation of tree protection fencing at the drip line of the Atlas cedar and that construction in the protected drip line occur with the supervision of a certified arborist. Further, they recommended that the certified arborist perform all root cuts to the Atlas cedar. The Tree Commission recommended planting one street tree as mitigation for the removal of the ponderosa pines. G I The criteria for Tree Removal Permit approval are described in AMC section 18.5.7.040.B: 2. Tree that is Not a Hazard. A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. 1. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements and standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical and Environmental Constraints in part 18.10. 2. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. 3. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. 4. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance. 5. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Planning Action #2015-02381 is a request for a tree removal permit to remove six ponderosa pine trees from the property and one Atlas cedar from the properties located at 903/905 Bellview Avenue and 2350/2370 Siskiyou Boulevard. The application with the attached conditions below complies with all PA #2015-023 81 903/905 Bellview Ave. and 2350/2370 Bellview Ave./mh PaaP 2 i applicable City ordinances for a tree removal permit for trees that are not a hazard tree. Planning Action #2015-02381 is therefore approved to allow the removal of the six ponderosa pine trees (tree # 3-8 on Tree Protection Plan by Madara Design, Inc. dated 12/2/15. However, the removal of the Atlas cedar (tree # 11 on Tree Protection Plan by Madara Design, Inc. dated 12/2/15) is not approved. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action #2015-02381 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2. The Atlas cedar (Cedrus atlantic) identified as tree number 11 on Tree Protection Plan by Madara Design, Inc. dated 12/2/15 is not approved for removal. 3. That prior to the issuance of a building permit, the Tree Protection Plan shall be revised to address the preservation and protection of the Atlas cedar (tree # 11) as recommended by the project arborist and incorporating the Tree Commission recommendations from the January 7, 2016 meeting. 4. That the one street tree shall be installed in accordance with the City of Ashland Recommended Street Tree Guide, irrigated, and provided in accordance with AMC 18.5.7.050 within one year of the permit issuance. 5. That the recommendations of the Tree Commission from their January 7, 2016 meeting shall be conditions of approval where consistent with the applicable standards and with final approval by the Staff Advisor including but not limited to the following. a. The Tree Protection Plan shall include measures for protection of the Atlas cedar during construction including that if any disturbance in the tree protection zone is undertaken, a certified arborist shall be on site to supervise any work. In addition, any cuts to the Atlas cedar's roots shall be performed by the certified arborist for the project. 6. That a Verification Permit shall be applied for and approved by the Ashland Planning Division prior to the issuance of a building permit and prior to site work, staging, building demolition, and/or storage of materials. The Verification Permit is to inspect the identification of the trees to be removed and the installation of tree protection fencing for the trees to be protected on and adjacent to the site. The trees to be removed shall be tagged by number and identified for removal with tape, inspected, and approved by the Staff Advisor prior to their removal. The tree protection shall be chain link fencing six feet tall. No construction or activities shall occur within the tree protection zone including dumping or storage of materials such as building supplies, soil, waste, equipment, or parked vehicles unless stipulated on the revised and approved Tree Protection Plan. In order to retain the Cedrus atlantica, the Commission recommends the following: 1) That a tree protection fence be installed for the cedar tree at the dripline. If construction needs to occur within the protection zone, the work shall be supervised by a certified arborist and all cuts to the tree's roots shall be done by hand by the project arborist. 2) Furthermore, the Commission recommends one street tree to be required as mitigation for the removal of the five Pinus ponderosas. The Ashland Planning Division Staff has received a complete application for the property noted above. [Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above. Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a notice is sent to surrounding properties within 200 feet of the property submitting application which allows for a 14 day comment period. After the comment period and not more than 45 days from the application being deemed complete, the Planning Division Staff shall make a final decision on the application. A notice of decision is mailed to the same properties within 5 days of decision. An appeal to the Planning Commission of the Planning Division Staffs decision must be made in writing to the Ashland Planning Division within 12 days from the date of the mailing of final decision. Oregon law states that failure to raise an objection concerning this r application, by letter, or failure to provide sufficient specificity to afford the decision maker an opportunity to respond to the issue, precludes your right of appeal to the Land Use Board of Appeals (LUBA) on that issue. Failure to specify which ordinance criterion the objection is based on also precludes your right of appeal to LUBA on that criterion. Failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with sufficient specificity to allow this Department to respond to the issue precludes an action for damages in circuit court. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone, d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. This is an update of an extensive survey completed in 2008. Since that time six lots have been developed on the site. Two units were constructed and the other four were prepared for the construction of units. All underground utilities were installed, the sites were completely graded and base rock was installed, and the parking/driveway was put in. No additional underground work will be necessary. The only construct processes that remain for the completion of the final four units are the construction of the building foundations and backfill against them. 18.5.7.030 Application Submission Requirements B. Plan Submittal. 1. The current tree survey indicates only one tree will need to be removed for the construction of a unit. A Cedrus Atlantica will be too close to the final construction of 905 Bellview and will have to be removed (tree is noted as 11 on the attached survey). Also, the Arborist recommends the removal of tree 8 on the survey as it is unstable. It's removal is not required for the construction of 903 Bellview, however. The Arborist further recommends thinning of the cluster of 5 pines, collectively indicated as 2-6 on the attached plan, so the strongest tree(s) will be able to thrive. 2. It approved, the trees would be removed during the month of January, 2016. 3. This is the initial application. All the existing trees were protected, and the protection measures inspected by the City of Ashland, during the underground phase of the development of these lots. There was no Planning Action that specifically dealt with any of these trees. 4. New trees will be planted in accordance with the requirements of the Section 18.5.7.050.A of the Municipal Code in locations on the lots more conducive to their survival and further away from new construction. New trees more appropriate to an urban environment will also be selected. The project Arborist will recommend replacement trees. 5. The Arborist performed a visual inspection of the property and produced the report during the week before December 2, 2015. 6. A tree protection plan and detail is on the tree survey document and is hereby included in the construction documents for the project. 7. If needed, the Arborist's report is available for review by the City.
