AN ORDINANCE DISPENSING WITH AN ELECTION WITHIN THE CITY OF ASHLAND
ON THE QUESTION OF A PROPOSED ANNEXATION AND SETTING THE TIME AND
PLACE FOR A PUBLIC HEARING THEREON: SETTING A PUBLIC HEARING DATE
ON THE WITHDRAWAL OF CERTAIN REAL PROPERTY FROM JACKSON COUNTY FIRE
DISTRICT NO. 5: DIRECTING PUBLICATION OF NOTICES AS DIRECTED BY
ORS 222.524; AND DECLARING AN EMERGENCY. (ALBERTSON ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The City of Ashland finds that the owners of the property
escri e in Exhibit "A" attached hereto and by this reference incorp-
orated herein have consented to the annexation of said land to the City
of Ashland.
SECTION 2. The submitting of the question of the said annexation is
Hereby dispensed with and a Public Hearing is hereby called at the
Council Chambers, Civic Center, 1175 E. Main Street, Ashland, Oregon,
on the 18th day of November, 1986, at the hour at 7:30 P.M., at which
time all persons may appear and be heard on the proposed annexation.
SECTION 3. The City Staff is directed to cause notice of said hearing
to be given as required by ORS 222.120 so that public notices are pub-
lished in a newspaper of general circulation appearing in the City in
issues of such newspaper on October 28, 1986 and November 4, 1986 and
that notices be posted in four (4) public places in the City for a
period of not less than two (2) weeks prior to the date of the public
hearing.
SECTION 4. Pursuant to ORS 222.524 a Public Hearing shall be held on
ovemFer I8, 1986, at 7:30 P.M. in the Council Chambers, Civic Center,
1175 E. Main Street, Ashland, Oregon, on the question of the withdrawal
of certain real property from Jackson County Fire District No. 5. All
persons may appear before the Ashland City Council and be heard on the
question. The real property above mentioned is situated in Jackson
County, Oregon, and more particularly described in Exhibit "A" attached
hereto and by this reference made a part hereof.
SECTION 5. The City Staff is directed to publish and post notices of
said Baring in the same manner and on the same dates as described on
Exhibit "A" attached hereto relative to the proposed annexation.
SECTION 6. In order that a public hearing may be held on a timely basis,
the pu is welfare requires that an emergency be hereby declared, and
this ordinance shall therefore be effective upon its passage by the Council
and approval by -she Mayor.
The foregoing ordinance was first read on the 21st day of October, 1986,
and duly PASSED and ADOPTED this~day of November, 1986.

PARCEL 1:
Commencing at the point of intersection of the West line of Clay
Street with the South line of Section 11, in Township 39 South, Range
1 East of the Willamette Meridian in Jackson County, Oregon, which
point bears South 890 531 East, 639.14 feet from the Southwest corner
of said Section; thence North 00 08' West, along Clay Street, 1316.70
feet; thence North 890 531 West, 125.0 feet, to the True Point of
Beginning; thence North 0° 08' West a distance of 478.54 feet to a
point on the North line of premises described in Volume 377, Page 99,
Jackson County, Oregon, Deed Records; thence West along said North
line a distance of; 765.50 feet to the Northwest corner thereof;
thence South along the West line of said tract a distance of 470.76

East, along the South ling of said tract, a distance of 765.50 feet
to the point of beginning.

the Willamette Meridian in Jackson County, Oregon, which point bears
South 890 53' East, 639.14 feet from the Southwest corner of said
Section; thence North 00 081 West, along said West line of Clay Street,
1566.7 feet to the true point of beginning; thence North 890 53'
West, 125.0 feet; thence North 01 08' West, 228.54 feet to the South
lane of Iowa Street, being at 'a point on the North line of premises
described in Volume 377, Page 99, Jackson County, Oregon, Deed
Records; thence along said street, and said North line of premises,
South 890 49' East, 125.0 feet to the' said West line of Clay Street;
thence South 00 08' East, along said West line of street, 228.40 feet
to the true point of beginning.
PARCEL III:
Beginning at a point 2033.0 feet South, and 1770.0 feet East of the
Northeast corner of Donation Land Claim N6.45 in Township 39 South,
Range 1 East of the Willamette Meridian, Jackson County, Oregon, said
point also being the Northeast corner of Tract "A" as described in
Volume 377, Page 99, Jackson County, Oregon, Deed Records; thence West
along the North line of said Tract "A", 890.5 feet to the Northwest
corner thereof; thence North parallel to the West line of Section 11,
said Township and Range, 30.0 feet to a point on the South line of
Parcel I as described in Document No. 79-06122, Official Records of
.7ackson County, Oregon; thence East along the South line of said
ti :act, 17.3 feet to the Southeast corner thereof; thence North along
the East line of said tract, 30.0 feet to a point on the South line
of tract described in Volume 190, Page 99, said Deed Records; thence
East along the South line of said tract and the South line of tract
described in Volume 260, Page 3691 said Deed Records, 873.3 feet to
the Southeast corner of said tract described in Volume 260, Page 369,
said Deed Records; thence Southerly 60.0 feet to the true point of
beginning.
