The tree is approximately 75 feet tall and 36 inches in diameter at breast height. The tree is located in a grove of four silver maple trees on common area owned by the Helman Springs Homeowners Association. The arborist notes that the tree has a rotten core from ground level to approximately 14 feet up the trunk. In addition, the main trunk is significantly hollow with only a shell of live wood supporting a heavy upper crown with a predominant lean over three houses. COMPREHENSIVE PLAN DESIGNATION: Single-Family Residential; ZONING: R-1-5; ASSESSOR'S MAP: 39 lE 04BC; TAX LOT: 407. The Community Development Director's decision becomes final and is effective on the 12th day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). The ALUO sections covering reconsideration and appeal procedures are attached. The appeal may not be made directly to the Oregon Land Use Board of Appeals. Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below. 1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: 1. Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 18.5.1.050.B. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing Procedure. a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.G.1, above, may appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b. Time for Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. Content of Notice ofAppeal. The notice of appeal shall be accompanied by the required filing fee and shall contain. i. An identification of the decision being appealed, including the date of the decision. ii. A statement demonstrating the person filing the notice of appeal has standing to appeal. iii. A statement explaining the specific issues being raised on appeal. iv. A statement demonstrating that the appeal issues were raised during the public comment period, d. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before the Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type II public hearing procedures, pursuant to section 18.5.1.060, subsections A - E, except that the decision of the Planning Conunission is the final decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of Appeals, pursuant to ORS 197.805 - 197.860. SUBMITTAL DATE: February 1, 2016 DEEMED COMPLETE DATE: February 23, 2016 STAFF APPROVAL DATE: March 21, 2016 DEADLINE TO APPEAL (4:30 p.m.): April 4, 2016 FINAL DECISION DATE: April 5, 2016 APPROVAL EXPIRATION DATE: October 5, 2017 DECISION The application is a request for a hazard tree removal permit to remove a silver maple tree from the property located at 200 Randy Street. The application identifies the silver maple tree as 75 feet in height and 36 inches DBH. The subject tree is located nearest the southeast corner of the lot and is marked with a band of green "plant tie" plastic. The site is on the south side of Randy Street and is located on private land known as Common Area B owned by the Helman Springs Homeowners Association. The properly is 0.13 acres in size and zoned Single-Family Residential (R-1-5). Randy Street is adjacent to the north side of the property and access is provided from Randy Street. Sidewalks are in place on the Randy Street frontage. The approval criteria for a tree removal permit for a hazard tree in AMC 18.5.7.040.B.1 require that the application demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable danger of property damage to an existing structure. The application includes a report from a certified arborist that finds that there is extensive rot within the trunk of the tree. The arborist notes that there is a hollow opening in the trunk cavity approximately 6-8 feet up. There is another opening into the trunk cavity at ground level. The ground level opening was probed by the arborist and found to be mostly hollow to within a few inches of the cambium on the other side of the tree. In addition, the tree is tall and is leaning which puts added leverage at the base of the trunk. Finally, the arborist report identifies that due to the deteriorating condition of the trunk and the top heavy nature of the tree, this is a moderate to high risk hazard tree. j The approval criteria also require that the hazardous condition cannot be alleviated by treatment, relocation, or pruning. The arborist notes that severe pruning is an option; however, the tree may never have a nature appearance and is a treatment reserved for a tree whose absence from a specific location i PA #2016-00195 200 Randy StreeVMMS Page 1 would detract from the area. Also due to the subject trees proximity to adjacent dwellings a trunk failure would cause significant damage or injury. Therefore, pruning or removal of portions of the tree will not alleviate the hazardous condition. Finally, the approval criteria allow that mitigation be provided for the removed tree and a condition has been added to that effect. The criteria for a Tree Removal Permit for the removal of hazard trees are described in AMC Chapter 18.5.7.040.B as follows: 1. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i. e., likely to fall and injure persons or property) or a foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of hazard tree in part 18.6 b. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Planning Action #2016-00195 is a request for a hazard tree removal permit to remove a silver maple of approximately 36-inches diameter at breast height (DBH) from the property located at 200 Randy Street. The application with the attached conditions below complies with all applicable City ordinances for removal of a hazard tree. Planning Action #2016-00195 is therefore approved to allow the removal of the subject tree (one silver maple). Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action #2016-00195 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2. That the tree removal shall be mitigated as provided in AMC 18.5.7.050 within one year of the permit issuance. 3. The Ashland Planning Division Staff has received a complete application for the property noted above. Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way, Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above. A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions, a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance C' requirements and standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical E and Environmental Constraints in part 18.10, b. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 h feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance. e. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. To whom it may concern: The tree has a rotten core from ground level to approximately 14' up the bole near the first major trunk juncture. The main trunk is significantly hollow with only a shell of live wood supporting a heavy upper crown with a predominant lean over three houses. There is an opening into the trunk cavity 6-8' up. At ground level another opening, when probed, extends completely across the root crown area to within a few inches of the cambium on the other side and extensive rotten wood is visible inside. Were this the only defect in the tree I would recommend a partial root crown excavation to determine the extent of the rot and it if has entered or affected the roots. Due to the condition of the upper bole I don't think the additional expenditure is warranted. The cavity in the trunk almost certainly connects with the rot at ground level (I was able to probe to within a few inches of each from the bottom up and the top down) indicating a largely hollow base from the ground up. The maple is a tall tree with all the trunks leaning in roughly the same direction which puts a tremendous leverage at the base of the trunk, exactly where the compromised wood is. The tree survived our recent heavy snow (no leaves on) and high winds. A hollow trunk is still structurally a pipe which does have strength. It's possible the tree may stand for some time without failing, but due to the compromised condition of the trunk and the extensive top weight, I would place it in a moderate to high risk bracket as a hazard tree. If it were in the middle of a field it might not be as much of a concern, but due to its proximity to the houses, were the trunk to fail significant damage or injury could occur. One option for mitigation would be severe topping to perhaps 1/3 the height of the tree. Ii 1 would probably re-sprout adequately and require pruning every few years to encourage proper limb development and prevent the new top from overweighting. The cut trunks would rot down their centers, but if the tree were kept to a smaller size they could be sufficient to support the new growth providing the rot at the base did not advance to an unacceptable level for the smaller tree size. The new limb junctures could be questionable in their attachment to the shorter trunks. The tree might never resume a natural appearance. This is a severe treatment I would normally reserve for a tree whose absence from a given location would too greatly detract from the surroundings. The second option is complete removal. Considering the positioning of the surrounding trees, removal of the tree would not in my opinion detract from the grove and could in fact enhance the appearance of the area as the remaining canopy coverage from the other three maples in the grove is substantial. Due to the same, large tree canopy coverage for that specific local residential locale would still be 75-80% of what it is now so ground cooling and water retention would not be heavily affected. The remaining three maples have broader canopies and would continue to spread into the area opened by this removal. I don't take tree removals lightly so have spent due consideration on this recommendation.
