Tract in the City of Ashland, Jackson County, Oregon; thence North 23°11'39" East 35.00 feet to the most northerly corner of tract
described in Document No. 77 08523, of the Official Records of Jackson County, Oregon; thence South 66°54'17" East, along the
northerly line of said tract and the southeasterly extension thereof, 86.44 feet to a 5/8 inch steel pin marking the True Point of
Beginning of the herein described tract of land; thence South 23°11'57" West, parallel with the easterly line of said tract described in
Document No. 77-08523, said Official Records, 47.48 feet to a 5/8 inch steel pin marking a point on the southeasterly extension of
the southerly line of said tract; thence South 66°54'31" East 63.70 feet to a point on the westerly line of Pioneer Street; thence
North 23°11'57" East, along said westerly line, 47.48 feet to a point on said southeasterly extension of the northerly line of tract
described in Document No. 77-08523, said Official Records; thence North 66°54'17" West 63.70 feet to the True Point of Beginning.
As grantor and owner of the property listed above, I hereby consent to the following improvements, dedication, or other actions as
required by the City of Ashland, and agree to bear the proportionate payment of associated costs. This Agreement is to be binding upon
myself/ourselves, my/our heir(s), executors, and assigns, and it is my/our express intention that this Agreement shall run with the land, so
that fulfillment of the items listed below shall be binding upon future owners of the property.
Action: The existing property contains a 1,425 square foot commercial building in the commercial (C-1) zone
and requires a planning application approval prior to a change in the use if the building or property including
but not limited to use of a portion of the building for a residential dwelling unit, travelers' accommodation, or
hotel/motel unit. BD-2015-02120 is a building permit to remodel the interior of the building from a drycleaners to
a gallery. The break room shall not be used as a separate residential unit, travelers' accommodation, or
hotel/motel unit involving short or long term overnight stays. The owner shall not install kitchen facilities in the
break room area identified on the building permit BD-2015-02120. A residential dwelling unit, travelers'
accommodation, and hotel/motel unit are not a permitted use of the building or property without obtaining a site
design or conditional use permit approval, and therefore use of the building as a residential dwelling unit,
travelers' accommodation, or hotel/motel unit would be a violation of the Ashland Municipal Code and subject to
