Selection of Park Commissioner Position #3

SUMMARY
On November 6, 2012, Park Commissioner Rich Rosenthal was elected to Council Position #5 which
resulted with his resignation from the Park Commission effective December 31, 2012.
The Parks & Recreation Commission recommends appointment of Mike Gardiner to the open Park
Commission Seat #3 for a term ending December 31, 2014.
BACKGROUND AND POLICY IMPLICATIONS:
City Charter does not provide for a separate process of appointment to the Park Commission when a
vacancy occurs.
City Charter states that a vacant elective office shall be filled within sixty (60) days (which is March 1,
2012) by the City Council electing some qualified person to fill the vacancy. The appointee’s term of
office shall begin immediately upon appointment and shall continue until a successor, elected at the
next biennial election takes office for the unexpired term. (Biennial elections take place very two
years; next biennial election will be November, 2014)
City Council requested the Parks & Recreation Commission to assist in the process for selection of
appointment. The position was advertised in the local newspaper and three applications were received.
Of the three applications received from Mike Gardiner, Joseph Graf and Scott Kurtz the Park
Commissioners recommend Mike Gardiner. Mr. Graff and Mr. Kurtz requested that they be allowed to
step aside from the appointment and supported appointment of Mike Gardiner.
STAFF RECOMMENDATION AND REQUESTED ACTION:
Council consideration of the following:
Confirm by motion the recommendation of Mike Gardiner to the Park Commission Seat #3 for
a term ending December 31, 2014.
OR
Council can choose to conduct the selection process for filling the vacant Park Commission
Position #3. Direction would be provided to the City Elections Officer on the process for this
appointment.
