Dear Dick:
This Amendment No.1 (Amendment) between the City of Ashland (Ashland) and the
Bonneville Power Administration (Bonneville) revises Exhibit A to modify the
Implementation Budget in Project 3, the Expanded Standard Offer for Commercial and
Industrial Lighting (ESO), and adds Project 5, the Expanded Standard Offer Plus for
Commercial and Industrial Lighting (ESO Plus), and Project 6, Energy Star Homes
Northwest.
Bonneville and Ashland agree:
1. EFFECTIVE DATE. This Amendment shall take effect on the date
executed by the Parties (Effective Date).
2. EXHIBIT REVISIONS. This Amendment revises the following Projects in
Exhibit A:
(a) Revision No.3, Exhibit A, Project 3, ESO, shall be replaced with
Revision No. 3, Exhibit A, Revision No.1, Project 3, ESO.
(b) The enclosed Project 5, ESO Plus shall be added to Revision
No.3 of Exhibit A.
(c) The enclosed Project 6, Energy Star Homes Northwest shall be added
to Revision No.3 of Exhibit A.

REVISION NO.1, PROJECT 3, EXPANDED STANDARD OFFER I~OR
COMMERCIAL AND INDUSTRIAL LIGHTING
This Revision No.1 to Project 3 closes this Project 3 by transferring 25,000 dollars to
Project 5, 15,000 dollars to Project 6, and 305,766 dollars back to Bonneville, and thus
reducing Project 3's Implementation Budget to the amount already expended.
1. Project 3 Description
(a) Expanded Standard Offer Program
(1) This Expanded Standard Offer (ESO) provides rebates for retrofits of
lighting in commercial and industrial facilities. The Measures eligible for
payment under this ESO include only those listed in the Lighting Rebate
Verification Report. In addition, a 30 percent watt reduction of the
affected lighting load for each proj ect is required to receive the rebate.
Ashland shall ensure that all materials, including PCB ballasts, are
disposed of or recycled in accordance with current environmental laws.
(2) Ashland shall implement a commercial and industrial sector lighting
retrofit program designed to install the Measures listed in the Lighting
Rebate Verification Report below. Ashland may implement the program
using Ashland's staff or contractors to provide the services necessary to
install the Measures.
(3) Ashland shall provide a work plan to Bonneville within 120 days of the
execution of this Project 3. The Plan shall include: (1) a brief description
of Ashland's program, (2) method for determining eligible facilities, and
(3) qualifications required for auditors, installers, and inspectors.
(4) Bonneville shall review this work plan and upon acceptance, send Ashland
written notification to proceed.
(5) Should the level of program implementation fall substantially below the
activity level identified in the work plan, Bonneville reserves the right to
adjust the implementation budget pursuant to section (i) belo\v.
(6) In order to accommodate the addition of new technologies and. revised
specifications, Bonneville may annually revise this Project 3.
(b) Implementation Period
This ESO is available from the Execution Date of this Project 3 through
September 30, 2006.

(c) Energy Savings Verification
(1 ) Ashland shall inspect all installations to ensure Measures are installed
correctly and that the Measures meet the specifications listed in
sections (k) and (1) of this Project 3. Ashland shall:
(A) complete, sign, and date the Lighting Rebate Verification Report
for each proj ect,
(B) attach the Wattage Reduction Summary Sheet for each facility
showing the wattage reductions and energy savings,
(C) attach any cut sheets or equipment descriptions for the installed
equipment,
(D) submit the above with an invoice as described in section (d) below.
(2) Ashland shall retain all supporting documents for each project that
include, but are not limited to purchase orders, subcontractor invoices,
pre-project estimates, or other related project documents. Bonneville may
review these records as provided for in this Agreement.
(d) Bonneville Payment and Invoicing Requirements
(1) Bonneville shall provide $350,000 for implementation of this proposal.
Ashland may invoice Bonneville up to this total Implementation Budget
for this ESO through September 30, 2006. In no case shall the total
invoiced to Bonneville for past and future work under this proj ect exceed
the Implementation Budget. If Ashland expends this Implementation
Budget amount prior to September 30, 2006, Ashland may request
additional Implementation Budget. Bonneville shall review the request
and may add additional funds to the Implementation Budget by
modification to this Agreement.
(2) Ashland may invoice Bonneville when projects are complete, but no more
often than once a month. Bonneville shall review, and upon acceptance,
pay the reimbursements for Measures installed. Ashland shall, if
requested by Bonneville, arrange for an onsite inspection by Bonneville of
the Measures installed.
(e) Technical Interpretations
Ashland may submit technical questions in writing, including E-mail, to
Bonneville regarding the specifications and the rebate list.
(f) Consideration of Non-Standard Measures
The intent of the ESO rebate list is to provide standard incentives for eommon
lighting efficiency Measures. Ashland may request, on a case-by-case basis,

Bonneville consideration of lighting Measures that are not included in the
Lighting Rebate Verification Report. Such Measures must be determined by
Bonneville to be cost-effective Measures and meet general Conservation
Augmentation program requirements. Bonneville reserves the right to approve or
disapprove use of such non-standard Measures.
(g) Program Requirements
(1) The facility shall be non-residential and served by Ashland.
(2) Rebates are available for replacement of existing equipment in existing
facilities only.
(3) The total rebate for each project shall not exceed 70 percent of the total
proj ect cost.
(4) All projects must reduce the affected lighting wattage by 30 percent or
greater, where: Percent Watt Reduction = 100 x (Input Watts of Removed
Lighting - Input Watts of Installed Lighting) -7 Input Watts of Removed
Lighting).
(5) All payments for savings under this Project 3 must be passed through from
Bonneville to the end-user by Ashland.
(h) Measure Life
Regardless of the method for determining Measure life as described in
section 14(e)(1) of the body of this Agreement, the Measure life for all Measures
under this proj ect is 10 years except for CFLs, which is 3 years.
If a termination charge is implemented under section 14( e) of the body of this
Agreement, the Measure life provided in this section shall be used in the formula
provided in section 14(e) of the body of this Agreement.
(i) Budget Review and Adjustment
Bonneville shall periodically review Ashland's progress to ensure that the
program is being implemented in a manner that provides assurance that the funds
will be utilized by Ashland during the term of Project 3. Bonneville nlay, in
consultation with Ashland, and only after providing 3 months notice, reduce the
budget. Bonneville shall take into account all issues that Ashland believes will
affect future rates of expenditure. In any case, Bonneville shall not reduce the
budget:
(1) below the level needed to meet all commitments previously made in
writing by Ashland to any consumers. A list of commitments shall be
provided to Bonneville;

(2) below the level needed to cover the estimated cost associated with all
projects that have been formally presented to Ashland by any consumers,
and that, in the opinion of Ashland, have a high likelihood of gaining
utility or Bonneville approval, whichever is needed. A list of projects
shall be provided to Bonneville.
(j) Consumer Triggered Stranded Conservation Investments
(1) If a consumer who received conservation payments under the terms of this
exhibit;
(A) provides notice to Ashland it will stop placing firm load on
Ashland, and
(B) that consumer continues to operate the facility with electricity
provided by any other entity, including energy the consumer may
produce using its own generation resources, and
(C) the Bonneville payment to Ashland to achieve that conservation
with that consumer was $100,000 or greater, then Ashland shall be
responsible for repayment for the resulting stranded conservation
investment.
(2) The amount of the repayment shall be calculated using the fornl1ula in
section 14(e). The definition of the variables in the formula shall be
construed to apply to those projects for which repayment shall be required.
The Measure life shall be consistent with those provided in section (h) of
Project 3 of this Exhibit A.
(3) The repayment shall be made within 60 (sixty) business days fJrom when
the business ceases to place firm load on Ashland.
(k) General Equipment Requirements
(1) All equipment shall be new.
(2) All ballasts and luminaires shall be Underwriters Laboratory (lJL) rated.
(3) Ballast Warranty: All electronic ballasts shall be warranted against
defects in material and workmanship for a minimum of 3 years, except for
those ballasts listed under sections (1)(1), (1)(2), and (1)(8) below. These
ballasts are warranted for 5 years as required by the Lighting Design Lab
T8 & T5 Fluorescent Lamp Electronic Ballast Specifications. The
warranty shall include either a $10.00 replacement labor allowance or
complete replacement including labor by an agent of the manufacturer.

(4) Lamp Warranty: Lamps shall be warranted against defects in nlaterial and
workmanship for 2 years. The warranty shall provide for replacement
lamps.
(5) Compact Fluorescent Warranty: CFLs shall be warranted for at least 1
year, or for the manufacturer's stated life of the CFL.
(6) Starting Temperatures: All ballasts shall be capable of starting the lamps
at the appropriate ambient (surrounding) temperatures. Examples include
indoor heated, indoor non-heated, normal outdoor, and cold cliJmate
outdoor.
(1) Rebate Item Requirements
(l) High Performance T8 Fluorescent Lamps and Electronic Ballasts
(A) Includes fixture retrofits and new fixtures.
(B) This category is primarily intended for 4- foot T8 lamps, but
includes T8 and T5 linear fluorescent lamps, 2 feet to 8 feet in
length, with ballast input watts from 15 to 114 watts, that meet the
95 lumens per watt requirement.
(C) Lamps shall have a CRI equal to or greater than 85, lunlen
maintenance equal to or greater than 95 percent, and laJnp life
equal to or greater than 24,000 hours (at 40 percent of rated life,
3 hours per start). Four-foot F32T8 lamps shall have initial output
equal to or greater than 3,100 lumens.
(D) Ballasts shall meet the requirements of the Lighting Design Lab T8
& T5 Fluorescent Lamp Electronic Ballast Specifications current at
the time of ballast installation.
(E) Lamp/ballast combinations shall have an efficacy of equal to or
greater than 95 lumens per watt:
Lamp/Ballast Efficacy = (Initial Lamp Lumens x No. of Lamps x
Ballast Factor)/Ballast Input Watts.
(F) For this "High Performance" rebate, the application must include
either the manufacturer's specification sheet documenting Initial
Lamp Lumens, Lamp Lumen Maintenance, Ballast Factor and
Ballast Input Watts, or list manufacturer's model numbers and
performance.

maintenance equal to or greater than 90 percent, and lalnp life
equal to or greater than 18,000 hours (at 40 percent of rated life,
3 hours per start). Four-foot F32T8 lamps shall have initial output
equal to or greater than 2800 lumens. Lamp ballast cornbinations
shall have an efficacy equal to or greater than 80 lumens per watt.
(D) Ballasts shall meet the requirements of the Lighting Design Lab T8
& T5 Fluorescent Lamp Electronic Ballast Specifications current at
the time of ballast installation.
(3) Hardwired Compact Fluorescent
(A) Includes new hardwired compact fluorescent fixtures and fixture
retrofits, 15 to 99 watts.
(B) Must replace existing incandescent or mercury vapor lighting.
(C) Hardwire retrofits must remove screw-in lamp socket. Recessed
fixtures must include a reflector designed for the new lamp.
(D) Lamps shall have a CRI equal to or greater than 80, lurnen
maintenance equal to or greater than 80 percent, and lamp life
equal to or greater than 10,000 hours (at 40 percent of rated life,
3 hours per start).

(E) Ballasts shall have a power factor equal to or greater than
90 percent, THD less than or equal to 33 percent, Lamp Current
Crest Factor less than or equal to 1.7, Class A sound rated, and
provide end of life protection.
(F) Lamp/ballast combinations shall have a minimum efficacy of
46 lumens per watt for lamps under 30 watts, and 60 lUlnens per
watt for lamps 30 watts or greater.
(4) Ceramic Metal Halide
(A) Includes new hardwired fixtures and fixture retrofits, 39 to
250 watts (nominal).
(B) Must replace existing incandescent lighting.
(C) Lamps shall have CRI equal to or greater than 80, lumen
maintenance equal to or greater than 80 percent, and maximum
color shift over life of lamp less than or equal to 200 degrees
Kelvin.
(5) Screw-in Compact Fluorescent Lamps
(A) Includes one-piece or modular screw-in compact fluorescent, 3 to
150 watts (nominal).
(B) Must replace existing incandescent lighting.
(C) Installation in recessed fixtures is not recommended. Lamps in
recessed fixtures must include a reflector designed for the lamp.
(D) Screw-in compact fluorescents must bear the ENERG'l' STAR@
label and meet the ENERGY STAR@ specifications for energy
efficiency. Exception: Where ENERGY STAR@ specifications
do not apply, substitutions may be allowed with prior approval
from Bonneville.
(6) LED or Cold Cathode Exit Signs
(A) Applies to new LED or Cold Cathode exit signs.
(B) Must retrofit or replace existing incandescent exit signs.
(C) Exit signs must meet the ENERGY STAR@ specificatilons for
energy efficiency. Input power must be less than 5 watts per face.
(7) Induction Lamp Luminaire
(A) Includes new induction lighting systems.

(B) Must replace existing incandescent or mercury vapor lighting.
(8) High Output Fluorescent Luminaire
(A) Includes T8, T5, standard or HO, 4-foot and 8-foot lamps, 85 to
600 input watts.
(B) Must replace T12 fluorescent/magnetic ballasts, mercury vapor,
probe-start metal halide, or incandescent.
(C) Lamps shall have a CRI equal to or greater than 80, IUlnen
maintenance equal to or greater than 90 percent, and larnp life
equal to or greater than 18,000 hours (at 40 percent of rated life,
3 hours per start).
(D) Lamp/ballast combination shall have an efficacy of greater than
80 lumens per watt.
(E) Ballasts shall meet the requirements of the Lighting Design Lab T8
& T5 Fluorescent Lamp Electronic Ballast Specifications current at
the time of ballast installation.
(9) Pulse Start Metal Halide
(A) Includes new pulse-start lighting systems. Where possible, high
output fluorescents are recommended over metal halide.
(B) Lamps shall have a CRI equal to or greater than 65, lunlen
maintenance equal to or greater than 75 percent, and lalnp life
equal to or greater than 20,000 hours (at 40 percent of rated life,
3 hours per start).
(C) Lamp/ballast combination shall have an efficacy equal to or greater
than 89 lumens per watt.
(10) Occupancy Sensors
(A) Includes infrared, ultrasonic, and dual-technology sensors, and
wall, ceiling, and fixture mounts.
(B) Occupancy sensor must be compatible with the controlled lighting
equipment and rated for the controlled wattage.

(C) Infrared sensors require an unobstructed view of targeted motion.
(D) All sensors shall be tuned after installation for proper coverage,
sensitivity, and time delay.

Reduction Summary Sheet are part of this Project 3.

PROJECT 5, EXPANDED STANDARD OFFER PLUS FOR COMMERCIAL AND
INDUSTRIAL LIGHTING
Effective on the Date Executed by Both Parties
This Project 5 is added to Exhibit A. An Implementation Budget of 25,000 dollars is
established for this Project 5.
1. PROJECT 5 DESCRIPTION
Ashland shall implement a commercial and industrial lighting program that shall be
known as the Expanded Standard Offer PI us for Commercial and Industrial
Lighting (ESO Plus). The ESO Plus provides incentives for upgrades to Jlighting in
commercial and industrial facilities. The eligible Measures that may be installed
under this ESO Plus are described in section 12 of this Project.
2. ESO PLUS WORK PLAN
Ashland shall provide a work plan to Bonneville within 120 days of the execution of
this ESO Plus. If Ashland has submitted a work plan as part of an earlier ESO
Project, and Bonneville has approved such plan, no new work plan submittal is
required. Bonneville may review the existing work plan with Ashland upon
execution of this new ESO Plus Project.
(a) Contents of Work Plan
The work plan shall include:
(1) a brief description of Ashland's program;
(2) a method for determining eligible facilities; and
(3) qualifications required for auditors, installers, and inspectors.
(b) Bonneville's Review and Approval of the Work Plan
Bonneville shall review this work plan and, upon acceptance, send Ashland
written notification to proceed with the implementation of the ESO Plus.
3. DEFINITIONS
In addition to the defined terms found in section 2 of the body of this Agreement,
certain technical terms are used throughout this Project and are defined in the
section below.
(a) Ballast is an electrical device used with Fluorescent or High Intensity
Discharge Lamps to supply sufficient voltage to start and operate the
Lamp(s) as well as to regulate the current to the Lamp(s) during operation.
(b) Cold Cathode is an electric-discharge Lamp whose mode of operation is that
of a glow discharge. Neon lights are an example of a Cold Cathode Lamp.

(c) Color Rendering Index or CRI is a measurement of a Lamp's ability to
render colors accurately. The scale ranges from 0 to 100. A Lamp with a CRI
of 80 and above is considered to be a high quality light source.
(d) Compact Fluorescent Lamp or CFL is a smaller version of a Fluorescent
Lamp. A CFL can screw into a regular light bulb socket or can plug into a
small lighting Fixture.
(e) Cut Sheet refers to the manufacturer's written technical descriptions of
specific lighting equipment (Lamp, Ballast, reflector, etc.). The Cut Sheet is
also referred to as a "tech sheet."
(f) De-Lamp or De-Lamping refers to the removal of one or more Lamps from
a Fixture or a Luminaire as part of a Retrofit.
(g) Efficacy is a measure of a light source's efficiency and is described in terms
of Lumens per watt.
(h) Fixture refers to lighting equipment that is permanently attached or
securely fixed in place. A Fixture consists of the housing but may :include the
Lamps and Ballasts as well. Fixtures screwed together (adjacent to each
other) can be considered as separate Fixtures.
(i) Fluorescent is a lighting technology that produces light by exciting organic
phosphor material on the inner wall of a glass tube or bulb.
(j) Hard-wired Fixtures are new Fixtures that have Plug-In Lamp sockets
instead of screw-in Lamp sockets making it impossible to screw in an
incandescent bulb.
(k) High Intensity Discharge or HID is a light source that produces light by
creating an arc of electricity across two electrodes. Types of HIDs include
Mercury Vapor, High-Pressure Sodium, and Metal Halide Lamps.
(1) High Output Fluorescent Luminaire is a new Fixture that includes
Fluorescent Lamps that have a high Lumen output. High Output
Fluorescent Luminaires are most often located in a high bay, e.g., a high
mounting height location.
(m) High Performance is a generic term that is used to describe certain
Measures offered under this ESO Plus that are more energy efficient than
standard lighting products.
(n) High Pressure Sodium is a yellowish appearing HID light source that has
a low CRI.

(0) Induction Lamp is a Fluorescent technology that excites the phosphorous
material with high frequency radio waves instead of using an electrical
discharge. The expected life of these Lamps is 80,000 plus hours.
(p) Installer is the person or company that installs the lighting Measures as
allowed under this ESO Plus.
(q) Lamp is a generic term for an artificial light source.
(r) Light Emitting Diode or LED is a semiconductor that glows when a
current is passed through it. LEDs are low Lumen, low wattage dBvices that
produce a directional light beam. LEDs can be arranged in different patterns
and therefore are ideal for signage lights.
(s) Lumen is the unit of measure for the total light output of a Lamp or
Luminaire.
(t) Lumen Maintenance refers to the decrease of the Lamp Lumen output over
time. Such a decrease is caused by bulb wall blackening, phosphor
exhaustion, filament depreciation, and other factors. Lumen Maintenance is
also referred to as Lamp Lumen depreciation.
(u) Luminaire refers to the entire lighting unit and primarily includes the
housing, Lamp, the Lamp holder, the Ballast, the lens, and the reflector.
Strip Fixtures where the Installer installs all new Lamps, Lamp holders,
Ballast, lens, and reflector can be considered a new Luminaire.
(v) Mercury Vapor is an older type of HID light source that has a lov{ CRI and
low Efficacy.
(w) Metal Halide is considered the best HID light source for most applications.
Metal Halides produce a neutral white light that has a relatively high CRI.
(x) Nominal means "manufacturer stated." A manufacturer will stanlp a value
on the piece of lighting equipment or on the nameplate that is usually
expressed in watts or Lumens.
(y) Plug-In Lamp or PL designates a snap or plug-in Fluorescent La:mp as
opposed to a screw-in type Lamp.
(z) Probe-Start refers to the typical method for starting a Metal Halide bulb.
Probe-Start is less efficient than the pulse-start method.
(aa) Retrofit means the installation of new Lamps and Ballasts in existing
Fixtures. In some cases, reflectors may be added and old lenses may be
replaced.

(bb) T5s, T8s, and T12s are Fluorescent tubes that are 5/8 inch in diameter,
1 inch in diameter, and 1-1/2 inches in diameter, respectively.
(cc) Total Harmonic Distortion or THD is a measure of how close the wave
form of an electronic device is to a perfect sine curve. THD is expressed as a
percentage. The higher the percentage of THD, the higher the distortion
level. A THD percentage of 20 percent or less is considered a low distortion
level. A device that creates a high distortion can reduce the expected life of
such equipment, and in some instances reduce the expected life of
surrounding equipment.
(dd) Very High Output Fluorescent Lamps are Fluorescent Lamps that are
designed to have significantly higher Lumen output than standard Lamps.
The Ballasts overdrive these Lamps to the point where they are inefficient
and have short lives. These Lamps are targeted for Retrofit or in some cases
the entire Fixture replaced.
(ee) Underwriters Laboratory or UL is an independent laboratory that
evaluates products primarily for safety. A UL label or rating indicates a
measure of safety.
4. PROGRAM REQillREMENTS
(a) The facility where the ESO Plus Measures are installed shall be non-
residential and served by Ashland.
(b) Incentives are available for replacement of existing equipment in existing
facilities only.
(c) The total incentive, exclusive of any funds provided to Ashland per
section 7(d), for each Sub-Project! shall not exceed 70 percent ofthB total
Sub-Project cost.
(d) All Sub-Projects must reduce the affected lighting wattage by 30 percent or
greater, where:
Percent Watt Reduction = 100 x (Input Watts of Removed
Lighting - Input Watts of Installed Lighting) + Input Watts of
Removed Lighting.
(e) Ashland shall pass through all incentive payments for Energy Savings under
this ESO Plus to the Consumer, with the exception of the discretionary funds
as described in section 7(d).
1 "Sub-Projects" shall be defined as those submitted by Ashland as outlined under this ESO Plus.
The term "Project" refers to the entire ESO Plus and includes all "Sub-Projects" as approved by

5. IMPLEMENTATION PERIOD
This ESO Plus is available from the Execution Date of this Project through
September 30, 2006. Final invoicing shall be done pursuant to section 8(b).
6. ENERGY SAVINGS VERIFICATION
(a) Ashland shall inspect all installed Measures to ensure that they are installed
correctly and that the Measures meet the specifications listed in sections 11
and 12 of this ESO Plus. Then Ashland shall:
(1) complete, sign, and date a copy of the Lighting Rebate VeriJtication
Report attached at the end of this Project for each Sub-Project done
under this ESO Plus;
(2) attach either a paper copy or submit the electronic version of the
completed Drop Down Wattage Reduction Tool for each facility where
Measures are installed. This document shall show the equipment
installed, wattage reductions, and Energy Savings. The electronic
version is available on Bonneville's ESO Plus website located at:

If Ashland cannot access this electronic form, an equivalent form may
be used. Ashland shall contact Bonneville for further instructions;
(3) submit the Cut Sheet for any High Performance Measure installed
under this ESO Plus; and
(4) submit the above with an invoice as described in section 8 of this
Project.
(b) Ashland shall retain all supporting documents for each Sub-Project that
include, but are not limited to, purchase orders, subcontractor invoices, pre-
Sub-Project estimates, or other related Sub-Project documents. Bonneville
may review these records as provided for in section 9 of the body of this
Agreement.
7. IMPLMENTATION BUDGET
(a) Amount
Bonneville shall provide 345,766 dollars for implementation of this ESO Plus.
Ashland may invoice Bonneville up to this total Implementation Budget for
this ESO Plus in a manner as described in section 8 below. In no case shall
the total amount invoiced to Bonneville for work under this ESO Plus exceed
the Implementation Budget.

(b) Request for Additional Implementation Budget
If Ashland expends this Implementation Budget amount prior to
September 30, 2006, Ashland may request additional Implementation
Budget. Bonneville shall review the request and may add additional funds to
the Implementation Budget. If additional funds are approved by Bonneville,
Bonneville may, by written notice, unilaterally increase the Implmnentation
Budget.
(c) Implementation Budget Review and Adjustment
Bonneville shall periodically review Ashland's progress to ensure that the
ESO Plus is being implemented in a manner that provides assurance that the
Implementation Budget will be utilized by Ashland during the tenn of this
ESO Plus. Bonneville may, in consultation with Ashland, and only after
providing three months notice, reduce the Implementation Budget"
Bonneville shall take into account all issues that Ashland believes will affect
future rates of expenditure. In any case, Bonneville shall not reduce the
Implementation Budget:
(1) below the level needed to meet all commitments previously made in
writing by Ashland to any Consumers; nor
(2) below the level needed to cover the estimated cost associated with all
Sub-Projects that have been formally presented to Ashland by any
Consumer, and that, in the opinion of Ashland have a high likelihood
of gaining Ashland approval.
If requested by Bonneville, a list of commitments and potential Sub-Projects
shall be provided to Bonneville.
(d) Discretionary Funds
A portion of the Implementation Budget may be used as specified in sections
7(d)(1) and 7(d)(2) below. Ashland shall document how the discretionary
funds were used as part of their final invoice to Bonneville.
(1) Ashland may use 500 dollars for the development of marketing
materials for the ESO Plus. Ashland shall include this amount on
their first submitted invoice to Bonneville.
(2) Ashland shall receive an additional dollar amount equal to JlO percent
of the total amount of the incentives invoiced to Bonneville and as
shown on each submitted Lighting Rebate Verification Report.
Ashland may use these funds in any of the following ways:
(A) the funds may be used to cover certain costs Ashland incurs as
part of operating the ESO Plus. Such costs include staff time,
the cost of audits, marketing efforts, or training; or

(B) the funds may be used to provide incentives to Installers to
implement ESO Plus projects.
8. INVOICING
(a) Frequency of Invoicing
Ashland may invoice Bonneville when Sub-Projects are complete, but no more
often than once a month. Bonneville shall review the invoice and, upon
acceptance, pay the incentives for Measures installed. Ashland shall, if
requested by Bonneville, arrange for an onsite inspection by Bonneville of the
Measures installed.
(b) Final Invoicing
All Measures shall be installed and operating by September 30, 2006, in
order to qualify for incentive payments under this Project, but for the
following exception:
By September 1, 2006, Ashland may submit a list of all ESO Plus Sub-
Projects started but not yet completed. If any of these Sub-Projects are not
completed by September 30,2006, but are completed during the month of
October 2006, Ashland may include such completed Sub-Projects on their
final invoice to Bonneville.
9. MEASURE LIFE
Regardless of the method for determining Measure life, the Measure life for all
Measures under this Project is 10 years except for CFLs, which is three years.
If a termination charge is implemented under section 14(e) of the body of this
Agreement, the Measure life provided in this section shall be used in the formula
shown in section 14(e) of the body of this Agreement.
10. CONSUMER TRIGGERED STRANDED CONSERVATION INVEST1\IENTS
(a) If a Consumer received incentive payments under the terms of this ESO Plus
and:
(1) stops purchasing its electricity from Ashland; and
(2) continues to operate the facility with electricity provided by any other
entity, including energy the Consumer may produce using its own
generation resources, and the Bonneville payment to Ashland to
achieve that conservation with that Consumer was 100,000 dollars or
greater;
then Ashland shall be responsible for repayment to Bonneville for the
resulting stranded conservation investment.

(b) The amount of the repayment shall be calculated using the formula in
section 14(e) of the body of this Agreement. The definition of the variables in
the formula shall be understood to apply to those Sub-Projects for which
repayment shall be required. The Measure life shall be consistent with
section 9 of this Project.
(c) The repayment shall be made within 60 business days from the date the
Consumer ceases to place firm load on Ashland. The repayment shall be
remitted by electronic funds transfer to Bonneville's account or by check to
the following address:

Ashland shall reference the Agreement number on the repayment document.
11. GENERAL PROGRAM REQUIREMENTS
(a) Ashland may implement this ESO Plus using Ashland's staff or contractors to
provide the services necessary to install the Measures.
(b) All equipment shall be new.
(c) All Ballasts and Luminaires shall be UL rated.
(d) Ballast Warranty: All electronic Ballasts shall be warranted against defects
in material and workmanship for a minimum of three years, except for those
Ballasts listed under sections 12(a), 12(b), and 12(h) of this Project. The
Lighting Design Lab T8 and T5 Fluorescent Lamp Electronic Ballast
Specifications require that these Ballasts be warranted for five years. The
warranty shall include either a 10-dollar replacement labor allowance or
complete replacement including labor by an agent of the manufacturer.
(e) Lamp Warranty: Lamps shall be warranted against defects in material and
workmanship for two years. The warranty shall provide for replacement
Lamps.
(f) Compact Fluorescent Light Warranty: CFLs shall be warranted for at least
one year, or for the manufacturer's stated life of the CFL.
(g) All Ballasts shall be capable of starting the Lamps at the appropriate
ambient (surrounding) temperatures. Examples of such ambient
temperatures include indoor heated, indoor non-heated, normal outdoor, and
cold climate outdoor.

(h) Ashland shall ensure that all materials, including Polychlorinated
Biphenyls (PCB) Ballasts are disposed of, or recycled, in accordanee with
current environmental laws.
12. INDIVIDUAL MEASURE REQUIREMENTS
Ashland may submit technical questions in writing, including E-mail, to Bonneville
regarding the specifications and the rebate list. The specifications for each
individual Measure are described below.
(a) High Performance T8 Fluorescent Lamps and Electronic Ballasts
(1) This Measure can be installed as part of a Retrofit or included as part
of a new Fixture.
(2) This Measure must replace a T12 Fluorescent, T8 De-Lamp,
incandescent, or Mercury Vapor lighting.
(3) This Measure primarily consists of 4-foot T8 Lamps, but may include
T8 Lamps between 2 feet and 8 feet in length. High Perfonnance T5
Linear Fluorescent Lamps may be included as part of this ]I.leasure if
they become commercially available.
(4) The Ballast input watts shall be from 15 to 114 watts.
(5) The Lamps shall have:
(A) a CRI equal to or greater than 85;
(B) a Lumen Maintenance equal to or greater than 94 percent;
(C) a Lamp life equal to or greater than 24,000; and
(D) 4-foot F32T8 (Fluorescent 32 watt T8) Lamps shall have initial
output equal to or greater than 3,100 Lumens.
(6) The electronic Ballasts shall meet the requirements of the Lighting
Design Lab's T8 and T5 Fluorescent Lamp Electronic Ballast
Specifications current at the time of Ballast installation. These
specifications are located on the Lighting Design Lab's web site at:

(7) Lamp/Ballast combinations shall have an Efficacy of equal to or
greater than 95 Lumens per watt.
Lamp/Ballast Efficacy = (Initial Lamp Lumens x No. of

(8) Ashland shall submit either the manufacturer's Cut Sheet
documenting initial Lamp Lumens, Lamp Lumen Maintenance,
Ballast factor, and Ballast input watts, or list the manufacturer's
model numbers and performance when submitting an invoice to
Bonneville for this Measure.
(b) T8 or T5 Fluorescent Lamps and Standard Electronic Ballast
(1) This Measure can be installed as part of a Retrofit or included as part
of a new Fixture. This Measure is to be installed only when the
Measures described in section 12(a) would not be most appropriate to
install at a particular facility.
(2) This Measure includes T8 and T5 linear Fluorescent Lamps, 2 feet to
8 feet in length.
(3) The Ballast input watts shall be from 15 to 114 watts.
(4) Lamps shall have:
(A) a CRI equal to or greater than 80;
(B) a Lumen Maintenance equal to or greater than 90 percent;
(C) a Lamp life equal to or greater than 20,000 hours; and
(D) any 4-foot F32T8 (Fluorescent 32 watt T8) Lamps shall have
initial output equal to or greater than 2,800 Lumens.
(5) Ballasts shall meet the requirements of the Lighting Design Lab's T8
and T5 Fluorescent Lamp Electronic Ballast Specifications eurrent at
the time of Ballast installation. These specifications are located on

(1) This Measure includes both Hardwired Compact Fluorescent Fixtures
and Retrofits.

(3) This Measure must replace existing incandescent or Mercury Vapor
lighting.
(4) Any Hard-wired Retrofits must remove the existing screw-in Lamp
sockets. Recessed Fixtures must include a reflector designed for the
new Lamp.
(5) Lamps shall have:
(A) a CRI equal to or greater than 80;
(B) a Lumen Maintenance equal to or greater than 80 percent; and
(C) a Lamp life equal to or greater than 10,000 hours.
(6) Ballasts shall have:
(A) a power factor equal to or greater than 90 percent;
(B) a THD less than or equal to 33 percent;
(C) a Lamp current crest factor of less than or equal to 1.7, Class A
sound rated; and
(D) an end of life protection provided.
(7) Lamp/Ballast combinations shall have a minimum Efficacy of
46 Lumens per watt for Lamps under 30 watts, and 60 Lumens per
watt for Lamps 30 watts or greater.
(d) Ceramic Metal Halide Luminaire
Ceramic Metal Halide is a Hard-wired Fixture that uses a HID LaInp. The
Ceramic Metal Halide:
(1) shall have a Ballast input wattage between 20 and 250 watts
(nominal);
(2) must replace existing incandescent lighting or Mercury Vapor
lighting; and
(3) shall have Lamps that have:
(A) a CRI equal to or greater than 80;
(B) a Lumen Maintenance equal to or greater than 80 percent; and
(C) a maximum color shift over the life of the Lamp of less than or
equal to 200 degrees Kelvin.

(e) Screw-in Compact Fluorescent Lamps
(1) This Measure may consist of either:
(A) a one-piece or modular screw-in CFL that is rated at 3 watts or
above (nominal); or
(B) screw-in Cold Cathode Lamps.
(2) The Measure must replace existing incandescent or Mercury Vapor
lighting.
(3) The installation of this Measure in recessed Fixtures is not
recommended; however, if done, the Lamps in recessed Fixtures must
include a reflector designed for the Lamp.
(4) Screw-in compact Fluorescents must bear the ENERGY STAR@ label
and meet the ENERGY STAR@ specifications for energy efficiency.

(f) LED or Cold Cathode Signs
(1) This Measure includes new LEDs or Cold Cathode signs.
(2) This Measure must be a Retrofit or replace existing incandescent or
Mercury Vapor signs.
(3) The new signs must meet the ENERGY STAR@ specifications for
energy efficiency. These specifications are located on the EPA Energy
Star website located at:

(4) The input power must be less than 5 watts per face.
(g) Induction Lamp Luminaire
(1) This Measure shall be new, however, in some cases, high-quality
Fixtures may be retrofitted. Such Fixtures shall be heat tested to
ensure that the Retrofit configuration is within the manufacturer's
required temperature range.

(2) This Measure must replace existing incandescent or Mercury Vapor
lighting.
(3) The Lamps shall have:
(A) a CRI equal to or greater than 80; and

(h) High-Output Fluorescent Luminaire
(1) This Measure is a Luminaire that may include new T5, T8, or long
twin-tube PL. The Lamps can be either standard or high-output
Lamps. The Luminaire must be either 4-foot or 8-foot in length.
(2) The Ballast input watts shall be from 85 to 600.
(3) This Measure must replace:
(A) T12 Fluorescent/magnetic Ballasts;
(B) Mercury Vapor;
(C) High Pressure Sodium;
(D) Probe-Start Metal Halide; or
(E) incandescent bulbs.
(4) The Lamps shall have:
(A) a CRI equal to or greater than 80;
(B) a Lumen Maintenance equal to or greater than 90 percent; and
(C) a Lamp life equal to or greater than 18,000 hours.
(5) The Lamp/Ballast combination shall have an Efficacy of greater than
80 Lumens per watt.
(6) Ballasts shall meet the requirements of the Lighting Design Lab's T8
and T5 Fluorescent Lamp Electronic Ballast Specifications eurrent at
the time of Ballast installation. These specifications are located on

(i) Pulse Start Metal Halide Luminaire
(1) This Measure shall be a new Luminaire and shall be instalJled only
when it is not feasible to install High Output Fluorescent Luminaires.
(2) The Ballast input watts shall be from 300 to 750 watts.
(3) Lamps shall have:
(A) a CRI equal to or greater than 65;
(B) a Lumen Maintenance equal to or greater than 75 percent; and
(C) a Lamp life equal to or greater than 20,000 hours.
(4) The Lamp/Ballast combination shall have an Efficacy equal to or
greater than 89 Lumens per watt.
(j) Occupancy Sensors and/or Timers
(1) This Measure includes infrared, ultrasonic, and dual-technology
sensors. This Measure may be installed on wall, ceiling, or Fixture
mounts. Timers can also be included as part of this Measure. Either
the occupancy sensor or the timer can qualify for incentives under this
ESO Plus.
(2) The occupancy sensor must be compatible with the controlled lighting
equipment.
(3) The infrared sensors shall require an unobstructed view of targeted
motion.
(4) All sensors shall be tuned after installation for proper coverage,
sensitivity, and time delay.
(5) The timers and the occupancy sensors shall be rated for the controlled
wattage.
(6) The timer may be either electronic or mechanical.
(k) High Output Fluorescent Retrofit
(1) High Output or Very High Output T12 Fluorescent equipment shall be
retrofitted with T8 High Output Lamps and Ballasts. This :Measure
does not require a new Fixture. The Lamps and the Ballasts shall be
new.

(2) The input watts of the existing Luminaire shall be greater than
200 watts.
(3) The Lamps shall have:
(A) a CRI equal to or greater than 80;
(B) a Lumen Maintenance equal to or greater than 90 percent; and
(C) a Lamp life equal to or greater than 18,000 hours at existing
conditions.
(4) Lamp/Ballast combination shall have an Efficacy of greater than
80 Lumens per watt.
(1) Very High Output Retrofit with T5 Lamps and Ballasts
(1) Very High Output Fluorescent Lamps (T12) equipment shall be
retrofitted with T5 Lamps and Ballasts. This Measure does not
require a new Fixture. The Lamps and the Ballasts shall be new.
This Measure is to be installed only for applications where the Lumen
output must be equivalent to the Lumen output of the existing
equipment.
(2) The input watts of the existing Fixture shall be greater than
400 watts.
(3) The Lamps shall have:
(A) a CRI equal to or greater than 80;
(B) a Lumen Maintenance equal to or greater than 90 percent; and
(C) a Lamp life equal to or greater than 20,000 hours at existing
conditions.
(4) The Lamp/Ballast combination shall have an Efficacy of greater than
80 Lumens per watt.

(m) Non-Listed Equipment under the Electronic Drop Down Wattage
Reduction Tool
Ashland may install equipment as part of the Measures listed in this section
that are not specifically listed in the Electronic Drop Down Wattag1e
Reduction Tool (as described in section 6(a)(2)) as long as they meet the
Measure specifications as listed above. Ashland shall enter the infi)rmation
regarding such equipment on the Electronic Drop Down Reduction Tool.
13. CONSIDERATION OF NON-STANDARD MEASURES
The intent of the ESO Plus rebate list is to provide standard incentives for common
lighting efficiency Measures. Ashland may request, on a case-by-case basis,
Bonneville's consideration of lighting Measures that are not included in this ESO
Plus. Such Measures must be determined by Bonneville to be cost-effective
Measures and meet general Conservation Augmentation program requirelnents.
Bonneville reserves the right to approve or disapprove use of such non-standard
Measures. Bonneville shall provide written notice to Ashland of the decision for the
non-standard Measure requested.

PROJECT 6, ENERGY STAR HOMES NORTHWEST PROGRAl\'[

This Project 6 is added to Exhibit A. An Implementation Budget of 15,000 dollars is
established for this Project 6.
1. PROJECT 6 DESCRIPTION
Ashland intends to participate in the Energy Star Homes Northwest Program
(Energy Star Homes Program). The Energy Star Homes Program was developed by
the "Northwest Energy Efficiency Alliance" and the "Northwest Power and
Conservation Council" to increase the overall energy efficiency of new single-family
homes in the Pacific Northwest. Bonneville shall offer incentives based on the
electric Energy Savings achieved in each qualifying Energy Star Home.
2. BONNEVILLE PROGRAM REQillREMENTS
(a) Types of Homes
Bonneville shall offer incentives to Ashland for pass through to the
homebuilder or the homeowner for the electric Energy Savings achieved in
new electric-heated, gas-heated, propane-heated, or oil-heated single-family
homes built as part of the Energy Star Homes Program. These electric
Energy Savings and incentive amounts are further described in this Project
below.
(b) Certification Requirements
Each completed Energy Star Home shall be certified by the appropriate State
Certification Organization (SCO) to qualify for incentives under this Project.
In Oregon, the SCO is the Oregon State Energy Office. As part of the
certification process, each Energy Star Home shall be inspected by an Energy
Star compliance verifier. Both the verification and certification processes are
further described on the Northwest Energy Star website located at:
http://www.northwestenergystar.com
(c) Technical Specifications for Energy Star Homes
Each single-family home built as part of the Energy Star Homes Program is
required to meet the thermal envelope, heating system and lighting and
appliance efficiency requirements listed in the Northwest Builder Option
Package (NWBOP) in order to qualify for certification as described in section
2(b) above. These requirements may be revised, but those in place at the
time each Energy Star Home Project is initiated shall apply to that
particular Project.
The NWBOP, and all other requirements and information regarding the
Energy Star Homes Program can be found on the Northwest Energy Star
website referenced in section 2(b) above. The NWBOP includes the following
types of documents:

(1) NWBOP 1 and NWBOP 2
The NWBOP 1 is the prescriptive standard for Energy Star Homes
built with heat pumps or natural gas furnaces. The NWBOP 2 is the
prescriptive standard for homes built with zonal electric heat or with
propane or oil furnaces.
(2) Technical Compliance Options
A limited set of technically equivalent, prescriptive compliance options
are available and are known as Technical Compliance Options that
allow for trade-offs between Measures. The documents describing
these options are located on the Northwest Energy Star website.
(3) Other Technical Reference Documents
The Northwest Energy Star website contains other technical reference
documents that are to be used as part of implementing the Energy
Star Homes Program.
3. SAVINGS AND INCENTIVES
(a) Basis for Bonneville Incentive
Bonneville's incentive payment is based on the Measures installed in each
Energy Star Home that produce electric Energy Savings. The Measures
producing electric Energy Savings for each type of heated and cooled single-
family home are shown below. Certain variations to the combination of
Measures can be made, but all such variations shall be in accordance with the
specifications and requirements as cited in section 2(c) above.
(1) Heat Pump Heated Home (includes homes with both crawlspaces and
basements)
(A) An energy efficient heat pump
(B) Heating and cooling duct tightening
(C) Increased home insulation
(D) Energy efficient windows and doors
(E) Energy efficient electric water heater (unless heated by natural
gas)
(F) Energy Star built-in dishwasher
(G) A minimum of 50 percent of electrical sockets will be Energy
Star bulbs, fixtures, or both
(2) Zonal Electric Heated Home
(A) Increased home insulation
(B) Energy efficient windows and doors
(C) Efficient ventilation and air sealing
(D) Energy efficient electric water heater
(E) Energy Star built-in dishwasher

(b) Savings and Incentive Table
The table below shows the electric Energy Savings attributed to the heating
system of each home and incentive Bonneville will pay to Ashland. The
entire incentive payment amount shall be paid to the homebuilder or the
homeowner. The homebuilder will only be paid incentives for hOInes built in
Ashland's service territory.
The Federal minimum efficiency standards for heat pumps may change in
January 2006. If such changes affect the calculation of savings shown below,
Bonneville may revise the Energy Savings figures. Those Energy Star
Homes where the construction began prior to such Bonneville Energy
Savings revision will qualify for the original incentive amount.

4. IMPLEME:NTATION BUDGET
(a) Implementation Budget Amount
Bonneville shall make available to Ashland an Implementation Budget of
15,000 dollars for the Energy Star Homes Program. Ashland may continue to
invoice Bonneville for completed and certified Energy Star Homes until the
Implementation Budget is fully allocated or the end of the Implementation
Period as described in section 5 below.
(b) Implementation Budget Review and Adjustment
(1) Bonneville shall periodically review Ashland's activities and
implementation under this Energy Star Homes Program. In

consultation with Ashland and after providing three months written
notice, Bonneville may unilaterally reduce the Implementation
Budget. Bonneville shall take into account all factors that Ashland
believes will affect future rates of expenditure. Bonneville shall not
reduce the Implementation Budget below the amount Ashland expects
to invoice Bonneville for Energy Star Homes under construetion; those
Energy Star Homes planned for; and for those Energy Star Homes
completed but for which Ashland has not yet invoiced Bonneville.
Ashland shall provide a list of such homes to Bonneville if requested.
(2) If Ashland expends this Implementation Budget amount prior to
September 30, 2006, Ashland may request additional Imple:mentation
Budget. Bonneville shall review the request and may, but is under no
obligation to, add additional funds to the Implementation Budget. If
additional funds are approved by Bonneville, Bonneville may, by
written notice, unilaterally increase the Implementation Budget.
5. IMPLEME:NTATION PERIOD
Bonneville incentives for Energy Star Homes are available from the Execution Date
of this Project through September 30,2006. However, Energy Star Homes where
the construction began prior to September 30, 2006 may qualify for incentives under
this Project as long as such Energy Star Homes have been certified by the SCO by
September 80, 2007.
6. INVOICING
Ashland may invoice Bonneville for homes certified by the SCO under this Exhibit,
but no more often than once a month. The procedures described in section 8 of the
body of this Agreement, "Invoicing and Payment," shall be followed. Ashland shall
also submit a copy of the individual Energy Star Home certification to Bonneville
along with the invoice.
7. MEASURE~ LIFE
For the purposes of this Agreement, the Measure Life for the Measures installed
under this Exhibit shall be deemed to be 10 years.
